the wall street journal says the border security bill will pass. the washington post, republicans will never get a border security bill as good as this. the border agent supported and politicians on both sides of the aisle. my question, does this bill do what americans want. they want the invasion to stop. it streamlines the illegal flow. the bill is supported out of frustration to do something. forced on politicians, it's a political trick. and they likely well. and americans are fed up. an elderly woman dragged by a migrant criminal.

migrants they were released within hours and why would they release them in the first place. does this do anything about sanctuary cities or radical das? it does not. we are going to keep paying for it all. how many times we have to report the breakdown of civil order. the massive expense of healthcare. and plain old cash. dues anyone believe this bill if enacted would stop the invasion. going to the polls, vast majority believes this invasion is biden's fall. whatever you think of trump is right on the border. he is the president who cut the flow to a trickle. it was biden who invited them back in. it won't end if we have a president committed to stopping the invasion. second hour of varney starts now.

steve hilton joins me now for the hour. where do you stand? i say the bill doesn't stop the invasion and i don't like it. >> it won't happen. it is not going to get through. they are all good things in it. no doubt about that but the overall context is what matters. the thing that i'm completely outraged about is this bill, the only reason we have abilities ukraine. these senators standing there saying we've done this brilliant negotiation republican saying we've done a great job on the border. what have they been doing for the last three years? nothing. they've been doing nothing. the only reason they even started thinking about doing something like this is because of ukraine. that the only reason. that's an insult to every american and if you look at the

tactics to get this through, what happens to a bill that has three times as much money for ukraine as it does for the border. the funding is mainly for ukraine. that means people say where are your priorities? stuart: it's not going to pass. >> republicans in the house have made it clear. we are back to as you said the president, president biden on day one invited this catastrophe and the crime that we see and all the rest of it on day one. just as he reversed the trump policies he could reverse and do it overnight. stuart: it's going to be the key issue in november this year. you've got a british accent. you know what we are going to

talk about. king charles diagnosed with cancer. prince harry has arrived in london but his wife, megan, is not there. what's the significance? >> it is serious. i think that is the first reaction to this, edward has a human reaction. this is a terrible news for anyone to get in any family. it causes anxiety. in that sense we should not read anything into it that it is pretty serious. king charles communicated this, you would expect that and the fact that he has gone there tells you there's a lot of concern. stuart: megan tells you that she's not there. >> the things that they say,

i want to talk eli lilly, stock is up 20%. they are a weight loss company primarily. would you buy into it? >> we need to have some exposure. this is a big deal. eli lilly today overtook tesla. they have a big shape up in the magnificent 7. microsoft overtaking apple. this is a demand story. less and less demand, 3800 auto dealerships begging biden, this glp one, drugs like the ozempics, these, there is obviously a ton of demand for these. eli lilly's drugs out there

right now, more effective for weight loss. we have to have some exposure but i told you one of my concerns was if i wanted to get ozempic without a prescription i could google it and have it at the front door in three days. stuart: i want to talk in video. it cost $700 a share. a lot of people say it is going to 900 or thousand or 1100, takes a strong stomach to buy a stock that has gone straight up to $700 a share. would you buy it? >> i own it but some of the things you need to do with microsoft, apple, all these stocks, you need to be prudent. you should have owned a year ago, trimming on the way up. we haven't removed nvidia recently, have no intention of

neutral. at least you have a bounce back today after the downgrade. stuart: do you have anything to say about musk's use of drugs? >> it was an amazing story, good reporting. i am shocked. on the other hand in the end, charge by results and actually if you look at the progress of his companies. a lot of attention is on x. look at neural link, massive breakthrough. space x continuing to be a vital part of our space expiration program. these companies are doing well. stuart: he is quite a genius. lauren: drug tests passes, maybe they need to bring completely independent board of directors.

