in the real-world. all right, fair enough all right. i want to leave you with this little palate cleanser, taylor swift, and the chiefs tight end, travis kelce, marking an era for them. one here ago this week, kelce went to see her concert at the chief's home stadium in kansas city with a friendship bracelet featuring his phone number. it's a story that he told on his brother, on their popular podcast. >> i was disappointed that she doesn't talk before or after her shows because she has to save her voice for the 44 songs that she sings. so i was a little butt-hurt. i didn't get to handre one of the bracelets i made for misconnection, eventually made its way to swift. the rest is history. she became a fixture at his games, including the chiefs super bowl victory in february. of course, he's been a regular attendee at her era's tour shows, making an appearance as a backup dancer show in london just a few weeks ago banning himself, kelce side gig may

court a jury selection begins, i'm sara sidner with kate bolduan and john berman. this is cnn new central we are standing by for two meetings, really that good determine the future of the presidential race and the president himself. we will soon know if the aggressive pushback from president biden has bought him a reprieve from calls to drop his campaign reelection. very shortly, house democrats hold an all caucus meeting. the handful of members who have publicly called from the dropout will be face-to-face with those who have voiced their support, including now overnight, the congressional black caucus and his hispanic caucus later, senate democrats, me so far, none have directly called for the president to step aside, but several have echo concerns like these from patty murray who said, quote, we need to see a much more

forceful and energetic candidate now the president himself delivers a speech at the nato summit in washington. one bbc headline says it could quote, save or sink biden's candidacy. cnn's arlette sines is at the white house shaping up to be quite a day or let yeah, it is john and overnight the white house is trying to offer some explanation for these reports that a top neurologists who is a parkinson's disease specialist, had visited the white house on several occasions. >> now, these visits by dr. kevin cannard, first came to light through white house visitors logs, which showed that the neurologist had visited with biden's physician, dr. kevin o'connor, here at the white house in january. these logs also show that the doctor had been here at least seven other times in recent years now, overnight of the president's physician, dr. kevin o'connor released a very rare letter explaining why cannard had been to the white house and saying that canard
4:04 am
was the doctor who examined biden amid around his physical for that virology test and that the president has not conceded tilted or visited with other neurologists, despite through his annual physical as down the explanation from the white house now, is that dr. kevin cannard was here for what? neurology clinics for those active duty members of the military who are serving in and around the white house. dr. kevin o'connor, writing many military personnel experienced neurological issues related their service and dr. cannard regularly visits the white house medical unit as part of this general neurology practice now, yesterday at the white house press briefing, white house press secretary karine jean pierre would not confirm these visits by dr. cannard and she faced multiple contentious quench questions. about whether president biden himself had been treated for parkinson's disease. take a listen has the president been treated for parkinson's know, is he being treated for parkinson's know? he's not. is he taking medication for parkinson's
4:05 am
know? so all of that comes as there are concerns among some voters about president biden's age and health heading into this election. now it is shaping up to be quite a consequential day for the president up on capitol hill, there will be some key meetings of democrats both in the house and senate at a time when there is a big debate amongst lawmakers there's about whether president biden should remain in this race. the house democratic caucus will be meeting in the morning and then senate democrats will be meeting around noon at their weekly it luncheon. it comes as president biden had really engaged in this public pressure campaign yesterday to try to make clear that he has dug in the he is remaining in this race. but you have heard vocal group saying that the president should step aside at the same time, he is still up maintaining a lot of his son before it up on capitol hill. we think about the congressional black caucus and other leaders as well. so this is all a big test for president biden, as he also has that nato summit kicking off here in washington later today.
