forward that tie this whole story together. and oh, by the way, we also have the receipts. we have the 34 allegedly fraud or what they say is fraud documents. they have the business vouchers, they have the checks and they have the invoices, all that evidence and witness testimony that they are going to highlight and sort of show the jurors their entire case because of course, the burden is them. now, we he understand it's possible that these closing arguments could last the entire day today and could even go into tomorrow once closing arguments are done, though, then there is another part of this case, of course, that's so crucial and that is the jury constructions. we have not seen what those jury instructions look like. remember, they are being debated at the end of the last time jurors are rather lawyers were inside the courtroom. and that'll take about an hour. and then once because are done with the deliberations, begin to decide guilty or not guilty on these 34 counts for former president donald trump, guys. >> all right. friend. thank you so much. 34 counts hours ahead

officials admitted the jail was unaware. any of them had escaped until they concerned citizen contacted the warden, cnn's ryan young is with this year with the very latest ryan, what are you learning? >> we'll talk about a detail that stands out, john, the idea that this jail did not know that these inmates had escaped until someone gave them a phone call on sunday. it's quite a head-scratcher at this point from what we know, these tangible inmates were inside that facility and on saturday, two of them escaped and then apparently, i guess the word spread throughout that facility to more escape. now, for their part, the jail saying that this is a lack of supervision, that they didn't do a head count. the wire on the yard was actually weaken by corrosion. so at some point they were able to evade that, go under offense slide and then jumped over to fences and there was also a lack of race as a wire. so get you normally don't see a lack of when you talk about a jail facility, but listen to one of these correctional officials talk about the problems that they're going through at this point the wall wouldn't have a

gap in it. you wouldn't have to get over the wall or onto the wall if the fence wouldn't had the corrosion where they were able to take him physically break the wire and work at loose you wouldn't been able to get to the wall to go under it? john, this isn't a movie, this is actually something that has played out in these two men are still on the run right now. but let me just also talk about this. not only did they get away, but someone called in and once they were called in, they were able to track two of them and dow, who were hiding in a dumpster behind $1 tree. now at this 0.2 of them in a in hoffman and jeremiah stefano are still in the run. police are looking for them as we speak, they're hoping that as we put these mug shots up, there's someone in that community might be able to focus on these two men's picture and help capture them because obviously there was some time between sunday and monday before they realized that they were gone. now, obviously, they're probably make some changes at that jail, but at this 0.4 different men were able to escape. they

happening now nearly 50 million americans are at risk of severe weather today. >> a tornado warning and the dallas metro area flash flood warnings all over the place as well. menacing pictures from texas this morning. let's get ready to cnn's allison chinchar for the very latest al. so what are you seeing? >> cluster of showers and thunderstorms sliding through the dallas area? the worst of it now, just on the southeast side, but notice still there some of those training storms behind it. you've still got this severe thunderstorm watch and effect for a little bit longer. we've even got a severe thunderstorm warning and this tornado warning on the south eastern suburbs of dallas here that's valid i will then until 7:30 a.m. central time. this morning. but again, just overall, all of the rain that's coming from this is triggering a flash flood warning and that does include the metroplex area because there's even more rain on the way now, all of those storms as they've moved through, have caused a significant amount of power outages already. we're up to over 600,000 wasn't people without power. the bulk of

those are in that northern texas area. that number could continue to go up as more of those storms continued to slide in because we are going to see some extra development even as we get later on into the afternoon, hours two, you're going to start to see more of this popup, say 234 o'clock this afternoon, that full line begins to take shape once we get towards after evening, that's going to slide in and bring additional showers and thunderstorms to places like dallas, austin, and then eventually by the overnight hours should finally slide into the houston area, bringing them the potential for those strong to severe thunderstorms. so overall the greatest threat for severe weather is included in this general area. you see here biggest threats are going to be very large hail. we're talking golf balls, eggs, maybe even the size of baseballs. you're looking at more damaging wind gusts, which in turn means yes, there could be additional power outages for a lot of these areas and also cannot rule out the potential for another tornado. this does include dallas, houston, san angelo san antonio, austin, up through amarillo, and even over into oklahoma city as well,

