and this, of course, again, the bar four what voters are looking for in this debate is which one of these men is capable of doing the job of the presidency. they are not that far apart in age, but are pulled show perceptions that president biden comes across it's a bigger problem for president biden. what does it say to you that the stamina aspect of this is something that they're working on. >> i think it definitely is telling you saw that the state of the union, it was a very log saved the union. he was able to stand up and kind of get this kind of really strong speech for the entirety of the program. then this is also me, the trump campaign is focusing on. i mean, they held a press call yesterday with jason miller said that just because joe biden can stand up for 90 minutes is not meeting should get a participation trophy. and this is part of the expectation that they're setting to where they're trying to say that just because biden does do this is not mean that he won the debate or whatever the expected he should be able to do this. but i think it is telling that i mean, biden was obviously this will be he the longest

wall street journal reporter evan gershkovich facing a closed-door trial in russia this morning on espionage charges. the 32-year-old has been imprisoned since last march when he was on assignment the charges have been denied by the u.s. government and his employer is calling it a sham trial the wall street journal's editor in chief published a letter tuesday that reads in part it will be held in secret. no evidence has been unveiled, and we already know the conclusion. this bogus accusation of espionage will inevitably lead to a bogus conviction for an innocent man. who would then face up to 20 years in prison for simply doing his job. cnn's max foster joins us live now from london. max. good morning to you at the state department has said that these allegations against gershkovich have absolutely zero credibility. >> the bottom line here, the journal seems to be correct that we know what's it's going to happen next. >> what are the chances that we're going to get evan gershkovich back on us soil the

problem is we just don't know enough about the trial. >> obviously, this is national secrecy, so there explaining that they can't let in the number of people who might normally be allowed in. so there won't be any us embassy staff or other people to represent him. he's going to be in there pretty much on his own. so we don't know whether or not it'll be a fair trial because you don't have those independent arbiters in supporting his point of view. so we don't really know what's fair trial is going to be. i think the wall street journal, i think the u.s. government clearly think this is a bit of a setup and setups suggests that he will be found guilty but we can't see all the evidence because of the nature of the trial. so we just don't know what evidence there is or whether it will be fair so max tucker carlson, of course, you may remember sat down with russian president putin a lot a lot to be said

flooding because this is not one of the situations that just goes away very quickly. we've had a tremendous amount of water and it takes time for that water to recede. and in the case of rivers, creeks, and streams, it takes time to even flow downstream. so right now a lot of those river gauges that are at the moderate and even major you're flood stage are farther to the north, but all of that water is eventually going to flow south. so you're going to start to see some of even those river gauges begin to tick back up in the coming days. take for example, the mississippi river at st. paul. you can see here that river continuing to rise and it's expected to keep going up really not even peaking until we actually get to this this weekend. one thing to note though drier weather is in the forecast today because this cold front is starting to slide farther south and east as it does, it's going to bring the potential for severe storms to several different areas, including the northeast, the ohio valley, and portions of the south. we are still looking at severe thunderstorm warning in effect for at least a couple more hours across the these areas as this line of systems continues to make its way through the potential today for

stacked docket of decisions to make before its term wraps up. in the next week. >> including former president trump's claim of immunity from criminal prosecution. that decision is likely to impact three pending criminal trials that he faces he is, of course, the presumptive republican nominee. let's bring in just brave and who covers the high court four the wall street journal. just good morning to you. thank you so much for being here. >> let's start with this immunity decision because of course we're expecting at 10:00 a.m. the court to come in. >> we're going to find out what cases that are left. these are of course their highest stakes, most important cases that they leave for the very end of the term what are you watching for in terms of this? immunity question when you learn that it is actually coming, what will you be particularly focused on i think the most important thing is going to be firstly, if he has absolute immunity as he claimed, which means there's no possibility of criminal prosecution for anything he did while in office. >> so that obviously is a huge win for mr. trump. if he if he gets it, more likely it will be