4:06 am
>> yeah, we are standing by up on capitol hill to watch members enter that meeting. arlette saenz. thank you very much for that. >> and as for donald trump tonight, he is holding a rally in miami as speculation continues to swirl in linger over who he will pick as his running mate, trump is now suggesting that he's waiting to see what actually happens with biden before making his final choice. cnn's alayna treene is in washington tracking all of this for us. alayna, what are you learning about this? well, look, kate, i mean donald trump for over a week now has really laid low. he had had no public events, really trying to keep the spotlight on all of the hand-wringing happening in the democratic party over whether or not they believe that president joe biden is fit to serve for another four years, but we are seeing his return today with this rally in miami, and it's interesting because miami is where marco rubio is from. one of donald trump's top advisors. i am told that rubio is going to be present at that rally later today. however
4:07 am
donald trump's advisers say not to read too much into that. i also want to note that later this week over the weekend, donald trump is going to be holding another rally in butler, pennsylvania that's just on the border of ohio where we know senator jd vance, another top contender, is also his his home. and so there's a lot of questions over the location of these rallies and whether or not that means donald trump is ultimately going to make his vice presidential announcement. but donald trump said, just as late as last night, that he is still mulling this decision over. take a listen to what he told sean hannity i haven't made a final decision, but i have some ideas as to where we're going and a little bit, we wanted to see what they're doing to be honest, because you know, it might make a difference. >> i don't know. i'm not sure that it would, but there are those who say trump's waiting until he finds out what's going to happen with crooked joe biden, and we'll see what happens with biden now, kate, i
4:08 am
will tell you from my conversations with donald trump's advisers that absolutely the questions over what will happen with joe biden if he will ultimately step aside, is impacting donald trump's decision, but he has a self-imposed deadline of announcing his vp back at buy or at the republican national convention with starts just a week from today in milwaukee. >> and i'm told his decision could even come as late as that first day, july 15th. and so we're all waiting to see exactly what will happen here. >> yep and the impact, if any, it will have on the rest of his candidacy, it's good to see you, alayna, thank you so much, sir all right. >> another big moment for president biden world leaders meeting for the nato summit today in dc as ukraine reels from russia's deadly attack on it children's hospital in key president biden's upcoming meeting with the premium president zelenskyy, a critical test as he faces intense scrutiny of his leadership at home. and those signature tax cuts from donald trump's presidency he is set to expire

max in less than two hours. the white house democratic caucus is set to meet behind closed doors as a half dozen democratic lawmakers have publicly called on president biden to drop his reelection bid. the president is vowing though, to stay in the race and his strongest support comes from the congressional black caucus switch remains united behind him. after a virtual meeting with the president last night, joining us now, democratic congressman of maryland and congressional black caucus member glenn ivey. thank you, sir, so much for coming on. appreciate your time this morning. >> thanks for having me all right. >> so the first question to you is, what was the conversation like? was it something that biden had to convince the congressional black caucus that he should stay in the race, or were you solidly behind him before that all of this well, it's an off the record meetings, so i don't want to get into the particulars, but i think it's clear, not just from the meeting, but from the days leading up to it, that the congressional black caucus has been solidly behind the

4:16 am
the job and starts talking again about the actual campaign. because i think that's where we need to go. we need to get back to explaining all of the positive things that were accomplished by the biden harris team. and the first two years and where he wants to take the country in the future. >> what do you think president biden needs to do to reassure the public? you all from the congressional black caucus have major decision you are sticking by his side. the public may need some reassurance. what does he need to do to reassure them? >> i think it needs to keep doing what he's been doing in the past few days. the call in the morning, joe, you all have covered some of this this morning. again, the nato speech today could be very significant. i think the speeches and the outreach he did over the weekend to campaign offices. that was televised speech at the philadelphia church you know, more television appearances. i think he needs to keep doing that which is basic campaigning but get back to talking not so much about all of these other
4:17 am
