it says a lot about candidate trump that all the republican leaders that ran against him rallied behind him in this tour deforce last night in new hampshire. i think it's gob that pay great dividends. we'll see how it works tonight. anyway, i know everyone is going to rally behind liz macdonald. that's what always happens. elizabeth: we can only hope,
5:01 pm
larry. always appreciate you. thank you so much. larry kudlow, the one and only. thank you so much. okay, we've got news coming in, we have senator ron johnson is coming up in just a few minutes. senator ron johnson will talk to us about a new harvard harris poll showing a border crisis has rocketed to the top of the list of concerns for voters nationwide and senator ron johnson will join us in just a second. bring in m marc thiessen and bil mcgurn. both are authors and former white house speech writers to president george w. bush. bill, first to you, polls closing in a new hours and good to see both. new hampshire, first in the nation primary. bill, where is this going? >> well, i personally, you know, have no inside knowledge. i think trump's going to win, and i'm kind of amused at all the speculation. we saw it in iowa too. everyone is talking what happens
5:02 pm
if so and so doesn't get over this margin. if nikki haley comes in second. winning the majority is getting the delegates in the state. i'll be interested to see who turns out more, trump's voters or haley's voters. elizabeth: you know, the news is coming in what bill just said, mark, where do you come down on this. politico is reporting that "trump's strength is that he's had a far more disciplined campaign, highly focused obvious voter issues like the border but haley's campaign is about generational change". what do you think, mark? >> i don't associate the words discipline and donald trump in the same sentence very often. i think the reason donald trump is doing so well is because he and the republicans have looked at -- republican voters have looked at this and seen starting
5:03 pm
with the bragg indictment and all the other 91 diems. i think he's been -- 91 indictments -- elizabeth: yeah, mark, hang on. voters are setting aside and trump is dominating the polls and they're saying trump is running a disciplined campaign focusing on the issues. he's saying he wants to unify the nation and success. listen, t "the evening edit" doesn't come either way to either candidate and listening to what trump is saying and the best revenge and not about retrocochlear reigns leading abuse and wants to unify america based on prosperity. >> i don't disagree with that, and he's been more disciplined recently in the past but that's not why he's winning the republican nomination right now. he's winning the republican nomination right now is because of the indictments and because the republican voters rightly, i think, think that the left is weaponnizing the justice system to go after donald trump and by extension go after them.
5:04 pm
they elected him and second he came into office starting with the mueller probe and impeachment and second impeachment and the bragg indictment and the hush money indictment and goes on and on and on. 91 indictments. ten indictments for the uni bomber. this is political overkill and the republican voters are rallying around him. nikki haley's argument is that's where your heart is but your head should be he's going to lose the election and there's a bunch of polls showing he might win the election and looking why do i have to choose between my head and heart and going with donald trump? elizabeth: we're so far out from the election, nobody knows where it's headed, bill, to what mark is saying. nobody knows where this rice will go. let's listen to nikki haley and hear former president trump and former candidates vivek ramaswamy and governor doug burgum, watch this. >> what donald trump has shown is donald trump has shown he's good at breaking things.
