an urgent message from the forrest gump star over a.i. generated content that uses his likeness to sell what he calls some dental bland. he posted this morning on his instagram saying he has nothing to do with this advertisement, and i should note, cnn has not independently verified the ad. but you see these all the time, these deepfakes, these artificial intelligence scams, all over your social media feeds, from things ranging from politics to pop culture. at the same time, we are hearing from robin williams's daughter zelda who is also speaking out against these recreations of her father. she says an authorized use of his voice to create new content is presented disturbing to her, and she added this quote, saying these replications are at their worst, a frankenstein style monster altogether from the worst bits of everything that the industry is. quite a blunt warning there, and of course, big warnings on the future of that. meanwhile, thank you so much for joining us for this very busy breaking news hour.

cnn prime time with abby philip is up next. >> in the early 20th century, the marx brothers became one of comedy's most famous acts. they were showman, full of gags and stunts on stage in front of the camera as well. and in a wild twist, a century later, one of their most famous lines is now being used in the fraud trial of a former president. >> your excellency, i thought you left. >> oh no, i don't leave. >> but i saw you with my own eyes. >> who are you going to believe, me or your own eyes? >> that was the quote. it was used by a judge in a ruling that donald trump is liable for fraud, pointing out that trump's fantasy world when it comes to the value of his properties and himself, and
7:02 pm
like the marks brothers, the scene inside and outside new york city's courtroom today became a vaudeville routine and a parade of insults. good evening, i'm abby philip, and trump appearing today in court for the first day of his trial, which threatens to decimate his entire real estate empire in new york. >> this is a continuation of the single greatest witch of all-time, we have a rogue judge, we have a racist attorney general who is a horror show. it's a scam and a sham. and our country's gone to hell, it's all run by doj, which is corrupt. frankly, our country is corrupt. >> so as you can see there, trump and his lawyers have now turned that courtroom into a campaign stop. and at one point, the judge told his lawyers to lower their voices as they shouted trump's side in the courtroom as if they were addressing the jury. but the thing is there is no jury. >> as you, know we're not
7:03 pm
entitled to a jury, which is pretty unusual in the united states of america. so we think it's very unfair that i don't have a jury. >> the judge, to explain today that neither side, neither the prosecution nor the defense requested a jury trial in this case. he also added that bylaw, a case like this, the judge decides the outcome anyway. now remember, the new york attorney general is asking for the trump organization to pay a quarter billion dollars and halt all his business activities in the state of new york as punishment for lying about the property values of his properties, among other things. joining us now is michael cohen, to respond, and he will be with us here in just a moment. but first, i want to take you through the facts today. we have daniel dale with us to walk us through what happened in the courtroom today. daniel, trump made quite a few claims, as usual. some of them have already been rejected by this judge.
7:04 pm
but here is the former president claiming that this lawsuit is part of a coordinated effort by the department of justice. is there any truth in that? >> there -- >> this trial was railroaded and fast-tracked. this trial could've been brought years ago, but they waited until i was right in the middle of my campaign, the same with other trials and indictments. it's all run by doj, which is corrupt, in washington. everything goes through them. >> so the doj, he says, it's part of all of this. is there any truth to that? >> no, there is no truth to that. there is not a shred of evidence that doj is the hidden hand behind the scene. this is a state case brought by a state attorney general, who trump correctly noted today and on previous occasions, made it part of her campaign platform that she was going to be tough on trump. and the second significant inaccuracy in those comments there, abby, is the part about timing, wait until the middle
7:05 pm
of my campaign. attorney general james launched the lawsuit that left this trial in september, 2022. that's when she filed it. trump did not launch his campaign until november, 2022. so the lawsuit that led to this trial was filed roughly two months before he would've announced his 2020 candidacy. >> yeah, a good point there. daniel, trump also talked about at length that what he called a worthless clause, a disclaimer that he put, or his aides had put in the financial statements, that are now at issue in this trial. let's listen. >> we have a clause in the contract. it's like a buyer beware cause. it says when you take a look at the financial statement, don't believe anything you read, this is up front. some people quote worthless laws, because it makes a statement. and if you read the statement, worthless. this is what's called a full disclaimer. we disclaim the financial status. but even with a full disclaimer, which immediately takes you out
7:06 pm
of any fraud situation and any litigation -- >> so what do we know about that, daniel? >> trump is making this clause sound way stronger than it actually is. you can read it, what it says, and i'm paraphrasing, is that the asset valuations in trump's financial statements are estimates, that they used a variety of methodology's two companies estimates, including in some cases, the judgments of trump and his associates. it says you may not be able to sell these assets for the same price that is listed here. so does basically, in so many words, encourage readers to be cautious about what they're seeing. but it does not say what is contained in these statements is useless or worthless. it doesn't say don't believe anything you read. and the judge himself noted this in his ruling last week finding trump and his sons liable for fraud. the judge said that they're reliant on this so-called worthless clause is itself worthless. they say that you cannot rely on such a vague disclaimer to