issues, but really talk about the things the american people are focused on, especially how they can benefit from the economic gains that we've made as a nation, 15 million new jobs, lowest unemployment, all of that at the macro level, we're the envy of the free world but he's got ellis. so explain to people who haven't really gotten on board yet how we can help them in the future with student debt relief and the like. >> what would you like to say to several of your colleagues, at least six of them who have come out publicly and called for mr. biden to step aside yeah. we had conversations last night. i talked to a lot of my colleagues. this is my first time having a chance to see him since fourth of july break and we're going to have more conversations today. i respect their views. i mean, everybody's district is different than mine. so they're. smart people there, talented people at the end of the day, we all want the same thing, which is to beat donald
4:18 am
trump. my view is that the best way to beat donald trump is moving forward with the biden-harris ticket. certainly a big swap out. you bring in new talent we've got a lot of deep bench there i think, but the mechanics of it, like the but the 220 million plus, that's been raised by the biden harris campaign when not transfer over to a new ticket. the campaign apparatus they have in place, which is like 1,000 offices across the country. that doesn't transfer either a new candidate would have to pay for it at fair market value. the list, the computers, the leases, all of that stuff, and the logistics of trying to put together a winning presidential campaign in three months, especially from someone who might be well-known in their particular state, but would be singled single-digit name recognition than other parts of the country including battleground states. it's hard to see how that comes together. i think our best shot is with the people who have a strong record the biden-harris ticket has that
4:19 am
they've got the apparatus in place. they've got great fundraising capabilities that i think 38 million came in over the two days after the debate were in poised to win. many of the polls are, you know, we're behind at some of those, but many of them are margin of error. so i think we need to relax my view is stay the course. i know we've got colleagues that have different views, but let me say this to you. not i'm old enough to remember conventions where we've come out, where people were salty about their candidate not getting picked or had mixed feelings about the standard bearer. but barak obama won, bill clinton won. joe biden won, and we can do it again. >> all right, congressman glenn ivey, thank you so much for joining us this morning. appreciate you thank you right this morning, millions are without power after hurricane beryl devastated parts of the south, killing at least eight people and then students at one of the most prestigious medical schools will now be able to attend for free after a one $1,000,000,000 donation this

4:25 am
storm like beryl is obviously top priority, but it's also a massive task and that is where these people come in handy. these were actually at one of the dozen or so utility restoration staging areas in the greater houston area and their job is to bring back the power to the homes here, harris county, for instance, has over 70% of people, customers without power our and let me tell you, driving in the dark in downtown houston after a hurricane is no easy feat down trees, down power lines in complete darkness. it is treacherous. i experienced it this morning. so the staging crew that you see behind me, the utility workers their job is to bring back the power and the utilities and it couldn't come at a moment sooner because the heat that is building today is going to be dangerous right now, we have 2.3 million customers just in the state of texas without power and we have a coinciding heat advisory from the national weather service. now they wouldn't normally
4:26 am
issue it for the heat heat criteria that it will be met today. it's just that so many people are without power. so the potential here too, as you clean up the debris from the hurricane, could to exhaust yourself, not be able to cool yourself down in air conditioning is real look at the feels like temperature for houston and the surrounding locations. we're talking triple digit heat today. we're just kind of not looking forward to the sunrise here in the next coming hours because we know it's going to get brutally hot and everyone here in houston knows that it's going to get hot today as well as they go into this recovery mode not just texas. look what happened from beryl in the state of louisiana, just to our east. there was a record number of tornado warnings from the shreveport national weather service office yesterday, 67 nearly doubling their previous record that knocked out power across parts of that state as well. there also contending with heat. so coinciding those together whether it is going to be an uncomfortable day here across the gulf coast especially for the people who will not be able to cool
4:27 am
themselves down. it's the heat and humidity. those factors combining together and then also we need to consider the fact that overnight lows aren't going to bring much relief as well. so when you anticipate or at least your body anticipates to cool down. you won't get that for tunity because tonight and the next couple of nights will stay well into the upper sundays and the high humidity levels will make it feel absolutely horrible. john, not comfortable at all. derek van dam in houston. thanks so much, derek so a big moment in the case against actor alec baldwin, jury selection begins this morning. baldwin's defense team already notching a win with the judge even before they start to lay now, the case, we have that for you and 20 years ago, a news legend was born how much time? >> i love scotch, i love scotch. scotch. he's got scott air go down, down and do my belly that is good how are you

