bill mackinnon, you're terrific. getting to john lonski. this is breaking news. john, you're an expert on this. the new jobs report for december and decent 216,000 jobs and, john, we did a deep dive into the government num numbers and d the government overstated the initial jobs report over the last 11 straight months by 414,000 jobs. they erased 414 jobs after the fact, after the prior 11 jobs report. the president is not as great at touting jobs. what do you think? >> that's exactly right, liz. in fact the latest jobs number if not for the downward revisions of october and november, the monthly increases instead of being 216 falls down

to 145,000 4:jobs. in turn, i would expect that this latest number for december will be revised lower telling us that the labor department has been overstating the health of the jobs market throughout 2023. >> i mean, john, it's not random if it's 11 months straight they're doing it. elizabeth: something is going wrong and something is wrong with what the government is doing with the jobs report. >> well, for now, there's a problem with the algorithm and estimation technique and i want to add that the jobs report today is not as accurate as and that's because the percentage of companies and businesses that respond to the survey that's mailed out by the labor department is considerably less than years ago and perhaps this

unanimously that this is something that you can't do. this was not meant, what they're trying to do to president trump is sleetly inappropriate and it was meant during the time of the civil war when somebody was trying to overthrow the country and doesn't apply to anything that happened with president trump and that's what they're going to say. elizabeth: liz is joining the push to remove trump from the state ballots and about 13 states trying to do this, congressman. democrats like nancy pelosi and jamie raskin say it's up to the states to do this and they're wrong. they're misreading the 14th amendment. doesn't section 5 say only congress can do anything anywhere remotely near that? >> absolutely. and of course they're wrong. so they're pretending not to understand the constitution, you know, what's unfortunate is that

people that were supposedly educated should know better are at a point where they're behaving as if they were in totalitarian governments or totalitarian third words and putin is pulling everybody off the ballot that will oppose him and we're at a time in the are desperate and doing the wrong thing and will come out in the supreme court case. elizabeth: house democrats attacked trump claiming his business got $7.8 million from foreign entities while president but eric trump said the democrats botched this and eric trump said the trump organization donated the profits from foreign entities during trump's presidency to the u.s. treasury and don't have the ability to stop people booking

rooms at trump hotels overseas like on sites like expedia. >> president trump had a real flourishing business. he's a businessman and became president so they voluntarily gave to the treasury any profits that they made because people stayed in their hotels. unlike the biden administration and president biden is when he was vice president had no business. their business was influence peddling the united states government for their own gain to make money, and, boy, they sure didn't give anything back to the treasury. as we know, president biden's son didn't even pay his damn taxes. i mean, they're very, very different but again, this is because they're desperate, they want to win the election, they'll go to any means to do so and this is just one more example. i'm going to tell you that the bowing open up on the republican party for president trump and they're actually afraid that we're going to bring america

home again, that we are going to restore our america to where it should be and they're going to do everything they can to stop it. you are seeing it now, and we're going to see it even more so hold on. this is going to be a rocky ride. elizabeth: once the supreme court rules in trump's favor here. >> when they rule in his favor, they're going to absolutely say that you can't take him off the ballot. he'll be on all those ballots, and anybody obviously should be afraid of what they're trying to do to democrats because, you know, republicans could try to do it in reverse and say that biden shouldn't be on the ballot or somebody else shouldn't be. this is third world activity, this is what totalitarian dictatorships do. this is not the united states of america. also the united states of america is not open boarders. it's everything they're doing to change this country structurally forever from something that's never been. elizabeth: we go down the middle

next week and where do you think that goes and we have constitutional scholars and reagan's attorney general saying special council jack smith shouldn't even have this office or the power of u.s. attorneys and congress never enacted the office and never approved the office or passed legislation putting smith's office in place so that d they're saying that smith's own office is illegal and annotational and never nominated by the president, never confirmed by the senate. what do you think of that? >> it's just business as usual for these people and whatever sticks against the wall they go for it. they're trying to wear the president down, president trump down and they're trying to throw everything they can at him. whatever theyly will work, they push. they don't care about the rule of law or constitutionality.

this entire case and generally civil law is designed to punish people that have done something wrong like committed fraud if it's a civil case, make the victim whole again or the criminal case, the purpose is to punish a perpetrator but this is civil. the supposed victims, the banks, testify that had they weren't victimized at all. there was no fraud. we had president trump put up an expert who was a recognized ebbing pert who the judge -- expert and the judge somehow disregarded and said there was nothing wrong with the accounting the trump team was using and this is the hard to understand what the judge is going to stand on when he rules as i don't doubt he will as he rules for leticia james and what she's asking for. i don't know if she'll get everything but won't surprise me given what i see as the kangaroo court proceedings that have taken place thus far in the crop. elizabeth: i'm going to ask a team to tee up democrat jamie raskin sound bite talking about this.

illinois voters, they're the latest state trying to remove trump from their state ballot citing the 14th amendment on insurrection and listen to democrat congressman jamie raskin joining former speaker nancy pelosi, apparently neither of them read the full text of the constitution, basically saying that, yeah, the states are allowed to remove trump from state ballots. watch this. >> well, the text of the constitution is un-ambiguous. it's perfectly clear if you swore an oath to uphold the constitution and violate it by engaging in insurrection or rebellion, you're never allowed to hold federal or state office again. i guess my major question is given the comprehensiveness and air-tight logic of the colorado decision, why would there be any reason to depart from the clear text of the constitution and from the original purposes? i would pose that specifically to the so-called textualists and originalists on the court.