7:07 pm
misrepresent facts and claim that that inoculates you against claims of fraud. so trump's assertions about what this clause says and how the supposedly protects him against any and all liability is just not borne out by the facts. >> yeah, dowdy pretty hard to believe, honestly, if they were true. so daniel, also, shortly before trump appeared in court today, his campaign released a statement about new york city's crime data, as if that is related to all of. this was an even accurate? >> so it wasn't false. they use actual numbers. but they were cherry-picking the and point for those numbers. so in talking what new york state, they ended their data in 2021. talk about new york city, they ended in 2022. so they said new york city shootings increased 70% from 2018 to 2022, murder is up 48% from 2018 to 2022. but they didn't mention though is that we are in october 2023. and the trend line is now sharply downwards. so murder in new york city is down 11% this year. that's in addition to 10%
7:08 pm
decline last year. shooting incidents are down 27% this year, and that's after a 17% decline last year. so in addition to the broader point that you can't attribute any trend in crime up or down to any individual attorney general, this is complicated, difficult stuff to pinpoint, those numbers do not and in 2022, they're not going up anymore, they're going sharply down. >> all right, daniel dale, thank you very much. and joining me now to discuss, trump's former fixer, michael cohen. he is now a principle of crisis x and also the host of two podcasts, mea culpa and political beat down, and the new york times bestselling author of revenge, how donald trump weaponize the united states department of justice against his critics. michael, good to see you. you know trump very very well -- >> good to see you, abby. >> what did you take away from seeing him, his demeanor outside that courtroom, and even inside that courtroom? >> so, this is very typical donald. on the outside of the courtroom,
7:09 pm
he was all bluster, he was typical donald, he was in campaign mode, to the point that he was looking to figure out how to make this scenario into something profitable. inside the courtroom, he was behaving the way that you would expect somebody to behave when they're in a situation that they have no control over. and that's something that donald hates. he hates not being in control. he sat there like a good child. he didn't say a word. he didn't speak. he didn't get out of control -- >> he was angry. >> where he had to be reprimanded by the judge. of course he's angry, how could he not be. he's watching as his company, his 50 plus year company, is in a death spiral. i mean, basically what letitia james did, our unsinkable attorney general, she gave him the corporate death penalty. and judge engoron is in
7:10 pm
agreement with laetitia james that the company should not be able to practice, neither should donald. allen weisselberg, don junior, donald trump, or jeff mcconney, none should be able to operate any business in the state of new york. sure, it's understandable that he would be angry. >> michael, you are at the center of today's hearing in some ways. i want to get your sponsors on the comments are made today in court by cliff robert. he is one of the representatives for darwin junior and eric trump. he said in part, quote, their major linchpin's major -- michael cohen. so when you talk about credibility, you're going to have a guy who lives to everyone, who's a convicted felon. and he is a fixture of what their cases about. what's your response to that? >> [laughter] i think cliff roberts is an idiot. first and foremost, i have now provided testimony to seven different congressional committees, to the mueller team, to the district attorney on 23 occasions, to the attorney
7:11 pm
general, and only cliff robert and donald trump, it's all part of the gop -- all they're going to do is sit there and try to discredit me to disparage me. that's the name of the trump game. look at what he did today, forgetting about michael cohen. what i brought to the table were documents and corroborating testimony. so there's -- listen, i don't even think that it would be 100% necessary for the a.g. to use me in order to find trump guilty of the crimes that, you know, he's been charged with. look at what he did today, just with his james and judge engoron. judge engoron, he called him all sorts of names, a rogue judge. tish james, of course, is a racist, it's a line he's used many times with many people. he said the same thing about jack smith. he says the same thing about fani willis. this is a guy who doesn't understand disparaging somebody
7:12 pm
is not the way to win a case. what you need to do is bring the evidence, bring the documents, in order to clear name, as opposed to thinking you are going to clear your name by disparaging somebody else. and the fact that you get guys like cliff robert, the fact you get even like alina halle or chris kise to make these statements, the fact that now jumbo jordan is now added as well. this is all part of the playbook. i've watched that playbook since 2015, as it relates to the campaign. this is so part and parcel for the playbook it doesn't even affect me. >> do you think that trump cares, to your, point about whether or not he loses this case? it seems they're not as worried about the legal ramifications of all of this. >> this is actually a big one for donald, because donald entire id, his ego, his super
7:13 pm
ego, have all been predicated around the notion that he is this incredibly rich entrepreneur genius businessman. and what this does is it strips him of all of that. it demonstrates that he's neither rich, he's certainly not a genius businessman, and he's certainly not a good entrepreneur. >> do you think he can survive -- >> so tish james i stripped him of everything that he has -- >> to think he can survive, do you think he can survive a penalty of a quarter of a billion dollars, or potentially more, because it's really up to the judge what that number ends up being? >> correct. that's also something that people make a terrible mistake with. what attorney general james stated is that it is a baseline of 250 million, meaning that's the bottom. that doesn't mean that that's the top. the way i calculate it based on the information that i know, it's going to be at least, at least double, if not 2.5 times that amount with penalties and