5:05 pm
you've got to have somebody that can fix things too and that's the situation we're. we've got a lot to fix. i think it's not the party uniting around president trump, it's the political elite uniting around president trump and the political elite have never been with me my entire career because i've always pushing back. >> now is the time for the republican party to columbia together and we have to unify and i'm delighted to be joined today by a number of outstanding leaders, big leaders, powerful leaders, greatly respected leaders, and they're also unbelievable competitors and we're all on the same team 100% focused on biden and beating him in november. >> if you want to seal the border, vote trump. if you want to fight inflation, vote trump. if you want to revive national pride in this country, vote trump. >> there's one candidate in this race that understands how to make our nation more secure, our nation more prosperous, it's the person who did it when he was
5:06 pm
president before. that's donald j. trump. elizabeth: what do you think, bill? gop lawmakers want the front runner to focus on the boarder and the economy. that's where biden is most vulnerable and trump won 2016 based on that, bill. >> yeah, the issues favor trump. immigration, the economy, so forth and they're the ones joe biden is weakest on. i disagree with nikki haley and i would add to mark's thing about the democrats boosting pop lairly with law fair and overkill and what trump voters perceive is sneering from republican elites and one of the things this race will probably illustrate is rep leaders illustrate -- republican leaders illustrate trump's support by the party and some business is
5:07 pm
in a strong second, more money will come in and they'll make another -- i don't see it. i may be wrong. but i don't see it. elizabeth: okay, you don't see it. mark, it was really interesting and also a story about president biden snubbing new hampshire. mark, he's the first incumbent president to do that in more than half a century. we have news coming in, new hampshire voters are saying why should we write in biden's name. that's happening. let's get your reaction, mark, to democrat contender dean phillips. watch this. >> people are really fearful. last night, i saw a trump rally outside of mine. i walked up tolt line of people a mile long and simply said hello. i was met with 50 people going to the trump rally who were friendly, h hospitable and thoughtful and some saying they voted for barack obama and bernie sanders and half of whom had never been to a trump event before. everybody watching, donald trump is on a big mission to win and joe biden is going to get creamed. i just wish democrats would wake
5:08 pm
up and ensure that at least we give it our best shot because right now i'm afraid we'r diluted into a nightmare. elizabeth: what do you think, mark? >> he may be right. the democratic results here might just be as interesting as republican results. there's a movement to write many ceasefire and see how many votes ceasefire gets tonight in the democratic primary. elizabeth: really interesting stuff. markmarc thiessen and bill mcgu. the border is 35% and inflation is a close second at 32%. now, the senate is working on a border deal right now. we don't know if it'll cut the number of illegal crossings and hillary vaughn on capitol hill with the story. watch. reporter: some democrats have gone from defending president biden's handling of the border to condemning it. 14 house democrats to voting with republicans to rebuke the
5:09 pm
open border policies and nine democrat governors are joining calls for the white thousands to do something as this crisis reached its peak on their watch and some democrats in the senate are admitting the border is a problem. >> i think two thing cans be true at the same time. you can be very supportive of immigration but also need to have a secure border. i really, i think about immigration as we want to provide american for any migrant, but it seems very difficult when you have 300,000 people showing up encountered at a border to do that. reporter: fetterman not on an island and senator john tester from montana calling out biden wriwriting in an op ed. no matter your political beliefs allowing anyone to enter the country without being properly vetted or going through a legal process undermines the national security. i told president biden is homeland security mayorkas that what's happening obstructing cerumen -- on our southern border is unacceptable. liz. elizabeth: that's great reporting from hillary vaughn. always terrific reporter: joining us from senate
5:10 pm
