bolduan and john berman. this is "cnn news central." donald trump is making another courtroom campaign stop today. he is back in there, as his latest defamation trial continues. his only republican rival, nikki haley, is campaigning in new hampshire. with less than 24 hours before polls open in the state. the race is a trump/haley match j -up. just the two of them now. florida governor ron desantis, out of the race. he is throwing his support behind donald trump. that means former rivals have now endorsed donald trump. does any of that matter to new hampshire voters? kristen holmes is in manchester, new hampshire, for us. it's beautiful there. what are you hearing from team trump about what happens now?

>> let's talk about your question and whether or not these endorsements matter. does it matter for votes being cast? likely not. donald trump has always viewed new hampshire as a two-person race. they viewed it as trump versus haley. what does change is those endorsements that you mentioned. that gives trump an opportunity to say it is time for the party to rally around me. look at my rivals. now, he's backing me, as well. trump is in court today, part of the campaign strategy. sucking the oxygen out of the race a day before votes are cast in new hampshire. and he is talk about his legal issues. >> presidents leave and there's things you can go after. and that's one of the reasons

that security is looking at immunity. you have to have guaranteed immunity for a president. otherwise, a president can't function. tomorrow, i do the court thing and i make a speech tomorrow night and hopefully that should wrap it up. we are so far ahead, it's incredible. >> reporter: the other thing to note is he has been fixated on the margins. his team believes he will win in new hampshire. the question is how much he will win by. i was told, if he did well in iowa and new hampshire, they would move out to some of the battleground states, michigan, arizona, georgia. something to watch close think to see. all going to be banking on what happens tomorrow. >> absolutely. kra great to see you. next hour, nikki haley will kick off another big day of campaigning in new hampshire, where the stakes couldn't be higher for her now.

this may determine if she continues. ron desantis ended his campaign days after finishing a distant second in iowa. he told supporters there was no clear path to victory and endorsing the man he spend a while battling. jessica, how does the desantis departure impact this race. now, we're in a two-person race here. >> this is a race that nikki haley said she wanted. she will get it when we go in and see the votes being cast in new hampshire, down to a two-person race. if you look at the polling, our polling that came out of new hampshire. desantis was in low single digits. the idea his supporters going to one person or another, really isn't going to have a huge impact in this race.

haley advisers think they will split evenly. desantis was to the right, even to the right of trump. it's possible a lot of his voters go to trump. he wasn't in big numbers that it will make a huge impact. it was south carolina that desantis and his team wanted to foe kes on. the thought process was to go there and beat her in her home state. that's not how things shook out in the end. nikki haley is contending with what will happen in new hampshire. she will look to her home state in south carolina. we've seen the former president now, bringing out all these endorsements from her home state. tim scott, the current governor, here's what she said about that.

you can see without ron desantis, donald trump's lead grows. 11 points with ron desantis. let's talk about why nikki haley is strong and has a chance there. undeclared voters in hn. independents make up a huge percentage of people that will vote tomorrow. she has a big lead. voters with a college degree, she has a significant lead. in our poll, we tried to figure out who would be voting tomorrow. undeclared, a huge point. but republicans, a bigger chunk. college grads, and donald trump is cleaning up. registered republicans, a 40-point lead in our poll.

vote rs no college degree, lead of 20 points. that's why he has the lead over nikki haley. one thing to look for. nikki haley could pull this out. donald trump could win. he is leading by 13 points in our poll. that would put him up with the biggest margins in history. reagan was the only one to get more than 50%. he won by 27 points. donald trump almost won in 2016. does he do better or worse over nikki haley tomorrow? >> fascinating. any chance to use penultimate, john berman will capitalize.

