prosecutors, defense lawyers, legal hello. so around the world, trying to figure out what the jury is thinking it is. verdict watch and the criminal case against donald trump, the jury has the case. they have been deliberating for four hours, but they asked to be red key pieces of testimony, testimony that largely involves david the man that ran the national enquirer testimony about discussions that he says he had with donald trump himself about bearing stories before the 2016 election. the jury also asked to hear their jury instructions from the judge. once again with us this morning, cnns brynn gin grass from outside the courthouse within an hour or so we should learn a whole lot of new information. brynn yeah that's right, john, testimony as

you're laying out for the viewers that in closing arguments, the prosecution said pay attention to this testimony up. >> david pecker, the prosecutor, who gave those closing arguments is saying he believed his testimony was utterly devastating. so certainly interesting that the jurors are requesting to hear back some of this testimony, though it's unclear, of course, why. so as you just laid out, they had two requests before they left yesterday, the jurors one request was to hear back for different parts of testimony regarding david pecker and his interactions with donald trump about the karen mcdougal deal. and also a testimony from both david pecker and michael cohen from now, august 2015 trump tower meeting, where they sort of according to prosecutors, hatched out this catch and kill scheme, the basis according to process the cures of this conspiracy that they allege against donald trump. so very, very key parts, unclear exactly what parts, you know, definitely unclear. what parts

they're going to read back. but we're hearing it's about 30 minutes or so that that's going to take to read all that back to the jurors. their second request, as you noted, they'd like to hear back jury instruction. what's unclear this morning is how much of the jury instruction they don't get a copy of that when they go back into the room and deliberate. so do they want to hear all of it? all 55 pages or do they want to hear a portion? the judge asked them to clarify that. so will here when court resumes at 9:30 this morning, so look when court picks back up, that's where we start off we'll hear back the read back of this witness testimony will figure out how much of jury instructions will be read back if portion of it all of it. we don't know yet. >> and then the deliberations are going to continue one little thing to point out as well. that's interesting for the jury irs they actually have a computer back in there deliberation rooms that has all the evidence on it that they can access. but again, it's the testimony that they don't have access to and that's what here when court starts back up guys like computer without wi-fi

capabilities. interesting, alright, bridge and gingras, great to see you this morning. thank you very much john, have you the least interesting part about this. >> just kidding. i'm just kidding cnn legal analyst and former federal prosecutor and jennifer rodgers is here also criminal defense attorney and former new york prosecutor, bernhard veal hello, and thanks guys for being here. >> okay. so jennifer add the questions up that the jury has now asked for the judge as brynn was brynn pulling together and what is the range of what it could mean? >> well, i think prosecutors are happy with these questions because the jury is doing what prosecutors asked them to do, go through the evidence in this way, evidence that initially you don't even have to think about what michael cohen says. think about what david pecker says, and largely in chronological order, think about the meeting about catch and kill when the whole scheme was set up to when wins the election by catching and killing these stories, right? >> so i think they're happy because this evidence is it will come back into them in the form of the testimony largely benefits their side of things,

right so that's what the parties are thinking about and the defense, you know, maybe a little bit worried is what they're doing, but you never know why they're doing yeah. >> right. is this what's the motivation of his 11 jurors trying to convince one to come over to the conviction. sayyed as it the opposite. we don't know, but to the extent we're reading tea leaves, i think prosecutors are happy when the evidence that they're asking for and there's going to be read to them benefits their narrative, and to continue reading tea leaves, asking for michael cohen's testimony to be read back. can people take that or consider taking that bernardo as prosecutors clearing at least one hurdle which with the jury, which is that they're not completely discrediting all of michael cohen's testimony flat-out. >> yes, absolutely. i think it's quite possible that they've already determined that the document itself of those documents have been falsified, meaning that it wasn't a payment to michael cohen for legal services as opposed to that, it was reimbursement for the money that he paid for stormy

daniel's in terms of michael cohen's testimony for them to ask for a bag, they haven't completed discredit him. but remember, it can be two jurors, three jurors, five jurors. how for the jury, we don't know, but the important part is that michael cohen's testimony when they asked for it and david pecker's testimony about a specific meeting that they're comparing the testimony between the two, trying to see if it can be corroborated between the two. and it also goes to show you number one of the jury instructions has to deal with accomplice testimony and on michael cohen as an accomplished, you can't just take his testimony alone. you need to corroboration. so perhaps they are looking for that cooperation as well. >> as you're mentioning the jury instructions, 55 pages. we've kind of talked about it at leading up yesterday how important it was and what the jury needed to take from it. >> but now, i heard marco mira is an attorney that we all know very well and he said the fact that even though it is standard in new york that the jury cannot take the instructions back to the room with them. >> he thinks is pretty