homeland security, senator ron johnson joining us. good to have you back on, senator. we're seeing more and more reports nationwide and drug gangs are overtaking u.s. cities and neighborhoods and a drug gang shooting right where president biden grew up in scranton and black democrat voters suing chicago over the border crisis. chicago is now facing seven lawsuits over this. what do you think? >> first of all, ramifications of joe biden is his democrat colleagues in the congress, they're open border policy will be failed for years, probably deck -- felt for years and probably decades. i met with the county sheriffs and used to be a hub in chicago in terms of drug trafficking. that's branched out to now multiple hubs in wisconsin so this is completely out of control. six million migrants since biden took office and two million are got aways and no idea who those people are and don't know who the six million people are or where they reside and it's a
5:11 pm
clear and present danger to america and the bottom line democrats want an open border and john tester voted against completing the wall and bought and paid for and have religion and finding the news media and mayor adams said it'll destroy new york city, these democrat mayors are complaining and news media covering this in a more honest way but they're still covering umm for biden is now it's becoming an issue and my belief is they're negotiating for political cover and republicans have to insist we secure the boarder and i'm afraid that's not what the negotiations are getting to. elizabeth: elmore democrats think the border crisis is unfair and worked hard and stood in line and pay taxes and they can't retire because their savings are eaten by inflation. so to see illegal immigrants walk across and get money, houses, worker permits and their
5:12 pm
real wages are getting hammered and it's not fair and the rubin reports saying the tsa under avenue leeanne of scrutiny and putting up signs in miami airport telling illegal immigrants to pass through security check points without photo ids and how can they do that with a generation after 9/11 where 19 terrorists boarded planes to kill thousands of americans? >> because they work for joe biden. it's not fair and destructive and dangerous. democrat governance is destroying the country and i'm hoping that democrat voters understood what they voted for and what they're getting and dollar inside the biden administration is now worth 85-cents and inflation is slowing, that damage has been done. the open border, that's destroying small towns and large towns throughout america. we haven't even begun to feel the full ramifications of the open border policy. the weakness shown in foreign policy set the world aflame because it's emboldened our
5:13 pm
adversaries and this is what democrat governance gives you, and i hope democrat voters understand and switch their vote. elizabeth: listen to dave rubin on this, watch this. >> that in the pre-tsa line and that's a selected line to be in where you got the pre-tsa clearance, i gone know why migrants would be in that line if any line in the first place. i don't now hundred that note was up there but i'm just, in this case, i happened to be a private citizen that saw something that alarmed me and i posted that picture, and i'm glad it's now escalated this issue because first off, people shouldn't be in this country illegally in the first place. that's the first time they've broken the law. elizabeth: senator johnson, final word. >> again, the open board service connected a clear and present danger to america and it's not fair. not fair to people that come to this country legally, as a legal immigrants and it's got to stop. we need democrats to actually be serious about securing the
5:14 pm
border and we need republican negotiators to insist whatever they negotiate will secure the boarder and not create group loopholes and be worse than passing nothing. elizabeth: senator johnson, thank you so much and good to sea you. >> have a good night. elizabeth: you too. still ahead, mark daniels, former deputy assistant attorney tom dupre, and disrupting the 2024 race? fake robocalls impersonating president biden trying to suppress the turnout in new hampshire. this new controversy, the democrats on the january 6 committee give da fani willis miles to prosecute former president trump, files they later deleted and why is president biden still a no show inest palestine, ohio, a year after that toxic rail crash? former president trump went. that was the start of trump's come back reports say. and texas vows to fight the supreme court temporary stay on
5:15 pm
its border fencing. plus, seattle talk show radio host jason rantz is here talking about driving an electric car that the biden white house demands all of america drives. all of this coming up on "the evening edit". the best advice i ever got was to invest with vanguard for my retirement. the second best? stay healthy enough to enjoy it. so i started preparing physically and financially. then you came along and made every mile worth it. hi mom. at vanguard you're more than just an investor, you're an owner. helping you prepare for today's longer retirement. that's the value of ownership.

