joining us here in the u.s. and around the world, you are watching cnn newsroom. a 7 1/2 magnitude earthquake struck western japan over an hour ago and a tsunami warning has been issued. the chief cabinet secretary went on television advising people in the area to go to higher ground. the quake has been followed by powerful aftershocks. the u.s. geological survey and japan meteorological agency said the original quake had a depth of 10 kilometers, that is six miles. video shows waves of water moving in words but at this point it is unclear how large any potential tsunami waves maybe. japan electric says nothing abnormal has been reported at

nuclear plants in the area where the initial quake struck. montgomery joins us from tokyo. what more are you learning now about this earthquake and tsunami warning? >> as you mentioned, this earthquake struck at 4:10 pm local time while many were at home celebrating new year's day, this was a very large and powerful earthquake. it has already triggered tsunami warnings for the entire western coast. we know it was a shallow earthquake and tsunamis that foow shallow earthquakes can be the largest and the mos destructive. we are already seeing's tsunamis that measure around four feet, for context that 2011 earthquake and tsunami that

killed 22 thousand saw tsunamis with 30 foot waves. we are already seeing aftershocks of 6 point to and 5 point to. we have not seen any nuclear abnormalities. the japanese prime minister has urged the public to be careful of powerful earthquakes and to leave areas with tsunami warnings, the prime minister said he has no details on damages just yet. >> residents are being told to get to higher ground in the wake of this tsunami warning, what help are they receiving to do that? i think the elderly could possibly be struggling. >> in order to get access and

help to these people in the most affected areas, the japanese government usually dispatches the self-defense force a emergency operators to get people out. we are still confirming the details, we know the japanese government usually conduct those types of rescue missions, for context, the 2011 earthquake and tsunami that killed 22 thousand, this is evoking a lot of the same feelings, people are very worried and scared about the potential damages this could cost to the western coast of japan. to see such a devastating and large earthquake on new year's day is frightening people in japan. >> understandably. we all recalled the horrifying images from 2011.

i know you will be in touch as soon as you receive more information. the new year could bring a new legal challenge for donald trump as oregon's supreme court decides whether or not to ban the former president from the state's ballot over his alleged role in the january 6 insurrection. it is not the first, anti-trump challenges have already succeeded in usinghe insurrectionist ban to remove trump from ballots in corado and maine though those decisions have been paused pending potential appeals. u.s. officials that take a two uphold the constitution are disqualified from holding future office if they engage in insurrection or have given aid or comfort to insurrectionist's. joining me now is thomas, director at the center of u.s.

politics in london. happy new year to you. so oregon's supreme court is deciding whether to kick donald trump off the ballot or not using the 14th amendments insurrectionist ban. so when can we expect the supreme court to weigh in and what will they likely decide? >> the supreme court has to rule on this soon, if it does not it will open a pandora's box. there needs to be clarity which is why i think we will get a expedited review and likely a ruling by super tuesday in early march. i do think trump will prevail in the supreme court challenge, not because he did not potentially commit insurrection

by a technical definition, it is largely a jurisdictional issue. the ruling is going to be that state officials do not have the authority to disqualify trump and that comes from section 5 of the 14th amendment that says the u.s. congress has the power to enforce the provisions of this article. justices can also draw a conclusion that the 14th amendment was never meant to to be a accountability for impeachment. >> so you think he will be on the ballot, what will be the likely consequences of any u.s. state successfully kicking trump off the ballot with most of the gop rivals siding with the president and warning this would be a risky move for

democracy? >> wanting to look out for is how state republican committees repositioned themselves in the meantime. it is possible several will petition the national republican committee to hold caucuses instead of primaries which will circumvent the rulings but state governments can also challenge those attempts. that is a scenario the supreme court would want to avoid. it would be messy and it would start to taint the credibility of the electoral process. we are starting to see variations in terms of how trumps republican contenders are responding, saying they will extricate themselves where trump is not eligible and others said they will pursue business as usual. this will work in trumps favor

he can cast himself as the victim and being attacked as part of a political agenda. >> what have democrats achieved by challenging the presidents credibility when it seems only to have emboldened trump again. >> the effort to remove trump from the ballot is a enormous gift to him. democrats like that and they perceive trump is more beatable and that very well may be the case but we know every single time trump faces legal challenges, he uses it to fundraise and cast himself as the victim. 91 indictments later his grip on the conservative base is as strong as it has ever been. if somebody is going to upset

trump the cycle of the political stars have to align and that candidate will have to run a nearly perfect campaign. instead with all of the court cases and legal challenges all of the stars align for trump and candidates like ron and nikki haley have not been flawless. >> you mentioned iowa, what is expected to happen there? we are watching a fierce battle for second place. >> absolutely, it is a foregone conclusion trump will be coordinated there and we go on to new hampshire. i do not think there is much of a contest. for second place the runoff position does matter. matter who is victorious and who comes in second and by how much? does it induce marginal candidates to drop out?
