considering this proposal? >> i can't believe he's going to be 20 this friday and he's not at home. he should be home. my message is, it's enough. we've suffered enough. all the families, all the 136 hostages, the families suffer enough. we cannot handle this situation anymore. so, i beg, i beg him to put an end to our suffering. >> i would also like to send our condolences to the u.s. servicemen killed in the middle east and we need to remember the other u.s. citizens killed on october 7th and send condolences to them as way. >> may they rest in peace. thank you for coming in. we hope your children come home very soon. >> thank you. >> thanks for watching. erin burnett "outfront" starts

right now. republicans working feverishly to bring articles of impeachment against homeland security secretary alejandro mayorkas, even though those same republicans say an immigration bill is dead on arrival. nikki haley meeting with some of the richest people in america tonight. will they give her the cash to take on trump? a gop donor is up next. any takers to have a computer chip implanted in your brain? good evening. house republicans taking a major step towards impeaching a sitting cabinet official, something not done in 148 years in the united states. the target is the homeland security alejandro mayorkas. they are working right now and
4:02 pm
frankly expected to keep working well past midnight. they're making the claim that he's committed high crimes and misde misdemeanors. what they're not working on is stopping people from coming over the u.s. southern border. they could be meeting to discuss the bipartisan bill negotiating by gop senators, a bill that republicans and democrats say would be the strictest bill in decades. why are they not doing that? because trump said it would be a gift to the radical left democrats. so trump's lemmings are getting in line. >> i heard speaker johnson saying it's absolutely dead, which is what i wanted to hear. >> it's a nonstarter as the speaker said. >> it's not going anywhere. >> it's not going anywhere, but they're drafting an impeachment
4:03 pm
resolution. one person who really summarizes it well, the issue here, is the former republican homeland security secretary. he writes, house republicans are ducking hard-fought compromise. republicans in the house should drop this impeachment charade. senate republicans are calling foul. here's senator kramer to manu raju. >> reporter: the former president said the deal is a betrayal. is that the right way to characterize this? >> not at all. the only betrayal is whether we're betraying the people we work for. sometimes that lines up for everybody and sometimes it doesn't. it's not a betrayal. >> senator kramer pushing back against the former president. here is what's happening in the house right now. republicans are working hard to
4:04 pm
get impeachment articles against mayorkas brought to the house floor. legal experts are slamming the impeachment effort. >> i don't think they have established any of those bases for impeachment. the fact is impeachment is not for being a bad cabinet member or even being a bad person. it's a very narrow standard. >> a very narrow standard. by the way, on top of this, this could take weeks if not months to go through impeachment proceedings. if you look at what's happened in the last weeks, days and months, in that time hundreds of thousands, even 1 million migrants could illegally cross the border, a border that house republicans are choosing to leave wide open at trump's request. manu raju is on capitol hill. manu, i know you're getting new
4:05 pm
reporting on the border deal as the senators are coming back. what are you learning? >> reporter: there was a debate behind closed doors and senate republican leader mitch mcconnell about how and whether to proceed with this deal given the staunch opposition from donald trump, house republicans and the fact that there appears to be no path to get this into law despite the demands from republicans for years to do something at the border. john cornyn said there has been no decision about how to proceed, just a lot of discussion that we're stuck. in talking to senator republicans that endorse this plan, many are exasperated. they said there's no text of this and we're seeing opposition. you heard from keven cramer pushing back against the former president. i asked him about the expectation that house republicans could kill this
4:06 pm
bipartisan deal and whether there would be backlash at the polls, he warns that there could be. >> here's what i worry about. if we don't try to do something when we have the moment to do something, all of those swing voters in swing states for whom the border's the number one priority have every right to look at us and go, you blew your opportunity. we were going to give you a shot and you blew it. i don't think that's a reward to us. if we don't try, shame on us. >> reporter: just so much uncertainty within the gop ranks. this comes as the house is moving to make alejandro mayorkas the second cabinet secretary ever to be impeached by the house. there could be a floor vote as soon as next week. republicans are telling me today they plan to get in line, but speaker johnson has very little margin for error in the razor
4:07 pm