4:33 am
this is an important person who could, could he change things if he, if he starts to change his mind as to who he's behind he absolutely could look. hakeem jeffries is a figure that not a lot of people who have gotten to know yet the national stage, but he is beloved by his members that the democratic members in the house, they are looking to him to set the tone of where this goes. obviously, a lot of divisions about what to do here. some people saying stick with biden, some people saying get rid of him, some people saying, whatever we do, let's just move on here. and they are looking for jeffries to from my reporting either be the barricade against the revolution that is coming against biden or to be the one to say to buy it. and essentially these people who represent democrats all across the country are saying there is not enough support for you. it's time to move on. and they believe that jeffries could be that force. he has been playing a very close to the vest. he caught up with us a little bit
4:34 am
yesterday. let's take a listen to what he had to say himself. >> mr. leader, do you support joe biden staying is your democratic nominee? >> yes. i made clear the day after the beat publicly that i support president joe biden and the democratic ticket my position has not changed and that's what he said, but of course what he's been saying to his own members as he's not going to stop them from coming out against biden. he's not going to stop them from saying that there for biden. and if things start to turn in this meeting today, and i think it's important to point out this is a meeting which is members-only. they have said that no cell phones are going to be lab in there. they're trying to make it so there are no leaks or at least no leaks. wallet is happening. that if it gets to a point where the caucus is turning pretty hard against biden that may be where things go. of course, he will be also thinking about the support from groups like the
4:35 am
congressional black caucus, which is very strongly behind biden at this point. >> and we just heard from one of those caucus members who made that very, very clear. but this ought to be a very interesting meeting. it would be nice to be a fly on the wall, wouldn't it to hear what's going on in that meeting? i'm sure we'll hear some of it when they all come out. isaac dovere. thank you so much for your reporting. appreciate it, john. just to be clear, our position is we're against no leaks. all right. with us now, cnn senior political commentator scott jennings and democratic strategist, matt bennett, mad, i just want to start with you because i am sure you have been talking to democrats in and end around washington lately. where do you think the momentum is this morning as house democrats had to this closed door meeting yeah, i think this is changing and an hour by hour way and i think what we saw yesterday with the president's letter to congress and the very strong support that he got from the from the congressional black caucus. as we heard from congressman ivey is it's pretty clear at this point that there is not the will and
4:36 am
congress to have that hard conversation with the president at this moment however, i what i hear from everyone, what we're hearing from senators and others is that the president has got to do more. it's been a week and a half since the debate. he's only done one an interview with george stephanopoulos and then a couple with some radio hosts. and very little else that has been off teleprompter a couple of events with supporters and voters, but not that much. he's got to go out and do town hall meetings. he's got to do a big press conference on thursdays, could do more sit downs with the press to show that as nancy pelosi said, this was an episode and not a condition and we just don't know the answer to that quite yet well, talk to me a little bit more about that show us more caucus. >> matt, if you will? because what are they saying? are they saying they want him out on the stage so they can judge further so that he can find his way back. is he on a sort of a no
4:37 am
strikes and you're out policy at this 0.1 more slip-up and then they would come out definitively well, no, it's not going to be one more slip up. i think what he has to show as a pattern that he can manage the job of running for president. that is the real question before us right now, can he prosecute the case against donald trump and do what needs to be done to win this incredibly important election. and i think what that will require is him going out and doing unscripted things. he does a great job when he speaks off the teleprompter. we saw that in the day after the debate. what we don't know yet is whether he can kind of get back on his feet in an unscripted way because the debate showed that that was a, that was a super bad night. but we just don't know if he can recover from that and do what he needs to do in an unscripted way going forward. >> scott jennings, you know, i love having you around, but you don't get a vote here. so i've been struggling to what to ask you about this that doesn't elicit just like, yeah, keep on