interest and so on. and the answer, abby, is no. he cannot survive this. he cannot recover from this. >> michael cohen, thank you very much for that perspective. >> thank you for taking me away from my -- ♪ ♪ ♪ >> up next for us, breaking news out of washington, republican congressman matt gaetz filing a motion now two outs speaker kevin mccarthy. i will speak live to one of the lawmakers who may end up joining his cause. plus, congresswoman victoria sparks explains why c's threatening to quit congress altogether. and donald trump's former chief of staff john kelly is saying tonight god help us that trump may end up in the oval office again. but kelly is confirming tonight about trump's actions toward veterans.

7:33 pm
that's the job of speakers. protect your members. there have seemed unable to do that in addition to all of the non governance. >> here is a wildcard, donald trump. matt gaetz has a look to this. he said he's talk to trump. he didn't say what he talked to trump about. at any point in this process, trump could win. that changes a lot. maybe everything. >> trump has already been weighing in and cheering on the circus it, burn it all down, shut the government down. i wouldn't be surprised if he has a direct line to matt gaetz and tells him to do the most incendiary divisive option. i think that kevin mccarthy, in this moment, he has to rely on democrats. i hope that that creates a moment of bipartisan momentum. might be too optimistic for where we are with our politics right now. it's that or more chaos. maybe he's just enough of it to get through the next 45 days. remember, we have another government shutdown looming in

