6:00 pm
i liked this actually music of the way people talk the way we walk is just everything is trusting timing. go tell them on the mountain. friend of the and mechanics. see a new series of africa direct on. i'll just be around the, [000:00:00;00] the, you're watching the news on our life or my headquarters and tell how i'm very navigate. i here's what's coming up in the next 60 minutes. the us supreme court rules and the donald trump case that former presidents do not have immunity from prosecution for an official act. but the supreme court has ordered a lower court to decide how to apply the verdict and from chase,
6:01 pm
limiting chances of the trial before the presidential election. trump, that's called a decision, a big win for democracy. they detained me without any charges, starved, beaten on tortures and is really the attention, the director of god's us and ship out hospital speaks about the treatment of palestinians after being released from prison. and from so as far right is closer than ever to forming an elective government. but opponents hope to stop them through to co, bowden in the 2nd round. and on piece of statements with the latest school to use phone slip to take a closer step to a physical therapy and championship title. for nearly a quarter of a century, pediatrician's team will be taking on belgium for a place in the quarter finals. the welcome to the news our the us supreme court has ruled that former presidents are
6:02 pm
not in use, a prosecution for act carried out in their private capacity. the decision comes after lawyers for the former president, donald trump argued that he should not face criminal charges for decisions made while in office trumpets facing several charges related to conspiracy to overturn the 2020 presidential election results. but the supreme court has asked a lower court to decide whether its verdict applies to donald trump's actions. and this makes it unlikely that trump's trial will take place before the presidential elections in november. so the chief justice john roberts rhodes, that the president enjoys no immunity for his unofficial acts. and not everything the president does is official. the president is not above the law, but under our system of separated powers, the president may not be prosecuted for exercising his core constitutional powers.
6:03 pm
and he's entitled to at least presumptive immunity from prosecution for his official act. and that immunity applies equally to all occupants of the oval office . while the liberal justice sonya soto, mayor, has written the descent note saying, never in the history of our republic as the president had reason to believe that he would be immune from criminal prosecution. if you use the traffic is off his office to violate the criminal law. moving forward, however, all former presidents will be closed in such immunity if the occupants of that office misused as official power for personal gain, the criminal law that the rest of us must abide, will not provide a back stop with fear for democracy. i this sense. so the former president has reacted to the supreme court ruling on his social media platforms, the truth social here's what he said. he's called the decision a big win for the constitution on democracy. and that he's proud to be american. mike herano, you're joining us from washington dc to talk us through this verdict and more of
6:04 pm
the reactions that have been coming through the 1st of all, i'd just like to pause uh that section that you read from chief justice robert's decision in this particular case. and it's actually very important to look closely at what he says in particular. he uses a wood presumptive t. as in tom, i told a trump is to at least presumptive immunity from prosecution for his official x. that means the supreme court is not moving on the nature of these acts as such, it is stating that a principle, the principle is that a sitting president cannot be held comfortable for visual x that he takes well in office. now in that the chief justice comment, he points out and emphasizes the president enjoys no immunity for his unofficial x
6:05 pm
. and not everything the president does is official. the president is not above the law. so, he's promising alex, we have something very important and that it makes very clear in the chief justice's rulings and findings that they are dealing with the principal of the matter. they are not dealing or looking at the facts in this particular case, that is something that the lower quote is going to be looking at. now this decision having being handed back to them to really look at its decision to uphold the fact that trump does not have immunity. that's cool too, and i'll have to start considering the facts of the case had been being given the principle of the case by the supreme court. the facts of the case. so something that must be looked at. and the key point here is going to be whether or not those charges brought against donald trump, all directed at actions taken in an official capacity or,
6:06 pm
and then an official could pass steve, this is going to be absolutely key to the review by that below a quote, i also just want to give you a response from the biden campaign. today is routing doesn't change the facts. so let's be very clear about what happened on january. the 6th, donald trump snapped off the last the 2020 election and encouraged them up to over throw the results of a free and fair election. trump is already running for president, is a convicted felon for the very same reason. the set i the by while them up violently attack the capital, he thinks he's about the little and is willing to do anything to gain and hold onto power for himself. so the binding campaign, all of that outlining exactly how it's going to have to change its tech in terms of attacking trump. as this campaign proceeds, it is made the generally the 6 events as the very center of hits campaign against donald trump. now, which has to an extent,
6:07 pm
had that removed from by the supreme court. insisting that trump has immunity from those actions or from those visual actions. so this brings us back to that key issue and something that the bite and campaign is going to be ongoing very strongly is that this does not necessarily absolve donald trump from what's happened on january. the 6th, the quote says that he cannot on the face of it, be held accountable for x, that the quote says, may have been carried out in an official capacity. now this is going to be something for a lower court to decide once again. bottom line is the, this is not going to be result before november. trump will not be facing the specific charges or trial and the specific charges before that election. and that is probably the most important thing to take away at this particular point. okay, mike, thank you so much. you've answered all my questions, so we'll leave it there for now. but thanks so much for breaking it all down for us . and my kind of report from washington dc will now speak to claire, a single sign, who's
6:08 pm
a professor of law and philosophy at the university of pennsylvania. joining us from philadelphia. welcome to the news our clear finkelstein um, did you expect this ruling? so this was the worst case scenario. this is one of the possible outcomes. i did not think that the court was going to grant total immunity. nobody thought that that would have been very inconsistent with his prior rulings. but the re, ma'am, to the lower court, and the finding of partial immunity was a distinct possibility. it was in my mind, however, a worst case scenario. so looks making up the lower court. i mean, what does the lower court decide next? once this case gets to the lower court as well, before i answer that question, let me just say that i believe that this decision is going to go down in the history of the united states supreme court as among its worst decisions ever right there with the court