brief time that he was in jail as he awaited and all of this legal process really played out. okay? really gonna get a sense of just how the remaining cases may play out later today when two of the accused, a four americans, will be in court. as you said, tyler wenrich is expected to learn his fate when a judge, a hands down his sentence, the 31 year-old, just like the other americans, is accused of bringing ammunition and to the country. and a fellow american wine ryan watson, rather he is also going to be in court. he's expected to decide whether he is going to plead guilty to his charges or if he's going to go to trial. now, both of these appearances come days after heydrich was allowed to return home, after a judge handed down that 52 weeks suspended sentence, and issued him a fine. now the 40 year-old, he boarded a flight back to pennsylvania on friday, just hours after that, judge ruled in his case and found that there were quote, exceptional

and width that in mind, the biden campaign is getting some help ahead of time from january 6, police officers, some of the very officers who defended the us capitol against the rioters will be mobilizing now in swing states to talk about what they see as donald trump's threat to democracy in 2024, cnn's kevin lip tack, is that the white house for us? he has this new reporting. kevin, what more are you learning about this? >> yeah, this is just another example, kate, of the biden campaign really working to sharpen that contrast with former president trump. and they really do view this moment with the hush money trial coming to an end. and as an opening to start reminding in some ways, re-introducing voters to the chaos and what they say is that antidemocratic tendencies of the former president. and that's exactly what we'll see. >> he's three police officers doing when they hit the campaign trail, all three of them were in capitol on january 6, and they have talked previously about their experiences and i think they

will really start to drive home this idea of the january 6, ryan as an example of trump's tendencies towards anti-democratic ideas. >> and these officers will hit states including arizona in nevada. just this week, they will then go on to states in the so-called blue wall, pennsylvania, wisconsin, and michigan. and we did talk one of the officers, harry done, who told us that if i can tell my history 1 million times, he will. and if i can do that, i'll just be doing my part to save democracy garcia. now whether that message breaks through amid all of the other issues that voters are looking at this election, i think remains to be seen. but when you talk to the president's advisers, they really do believed that this is a resonant issue, and i think they're challenge is bringing it from issues of democracy in the abstract and putting something concrete hi dan, and that's what these officers will do by relaying their own experiences in the capital on

january 6, this is a message that the president will start to ramp up over the coming weeks. you'll see him traveled to europe in the next two weeks for the 80th anniversary of d-day, he'll also be at the g7 and i think the issues of protecting democracy, maintaining democracy very much on the agenda. there we've also seen him really sharpening his language about president trump's mental state after the 2020 election, saying that in his view, trump's snapped after he lost, that he couldn't accept that he had lost the election, and that that is part of what led to january 6. so you really see a toughening of the language, a toughening of the rhetoric. all culminating in that cnn debate on june 27 yeah, it's great to see you, kevin. >> thanks for the reporting. >> jump right. in the meantime, we're less than an hour away now from closing arguments in the case that could make donald trump a convicted felon, or perhaps give them a huge political boost with us now

seen in legal analyst, jennifer rodgers and former prosecutor jeremy solana, in jennifer, i want to start with some of the details that we are learning about what might be in these closing arguments. >> cnn has learned that the defense might focus on who did not testify in this case, allen weisselberg, the cfo of the trump organization and keith schiller, trump's body man how would you bring them up and closing arguments? what would you do with them and what's the risk reward? >> well, the defense says, you heard we heard about this allen weisselberg, michael cohen is the only person who tells you that trump was in the know that he knew about the reimbursement scheme, but he says allen weisselberg, also new. so where's allen weisselberg? prosecutors didn't bring him to you? where's he wears? keith schiller. they came that keith schiller was on the phone. they were talking about these payments and so on. where's keith schiller? i mean, that's the way you do it, which of course implies that prosecutors could have brought them and should have brought them and didn't bring them. and then the question is we were talking about this before. what kind of instructions do prosecutors

get? about keith schiller who either side could have called if they wanted to. they'll probably get a missing witness charged with respect to him. but with allen weisselberg, who of course is in prison for perjury, having lied to protect donald trump at a previous trial, and who also would presumably invoke the fifth, right. and of course has the severance agreement where he's agreed not to voluntarily cooperate with law enforcement or he forgoes $2 million. so there are lots of reasons he's not there. the question is, if the defense raises it like that, i have to assume the judge gives an unavailable when it's charged saying to the jury he's not here. he's unavailable. neither party can call him. you are not to speculate as to why and then just leaves it at that. >> what is the prosecution du with that or how much do they care about how the defense uses allen weisselberg in closings? >> well, i think the prosecution has to bring it back to really the meat and potatoes here, which is the four corners of the charges. this is a falsifying business records case. you heard from michael cohen, you heard from stormy daniels. they gave you the back macron, you're from hope hicks. hear from david pecker, you have the handwritten notes, you have the