jake tapper, kelly confirms numerous stories about statements trump made about clusters, including attacks about u.s. service members and veterans. he discusses laws about the person who defends his country in uniform are shut down or seriously wounded in combat or spent years being tortured as p.o.w.'s are all suckers because there is nothing in it for them. a person who did not want to be seen in the presence of military amputees because it doesn't look good for me. miles taylor's former chief of, department of homeland security. he was, notably, a senior adviser under them dhs echo terry, john kelly. he's also the author of blowback. miles, you have noticed, most notably, the alarm on trump's misconduct while he was in office. why is john kelly, now, in 2023, making these allegations? >> look, in defense of the chiefs, i think that he has been out there, you know,
7:40 pm
intermittently throughout this process. certainly before 2020. general kelly has signaled a number of things about donald trump that he felt the american people needed to know. i think that all of us, he has seen america on the brink of making perhaps the greatest suicidal civic mistake our country has ever made. i think that's why he's going out here delivering this morning, abby. if you go back in time, i think kelly was very clear about this from the beginning. i won't forget the first conversation i had with him about going into the trump administration. i decided not to go into the trump administration. it was several months. and kelly was homeland security secretary. he and his team had recruited me to come in. kelly said, when you go swear that oath, rossi, researchers tech the country. against florence and domestic. as it, yeah,. yasser, i know. he said, foreign and domestic. he put the emphasis on the more domestic.
7:41 pm
it wasn't lost on me what it meant. john kelly was signaling his realization that the man who was serving as the president of the united states was one of the biggest thrust the united states. that's why he went and took the job, chief of staff. not because he thought it was going to be glorious. because he was terrified felt the man he witnessed in serving in that position, like the rest of us were. i hope, abby, continues to speak up the cycle. >> he really does hone in on a recurring feature of trump's conduct in office, his treatment of veterans. particularly those who are captured or gravely injured. this all flies in the face of how he presents himself in public. he will literally hug the american flag. he seems to have an issue with this group of people. do you have any understanding of why that is? >> look, i'm not a psychologist, abby, i think ultimately has to do with donald trump's lack of initiative and going into the united states military. at a really pivotal moment when
7:42 pm
he was supposed to be signing up to go fight in vietnam, by all accounts, donald trump avoided that service. ever since have seemed to have had to stain for veterans. it bet, his complete disregard for john mccain, refusal to honor john mccain after the senator died, it is what caused me to come out against donald trump at the time the president wanted to raise the american flags back up. even though they were lowered at half staff for john mccain. look here, abby, there is a much bigger and disturbing picture here. when your president of the united states, commander in chief of the armed forces, you are supposed to look at for american service members and for its veterans. donald trump, behind the scenes, was very, very different than that man you just noted hugging veterans and public. that's not just an attitude. it's not just disgusting comments he made behind scenes. i will tell you when speaking to the heads of veterans under donald trump, they have signaled that what he wanted to do was gunned the veterans
7:43 pm
health care safety net. they wanted to raise the veterans affairs to spend the money on political affairs. this is something they tell me he will do in a second term. again, these are donald trump's handpicked staff to run the department of veteran affairs saying in a spectrum term he will, quote, detonate them because he wants to use those funds elsewhere. there are real policy implications for donald trump's disdain towards america's veterans and its fallen soldiers. >> how are we supposed to take the fact that all of these events that were reported, a lot of them at the time, they were denied by people who worked at the white house. even though they were all true. now, three years later, some folks are coming forward and saying, it's true. isn't that part of the problem that no one was willing to speak up in realtime? >> yeah it's a huge part of the problem. abby, we are living that lesson
7:44 pm
right now. if more people don't come out and say what they knew about donald trump, this will happen again. make no mistake, it does have a difference. in 2020, when the largest group of administration officials in american history turned on a president who appointed them, donald trump, it did have an impact in getting independence, more uncertain how they were going to vote. concerned conservatives that did want to support donald trump, the air cover they needed to defect. we are going to have a close affection -- election 2024. if don trump is on the ballot, the american people want to avoid a second term and the autocrat, it is going to require people to step forward. i think the lesson here is that it is never too late to do the right thing. i would welcome anyone, even those who are standing by donald trump's side right now, to actually go speak their minds publicly and say the things they say to all of us privately. it's time for them to own up to the truth and come out and say what john kelly has that, what

ransom note that had been left behind for charlotte. state police works diligently, trying to find a match for fingerprint. first one trying, was unsuccessful. second one was. it identify any other prints in the new york state database that would be a match. the it came at 2:30 in the afternoon. there has been a dwi, in 1999 in the city of tokyo. her fingerprint was found. that matched what was found on the ransom note. so, the more research, where, identified the location, and identifying the fact that there's a home they could visit. they found a double white house with a woman, the suspect's mother.

the suspect the lived in the camper behind. they had what they had a dynamic entry. tactical maneuver. and within the camper, they located the suspect. look after some resistance, the suspect was taken into custody, and immediately, the little girl was found in the cabinet, covered. she was rescued. and she knew she was being rescued. she knew that she was in safe hands. her parents were immediately notified. secured at 6:32 this evening. the suspect, 47 year old [inaudible] it's still being questioned.

at this moment, charges have not been brought but they're fully expected. the daughter was transported to local hospital as is customary. and that's all the family wishes to reveal at this time. but they are united, she is in good hands. she appeared to be outwardly, physically unharmed at the time. but we will leave the rest of this information but little charlotte at a time they deem appropriate. often the stores don't end up like this. every second is key, there's a lot of pressure. from split decisions are made. because you know, not just a life is hanging in the balance. but little innocent child's are

hanging in the balance. so, to the teams behind me. you are quickly, you work with great agency. you work together the puzzle pieces, you went to track down the location where charlotte was through technology, but ultimately was the two swat teams, one, federal one, state that landed in helicopters and they came to rescue charlotte. still pretty overwhelming. all of us feared the worst. but i promise, for trisha and dave, they have been reunited with those charlotte once again, one, ten 14 years old. and the turn of events for the family and certainly charlotte,
7:52 pm
and will continue to keep the family in our plans as we heal. but she'll be going home. that's the story. charlotte will be going home. that's all i have to say. and the details -- >> extraordinary details, new york officials now detailing how a nine-year-old girl who went missing during a camping trip was found alive today. the suspect is now in custody. the governor detailed a ransom note. that was critical in this case. they used a fingerprint found on it to find the alleged kidnapper. she mentioned that there was resistance in that arrest, but ultimately, he was arrested. charges are expected. we do with charlotte and her family all the best today. lower codes will have much more on the story up next, but, first i want to go to some more breaking news tonight. democratic congressman, henry cuellar, is safe after having been carjacked at gunpoint