thin house republican majority. there are a handful of members undecided about it, so it's possible this effort could collapse. the republican leaders at the moment are confident they'll get the voice in the house, even though he's poised to be acquitted in the democratic-led senate. >> manu, thank you. just the frustration that the senator felt as he walked away. we talked about it could come down to a few societies. one of those is of republican ken buck. he joins me now. i appreciate your time as always, congressman. this house vote could come as soon as next week on whether this moves ahead. the gop-led effort to impeach secretary alejandro mayorkas. in november you voted to stall another republican attempt to impeach him. at the time you told me, congressman, secretary alejandro mayorkas hasn't committed an
4:08 pm
impeachable offense. do you still believe that or do you support the effort to impeach him now? >> i agree with professor turley that the impeachment clause is a narrow clause and it requires a high crime and miss demeanor or something equivalent to that. there has to be an egregious act that's like a crime. in my view secretary mayorkas has not committed that. i'm a no at this point. i'm open minded. i talked to constitutional scholars, former members of the house who understand the practice and procedures here. i've listened. i talked to the homeland security staff on why this impeachment should go forward. i'm leaning no, but haven't made a final decision. >> important, as you mentioned mr. turley and the point of view
4:09 pm
he has there. you could be doing a bad job, but it's a narrow standard and one you're saying hasn't been met. >> erin, can i interrupt? >> sure. >> one of the reasons professor turley has such credibility is he was a no on both of president trump's impeachments and i voted no on both of those . i look for guidance from processor turley. >> congressman, right now others in your party in the house are spending time working on this resolution and not talking about the border bill. obviously we heard republicans saying the bipartisan senate immigration bill is dead on arrival in the house, those are the exact words being used. do you believe that this bill -- you heard gop senator kramer saying it will be on republicans if this does not pass, that that will be a betrayal. do you think this bill should be
4:10 pm
voted down or moved ahead? >> i think it should definitely be debated on the floor and given a vote on the floor. i have no idea what's in it, nor does senator kramer or any other house member. saying it's dead on arrival is premature and unfair. i would like to say that there are plenty of laws on the books that can be enforced. president biden could have remain in mexico a strategy that president trump had. he could have agreements with q guat guatemala, honduras and el salvador. i want to see more legislation and legislation that's effective. >> i want to ask you, congressman, you ehave been a straightforward, the former president's role in this. he said a border deal now would be another gift to the radical democrats. that's what he said. he said that the other day. in recent days, just in the past
4:11 pm
week, he has said that criminals, rapists, murderers and terrorist are coming over the border. he said there's a 100% chance of a terror attack in the united states because of the people coming over the border. if those things are all true, there's a 100% chance of terror attack because of criminals coming over the border, how does he get to any kind of deal is a gift to the radical democrats? are you okay with his thinking? >> there's a lot to unravel with what you said about president trump's statements. i live in an area that has a lot of migrants in colorado. there are a lot of very good, hard-working people that come across the border. i would like them to do it legally. i would like our legal immigration system to work better. but to imply in some way all the people coming across are criminals is absolute nonsense and political rhetoric that shouldn't be used. i believe we need to enforce the
4:12 pm
laws we have better. i believe we need additional laws to give the executive branch more power. >> congressman, i appreciate your time. thank you so much. >> thank you. as this battle goes on on capitol hill, many republican officials in washington and around the country are rallying around texas governor greg abbott as his stand-off with the biden administration continues over the border. here's the real question, are abbott's policies, the barbed wire, is it stopping the flow of illegal immigrants. we went out to fact check this in eagle, texas. >> reporter: this man crossed into texas in the summer of 2021, just a few months after governor greg abbott launched a plan called operation lone star. [ speaking in a non-english language ] >> reporter: instead of being detained by border patrol agents, he was arrested by texas
4:13 pm
state troopers, part of operation lone star involves arresting migrants for trespassing. >> when people learn about this, they'll stop coming across the texas border. >> you were handcuffed, arrested and charged with criminal tresp trespassing. you spent a month in jail in texas. [ speaking in a non-english language ] >> reporter: he says the experience was hell. he spent his life working as a human rights lawyer and now was seen as a criminal. the trespassing charge was dismissed by a judge and three years later he's now in colorado awaiting his asylum hearing. the state arrest did nothing to derail that. kri kristen is a lawyer who has worked with a group helping thousands of migrants. >> it's a political stunt and has no effect on immigration. >> reporter: the state says