4:38 am
doing this, like extend this as long as it can. so let me ask you this. if you were donald trump do you want to face joe biden in the general election? would you rather face him or someone else at this point i mean he's he's there probably the worst candidate. >> right now. i mean, some of the polling that's out this morning from some democratic firm out there shows kamala harris doing a little bit better against trump than joe biden. but at the same time, biden, i don't think they can run them out of the race. i mean, he's got the delegates he wanted to marry, but that's a different question, but i do i do i do i do think that is a different issue of whether or not they can do it as difference. but if you are a republican who wants donald trump to win, and this is actually an important question for democrats to hear the answer to. if you're republican wants trump to win, do you think it's easier to beat biden than beating somebody else? >> yeah. of course. i mean, look, his approval rating is about 37% in aggregate. if you look at the trackers he is obviously facing internal

divisions in his own party right now. his unfitness for office is on full display. there's an article in the wall street journal this morning about the big cover up that went on to hide his infirmities from the public. and there are anecdotes and there about him skipping meetings with world leaders because he had to go to bed. i mean, everybody now knows his record brought him to a point of a 37% approval. and at the same time, he has become manifestly unfit for office. so if i'm donald trump, absolutely. i want to run against joe biden because the country is obviously already he soured on him. it will be very hard for biden to rebuild that trust with the american people now, on a purely republican question here, in terms of who donald trump picks as a running mate, there's some thinking out there that what's happened to the democratic side might impact his thinking right? >> he may not need, as quote, unquote safe of a pick that might have been north dakota governor doug burgum here. and trump might be willing to pick somebody who appeals more directly to conservatives and the right of the party like jd vance, what do you think about that?
4:40 am
>> i think that donald trump needs to pick the person who helps him win against joe biden. and i think donald trump needs to pick someone who can handle the job of president should something happen to him if he wins the election? i mean, this is another problem that democrats have right now, is there's not a ton of confidence in camila harris either. i mean, i think that's one of the things going on in the democratic party, is that biden is become infirm, but there's not a lot of confidence that she would be much better her job approval is about what his is. so if you're donald trump, you need a governing partner, someone who can do the job should something happen to you, but for the campaign purposes pick somebody who can help you when do not assume this is in the bag. pick somebody who's going to be the most broadly appealing to the american people and do no harm. that's that's the number one rule of all this. do-no-harm and picking a vice president, matt very quickly to you, part of what the white house and biden campaign has been doing is messaging. i think subliminally to democrats here which is that if you're going to want biden to go, it's going to be really hard. we're going to make it really, really hard for you. there will be blood
4:41 am
what do you think of that well, i think that if he goes it is almost certain that vice president harris would get the nomination. >> there's a lot of kind of aaron sorkin fanfiction out there about how we could have some process between now and the convention to open it up. but i think that's basically silly. we have a vice president and she almost certainly would be the nominee. what i have heard recently though, is a lot of support for her. if the president does decide to step aside, i think the party would unify behind her very quickly in ways that might've been surprising several months ago, but have changed since matt bennett, scott jennings, thanks to both of you you. >> a deadly russian strike on ukraine's largest children's hospital. they're still could be sifting through the rubble still this morning, it is a jarring reminder of what does it stake as nato leaders gather in washington today what will they promise ukraine will find

children's hospital in the capital, kyiv. >> ukraine's president zelenskyy now says 39 people were killed across ukraine in these attacks. now hundred and 90 others were wounded. just look at these scenes from kyiv yesterday and look at this. this is a young baby covered in blood being rescued after that attack from that hospital. this hospital has been invite has been vital in caring for some of the sickest children in ukraine throughout this war. you also have this scene outside of the hospital. now, young patients just look at them. they're lying i ended up outside in the street desperately still needing care know zelenskyy is calling for an emergency nato session. now in the wake of this destruction, nato leaders are gathering in washington today to mark the 75th anniversary of the military alliance on that joining us right now is a spokesman to the white house national security council, john kirby. john, thank you for coming in. i mean, really horrible scenes at the most important children's hospital and ukraine, ukraine said this morning, the evidence that's seen as its long-range cruise