5:20 pm
lyric joining us now, the host of the jason rantz show, he's jason rantz, great to have you back on. this 2024 race is about policies and issues. the biden white house wants to get rid of all gas cars and wants everybody in america to drive electric cars. you wrote about your nightmare with your electric car rental. can you tell us what happened in >> i was driving to a wedding in the middle of nowhere about 90 minutes from seattle and i rented a car because i don't own one. they gave me an ev. my only choice. they gave away the car i actually wanted, and i knew it was going to be trouble because how often do you pass any kind of place to plug in on the middle of nowhere. i'm driving there and my eyes are glued to the dash board looking at how many miles i have left till the battery died and by the time i got to the wedding
5:21 pm
i needed double about the amount of mileage in order to get home. throughout the entire wedding, i'm trying to find a place to plug in and the only place was a tesla location and i wasn't driving. i was out of luck and finally found one, a station like 30 miles away, and i'm driving down, it's very cold out apparently batteries don't like the cold, lots of hills, evs definitely don't like hills and of course it happened. the car dies and on the side of the road, i was there for hours trying to get a tow truck to pick it up. it was a little before midnight. it was around 9:00, 7-9:00 is when this all started but about 9:00 p.m. is where i'm hanging out there, i think at that point i was there for an hour waiting. no tow truck will come. i was trying to get an uber to come all the way out and pick me up and of course hertz, which i rented from no help whatsoever. it was such a nightmare. but it does wake people up, i
5:22 pm
hope, to the reality that we're nowhere near the green revolution of having evs. elizabeth: sorry to interrupt but hertz is also getting rid of a fifth of the electric car fleet. >> yep. absolutely. and they're making the right decision. they should unload all of them. the only way an ev could v is if you have the setup at your home and you really only talking about commuting to work and maybe this is a second car if you can afford one. if you're planning ongoing on any kind of long drive, just the idea of trying to plot out where you're going to stop and plug in and wait 20 minutes, 30 minutes for the battery to not even get to the top is ludicrous and look al a map, they don't have many places to plug in. elizabeth: not a lot of stations, charging stations. we have 16 republican governors, they're send ago letter to the white house. you've got to stop it with the electric car push. it's hurting consumers and governor doug burgum and sara huckabee sanders and more are
5:23 pm
sating 33% under biden they're getting hit and rise of more than 20% in electricity costs as he pushes for green energy. jason, we just had an arctic freeze that killed 95 people. people also could not start their electric cars in this arctic freeze. did wind and solar keep people warm in that? >> no, of course not and especially depending on where we're talking about u places like washington state doesn't get a whole lot of sunlight for several months out of the year, and we try to do wind power, but wind generally, we just also had a cold snap that was incredibly cold and ironically the largest supplier of electricity and natural gas sent customers a note telling them when it was about 10-15 degrees, turn down your thermostats because our electricity grid can't handle the overload. does anyone truly believe we're actually ready for transition to
5:24 pm
electricity away from natural gas and can't plug in cars or turn on your heat when it's cold out. that's not a great environmental policy. elizabeth: sounds that way, jason rantz, thank you for sharing your story with us. we appreciate you. we've got news coming in, we've got legal eagle tom dupre with us ask&this continue verse reigns leading is esca escalatid fani willis hiring her boyfriend on georgia's trump case and even a georgia judge cut off willis' attorney at a divorce hearing yesterday. new developments coming up. >> [inaudible]. >> let me ask you to just focus on part of the law that says that you need personal knowledge of any matter that's relevant. system of articulation elizabeth: interesting stuff.

elizabeth: okay, calls are growing for a fulton county da fani willis to recuse herself from georgia's trump 2020 case. this as a judge unseals records in her alleged boyfriend's divorce case. this is the same boyfriend she hired for the prosecution. steve harrigan in marietta, georgia, with the story. steve. reporter: elizabeth, this chief prosecutor is coming under a microscope in his professional and personal life and first what relationship we had with white house council in 2020 and same time next week a divorce hearing he's testifying at and grilled about his relationship likely with his boss, district attorney fani willis and the nature of that relationship. just on monday, those divorce records were unsealed by a judge
5:31 pm
and among the documents that have cop out of that case are plane tickets, bank records showing that nathan wade purchased tickets for himself and willis to travel to miami, san francisco, and aruba. now willis maintained that the efforts to drag her into this divorce case are simply efforts to try and slow down her prosecution of former president trump. an attorney for the estranged wife of wade said this has nothing to do about politics but it's about money and she claims that money is being hidden by the two from her client. >> we are pressing because i want to know about how he's been spending his money. i have reason to believe he's spending it on another woman. that's not -- i have questions about that. she's trying to hide behind the shield of her position. reporter: next up senate republicans in georgia are for the purpose ago commission to investigate what they say is the
5:32 pm