4:14 pm
they've made nearly 10,000 trespassing arrests. kristen says they're simply dismissed. >> it's been a $10.5 billion temporary and harsh detail to the asylum system. >> reporter: since operation lone star started almost three years ago governor abbott has continued to escalate the number of state troopers deployed to the border. state officials say operation lone star has turned over nearly 500,000 migrants and led to over 35,000 more serious felony charge. >> we deployed more national guard, thousands, than ever before in the history of the state. >> reporter: according to federal immigration data, the number of migrant encounters has increased overall since operation lone star launched in march of 2021. the texas governor's office points out that other states on
4:15 pm
the southern border, like arizona and california, have seen much sharper increases in migrant encounters than texas. this state representative once supported operation lone star and says the $11 billion price tag hasn't been worth it. >> the numbers have just continued to increase. we have to answer to the texas tax payers. i don't think it's enough what we're doing. as a matter of fact it's gotten work. >> reporter: morales represents eagle pass, the epicenter of the ongoing fight between state and federal authorities. texas authorities have taken over a public park and are blocking border patrol agents from accessing the area. the state installed miles of razor wire along the rio grande. texas sued the federal government from allowing federal agents to remove the wire.
4:16 pm
>> this is all political theater. you walk a mile that way or that way and it's completely open. >> reporter: we should point out for weeks cnn has seen migrants cross underneath that razor wire many times. despite the criticisms of operation lone star governor abbott continues to escalate the situation with republican lawmakers who passed a bill that would make it a crime, possibly a felony, to enter the state illegally. that law is being challenged in court. the governor is continuing to drum up support among fellow republican governors and attorneys general from across the country. erin? >> ed, thank you very much. one mile in each direction and there go the visuals of barbed wire. next, a brazen raid. israeli special forces dressed as women and medical staff storming a west bank hospital killing three. and a man who wants to be

killed. he and his brother also killed by israeli commandos were affiliated with islamic jihad. they said one of the men carried this gun, but did not say their troops were fired upon. >> translator: they killed the three youth in their room while they were sleeping. they killed them in cold blood with gunshots to the head. >> reporter: fierce battles broke out later where the israeli military has been cracking down on palestinian militant groups, killing at least 381 palestinians in the west bank since the october 7th attacks according to the palestinian ministry of health. reports of israeli forces at another hospital, this time in gaza. israeli tanks reported by the palestine red crescent society

4:25 pm
west bank hospital? >> erin, thanks. as you mentioned, there's a lot of details don't know. i would like to understand more before i pronounce judgment one way or the other on this. there's a lot of factors at play in this. this is not a war zone. there's reporting of an imminent attack, militants using the hospital for their own purposes. i do acknowledge it appears at least one of them was in a hospital bed. you know, the israeli forces in this case going undercover to protect themselves. there's a lot that has to be looked at. i don't know if i'm ready to announce this as -- we need the details on this. >> president biden earlier as
4:26 pm
this has escalated said he decided how to retaliate for the drone attack in which three soldiers were killed. here's how he put it. >> i don't think we need a wider war in the middle east. that's not what i'm looking for. >> of course there's also been 160 attacks on u.s. military personnel since this war began. now this this horrific event has happened, there's going to be a response. was it a mistake, general, for the u.s. to not have hit back sooner? >> i think so. i mean, i think we've seen this now for a number of weeks, in fact, months. i don't think we've sent a clear and unambiguous message through our strikes and other information operations that this was not going to be tolerated. as a result we've seen iran and its access of resistance
4:27 pm
continue to push the red lines on this. of course, with tragic results this past weekend in jordan. these elements are going to push as far as they can. if you don't push back hard on them, we are going to see results like we've seen. >> general, thank you for your time tonight. >> great to be with you. donald trump is obsessed with taylor swift, and so is everyone around him. why are they so intent on trying to take down one of the world's biggest stars? plus, nikki haley in new york tonight. she's asking some of the richest people in america to keep her campaign against trump alive. will it work? will it survive? one of the donors who left that fundraiser for haley is " "outfront."