missile from russia that hit russia's defense ministry though said monday, john, that the damage of the children's hospital was the result of a stray ukrainian air defense missile. can you respond to that? >> no evidence of that whatsoever. this this is in fact quite to the contrary, kate, just further evidence of mr. putin's utter brutality. it is is of a piece sadly, of his playbook, which is to terrorize the ukrainian people to cause damage to civilian infrastructure and to kill them in a wanton and indiscriminate i'm in a way that's part of what he's been trying to do for more than the last two years here so sadly, this is just consistent with the kind of war that this brutal dictator is waging on the ukrainian people on when we meet this week in washington, you're going to see the nato leaders really come around and unify over continued air defense capabilities for you crane, we've got to make sure that they have a better means and more of it to defend themselves from these kinds of
4:49 am
attacks. >> when you, when you see this destruction and knowing that it is quote unquote consistent with his tat with putin's tactics it's just terrifying, a terrifying reality the new reporting that i've seen going into the nato summit is the joint message communicated coming from the summit will describe ukraine's path to joining nato as quote, irreversible. can you confirm that? >> i won't get ahead of the actual communicate language. it's still being negotiated and worked on as you might expect here at the very beginning of the of the summit. but what i can tell you is that nato is in ukraine's future and the communique will state that very plainly and very clearly as president biden biden has maintained, nato is in ukraine's future, and there's going to be a path, what we call a bridge to nato, that the allies will talk about this coming week to include the signing of bilateral security agreements, which has already happened to make sure that they have long-term defense needs met for whenever. and however,
4:50 am
this war ends. but there'll be no mistake taking that ukraine will one day be a nato member. there's just going to be have to be a path laid out for them to get there and what zelenskyy is looking for is a date which we know is likely not in the offing a date certain when you see the discretion destruction that we were just talking about in ukraine. >> and that children's hospital. are there further conversation? and happening within the administration of removing all restrictions on ukraine's use of us weapons, how they use them, where they target them right now the policies that they can use us weapons just for targets right across the border and they're only place really in all of ukraine where this is a problem, is largely around kharkiv and even now, in just recent days, the russians have clearly failed and trying to take that city. >> but that's the policy that that has not changed we will continue as we do kate talk to the ukrainians every single day about what they need, the kinds
4:51 am
of capabilities that they require and whatever support that they need from the united states and from allies to use that those kinds of capabilities, those conversations happen every day, but i have no new policy or no who changes to speak to this morning biden actually has pointed to this nato summit as where people should be looking to judge his fitness to serve. >> since new questions were raised about his age i want to play for you what democratic congressman mike quigley said on our show yesterday, and what he sees perceptions are absolutely ruling and things like this in a campaign, he looks very frail. his voice is very soft. it's not robust. and again it is not how i perceive that. it's how the american people well perceive it. and you can see it influencing the numbers do you see that the president did i see every day including
4:52 am
yesterday, a couple of times in the oval office is robust. he's lucid, he's clear, he's direct, and he's in command of the context and information. i mean, he was asking me questions yesterday about events in europe that i simply didn't have the answers for us. i had to go back and and come back to him with some answers i mean, that's the president that i see every day that's the commander in chief that i've been serving 11 two-and-a-half years and look i can appreciate it may be uncomfortable to offer an such an assessment on your boss at any point, but especially publicly and on television. >> but biden himself has said for months and months that age is legitimate issue in something we saw last week is cnn is reporting the biden told democratic governors that part of his plan going forward after the debate was to stop scheduling events after 8:00 p.m. so that he could get more sleep from a national security perspective, can any president be effective if they have a cut-off time at 8:00 p.m. well, i think the white house denied
4:53 am