k john has the numbers where things have been or have looked. let's took whealk about where t are today. what are you hearing about the haley campaign today and in the long term? >> i talked to the haley campaign. they like the setup in new hampshire. they like the one-on-one. that's what they're planning for. they feel good about it. they placed a $4 million ad buy starting wednesday in south carolina. they are looking ahead, too. they like the road ahead, too. when desantis got out, they saw a spike in fund-raising. they are buoyed by the developments of the past few hours and days. they like going into new hampshire. they like what this looks like for them. >> one thing we're seeing, is how nikki haley is leaning in further and harder on

questioning donald trump's ability based on his -- ability and capability on his age. listen to this. >> he claimed that joe biden would get us into world war ii. i assume he meant world war iii. he says he ran against president obama. don't be surprised if you have someone that's 80 in office. their mental stability is going to continue to decline. when you're 80, that's what happens. you're not as sharp. there's a decline. we can't have four years. we need eight years of somebody that's on it all the time. >> what do you hear in that? what are voters getting? >> she's found a safe, comfortable way to make an argument against trump in that

context. those accusations are not the most objectionable or alarming aspects of donald trump's record, during or after his presidency. and she's not comfortable calling him out, still, on racial issues, on january 6th. but there is a comfort level across the republican party as well as other voters, in questioning people's fitness in age. she needs to go after him. up until the final day or two ahead of the new hampshire contest, she has allowed every rival, allowed a permission structure for nominating trump and voting for trump, as republicans decide they want to do that. how much more do we see her ramp up? or is he going to focus on the age. knowing she needs to attack

donald trump, she needs the undeclareds to turn out. >> what do you want to hear from her? do you want more of that? what would you like to see from nikki haley? >> new hampshire voters, i know them well. lots of friends and family in new hampshire. they wait until the last minute. they are concerned about policy. the age thing, the sanity thing, the chaos thing, those are good umbrella messages. but they care about policy. i was talking to a new hampshire voter this morning. old friend of mine. he is a state employee. he said, it's going to be nikki. we are the soccer mom state. it's been a while since i heard

that. it's been a while, two cycles, since that term came up. i'm interested to see if that voter comes out for nikki. >> how far that shift has gone. >> from soccer moms, to security mom, to momma bear. are they back to soccer moms? >> what is the lesson learned from the ron desantis campaign learned and the end of his campaign? >> the same lesson every other candidate is going to learn. you have to make a case for yourself and aggressive case why the person you're trying to beat cannot be re-elected. if you don't believe that, how do you expect another voter to believe that? we are watching to see if donald trump testifies in his defamation trial after a week of sparring with the judge.

he should have to pay. we're joined by senior legal analyst and former and state prosecutor, with many other titles apparently, ally honig is here with us. what can he say in this case that is going to make a difference if anything? >> if he testifies, it will be quick. this is not if he sexually assaulted or defamed e. jean carroll? that's been decided. the judges has said you cannot contest the things that are settled. you can't make a political speech. what would donald trump know about how much e. jean carroll has been damaged? there's been testimony about that. if he has anything to say, it

will be narrow. >> you've been in front of this judge several times. what's he like? and what's a warning if there's bad blood in the courtroom? is there a warning to donald trump and others? >> this is louis kaplan. he controls his courtroom. he doesn't allow dramatics or day yos. he's given us a taste of this. he will warn anybody out of line. he did this last week with donald trump. he will shut him down. if necessary, he will have a person removed from the courtroom. we've been watching the state case, who i think has allowed and permitted redluctantly a lo of theatrics. it's going to be an interesting clash. donald trump a big ego. judge kaplan does not allow dig

egos in his courtroom. i want to move on. a lot of us are talking about this. the georgia case. the controversial surrounding fani willis. nathan wade is a personal injury attorney. why is he on this case? and what's your take on the controversy that's sur rounded this case? they are accusing her of corruption. >> what matters legally, it boils down to money and a potential conflict of interest. and mr. wayne, his area of practice was personal injury law. not able to handle a major case. he's been hired along with two other lawyers to help the d.a.

nothing wrong with that. mr. wade has billed 60,000-plus dollars. is he working nine-times as much as the other folks? the other problem is there's a relationship of some nature. some of that money is being used on travel that the d.a. is accompanying him on. some of the money is being used for personal purposes for the d.a. there's a potential conflict of interest. we have a hearing in that case set for february 15th. we'll get more information then. it looks terrible and raises questions about the d.a. >> does it raise ethical questions? and will this have an impact on the case? is there a possibility this could have the case thrown out or moved or something that could happen with the actual subversion case?