ridiculous the way he described it as it's like, i'm going to read you here her 55 pages, read it once and now, go put together that piece of furniture with no problems, with no broken parts and he thinks it could be grounds for appeal. what do you think of that is not grounds for appeal. we were actually talking about this before because i also come from the federal system where they give them the jury instructions. i mean, why you would want jurors to be like, oh, let's try to remember what the law is and not have it in front of us. i also think is crazy, but it's the standard in new york. it's been through appeal 1 million times. there's no way it's grounds for appeal, but to me it's foolish. i wish they would change that look, i've been practicing care new york for 17 years. >> that was possible cuter are here in new york for 13 years. so as normal to me for the juror is not to have the instructions that's why it's also normal for the jury to come back and ask the judge. q. as these jury instructions. so i'm curious to see what specifically do they want from the jury instructions, then we'll have that note. one of the first node should be today. do they want the law itself or do they want accomplice testimony or do they want

the stuff that was going on behind the scenes. the whatsapp a group chat was started. first of all, because it's encrypted. so unless someone gives you access to it, there have been no way anybody would been able to review this, but some of the things i've going back and forth is sometimes when they would see a dead body, they would share of that picture amongst a group chat. they would joke about things going on. in fact, one of the messages talks about when deputies hunter elward add let's did you taste the man in the face or when another officer of the goon squad said, did you use your taser to shock the man's? so you can see the back-and-forth. there's even a time when there was a woman who apparently they had rested, they were talking about whether or not they would share pictures of this woman's naked body after the arrest. so obviously there's a lot of questions about how pervasive, how corrosive was this back-and-forth goon squad with these messages. now, some of the people who were involved here says this was just joke. this was just a mecole nature of what was going on. but when you realize that sometimes they were able to coordinate their efforts through whatsapp that

shows you how whatever happened in this chat group sometimes ended up affecting people. now, to go on here, one of the lawyers for one of the men who was arrested, actually, then you updike jeff reynolds, lawyer says the explanation by some they were just joking about torturing people in their whatsapp group rings hollow, given the multiple incidents of torture that have now been documented, maliuk chavez these attorney for jenkins and parker says the latest revelations regarding the rankin county, mississippi goon squad text messages are not surprising at all. you understand there's a lot of pain still in this community. i will tell you the justice department is still asking for people in this community to come forward with more things when it comes to talking about the goon squad but let's not forget five members of that squad have already been sent to jail. but at the same time, people believe this is a deeper corrosive problem within that sheriff's department. these messages are starting to bring the light some of the things that people talk about. john, i will continue to examine this as a bunch of people working to get to the bottom of it. but

would obviously would love some endorsements from some big young stars because they're having some struggles with younger voters with us now, cnn senior data reporter, harry, and when we're talking about these struggles with younger voters, what does that look like? >> yeah, we're talking about the youngest voters here. i unfortunately have aged out of this group, aright. so take a look here. biden trump margin, and this, take a look here age 18 to 24 biden won this group by 32 points last cycle over donald trump. look at where the polling is. now. john oh, by an still leads, but just by seven points. that is a drop. john, let's see if i can do this math. i believe it is a drop of 25 percentage points and compare that to the rest of the electorate where we're looking at a fairly similar race to where we were four years ago, where joe biden won those voters by two points last time around now donald trump leads by two. so that's a movement of four points. but four points, i don't need to tell

you, john is significantly less than movement of 25 points among those voters under the age of 25, we're there are way more voters over 25, but nevertheless, that is a huge showing. the likes of which the biden campaign has to be a little bit nervous about what are the reasons behind it here. yeah, so this question to me gets really at the reason of why this might be occurring do you prefer a want a presidential candidate who promises to restore restore normalcy to washington dc, or bring major change to the country overall, 54% of likely battleground state voters say they want a candidate, they prefer one who restore normalcy to washington dc, but look at voters under the age of 30. >> it is a total flip of that. bring major change to the us. look at 65% of voters under the age of 30, say they want a candidate to bring major change to the us. and in that same poll, which candidate they

thought would bring major change to the country. they've thought donald trump would. so all of a sudden you match up those two questions and you get a pretty clear understanding of why younger voters seem to becoming more republican versus just four years you got to read the small print here. the small print means has big implications. harry how quickly have opinions changed among younger voters? >> yeah, i think some people look at this polling and you know, they look at a slide like this and they say, oh, this change, this is just a polling artifact. i don't think it's necessarily the case because i want you to go back in time. i look at age 18 to 24 24-year-old voters look at the margins and look at this back in the early 2000s and 2000, those under the age of 25 were tied between bush and gore. look what happened in 2004. they started shifting, becoming more blue. john kerry one and by 13 points, barack obama in 2008 i'm by 32 points points. we had a movement of 32 points over just eight years. remember john, those voters under the age of 25 right now, they best were born in 2000. they were