tonight the right going all in on facebook's conspiracy theory that claims taylor swift's relationship with travis kelce is rigged to help joe biden win the election. >> this is what i think, there's going to be some type of proposal after the super bowl is
4:32 pm
rigged for the chiefs and then the two of these people become -- it's like rich like crazy levels of absolute fame and they use that in order to try to save joe biden. >> okay. those comments do not come out of nowhere. there's a whole lot about this. in fact, the former presidential cand candidate vivek ramaswamy tweeted, i wonder who's going to win the super bowl and i wonder if there's a future presidential endorsement coming. just some wild speculation. let's see how it ages. outfront now basil and eric. great to have you both with us. eric, this is qanon level
4:33 pm
pizza-gate conspiracy theories. it's all rigged so the chiefs win the super bowl and she gets more famous and gives her endor endorsement. vivek ramaswamy's post was in response to a promoter of pizza-gate. does this trouble you? >> of course it does. let me be clear. i should admit i've been to five concerts in my life. four taylor swift and one adele because my daughter wanted me to take her. i get the taylor swift fandom. my daughter tried to get me to wear a taylor swift sweat shirt tonight, but i didn't. these guys aren't serious, but they know people will believe them and in the process they'll get talked about. they might be able to grift on the it. they're whipping people into a frenzy about something they don't believe because they think it's funny to go viral and get attention and convince people
4:34 pm
who aren't bright to believe this. the right's talking about the most popular woman on the planet dating the most popular tight end in the nfl and they're just stupid. >> basil, look, here's the thing about this, i'm trying to understand who they're convincing about what. taylor swift endorsed joe biden in 2020. in 2018 she endorsed the democrat running against marsha blackburn in her home state of tennessee. by the way, didn't do anything there. in taylor swift's documentary she talked about why she got involved in that race. >> you think -- >> taylor swift comes out against trump. >> i don't care if they write that. i'm sad i didn't two years ago, but i can't change that. right now this is something i know is right. you guys, i need to be on the right side of history.
4:35 pm
if he doesn't win, at least i tried. >> you know, she then reacted when marshal blackburn won. i'm saying this because we know where she stands. she's clear about where she stands. i don't know who is ambiguous about where she stands on trump. why is there a conspiracy over this? >> you know, i have no idea. you know, i don't understand the taylor swift phenomenon. if it was shade, different story. i don't understand the taylor swift phenomenon in this regard. when we talked about pizza-gate, there were real world reactions to this. people were harassed. people got hurt. my sense is that what they're trying to do, as we said before, is to get trump supporters to reabo react and hope that translates into a vote and suppression of other votes in terms of harassment and intimidation. again, my concern is that this
4:36 pm
has real world consequences. that's number one. number two, how petty is this. you don't have policies to run on. you don't have a legislative agenda you can run on as a republican. you want to make sure that these conspiracy theories get pushed out to fill the void, the narrative void. what event does it have? it will gin up taylor swift supporters who are young voters all across the country, if that's possible, to get them to vote against you. why do that? >> this is the thing, taylor swift obviously being who she is as an inspiration to many young women, now you have some of the women who work with trump taking shots at taylor swift. again, i don't understand this. alina habba shared a post on instagram. it says who thinks this country needs more women like alina habba and a lot less like taylor
4:37 pm
swift. trump's press secretary said this last night. >> let's not forget that taylor swift has made a career off of writing songs about picking the wrong man. i don't think we should take advice from her now. >> you know, eric, you have perspective on this because your daughter's a taylor swift fan. do these women who work for trump saying this and behaving this way does it fall on p perceptive ears? >> maybe some. go back to tennessee. she endorsed marsha blackburn's opponent and it didn't work well. you know, yeah, there could be real world consequences. the pizza-gate grifters encouraged people to show up at that pizza restaurant and they did. >> they did.