stuart: may be. let's get back to nvidia. they hit $700 a share pre-market. now. neil: which should be down a little bit. do you no one. 7 market, nvidia is worth 23 companies that make up the entire energy sector of the s&p. stuart: it is 1.7 trillion at the moment. lauren: one. 68 to be exact. stuart: that's more than all the energy stocks combined. lauren: the news today is cisco is up 1%. they are teaming up with cisco to help companies customize artificial intelligence so here's another partnership for ai. blue one more job cuts this time at doc you signing. lauren: sometimes job cuts make the stock price go up. in his case down. down 4%.

they are cutting 6% of staff, 440 jobs. this appears to throw cold water on a takeover of the signature company. stuart: does boeing have another issue? lauren: can go on strike potentially at boeing. the contract ends in september. contracts next month. stuart: if that would be a union exercising what leverage it has. it has leverage. lauren: machinists and aerospace, what happened ten years ago? boeing threatened to move their production to south carolina. they did. how do you negotiate with that? they accepted a crummy deal, small wage increases, their pensions were sacrificed and they caved. if you speak to some experts, consultants, they say these

stuart: just days after the senate border deal was released, residents closest to the border are reacting. jeff paul is an eagle pass, texas which how do folks their care about this deal? >> reporter: lawmakers in dc continue debating the merits of the new border deal. the real work continues at the border. so does the flow of migrants to the us/mexico border. we are learning that the man in charge of representing 18,000 border agents says he supports the new border deal. brandon judd, who is president of the national border counsel

says he is endorsing the section that handles the border crisis. while not perfect, it is a step in the right direction, far better than the current status quo. the border union believes they will drop illegal border crossings nationwide and judd says he hopes words quick passage. fox news obtained an internal memo where the acting cbp provisioner, troy miller, called the deal the strongest senate tool it had in decades. when you talk to the folks who live right there on the rio grande, they feel a little differently. one family we talked to along the border says the deal doesn't go far enough. >> us on the river, it will not affect us, security, help, make us feel better, communication. that's not going to help any of us in del rio. they don't really care about us especially since we are on the river.

so you suck it up. >> reporter: the state of texas is not waiting around. this is new video of the border bench the state's building in del rio. governor greg abbott says texas is the first and only state to do something like this. even though we haven't seen the amount of illegal immigration or migrants crossing into the us, he's going to continue building those barriers, setting up this razor wire. that you see right behind me. stuart: that is the state of texas building part of that wall. jeff paul, thanks very much. florida attorney general ashley moody joining me now. florida does not allow the hiring of illegal migrants to work. is that accurate? >> reporter: i wouldn't say that is accurate. what florida does requires employers of a certain size to

make sure they are hiring people that are eligible to higher. but there are legal ways that folks can come to this country and work. stuart: can i ask you to hold on a second? >> reporter: leadership try to protect florida workers. blue one forgive me for interrupting. i just got back from florida. i know the state well. where i was, it is obvious, the landscaping businesses, there are illegals working they are. i can't prove it but it is obvious. this is happening in your state. are you okay with that? >> employers can hire folks from out of our country. there are legal processes to do that. stuart: i'm talking about illegals who come straight across the border ill legally who come to florida and they work. that is happening, isn't it? i suspect -- you need that labor.

>> no one in the country, and they are helpful, the job opportunities, to advance. stuart: do you support the border bill. >> is a barrage of epic proportions. it legalizes, and encouraging, a surge that lays cover for chemicals and individuals that can harm americans. the biggest indicator of that is the president can suspend any shutdown, that is what he has been doing for three years, dismantling our security structures.