elizabeth: how about we pose to him why he clearly did not read the 14th amendment. francey, how does an elected official, a lawmaker including nancy pelosi and now jamie raskin not read the 14th amendment? again, section 5 says congress only has the power to enact a law to do anything remotely like removing trump from any state ballots. they didn't do that. jowski well, you're right about that, liz. jamie raskin needs his eyes checked because he clearly cannot read and i don't know what state bar he's a member of. he certainly shouldn't be calling himself a lawyer as i know he does or a former prosecutor as he also cause because he clearly doesn't understand how to read the constitution and how to understand the construction of the 14th amendment, which is pretty clear. the president is not even listed in clause 3 of the 14th amendment as you've noted, congress has to prom l gait the

who are elected officials and individuals that are appointed by administrations. they want them to abide by the constitution. they want them to abide by the rule of law. and what we have seen the democrats carry out is something that's not in support of protecting our freedoms and liberties. it is all a power play. they are so ready to grab power and hold that power. they would like to have one one party rule, one party in power, two tiers of justice and two tiers of treatment by the federal government and diminish the rights and liberties and freedoms of hard working tennesseans and indeed hard working americans. elizabeth: senator, we want to get to the jeffrey epstein case

in just a second. there's news coming in, fox news brooke singman wrote a report that a top prosecutor on special council jack smith's team, he's ray hulzer and previously recommend that had the fbi shut down investigations into the clinton foundation in 2016 that the apparently there was illegal donations coming to the clinton foundation to buy influence with hillary clinton during her presidential campaign and three fbi offices investigating the clinton foundation and this member of special council's smith team shut that down. what do you think? >> that does not surprise me at all to hear that. when i was in the house and at energy and commerce committee, we had done oversight of the clinton foundation and we were surprised they were rate sod low

and most money went into overhead and not to the charityies and you remember, his, they had to pay ten years of back taxes on donations and tax filings. now, this should have been investigated and we were surprised that doj did not fallow through with that investigation. i think it is time for that investigation to be reopened and to look at what happened around the clinton foundation. elizabeth: you've been asking senator dick durbin, d moving onto jeffrey epstein case. dick durbin is senate and not honoring your request for the flight logs for jeffrey epstein's plane. you want justice for the victims and transparency for the american people. why is he blocking that when documents show one epstein victim, a teenage minor, was trafficked by jeffrey epstein to

prominent american politicians to obtain blackmail information. why are you being blocked here? >> we will hope that senator durbin will be true to his word that he's recently said he'd work with me on this. he has blocked two previous requests and i don't know why they're doing that . we have had such a surge in human and sex trafficking in this country. the tennessee bureau of investigation tells us that a child is bought or sold for sex every two minutes in this country. human traffic asking a $150 billion a year business over just the last few years. we need to know who was affiliated with jeffrey epstein, who he was working with and we have to break apart the human trafficking, sex trafficking

ccapitol hill. hillary, what's going on? reporter: good evening, liz. this $400 billion bank is key to biden climate legacy and they're rushing to try and spend every dollar of it before it expires but republicans in congress say, not so fast. they want to make sure there is no pay to play with this money and that it isn't going to our adversaries like china, and we aren't spending cash on scams. the top republican on the senate energy committee john barrasso alongside house energy chair cathy mcmorris rogers have been digging into this green bank and the loan programs office, which is part of the department of energy run by shaw and they want know where all the money is going and to who. senator barrasso saying of the investigation "shaw and the loan program's office are treating taxpayer dollars like monopoly money. it's a total abuse of american chartered money and we'll continue to investigate their corrupt and wasteful practices. solyndra is going to look like

chump change". it's not just republicans raising the alarm about this bank. inspector general in charge of oversight says the amount of money the biden administration is trying to spend so fast in such a short amount of time is unheard off and she warns they're not prepared. >> you have massive amounts of money moving quickly and all of these things happening at once create a level of risk that may candidly be unprecedented. on the issue of not funding our adversaries i'm freightly concerned about how things are going in that regard. reporter: the administration is trying to spend this cash fast not just because it expires but before november and democrats lose the election republican state control of congress and republicans in congress could clause back the money. liz. elizabeth: hillary vaughn, what reporting and terrific journalism, thank you so much. bring in the former chairman of the federal energy regulatory commission, neil chatterjee. neil what, do you think of that

story? >> it's another example of the administration trying to force outcomes instead of allowing the markets to determine what's in the consumer's best interest and forcing subsidies and mandates and the subsidies want to build a road and the clean energy future and paving that road with subsidies and mandates and all you do is hit the potholes. elizabeth: president biden accused of using taxpayer funds like funding groups and voter blocks to get reelected and that's the criticism and gone around the supreme court again to do student loan bailouts and plus the biden white house on top of all the slush fund stuff, for the first time they're showing up $3 billion in taxpayer funds for things like environmental justice projects and nearly a dozen universities and left wings and taxpayers are getting upset about all this, neil. >> this is why it's so important that chairman mcmorris rogers rs and senator barrasso are digging

into this. that's what the opposition party is for in congress. to ensure there's account and the the mere fact this administration is trying to rush this money out the door ahead of election and goes to show you that politics is driving this not smart energy and kudos to house senate and republicans and ensuring the taxpayer dollars are not being wasted. elizabeth: there's a group called climate justice alliance and it's reportedly getting $50 million. this group reportedly has repeatedly supported the palestinian cause on hamas amid the ongoing israeli and hamas war and they're describing the status of the palestinians of the climate justice issue and they get $50 million in taxpayer money. your word on that? >> this is infuriating to me about these groups and they're not focused on the core issue and if they cared about climate change and carbon emissions and