4:38 pm
>> it's insanity. many of these same guys six weeks ago were saying taylor swift was a curse to the chiefs because they weren't doing so well at the time. they're just trying to get viral attention and they don't care what the fallout is. it's a realism that's creeped into the right of deeply unserious people. >> it is deeply unserious, but there could be serious implications to that. trump himself has slammed taylor swift when she came out against him in 2018 and he now says, i wish the best for both of them. i hope they enjoy their life, maybe together, maybe not. >> again, how petty is this. you have nothing more to do than worry about taylor swift and who she's dating. at the end of the day,
4:39 pm
endorsements may not matter. however, one of the thing i remember from the obama campaign, you had all these celebrities encouraging their supporters to vote. the chatter and the buzz they can create is worth millions. you're just elevating her and that buzz and chatter. what's the strategy there? >> thank you both. so glad to see you both. next, some of the richest people in america coming together right now tonight to keep nikki haley's campaign alive. will it happen? one of the donors who just left her fundraiser is next. plus, an insider whose job it is to follow elon musk's every move is next. is musk getting closer literally to reading our minds?
4:40 pm
4:41 pm
4:42 pm
growing up, my parents wanted me to become a doctor or an engineer.
4:43 pm
those are good careers! but i chose a different path. first, as mayor and then in the legislature. i enshrined abortion rights in our california constitution. in the face of trump, i strengthened hate crime laws and lowered the costs for the middle class. now i'm running to bring the fight to congress. you were always stubborn. and on that note, i'm evan low, and i approve this message. tonight could be nikki haley's make or break moment. she's in new york meeting with some of the richest people in america. she desperately needs their cash to keep fighting against donald trump in a primary race. we sent cameras to the event to see who's there. some of the high rollers, leonard stern and stanley
4:44 pm
druckenberg and eric levine who just came straight here from the event. eric, i know you were just there with some of these individuals, all of them. what was it like in that room tonight? they see the polls and what everyone else sees. they know the reality as it appears. are they still willing to write the big checks? >> first, so my wife knows, i'm not one of the richest people in america. so the room was electric. there were a few hundred people there. nobody is pfazed. they still believe in nikki haley, as do i. >> ken griffin came out today. he wasn't at her event.
4:45 pm
he gave her $5 million earlier this year. he said, look, i'll support the senate, the house. i'll go that way as opposed to this way. there's some who may feel that way at this point. you look at the polls. south carolina she's 30 points behind trump right now. what path is she laying out for herself when she's speaking in a room like the one you just came from? >> her main point is she wants to make america normal again. i don't think she put mana together, but we could use that mana from heaven. her path is to stay in it and accumulate as many delegates as possible. this is not me speaking to the campaign. it's my surmise. if she can accumulate enough delegates and something happened to trump, he becomes convicted. he's not a young man. something could happen. she'll be there to pick up the pieces to make america normal
4:46 pm
again. if she gets out now and husbands her funds in hopes that something happens that forces trump out of the race, then 10,000 people will jump in. she has to stay in there and accumulate delegates. she's worked very hard. she deserves to be the nominee. she's the most qualified. she is the person that can beat joe biden. donald trump i remain skeptical will beat joe biden. just your last segment, the idea that people are fixated on taylor swift is one of the dumbest things i've heard. you don't become president by worrying about taylor swift. you become president by telling people how you'll make their lives better. you don't become president by telling me you don't want people like me. >> there was a trump donor who gave him $1 million for legal fees. >> i didn't see that. >> he agreed to donate another $20 million to the main pro trump super pac. what do you say to that?