call logs are so much evidence that you don't need michael, pardon me, that you don't need weisselberg. those notes are so critical, they really poked the dots are put the dots together and connect it all together. but at the end of the day, whether you're not, you have weisselberg you have the case. if you believe and the evidence, i think when in very very well and constantly, what the defense is going to try to do is make this about missing information about lai's and about blackmail. and every time they do that, although it's not back-and-forth anymore, the prosecution has to bring it back down to really the meat and potatoes they use that term again, this is really a simple case of falsifying find business records. not about sex torsion, not about whether you'd like michael cohen and not about where michael lights or weisselberg is, which side is gonna do more horrid thing in the closing argument two, which is to say, where might we see more passion? because as jeremy lays it out right there he's suggesting the prosecution you go second here and the closing arguments may be relatively dry and say, just look at the documents here. >> yeah, that's how it usually goes, right. prosecutors have to take the law as the judge

will instruct them, and then put the evidence in for each each element of the case and say, this is how we proved it. it tends to be pretty dry. i mean, hopefully they'll have some dramatic flourishes here and there to keep it interesting. but the whole ramping in the faux outrage and all of that definitely comes with a if that's they're the ones who saying are poor guy is on trial here. this is an outrage. he is the president all of that we'll get more from the defense for sure. >> and the jury won't get their jury instructions until wednesday, likely tomorrow, right. tomorrow, which is one we will be learning about them for the first time. but the lawyers here, they know, don't they? so what's in these jury instructions at this point? >> i absolutely. and when they do, their summations are going to keep that in mind. they're going to make sure they hit the elements of the crime. they're going to make sure that they identify any issues that may come up with those jury instructions. so for example, if there is a risk of of a witness, isn't going to show up and there's going to be an instruction as to a missing witness, which probably won't happen. they're going to get to that in their summation. they know they're going to telegraph it and they're going to answer it before it gets to the jury.

>> i mean, to the point it's almost like when you get an assignment to write a history paper, but x, y, and z, you literally in your introduction when you're in high school, say those words x, y, and z are the lawyers here mapping their closing arguments based on the jury instructions. so it's like mesh together prosecutors do. >> defense lawyers tend not to remember prosecutors want it to be organized and focused and tight. i mean, before powerpoint was such a thing, we used to even have our paralegals put together like a poster board, right where you'd put the elements of a simple offense and you would check it off. here's the evidence that proves this offense. check. so on defense so here's wanted to do the opposite. they want to say this is messy, this is complicated. i don't expect that they will do it like here's what evidence fits with this. instead, they'll say this is all over the map. there's so much reasonable doubt that's the sort of thing defense does. >> what percent of the defense closing arguments and again, nagel first very shortly. how much of it will be about michael color if i say 75%, you take the over the under, i take i think the over, i take the over. i think if the defense

do we see among all registered voters? we saw baraka a bomber would have won that group by six points. but of course he only one by four. so this is a very different thing that we see going on here. when you look at all registered voters, you get actually a more favorable environment for donald trump than if you look at those folks who are actually likely to turn out. again, this is a flipped from what we've seen historically. >> are there any states this matters more than others? >> yes. so we're looking nationally, but of course things are determined in the electoral college and one state where the poles have consistently shown the new york times sienna cultural. i've also seen a little bit in our cnn poll when i dug another cross tabs a little bit where we see this massive jump from registered voters. look at this donald trump at 49%, joe biden at 42% go to likely voters look at this a well within the margin of error contest in which joe biden actually scores 47% to donald trump's 46%. he is doing significantly better among likely voters in michigan then among registered voters. and part of the belief for that reason, john is because michigan has very lenient voter

registration laws, a lot of automatic voter registration in the state of michigan she got that explains michigan overall what might be contributing to this trend? yeah. so we spoken a ton about joe biden's problem with young voters, right? look at the 2020 results. we see joe biden in those exit polls and in the post-election survey from the pew research center, winning young voters, those under the age of 30 by 25 points, right now in the paulus look at that joe biden's up by just a single percentage point. my goodness, gracious. what a decline for joe biden, but there is of course, an age reversal going on here that i don't think get spoken about nearly enough, which is in those exit polls in that pew research center post-election survey. donald trump by five. now we have joe biden by six points. and of course, older americans are much more likely to vote. so this is an hey traverse like think joe biden will take, you want these are the voters who show up generally speaking, but that's a huge swing it's something historic, john. >> all right. harriet, and thank you. thank you let's talk about this joining us right now as republican congressman byron donalds from florida congressman.
