new developments in the election trial of donald trump. the latest please. lauren: the election trial goes to trial march 24th. 24. the former president could not claim presidential immunity meaning what he did as president can't subject him to common-law civil liability, she said no. he appealed that and now the special counsel jack smith stepped in to speed up the proceedings. they want to go to trial fast and elevated this case all the way to the supreme court to decide once and for all if trump can use the presidential immunity defense separately. there are a lot of cases. trump tried to use the same defense in his new york defamation case against ug who accused trump of rate. jury panel democrats rejected that immunity defense. they waited too long to invoke it and that lawsuit will proceed next month so three

rally continues. we had a big rally yesterday. a small one today, dow up 20 on nasdaq at 41. listen to what the white house had to say about the border crisis. >> the immigration system is broken. we've said that over and over again. the president has put forth an immigration, comprehensive immigration policy legislation on his first day to deal with this issue, republicans refused. they said no to border agents, they said no to new technology to fight fentanyl, they said no to additional troops and they voted unilluminating 2000 customs and border patrol agents. that is what republicans have done. stuart: so it's republicans fault. i don't know where to go from here. the gentleman on the right-hand side of the screen, democrats are talking about expanding migrant camps and deportation. in your opinion would that stop the flow?

>> just them denying it shows how delusional they really are. they need to start releasing them so when they start talking about putting more migrant camps, you got to see how they are going to do it because the cartels will control the southern border, they have a loophole of the floor ruling which they know if they cross with children they are going to be released in 20 one days. in the tucson sector they realize the jane doe lawsuit that has to release them within 10 days. they need to send immigration judges and asylum officers down on the border, look at each case and deport people immediately that don't fall under the premises of asylum but they are not going to do that. this is all smoke and mirrors. they've been doing this since day one and for them to say it's the last administration's fault i will remind them during the last administration the numbers were a lot lower than they are now and today one of this administration you start seeing groups of 300 plus

because they knew this administration was going to allow lawlessness. blue one while we have been speaking we been running video from a train as it approaches our southern border in mexico heading north to the border. on the side you can see it looks like thousands of migrants, there they are on the screen right now, looks like they are waiting for the train to stop so they can hitch a free ride to america. how are we going to stop this? it has become an invasion, hasn't it? >> you are not going to stop it because the administration doesn't want to stop it. the immigration process is broken because people have to take a backseat because of all the lawlessness but the border itself there is no border, people realize all they have to do is jump across, say they are looking for asylum and they will get released and they been detaining people from 100 countries and then you had the got aways. if it is that easy to come across, get released, can you imagine how horrible the intentions are of these individuals that are getting away?

saying about these nor border policies that are being considered? ashley: according to nbc news they are not very impressed, with one saying it would, quote, break the border while another said it would be counterproductive as opposed to what is happening now. i digress, the concern is detention centers would quickly become so full of the agencies would be unable to keep apprehending migrants as they cross the border, currently border patrol holds them for less then 72 hours, screens and for national security risks, releases most. under the proposed mandates all and documented migrants would be held in place detention, even those not considered a security risk, meaning border patrol could run out of space to temporarily detain or process new arrivals. is already a mess that i'm not sure we are talking about. stuart: a total mess, everybody knows it. more than 15,000 migrants have

crossed the border into eagle pass, that's just one entry point just in one week, 15,000, one week, one place, griff jenkins is there. you have that exclusive video of migrants waiting for trained in mexico, tell us more. >> you mentioned the 15,000 migrants that have crossed here in just this sector of eagle pass, border patrol agents can't take much more but they are going to get it. look at this video we got that was shot three hours directly south of where we are in eagle pass, a mexican town, you see tens of thousands of migrants waiting to get on trains already overfull, migrants cheering, nowhere are mexican officials trying to prevent the migrants from getting on the train. this is how they have been arriving here week after week, month after month. these migrants will soon be here either later tonight, tomorrow or into the weekend and continue to overwhelm the migrants.

expansion in 2024. stuart: thank you very much. now this. democrats continue to push for more aid to ukraine. republicans look to enforce border security, there's a class. were devoted stand on this? >> the majority of the public believe securing the southern border is more important than supporting ukraine this according to a poll that said 51% chose to reduce the number of legal border crossings over sending more money to ukraine, 30% said ukraine should be the priority. when you break it down by party, 73% of republicans chose the border while 13% were for ukraine, democrats meantime other way around, they opted for ukraine over the southern border by 53 to 33 margin and what about the independents, 48% said the border is the most pressing issue, 25% chose ukraine, the southern border

coming out on top. stuart: thanks. a recent paul in the wall street journal has biden's job approval rating added new low, 37%. david axelrod called that very dark for biden's reelection campaign. carly griswold is editorial director at the federalist and joins me now. axelrod is an obama guy. what is obama's role in biden's reelection campaign? >> of david axelrod, barack obama's right-hand man is saying this we can assume barack obama himself is saying it meaning the man who actually runs the democrat party, seemingly wants the party to dump president biden and move on. the problem for democrats is they don't have a biden problem, they have a policy problem. as we saw the border crisis to the economy to foreign policy, the wall street journal poll shows that negative views of democrats outweigh positive ones by 18 points. that's a huge deficit.

you don't overcome that deficit by shoehorning in a new candidate who supports the same policies as the failed incumbent. stuart: before we move on, what would you say to the possibility that axelrod is in there as a way is a way of moving biden out and moving michelle obama in? you dismiss that entirely? >> i would not dismiss anything entirely because we are still your out but there's been a lot of talk of how we are past the deadline for certain states for the primary. the only date that really matters is the democrat convention in august. as long as democrats can push president biden out before then there's definitely a possibility barack obama and his team can help decide who the next democrat nominee will be if not president biden. stuart: a look at this headline from the new york times. house approves biden impeachment inquiry, gop hunts for an offense. seems like they are saying

there's no grounds for impeachment but they didn't say that with russia, did they? >> exactly right. this is the new york times that still will not admit the russia collusion hoax which it pedaled was fake, now they say there's, quote, no evidence for an impeachment. accept for signed checks and testimony from irs whistleblowers and ex-business partners, highly credible fbi sources, texts, emails, goes on and on and that is not to mention biden's mishandling of classified documents, complete dereliction of duty on the border, deadly afghanistan withdrawal, this impeachment is not in want of an offense, it's how to boil it down to just a few. stuart: seems to be things are so bad domestically, crime, border, foreign policy the wars, things are so bad that the democrats really do want to push president biden aside. in your opinion do you think biden will be the democrat candidate in 2024 because i

cars behind where they tried to. stuart: let me move on from this. biden claims that israel is losing global support because of netanyahu's military tactics in gaza. i think he's trying to rain israel and. what do israeli people think about that? >> israeli people are divided. prior to october 7th the only thing that really changed it was that now we have bigger problems than political division. they are equally divided but there is one thing people seem to forget. whether netanyahu was in office or not hamas needs to be eradicated, doesn't matter who the prime minister's. that will be their job and it will be just as difficult and they have to make sure israel is not constantly terrorized by hamas. it's not a political issue. stuart: netanyahu says he will continue this to the end, that means when he has utterly crushed hamas.