4:47 pm
someone willing to put $21 million behind trump right now, that he's still getting money like that. >> trump's a cult. some people are cultists and follow trump, they crawl over glass for the guy. i understand it. i get it. but i remain skeptical that he can win. when someone donates $21 million, do we want someone to be president that has an $83 million judgment against them for defaming a woman and has been found to have accosted her in a dressing room -- bloomingdale's -- >> bergdorf. >> i knew it was a "b." it would be nice if we could elect a president we would be proud of. that's nikki haley. the world is coming apart. we're falling abroad. we're falling at home.
4:48 pm
you had a segment about three american service members killed in jordan by iran. hamas is funded by iran. hezbollah is funded by iran. proxies in syria and iraq are funded by iran and joe biden will not defend america. that's pathetic. it's disgusdisgusting. we need to replace him. i don't know that donald trump will beat him. we need nikki haley. she will defeat him. i primarily raised money for republican senate candidates. if donald trump is the nominee, god help us if we don't retake the senate because we'll lose the white house, the house and the senate will be the firewall between the country we have now and love and chaos. >> eric, thank you very much. appreciate your time coming straight from that fundraiser for nikki haley. next, i'll speak to an insider who has been following
4:49 pm
elon musk and his start-up which has implanted a computer chip in a human brain. and the two american soldiers who has been post-humorously promoted.
4:50 pm
4:51 pm
4:52 pm
4:53 pm
tonight open for recruitment, elon musk's company is recruiting volunteers to have a computer chip implanted into their brain. he says the ideal candidate is under 40 and a quadriplegic. now what musk says is the chip will enable your phone or computer by thinking about it. sarah mcbride is a reporter who has covered elon musk extensively, and specifically nero link, you know him and the company. this process, can you take us through what happened here, what is the procedure to implant this into someone's
4:54 pm
brain? >> sure, so this is a tiny device about the size of a quarter with a bunch of threads coming off of it with tiny electrodes attached to that threads, and the idea is that surgeons go into somebody's skull, open up there door and their brain, put the device in there, make sure the electrodes go down a few millimeters into the brain, so everything back up and there's a battery pack in it, and it will recharge wirelessly and it will communicate wirelessly, with an outside device that can control a computer cursor or an ipad, so the procedure will one day, elon musk has said, it'll take maybe a half hour, we are not quite there yet, the surgery that took place on sunday, likely took several hours and involved several surgeons as
4:55 pm
well as this famous robot device for surgery that nero link has invented to do these procedures. >> it's incredible and you can think about how transformational this would be for someone. stephen hawking, right, to even comprehend that, it's magnificent, but musk likens this to replacing a piece of the school with a smart watch and the company did share a video of a nero link trained monkey using just his mind, if it becomes more widely available, it could change the way that we exist, you could have waves in your brain, you are in traffic and you are looking for ways out, we can see the potential options. if you can use it to do something, it knows what you are thinking. what about mind reading, is
4:56 pm
that possible? >> that's possible, far into the future, like so many of musk's projects, there is what he says that might happen one day like teslas will be fully self driving and then the reality which is a little bit less than that. so, he has spoken about all of these futuristic possibilities, the reality is, right now, it could perhaps help somebody who's paralyzed, but years into the future and we are probably talking 20 years, maybe it'll be able to do some of those more concerning things you just mentioned. >> it's pretty incredible. all right sarah, thank you so much, thank you. next, the two u.s. soldiers who were killed in a drone strike who have been
4:57 pm
posthumously promoted.
4:58 pm
4:59 pm
things have gotten better recently, but too many businesses like mine are still getting broken into. it's time our police officers have access to 21st century tools to prevent and solve more crimes. allow public safety cameras that other bay area police departments have to discourage crime, catch criminals, and increase prosecutions. prop e is a smart step our city can take right now to keep san francisco moving in the right direction. please join me in voting yes on prop e.
5:00 pm
tonight the united states announcing promotions for two soldiers who were killed in a drone a track in jordan. i spoke to kennedy sanders parents, and here's what they wanted everyone to know about her. >> what do you want us to know about her, she has died in service to her country. >> the commitm