those claims and that reporting kate, but let's set that aside for a second he's the president of united states commander in chief, and that's a 24 hour job, seven days a week and my from my experience here and i've seen it the firsthand on the road and here in washington, dc, if the national security team needs to get to the president, they get to the president and it doesn't matter what the hour on the clock says. he's always there, he's always available. and they have ready access to him. and he also knows that the world doesn't take a breather after a certain time of day. that thing just to keep going on just like we saw this weekend in ukraine. and he's constantly peppering the team with questions. again, around the clock. that's the commander-in-chief that i've seen and more critically, kate, as the commander in chief, he knows he has to be and he has been here for the last three-and-a-half years john, it's always great to have you on. thank you so much. a huge week ahead. thank you john. yes, ma'am this morning, an

4:56 am
center just released a new analysis on what the impact of extending these tax cuts would be. and they found that almost half the benefits, 45% of the best and it fits would go to those making $450,000 a year or more. now that's not to say that only the rich benefit here, this analysis found that the vast majority of americans would get a tax break. but the question is, how big of a tax break? and this analysis found that say you're making between $65,000 in $116,000 a year. that's considered middle-income. you're going to get about $1,000 tax break now that's nothing to sneeze at, but it pales in comparison with what they higher earners would get the top 1%. that's people making about 1 million or more more, they get $70,000 tax break. and those in the top 0.1% would get almost $300,000 tax break. now, we still don't know a lot about exactly how president biden and former president trump will respond to

these explorations of the tax law, but the tax it's policy center said that one thing is clear, while extending the law as is would benefit most taxpayers, the biggest winners would be those making $450,000 or more when the average salary is about 60,000 that doesn't help that many americans upside it's still a tax break, not a tax increase that people do tend to like that. matt egan. thank you so much. appreciate it okay. >> so today, jury selection begins in the trial of alec baldwin. now this is now nearly three years after for the fatal shooting of cinematographer halyna hutchins on the set of the film, rust. prosecutors have charged the actor with involuntary manslaughter, saying that he was negligent and reckless in his handling of the gun on set. baldwin has pleaded not guilty and says that he never pulled the trigger of that prop gun. cnn's josh campbell has more from santa fe october 2021,
4:58 am
alec baldwin was rehearsing on the set of rust in remote new mexico, seemingly just another day in the life of a megastar with for decades and show business, he's handed a real revolver as a prop told it's safe, then an unexpected gunshot, one female shot the chest. >> hours later, cinematographer halina hutchins was dead. another crew member injured, and the film's production and chaos, baldwin's involved in the shooting and alleged safety concerns on onset suddenly thrust into the spotlight flash forward two-and-a-half years later guilty. the movie's armorer is sentenced to prison for involuntary manslaughter and baldwin, who's an executive producer on the film, he's facing the same charge. he's pleaded not guilty in a 2022 interview with cnn, denied any criminal liability. >> i never took a gun and pointed at somebody and click the good thing. he blames armor hannah gutierrez reed and assistant director david halls for the live round that was loaded into the gun, was

attorneys argued the shooting was an accident, and baldwin is not criminally liable just because it's an accident, doesn't mean that it's not criminal the convoluted path to trial has itself all the makings of a hollywood drama months after being charged in 2023, baldwin's case was suddenly dropped by new mexico special prosecutors, citing, quote, new facts. >> but the actor was indicted in january with involuntary manslaughter. this time by a grand jury. his attorneys trying then failed at multiple attempts to get the case dismissed at one point, alleging and proper destruction of evidence, arguing the gun was virtually destroyed by fbi testing. i'd love to do this one again. i'll do it again the pretrial hearings thus far marked by frequent clashes between attorneys from each side. >> if they prosecutors listening to testimony he that a prosecutor knows it's false. a prosecutor has an obligation to correct it. so this testimony that he's not stop stop both of you prosecutors
5:00 am
also intend to highlight what they say is baldwins negligence while overseeing a set allegedly plagued by dangerous conduct, he didn't do any of the things that he was supposed to do to make sure that he was saying if or that anyone around him was safe, and then he pointed the gun at halyna hutchins and he pulled the trigger beyond baldwins approaching legal fate, the future of russ is in limbo. there is no distribution partner, there was no release date beyond this one movie, a larger question remains, will the deadly accident on the set of rust lead to new laws regulating safety? practices across the film industry. there's a ton of production and other states like georgia with atlanta also new mexico. >> and of course new york. so it remains to be seen, just the reach of this terrible tragedy. and if these laws will go into effect nationwide and here in court yesterday as significant win for alec baldwin, what prosecutors originally wanted to do was charged them not for his role as just the person holding the gun when it went off, but also for his role as a