>> the questions are ethical. i don't think there's evidence of a crime. none of this will cause the charges to be dismissed. the allegations don't have to do with the charges against donald trump, trying to steal the 2020 election. sometimes a prosecutor may do something that keeps evidence away from a defend. that's not this. you could see forced recusals or voluntary recusals or mr. wade or the d.a. herself. if either thinks it's appropriate to do it on their own. >> this is big for donald trump's team for the public p.r. thing. we will be watching this. we'll have you back. elle honig. thank you so much. israeli prime minister benjamin netanyahu is responding after families forced their way

protesters, forcing their way into israeli parliament. families of hostages held in gaza. disrupting this meeting to demand action. over the weekend, families of hostages showed up at the prime minister's home to deliver their

messages. they want their loved ones back. they want more action to do it from the israeli government. just as netanyahu says he is not accepting conditions s set by hamas. jeremy dimon is in tel aviv. netanyahu's office said the prime minister told the families he has initiative to win release of the hostages. what are you hearing? >> reporter: the israeli prime minister is saying little about what that initiative is. he is talk about what hamas is demanding and making that clear that is untenable for his government. he says a hamas is demanding the exit from the gaza strip and the release of palestinian prisoners, including those that carried out the october 7th terrorist attacks.

he told the families, that's not a proposal. if he agreed to such proposal, several hundred israeli troops that died inside of gaza since the beginning of this war has died in vain. he has his own initiative. the top adviser to president biden, focusing on middle east af affairs, is traveling to make progress on the negotiations for the release of additional hostages. there's a broader deal that could see a longer-term cease-fire in gaza. as it is being discussed, you see the images on your screen right now. the pressure is ramping up on the israeli prime minister, on his government. a dozen families of hostages storming the knesset, israel's parliament, demanding they do

more to release their loved ones. there were more protests outside, of people demanding new elections. you're seeing this confluence of pressure that the israeli prime minister, that polls show is very unpopular in israel, would likely lose an election if it were held today. the confluence of factors, the lack of trust in government and the two goals of the war, destroying hamas and securing the release of the hostages, increasingly being seen as in conflict with one another. that tension is coming to the surface right now in israel. >> jeremy diamond, in tell aleve. thank you. the anniversary of roe v. wade, the supreme court decision. how democrats are using this as a major campaign event. the faa is urging new inspections of door plugs like the one that blew out of the

today, joe biden's re-election campaign is marking the 50th anniversary of roe versus wade decision, that puts a plan that has that front and center. vice president harris will begin the fight for reproductive freedom tour. and president biden will take part in an event, marking the anniversary of a supreme court ruling that guaranteed americans the constitutional right to an abortion. we go to the white house. how is this going to play out? and clearly, they see this as a very important part of their re-election campaign. >> they do. and when i talk to biden

advisers, they stress they want to put the arguments about reproductive rights at the center of the 2024 campaign. democrats saw success around the issue after the 2022 midterm elections, the same year that the supreme court overturned roe v. wade with their dobbs decision. they plan to stress and organize those freedoms and rights are under threat, specifically by former president donald trump. vice president kamala harris will kick off this effort today with the start of her repr reproductive freedom tour, starting in wisconsin. as you mentioned, president biden will meet with his reproductive task force. talking about announcements and initiatives they are taking. you've really seen the biden campaign over the course of the

last few days, to amplify this message, relating to reproductive rights. the most stark moment came when they announced they would release a new ad that features a personal testimonial. she is a mother of three in texas, who had to travel out of state to terminate a pregnancy after learning her fetus had a fatal condition. listen to what she said when she lays the blame on donald trump. >> two years ago, i became pregnant with a baby i desperately wanted. i learned that the fetus would have a fatal condition. and there was no chance of survival. in texas, you are forced to carry that pregnancy. and that's because of donald trump. overturned roe v. wade.

