completely different race than it was a few months ago. you can get a sense of a different shape of the campaign. harris now leads in most of these states on who was trusted to bring change. the sitting vice president is seen as the change candidate. she continues her tore through southern georgia today, cnn's priscilla alvarez in lovely savannah. what's on tap today? brazil well john, as you mentioned, the campaign is feeling pretty good about where they could try to close margins with republicans, but they also note that these polls show that it is still within the margin of error and that there is no clear leader, but it is the reason why they are employing aggressive strategy he's in the state of georgia, a crucial battleground state. >> and what has been notable about this visit is where they have been going hitting south georgia. those rural counties, counties that typically lean republican now i have spoken to senior campaign officials about this strategy and essentially

what they're trying to do here is show dave off votes from republicans, essentially lose by less and by doing that, assuming they still win big in metro atlanta, they can try to carve out that pathway to victory in georgia, a state that president biden only won by less than 12,000 votes. so this is really a place where every vote is going to count it that is what they have been focused on over the course of this bus tour. of course the vice president kicking it off with governor walz yesterday, hitting a high school where the vice president had an inspirational message for the students there. take a listen listen ban. >> when i was your age so i know a little bit about cohen's knows about the players, right that you all in doing it requires a whole lot of rehearsal, a whole lot of practice but that practice makes for. beautiful music. and that is a metaphor that is

the campaign trail, making two stops in the midwest now, he's supposed to talk a lot about the economy today. but if last night's late night rants is any indication his legal grievances may still be top of minds. cnn's daniel strauss following the trump campaign, daniel, while we were sleeping, trump was still posting. what did he say and what's on tap today? >> yeah. look, the former president in multiple truth, social post last night, did not focus on the economy. he did focus on jack smith and various new indictments and the importance here. and also nancy pelosi and the prince here is that this underscores the anxiety that trump hour eyes and trump strategists feel about how closely the former president can stay on message. they feel that in this very, very tight presidential race, he needs to focus on policy, shed the personal attacks, and really dig into the areas where polling shows that democrats that's are vulnerable. but he

hasn't been able to do that. and going forward, it causes real concern among rank and file republican leaders and you'll talk to us a little bit about trump himself will not be in georgia, but brian kemp, the governor will be. >> he's going to be fund raising for trump. this is something that some would say that you would have expected to see just even a few days ago but here we are, talk to us a little bit about that. what more can you share there yeah, look, this is this is really important because governor kemp a popular republican governor, has been at loggerheads with former president trump for a while. >> now, going back to trump in the final days of the 2020 presidential election and there has been an ongoing question about whether the former president and would, would have chem support at any single moment in time. now very recently, trump and his team, including senator j.d. vance, have been making efforts to try and cool down tensions between the two the fact that he's going to this event really

tonight at nine breaking overnight, russia launched a new wave of drone attacks in kyiv ukrainian president volodymyr zelenskyy is looking for permission from the biden administration to attack more locations inside russia. >> cnn's chief international security correspondent, nick paton walsh she is with us this morning this new wave of drone attacks this morning follows this huge uptick in activity from russia. why nick yeah, it's been a horrific week for ukrainians on the receiving end of this latest russian onslaught over 400 missiles and drones launched since friday, just last night, 79 launched five missiles, two of which were taken down and 60 of the 74 drones launched taken down as well. >> so a relative success for ukrainian air defenses, but still casualties on the receiving. and we don't always get full transparency is the damage done to ukraine's energy infrastructure, which is really the target here. as always, the kremlin trying to make the call forthcoming the

winter and the heat of the summer as a punitive as possible for ordinary ukrainians, i think many are interpreting this significant wave of strikes as being russia's bid to try and hit back after the humiliation, they've seen inside the kursk region. remember, ukraine three weeks ago, launching and encouraged into russia, the first since the nazis and taking and still holding quite a large part of the border areas here we're also seeing to a significant uptick in ukrainian strikes using it seems their drones and their domestically produced missiles deeper inside russia itself, hitting airfields, hitting oil depots ammunition sites as well remarkable frankly, to see the billowing smoke now often posted on social media from some of these russian towns where the war frankly has been a distant thing for the last two years plus all part of a broader push it seems by ukraine to bring the war to russia's front door after years of having an imposed on

find the best wrestlers on, and we bring them here wwe wednesday night don't live in tbs this morning. a crucial hearing in bryan kohberger, murder case. kohberger is accused of killing four university of idaho college students while they slept in their home and his attorneys are now requesting a change of venue saying that the potential jury pool and moscow, idaho told them that kohberger was not convicted, quote, they would burn the courthouse house down and quote, they would probably find him and kill him. let's bring in cnn's jean casarez here with the details. jean, what else did the defense and this what will the defense and prosecution has had filings. but today is the formal hearing. it's a very important hearing because the defense is saying moscow is a very small, it's a college town. everybody knows who's everybody, the emotions, the

trauma. it's still with this community. and they're going to be biased. bryan kohberger cannot get a fair and impartial trial in moscow. and this trial needs to be in the state capital of boise is must larger larger courthouse witnesses can fly in and out very easily, but the prosecution is saying, no it says, moscow's case. this is, this communities case. they lived this they deserve to have the trial here. so the defense was able to have an expert do a survey of 400 residents of lay tall county, which is moscow they found that first of all, 28% of the entire population of idaho is in moscow, but 36% of all the publicity of this case was in moscow. and they also found that fifth 70% of the people they polled believe he's guilty in moscow and 50% they're firm, they're not going to change there opinion at all, but they went farther to get some quotes from residents that they pulled and