a somewhat more nuanced decision you didn't wear the court sees some area of criminal exposure for x presidents. and the question is going to be what you have to do to find out what acts can be tried and what which are immune. and that is really going to be the question. the details are going to tell us whether there is possibility of an actual trial or not before the election. >> so there are obviously has been an incredible amount of scrutiny on the ethics of the individual justices. a lot of it's focused on samuel alito, but the court itself also very much in the political limelight. i how do the personal ways that each of these jobs justice relate to president trump, to the court, to the idea that the court is a political actor or not play into this immunity decision obviously, the members of the court will say not at all. >> they're able to completely separate any personal feelings or background that may have from the league we'll issues before them. the perception may be something different for, for the public and for the participants in the case. in fact, we know from polling that

most americans view the court has politically motivated faded rather than acting on legal principles again, who knows what's in the hearts of men and women however the the issues in this court that this case, the connections between members of the court and the litigant donald trump, are much closer than we've seen in really any cases, including one funds where a president has appointed justices were then ruling on a matter of personal importance to him president trump appointed three members of the court, even when they were nominated, there were questions about what is the degree of personal loyalty? >> will they have to him? cause he has made that an important factor in the decisions he makes about who's going to give to high office. and they also have no, none at all. were there purely look at legal issues, but we have seen of course it's that the wife of one justice ginni thomas, justice thomas, his wife was urging republican officials to reject biden's victory after the election in 2020 and then

and it's a story about the future. every election is about the future. it's a choice about the future. and so as a candidate, you're trying to create moments that reinforce your version of the story, the story that you want voters to remember when they go into polling booth come september so you wrote in an op-ed 4 cnn, here are recently you say quote for the sake of our families or communities, our democracy, the way we talk to one another has to change. >> we know this. most americans say they want more stability in our national discourse but how do we get there? now, the rules of this debate are such that the moderators will have controlled the microphone's of the candidates and they can be cut off. if necessary. but based on the tenor of the debate that we saw off from biden and trump in 2020? i i i admire the sentiment very much. how realistic is it, right? >> well, you know that that is a that's it for all of us as citizens. >> how we conduct ourselves as family members, as friends, as co-workers, as neighbors, how we can conduct a debate in our

democracy. i think one of the really interesting thing it's about this, this debate will be, will be the fact that the microphones will be off. so i'll be interested to see how that plays out. one of the central messages of the biden campaign right now, is that something after the 2020 election for donald trump's snapped that he's unhinged these angrier than ever he's more vengeful than ever. and if you remember one of one of the reasons that he was widely perceived to have lost the 20 21st, 2020 debates, praise. he kept interrupting joe biden and he looked out of control and unhinged, then. so if the microphone is off now and former president trump looks more restrained, it looks more presidential it could undercut that message somewhat. so we'll have to see how that plays out. >> how to do the personal things about, about someone, about a candidate play into the coaching you write in your book, for example, that obama is sometimes struggled to keep it brief when he was president, quote, there are times when i

am too long winded. he admitted to you once pointing to the press conferences and debates where he felt was artificial stilted, he's going on way too long. obama said comically impersonating frustrated advisers who would urge him to be more succinct. he's explaining too much stuff. i do remember hovering that also. but this is a window into i mean, obviously obama there's one man, but the personal proclivities and tendencies and how that plays into what we see. sure. it's the same challenge. in this case, it will be two minutes trying to distill a complex issue like abortion, reproductive freedoms the economy down to two minutes, 120 seconds, or rebuttal down to one minute, down to 60 seconds. it's hard, it's hard for all of us. it's hard for presidents, it's hard for candidates so i think one of the things that we can all watch for is does this person does this canada have the discipline necessary to boil a complex message down to a way that the american people can understand me. most americans haven't focused on this election yet and they won't

focus on it for many more months to come. but again, boiling that story down, de away, that's digestible. the american people, and that will resonate with them that they'll carry with them into the voting booth how do you think the timing? >> this will actually impact whether or not it matters because this is when we say it's the earliest debate we mean in the calendar in modern memory, right? normally we see three of these that don't start until like late september. now it's june, right now. so interesting right moments after the debate in the hours after the bait, the two campaigns will rush to distill their best and worst moments, their own best moments in the worst moments he opponent into clips that will go all over social media. so now we have the earliest presidential debate in history. and we'll have many, many months where those can just get baked into the ecosystem. our kids will see them on tiktok will all be seeing this will be talking about these for months. so in a way too old for tiktok my my kids are show you show me a lot of these clips before i see myself and so now these will