>> the campaign is hoping that personal stories will resonate with women and young voters. they are trying to tailor the ads to where women and young voters might be tuning in. places like "the bachelor." and tv channels like hdtv and bravo. it comes as the biden administration and the biden campaign really believe this issue of abortion rights is on their side. the majority of voters believe their views stand closer to where democrats are. they hope to make this a central issue with this launch today. tomorrow, biden and harris will be together for the first time in virginia, where the key focus will be protecting access to abortion. >> thank you so much. a programming reminder, don't forget laura coates with an exclusive interview kamala

harris at 11:00 p.m. eastern. let's talk new hampshire. in a few minutes, nikki haley kicks off the penultimate day of campaigning, with an event in the middle of the state in franklin, new hampshire. this is a town that donald trump won handily. you see by more than 20 points, four years ago. one of the things we're watching, how hard does nikki haley go after donald trump? how does she address the departure of ron desantis from the race? with me now, is chris sununu. the governor has endorsed nikki haley. great to have you. what is success for nikki haley in new hampshire tomorrow? >> you know, john, while the race itself has gotten at least apparently more difficult, desantis out, and ramaswamy and

tim scott endorsing the former president, the expectations with donald trump is exorbitant. some of the data that's moved around, the reporting you've seen. they're not talking about cracking 50%. not flirting with 60%. success in these things, the contests, these are judged by expectations. trump met and exceeded expectations in iowa. you can 2,070 republicans, and 344,000 undeclared voters. w what happens in terms of success? nikki haley has to pull the base and enough of those to win this thing. right now, success, to your point, is single digits for nikki haley. if she holds the former

president under 60% and keep this in single digits, she has to go out. it's not what keeps you out. it's what keeps you in. >> keeping donald trump under 60%. the only republican candidate to get above 50 was ronald reagan. he got barely above 50. you say if donald trump gets below 60, that's a fiailure for him. trump himself won by 20. that's a high bar. let's say 50%. the number the last few days is 50%. 60% is what is floating around here. let's call it 50%. does he crack 50? that keeps this thing going. just so people know what we're

talking about in new hampshire. 343,000 are undeclared. all of these folks can vote in the primary tomorrow. the problem is, as far as nikki haley is concerned, she's getting killed by republicans and in noncollege voters. she is leading in declared and college voters. what are the consequences if donald trump is the nominee? that's a great question regarding new hampshire. it's not urban enough. there's all the reasons why the democrats aren't playing here. new hampshire looks much more like what republican turnout needs to look like in a general election. we need to make sure that has to

get back to undeclared voters. hold the base and attract enough independent voters to win. that's a real problem. trump has a solid hold on the maga base of the republican party. you must have that. in swing states, we're going to have a problem if they cannot pull the republican button here. >> let me take this one step further. what do you think the consequences are for america if donald trump is elected president again? >> i have my problem with donald trump. it's not his policies that bothers me. it's the way he behaves. that's a problem for a lot of more moderate republicans and independents. the fact is, joe biden is making this easier on trump every day.

on our radar this morning, the faa urge ing airlines to inspect the door plugs on an earlier model of boeing 737 planes to ensure they are properly secured. the boeing 737 has the same door plug design as the newer max 9.

as you remember, a dor plug ripped off an alaska airlines max 9 in midair a few weeks ago leaving a refrigerator-sized hole. boeing fully supports the faa on this. the max 9 is still grounded across the united states. and is this morning, senator tim scott, the former presidential candidate, just announced his engagement to his girlfriend. scott said he he proposed on saturday, one day after going to new hampshire to endorse donald trump for president. his fiance is an interior d designer mom of three. the couple has been dating for about a year. >> tim scott on a the lot of lists for possible run mates for whoever gets the normination. just in, sara ferguson, the duchess of new york, has been diagnosed with malignant melanoma. the press association said is it was discovered after several

moles were removed after being treated for breast cancer. max foster is in london. st what's the latest here? >> this is her second cancer diagnosis since the summer. she talks about the shock, but she also wants to share her story to encourage more people to get checked. she had in june a ma testmy followed by reconstructive surgery. they saw some holes. they removed them, checked them and came back as malignant mel know many. so a big shock to her. she posted on instagram today. there's some really moving message there is. so very difficult time, but something she wanted to share for the wider public, which is what her father-in-law did as well. king charles last wheek announcd he had an enlarged prostate that's benign, but he shared that information to encourage