plastics to resign cycle the polystyrene, the stuff in those coolers, coffee cups, egg cartons, they could break it down, reuse it again and again and again, at least that was the promise, but they just closed after only managing to recycle about 3,000 and not 3,600 tons of plastic waste over five years. that was the promise they wanted to be able to do over 3,600 year. they only managed to do 3,000 over five years and then closed even though they called the project a success. but this is just sort of a glaring example now of the plastics industry, a big petrochemical schumer. that the recycling efforts aren't going the way they've been promised for so long, even back to the keep america beautiful campaigns you remember of the 70s of the crying indian putting the responsibility for recycling on the consumer instead of companies as they actively resisted those sorts of things, it turns out that only 9% of plastics these days is recycled globally and much less than that over i'm 5% in

the united states, the promise of chemical recycling, it was that it was this new magic process. unlike mechanical recycling, which takes more energy and it's harder to separate all those chemicals. they promised that the chemical way to do it would be the way to go, but only 11 one of these plants are operating in the us. and that capacity could only recycle about 1.3% of us waste even at full capacity if they're crank and full-time so what this does is now forced back to the debate over cutting down on the production of plastic in the first place industry wants to keep making the stuff with the promise that it could eventually be recycled the more activist consumers are saying no, we need to shut it off at the source, get a handle on the problem, right now. but as we speak, john, millions of tons of plastic are produced every day and a lot of them are single use that end up in waterways, almost immediately. a big problem needs, needs our attention a huge problem, and there is no magic solution

here, bill, we're great to have you on this morning. thanks so much. >> okay. >> so they are cold. they are the so-called social media babies. they're the generation whose childhoods coincide with the rise of the social media era there, the first-generation of child influencers, and they're now becoming adults. and there's a movement among them who are fighting back against the whole industry of parents posting birth announcements personal medical information, intimate family life details that children don't have control over. some i'm young people are now even calling on lawmakers to do more. my next guest is fighting to do just that with their organization. quick clicking kids, joining us now is chris mccarthy. chris, thank you for coming on. you've been advocating for this after you learned about one influencer in particular, who shared extensive kind of personal content online about her adopted son. why has this become your cause and your passion? what do you see here? >> that's a great question. i, and so interested in how we can better protect children online

i was fortunate enough to have a family that is very conscientious about the things that they share online. so this is not anything that i've gone through through firsthand, but the knowledge that social media is becoming increasingly ingrained in our daily life, that it's becoming easier and easier to find out a wealth of information just from their name or their photo it really makes me want to consider and help maybe other parents consider how they can be respectful when it comes to sharing. there children online one, until recently, we were looking at this. >> no states have laws protecting the privacy and financial interests of children influencers. but in july in illinois, a law goes into effect that will require parents to compensate child influencer fares which had me wondering where is the line and your view, when does posting family photos cross over to being unsafe and unfair for kids?

>> this is really interesting. so i think in general parents need to be careful when they're sharing their kids online, right? because regardless of the intention, the impact could still be there of people who have mal intent may be following these accounts or maybe downloading images of these children using them for nefarious purposes. that's always something you're going to have to be mindful of. however, the legislation in an illinois, which is based off of initial washington state legislation, is really specifically tailored to family social media accounts that are monetized and monetize heavily this legislation isn't saying you can never post your kids online. this is saying when posting your kids online becomes a business and needs to be regulated as a business. so that is really important to keep in mind when considering this issue. >> and also important to point out this isn't just a passion project of view. you also, you have working with lawmakers in washington to try to pass a bill is you're talking about similar to what we were seeing

rollout in illinois short of legislation. well, i guess even before that, what's the role of big tech in this? what do you think the role of the social media company? phase should be yeah, that's a great question. >> so social media companies ideally, it would be enforcing the privacy protection part of this bill. >> so in washington state and then this later got changed in illinois due to a complex variety of reasons. >> but most states that have introduced legislation to protect child influencers who i've two key components. >> the first is the right to privacy and the second is it right? >> as a right to financial compensation for that right to privacy, what that would look like is once these kids reached age of 18, they can request a social media platform to delete content that features than that they're no longer happy with having public. the second part, the right to financial compensation is modeled off of code we've been laws for child actors, which says that these children, if they are working in a monetized account, deserve to see some of that financial revenue that they're helping to generate because again,