improper relationship between wade and willis. elizabeth, back to you. elizabeth: great reporting, steve harrigan. you're terrorist content. thank you. let's welcome tom dupree on the show and your insights are always well copped. tom, there's reports coming in about this, that democrats on the january 6 committee first deleted 117 encrypted files and some they can't get into and republicans can't get into them. this happened before republicans took back control of the house. the debate is that democrats give information first to fulton county da fani willis to prosecute tram and house judiciary said you've got information from the committee to go after trump. what do you think? >> liz, this is so puzzling and i can't for the life of me figure out what would have led the democrats to delete a massive number of files before they turn the house over to the republicans. typically even when you have a change in power, information and evidence that's gathered by one
5:33 pm
committee isn't deleted or hidden from the new party into power but sh shared and preservd to the new party coming into power can look at everything and read the transcripts and see the evidence. it's puzzling what's going on here and the timing of it issue liz, is especially suspicious, right on the eve of the transfer of power. elizabeth: yeah, tom, this could hit the georgia case and special counsel jack smith's case and these cases are getting undercut with more news coming out about what was really going on behind the scenes, tom, and now we've got georgia state republican senator. he's saying he wants the state to launch a new special investigative committee to probe mist misconduct and corruption allegations surrounding da fani willis and that could have subpoena powers. what do you make of this? >> absolutely. the whole fani willis story is growing crazier by the day. we saw from the report she was doing everything she could not to have to testify in the very
5:34 pm
complicated divorce case and she said she's too busy prosecuting president trump to talk about her relationship with mr. wade. i think she can only delay so long and we got a bit from the judge where the judge basically said look, i understand you have a important job but you have a responsibility to testify to what you know. so i don't think she's going to be able to dodge accountability forever. she's going to have tocosm clean and testify under oath what her relationship has been with mr. wade. elizabeth: that'll be wild. she's accused of hiring her boyfriend on the trump-appointed case and he then -- trump case and bought luxury vacation travel and went to aruba. he has no rico experience. watch the cnn top legal analyst on this. watch this. >> his primary area of practice is personal injury law. not in my view qualified to handle a major complicated racketeering case. is he working nine times as much as the other folks? the other big problem though is there's clearly a relationship of some nature, we don't know exactly, between the d a and mry
5:35 pm
is being used on travel that the da is accompanying him on. elizabeth: final word, tom. reports are coming out that da fani willis paid him more than the other prosecutor she hired on the case. what do you think? >> liz, my word is with even when liberals are raising questions about her proprior tear and reasons for hiring him, there's a real problem and mr. wade and ms. willis coming under increased pressure to step aside and withdraw or resign from this case entirely. elizabeth: tom dupree, thank you so much. this story, we're coming up on one year anniversary of the toxic rail crash and norfolk southern rail cars and loaded and crashing in east palestine, ohio, and missy ellison. you were so upset by what happened. we had you on the show a year ago and you decided to run for mayor and how are things now?
5:36 pm
>> yes, thank you for having me back on the show. the cleanup is underway but it depends who you're talking to and if their lives are back to normal ryan higgins if they're being impacted? elizabeth: the president still has not gone. your neighbors, they just wanted to know those in power would help them out. east palestine residents say they feel like they don't matter. let's listen to -- get your reaction to president biden saying, yes, he was going to visit east palestine and then you'll hear transportation secretary pete buttigieg saying there's still no set date for bide ton go almost a year later. watch. >> democrat and republican and i'll continue to face this [inaudible] and we will be
5:37 pm
[inaudible] >> speaking of the president, he still has not visited east palestine, ohio, i don't know why that is and doesn't seem to make much sense to me. if congress needs pressure to get this done, why wouldn't he just go to east palestine and use the bully pulpit the way that, you know, harry s. truman would do and shame congress into passing that? why is that not even an idea the white house would contemplate? >> i don't have any updates on the scheduling front for the white house but what i can tell you is it shouldn't take anything more than we've already seen happen for congress to act. elizabeth: so, you see that, they keep blaming congress. former president trump went with bottles of water and, you know, it took president biden seven months to declare east palestine a federal disaster area and did in september. when you talk to your neighbors, how are they feeling now? we're seeing that those toxic
5:38 pm
chemicals had links to cancer, organ damage and more. reports of nausea, rashes and breathing problems and cdc team felt sick probing the derailment last march. how do your neighbors feel about president biden is feel about trump? >> well, first president biden still has yet to declare east ppalestine a federal disaster area. in september he said a fema coordinator would come to the area and evaluate east palestine. so we have not heard back from that. i'm a firm believer that you find a way or an execution and it's apparent that president biden found many excuses not to come to east palestine in the past year and it's very disheartening that he's barely acknowledged the devastation that's gone on here. truly does feel like a slap in the face to us americans living in this area. we are strong and resilient people, and we are moving forward and trying to recover but we also deserve to be heard.