listen to this people in moscow, residents according to the defense survey, said they would burn this courthouse down. outrage would be a mild description. they would probably find and kill him if he wasn't convicted. there would likely be a riot and he wouldn't last long outside because somebody would do the good old boy justice and these quotes right here are very stark and they are stunning because this is vigilante justice, right? so this is just what some people said. it just shows i think the defense is trying to portray the emotions in all of this. so it's going to be formal hearing. defense will have witnesses. the prosecution has st. judge. lets just try to get a jury in moscow because we've got thousands of people that can, we can bring into the courthouse for potential jury pool. we can get a fair and impartial jury here may take some time, but we can do it. and the trial is set for three months next year, starting in june, and it's a 20 pallets? yes. next year, death penalty trial, which takes us to

punish anybody in political life for for not being open to new information. >> overnight and all day yesterday, donald trump was posting on truth social. he was posting or re-posting slogans that are popular with qanon. he was posting pictures of the president, nancy pelosi, hillary clinton and vice president harris in jumpsuits. and he was posting or re-posting some gross sexist misogynist jokes and content what's your view on how the harris campaign should address this type of thing from donald trump yeah, i guess they'll have to make that decision for themselves. >> but here's the thing. you can't even say what the content was, right? i can't even say what it was that donald trump posted about

entity. they also are seeing a mixture of political ideologies of this man internet searches or other things from both the left and the right politically and also they're trying to dispel conspiracies. the fbi saying yesterday, there was no second shooter, john, still so many questions. katelyn polantz. thank you very much. real all right. john, it has been a very busy week for special counsel jack smith. and this morning it's not letting up monday, smith sought to revive the classified documents case against former president donald trump. the very next day he filed a revised indictment and his other against trump, the election interference case. to try to keep that alive as well. now, federal judge tanya chutkan, who is overseeing that case. she wants to hear from trump's legal team and the special counsel by tomorrow on a timeline going forward, let's bring in cnn, senior legal analyst and former federal and state prosecutor, elie honig, who is here. so l.a. tomorrow's the deadlines. what exactly are we watching for? >> this is where the real fight begins or how now, earlier this

week, what jack smith did is he took his original indictment and we're talking about the dc case, the january 6 case. any pared it down. he tries to conform it with the supreme court's immunity ruling. so we took out some of the allegations, but that's not the end of the story now, the parties have to tell the judge, well, how do we go through the new indictment? and figure out what's an official act and therefore immune and out of the case. and what's an unofficial act and therefore, in the case, trump's going to say the whole thing's an official act. you should throw out the whole indictment and jack smith is going to say, all that's left in the indictment. that's all fair game. so now, judge chutkan has to go through the difficult process of sorting through and saying what's in and what's out. >> and so one, will she have the last say? and then how does she go about weighing both sides here? >> so let me take those in opposite order. here's how she's going to go about it. she has two options. one, she can do it based on the brief. she can say to each side. okay. you each have to submit a detailed brief. you tell me what parts of the case you think are or are not immune and why? she can decide just on the papers that would be a fairly bland process. there wouldn't

be anything sensational happening, but judges tend to do things that way. option b that judge chutkan has, as she could hold a hearing, it could be a sort of mini-trial. she could say. okay prosecution, we want to have a fight about mike pence's testimony. let's hear from mike pence as to what he would testify to. that of course would be a very big deal, especially if it happened before the election. as to the other part of the question, will judge chutkan have the final say? no, she will not. because the supreme court, in its immunity decision said, whatever judge chutkan decides about what's in and out trump gets to appeal that before trial, meaning it will go to the dc circuit court of appeals and maybe right back to where it all began. the supreme court, which is his right. >> and he likely will if this doesn't necessarily go that his put his team wants, let's talk about the other case, the hush money case, which was sort of barreling toward a sentencing date, is that likely going to hold just in a few weeks from now? and what's happening there? >> so we might've missed this because this played out last week while we're all rightly focused on the democratic national convention, we've all had, i've certainly had september 18 circled in red ink

on my calendar. trump's sentencing date. that might not happen though. and here's why trump made a motion to throw out that hush money conviction based on the same immunity case he said some of the evidence the prosecutors use against me had to do with my time in the white house. that should not have been used against me. therefore, judge marshawn throw out the conviction that is pending. he has not decided yet, but trump has said, if you reject that, if you keep the conviction in place, i get to appeal before sentencing. and what happened last week is a conviction appeal to convince before you sentence me and the da last week put in a filing saying we're fine either way, judge. so it's up to the judge. he may well decide that i'm going to let trump appeal before sentencing, which would mean the sentencing would be way past the election or option b for judge marshawn is he could say no. i'm going to keep sentencing on for september 18, but that day heat now is very much in question as to whether we actually will see a sentence if it's option a, that effectively means that case basically goes back to square one. >> yeah.

it'll lift as soon as september 20, if not, it'll still live by september 25. and at that point, trump can really do whatever he wants in theory, he could sell this to pay legal bills. he could fund his presidential campaign. he could buy a sports team, whatever he wants. of course, practically as you know, rahel, it's always hard for major, major shareholders to quickly dump their stock and it's even harder in this case, right? i mean, how would that look? trump is not just the dominant shareholder. he is the popular user on the only product truth social's. he is the face. i mean the ticker symbol is djt. that's why nyu professor michael ohlrogge told me that it would be all but impossible. for trump to liquidauidate his whole stake or even just a third of it without completely tanking the stock price, it would create a crisis of confidence and look, these stock price is already tanking. it fell another 4% yesterday,