>> the teller swift effect is in full force right. now a record 27 million people tuned in last time to the chiefs jets game making at the most watched sunday nfl games since the super bowl. and those commanding younger viewers are watching. to variety reports last sunday's game was the highest among female viewers aged 12 to 17 years old. and 18 to 49 years. what this all stems from the remit romance between the pups superstar and the chiefs titan, travis kelce. the nfl reports the ticket prices for last night's game
7:55 pm
were up some 40%. join me now on this is jamele hill, she's a contributing writer for the atlantic. jamele, this is a crazy story. what do you think is behind the fascination of this potential power couple? taylor swift in the stands, people are losing their minds. >> let me tell you the biggest behemoth in this country, the -- we had the nfl which is the most popular sport in america. we had taylor swift who has -- it has set all kind of records in the number of albums sold, we saw her on tour this year. and this coalition is something that if you're in the nfl, you're just thanking god, where did this come from? one of the biggest stories of the season was -- going to the new york jets. is trans out that the biggest story of the season is taylor swift and whatever is or isn't happening with travis kelce. some other factors to consider
7:56 pm
beyond the facts that you perfectly illustrated with what this has done, if you were -- the young women who are now being engaged in and it fell in different ways. travis kelce's jerseys are on sale up 400%. betting on this game was up words 40% higher than it normally would've been for a chiefs game. listen, part of me doesn't understand it either because i'm a football fan, whether village fifth is there or not. but clearly, people don't have any problem with spending three and a half hours watching a football game if it gives them through a four glimpses of taylor swift. >> that's wild an amazing. but you might think, she could've just gone to a game. she didn't have to date the guy. by the way, her name was mentioned more than two dozen times by the announcers. i think we have the sound of this. listen. >> --
7:57 pm
>> oh it's just the video. you can see there she's dancing, she's making great time. she's also shown 17 times throughout the game. she's obviously the biggest popstar ever. she expanding her audience hereby drawing in some people who may be sports fans, not huge tillerson fans but maybe say they are? >> i think one thing in this particular way, she is helping the nfl. for those who don't know, it's a little bit annoying because you have a lot of broadcasts teams and pre-game shows, they want to have these breakdowns for the taylor swift fans who may not understand. football do understand that the nfl's fan base is -- so presumably some of these women are taylor swift fans. so they're not bringing somebody to the party that's never heard of football. it's really annoying when they start breaking down very basic
7:58 pm
things but i will say this, the nfl has had a hard time connecting with the really younger demo, not necessarily the 18 to 34 demo but the 12 to 18 kind of demo is making this case appealing because they're a lot of things competing for these in people's attention span. and they don't know suddenly watch and a half hours of pro football on a sunday -- and that millions of other things to grab their attention. taylor swift is helping the nfl introduce this game to a young fan base. and for that it should be appreciated because you want your fan base to get younger, not older. the nfl's fan base was trending in the other direction. this gives them some new life, they didn't anticipate, and they don't have to pay for it because it's not like they had to spend millions of dollars for taylor swift to come to this game. she's just showing up with some of her very famous friends. as an blake lively and you jackman. ryan reynolds. and making the nfl look cool.
7:59 pm
and i bet a lot of dads everywhere are very happy about this because they no longer have to watch the game on their phone, in, secret in a closet somewhere as the daughters hijack the tv. they can all watch it together because of taylor swift. >> all those taylor swift dads who took their kids to the tiller swift concerts their summer, their this is their payback, they get to watch the game in. peace jamal, thank you for joining us tonight. >> it's for having me. >> i do want to get now back to some breaking news that we mentioned earlier, cuellar is safe after he was car jacked at car point outside of his residence in washington, d.c.. our own manu ruch who has the latest on this. what do you know about this terrifying incident? >> terrifying, indeed. congressman cuellar was outside in the navy yard area which in washington d.c. is not too far