6:09 pm
a month to case the locked in her case. um the dred scott case and cases of that sort. this is a got punch to us democracy defined by the us president b now freely violate the criminal law commit crimes, possibly to remain in office is a shocking decision. one that i believe is very inconsistent with the history of the court's other rulings. and so i just wanna make sure that that's clear for your viewers how extreme this decision is, despite not being a complete, an absolute absolving of all precedents for all times. no. as to the lower port, of course, it will now fall to tanya shopkins to minister over the separation of personal capacity acts from 2 other categories that the court has identified,
6:10 pm
which is 4 acts committed in the court constitutional capacity of the presidents of constitutional duties. and official capacity acts. so just as roberts distinguishes those 2 categories from one another and says that presidents are entitled to immunity in, in the 1st category apps with, in their, for constitutional capacity. and are entitled to a presumption of immunity within their official capacity. right? and look for on that point, claire claire finkelstein looked at, i mean, are there, i'm going to be many questions now. being asked about what is an official presidential act? how is that defined? will that now be the crux of the issue? how one defines official versus unofficial or size slate that and the other category of what constitutes a precedents core constitutional duties? no,
6:11 pm
i would think that in this case tanya shop can will be clear. and there will of course be arguments and breach to this effect. but the president was acting here in his personal capacity because it was part of his election campaign. and that is the archetype of the personal capacity act. so, so the speech that he gave on january 6th and which he encouraged everyone to march down to the capital that was a personal capacity speech. and so on, rebound, it shouldn't be difficult for the lower court to find that he does not have a beauty for the acts of january 6. but the larger point will hold and it's donald trump is re elected. it will be a signal to him that he can commit crimes as long as he loves them in the language
6:12 pm
of official capacity and gives us the reason for his actions some official basis for his action. and that will be true. every president going forward, going into all of those trump. i'd argue that without him, unity president's would be how strong an office always fearful of being 2nd guessed by zeal as prosecutor, after leaving the white house, that's what he said, going into it. and now of course, there's been reaction from trump, he's called this, this isn't a big win for the constitution on democracy, and that he's proud to be american. what do you make of that reaction? and so no president has ever had immunity in the past. there has never been a declaration of substantive immunity for presidential crime any time in our past. and yet the people have still wanted to be president of them still proceeded without fear of, of performing their duties as president and have understood none. the less that they were not above the law and that they would be subject to criminal prosecution
6:13 pm
after leaving office. the furthest that any decision has gone is to say that presidents cannot be prosecuted while in office, but the reassurance that we've always had on that in particular, on the justice department policy regarding prosecuting a sitting president has been the policy is okay, because it can be prosecuted after leaving office. indeed the trump team argued that themselves in the trunk feedback's case of 2020. and now it looks as though even that argument is out the window because this decision says, for many acts, you won't be able to prosecute a president after he leaves office. right. all right, thank you so much clara. single sign. thanks for joining us on the news. our thanks for having me the

thanks for your time with us one l to 0. if you can just sort of give us your readings as to where things stand militarily right now on the ground and so done. sure, well the artist does continue to take some ground. they have some, some new momentum in various parts of the country. but i think the better way of phrasing this is that the student needs state continues to collapse. the army continues to be unable, essentially, to launch the major account or offenses. and it also continues to struggle to hold the ground. meanwhile, everywhere that the r a stuff basically takes over, they do not govern. we see the sued in the state recede and we see ongoing fragmentation and collapse of the soonest date. the longer this work goes on and we see more and more soothing these infrastructure also be destroyed. and so what you're saying then with these gains by the r s f recently, that we're entering a new phase of the conflict as well. the art stuff is held in the military momentum for most of this board,
6:26 pm
for most of the 1st year of the more they were the only ones really making any gains. there was a brief moment earlier this year where the student needs army did manage to make some gains with counter offensive. but those gains were limited. and they struggled to really maintain that where's the art stuff is a, is a force built for rapid movement just like their, their, uh, their name suggests they're able to, they're able to move with great speed and do kind of lightning strikes. so they're much able to sort of approach the defense is the army has been unable to really to, to, to hold ground and, and present some of these blinking maneuvers. so the time is really against them. if they're unable to mount a counter offensive and start to retake some of this territory. so what does the uh, the, the collapse of the states as you describe it. and the lack of governance in areas mean for the people there. what impact does it, having on them for those who still remain most of the student needs are starving to
6:27 pm
death. basically, everywhere this war has reached. we are seeing mass starvation. i hundreds of thousands on the brink of family and some say that they should already be declared in family. and this is for numerous reasons related to the conflict on millions have been displaced. but also both sides are blocking food aid. both sides are beseeching populations and since since control is chris crossed, that means they can the effectively stop not only aid, but also make trade very expensive or difficult in 2 areas. so we're seeing huge humanitarian crises wherever this words reached and the war keeps spreading. the longer it goes on, are we any require a closer today? it's a getting a warning party, the party leaders to talk about a cease fire and some sort of sustainable end to the fighting as well. the shooting these army, which is the one that has been losing ground over over the past few weeks, especially,
6:28 pm
has still been publicly refusing to come back to piece talks. you do have renewed momentum from some corners to try to bring them back to talks. what's really been missing is not only coordinated action. there are variety of different countries have tried to bring them together, but none of really done so at high levels and many of them are not willing to coordinate with each other. and we've also just not seen a high level focus from world leaders such as we've seen on ukraine or garza, or anything even approaching that level of concern or interest. and it's allowed these 2 warring parties and to continue to fight and face little pressure to end the war despite the huge consequences. um and maybe i assume you start to starve to death, will start to see a bit more focus. but it is possible to bring these to detox and in this more if there was more focus on it. thank you so much. allan bowles over here, i appreciate you speaking to us from cairo. thank you. still ahead on the i'll just