5:39 pm
you know, hopefully president biden makes good on his word and he does come to east palestine, but i don't want it to be a political stunt and photo opportunity because this is an election year f. he comes, he needs to bring support and a positive update to give this area hope. elizabeth: got it, misti allison, thank you for joining and yous good to have you on. >> thank you. elizabeth: fox business will be in east palestine, ohio, next week to cover the one year anniversary of the toxic train derailment and cochee county sheriff mark daniels and supreme court's temporary stay on texas' border fencing to stop the border crisis. first, check in with our friends dagen and sean on what's coming up on the bottom line. >> hey, emac, we have a great show and first primary of 2024 underway in new hampshire. king of new hampshire david webb and king of arkansas, the great mike huckabee going to join us.
5:40 pm
>> lieutenant governor of my home commonwealth of virginia where joe biden was talking about abortion. really? the left on the wrong side of that. she discusses and here as well and harvard divinity school student on the anti-semitic grgrady trimble fio tee that welcomed -- graffiti that welcomed him back to campus and drawing of hitler and nikki haley, he doesn't even know. top of the hour. things can transform. slipping out of balance into freefall. elizabeth: we're tracking the national polls from gallop, ququinnipiac and monmouth and ty don't like the border collapse and want legal immigration and not lawlessness and this story issue the supreme court put a temporary stay on the wire fencing texas set up at the border to stop the chaos. this fight is moving through the courts and texas is going to fight back. fox news danamarie mcnickels is live in texas with the story. reporter: hi, liz, none of the razor wire has been cut and the texas national guard has full
5:46 pm
control of shelby park where i'm standing and not allowed border patrol to enter the park or access the wire. he did speak with the texas department of public safety and they say they're holding the line and plan to continue installing razor wire also repair anything cut by border patrol in the future. this is not over. a message from texas governor greg abbott and helicopt to protect texas' constitutional authority to protect the boarder and prevent the biden administration from destroying property and texas dps said their role is to prevent another huge influx of migrants and stresses the importance of how dangerous the rio grand is and afternoons a drowning every single day. >> texas is doing every measure, putting every measure in place to peak spl vent that and discourage that but at the federal level, they've not done anything as far as trying to discourage illegal immigration especially those that want to
5:47 pm
cross a dangerous river. reporter: the justices by a 5-4 vote gave border patrol agents the legal authority to cut the wire granting an emergency appeal from the biden administration, which argues that the razor wire obstructs border patrol's act to process migrants already on american soil and help those that may be in distress. texas dps told me in emergency situations, they'll aid migrants through the wire and provide medical attention but border patrol and processing center not allowed in the park, single male and females tried to cross over that wire will be arrested, charged with criminal trespassing and taken to a state processing facility and held in prison till they stand before a court. families and childrens will be handed over to border patrol. they have access to the park only through the boat ramp so their boats can patrol the river and technically they have access to the wire. that way but the question is now if border patrol needs access to shelby park and will the
5:48 pm