making sure his administration does not enforce security and encourage surges. i believe this is a barrage and congress should pay attention. stuart: ashley moody, attorney general of florida, appreciate it always. now this. mayor eric adams, the rapper $0.50 just the plan to give migrants prepaid credit card. what did the mayor say? ashley: he's defending this giveaway. he says it will save the city to billion dollars. he says the rapper doesn't have all the facts. he wants to set the record straight. watch this. >> this was a policy shift, the pilot project. 500 people. if this is successful, we are going to expand it even more. i told fifty cent to hit me up

alicia, there's confusion among voters here. explain what is going on. >> reporter: stick with me. it's confusing. donald trump is not on the ballot. that was his choice. nikki haley is on the ballot. also her choice. if she wins today, she will not receive any ballots. she hasn't been here since october. the state legislature moved to a primary system which the nevada gop party opposed and said it would still only have delegate through a caucus which is holding this thursday. candidates may only participate in one of the contests. trump is doing the caucus and haley the primary. alien other republicans have been critical of the $55,000 fee a candidate must pay to be in the caucus and accuse the nevada gop of being in the tank for trump. >> we've not spent a time or

ounce of energy on nevada. we decided we would not be $55,000 to a trump entity, to participate in a process that was rigged for trump. >> everybody has equal opportunity to campaign in the state of nevada. the fact that nikki haley's team that the process is rigged, it's a great soundbite. at the end of the day i think she's kicking herself in the butt for not engaging in the caucus. >> reporter: folks want to pay attention to the results tonight because there's a risk for haley that there be a big showing for the candidates options on the ballot, which joe lombardo said he will choose, elections officials say this created confusion and distrust among voters who received primary ballots in the mail without trump's name on it

and write ins will not be canted -- counseled. also there's a democratic primary today and president biden is expected to win. stuart: the bottom line is trump gets it, that's the way i read it. trump gets the delegates, case closed. that was a fine effort explaining everything. this just coming at us. a federal appeals court has ruled donald trump is not immune from prosecution on charges he plotted to overturn the 2020 election. it seems to me to be a loss for trump but is a win for biden? >> kind of hard -- the short answer is yes it is a win for president biden. part of the plan to try to use the courts and use the federal judiciary to go after donald

trump and keep him from appearing on the ballot because that's their only hope, they can't beat him at the ballot box. the problem is there are all sorts of appeals and every time something like this happens, it's a reminder in the courts, in public polling, regular voters, still ostensibly or supposed to be you have voters in charge of the country who get to pick their leaders. it is a reminder the biden administration and democrats as a whole, stopping at nothing to avoid having to face somebody in any election they believe is going to beat them. it's funny listening to democrats, we would love to face donald trump in the presidential election yet every opportunity they get, they vote

for nikki haley and look at what they are doing, not what they are saying. stuart: donald trump said he wanted to debate president biden immediately. here's the president's response to that. >> mister president, donald trump is ready to debate you right now. do you accept? >> immediately he says. stuart: him i would want to debate too. stuart: trump said he would take biden's place in the super bowl after biden refused the second year in a row. seems to me trump really looks like a president in waiting, he wants so debate, he wants to do the interview. >> i think he has got a good shot here and the only hope president biden has is either

they can get donald trump off about and the only hope democrats have is they can get president biden off the ballot but doesn't look like we are going in that direction. there's something the various going on. they are using the courts to go after donald trump not only to keep him off the ballot but they are trying to delegitimize him so president biden doesn't have to debate him. they will use that as the excuse not to debate donald trump because imagine president biden is seeing people in crowds, doesn't see other people in crowds, he's wandering around, he can string a sentence together, imagine him in a debate with donald trump. it's going to be devastating. stuart: never let it happen. >> stop at anything. stuart: see you again later. i want to go back to the federal appeals court saying trump cannot claim, is that a win for biden?

>> it is what -- i'm not a lawyer but legal observers didn't expect this to be successful. it is part of the overall trump strategy which is to slow walk things, delay things, that's within his right and you expect his team to do that and that's part of the process which is working if you look at the timeline for these cases. it's being slowed down. in that sense trump's legal strategy is working successfully right now because a lot of people are looking at this saying we won't get these trials as they wanted before the election. stuart: sad story. toby keith has passed away. ashley is back with us. take us through the legacy and life of toby keith. ashley: toby keith had 20 number one billboard hits, sold 40 million albums, best known

stuart: markets, a little bit of green for the dow, 80 points, s&p down one point. not much movement today. president biden wants to circumvent the supreme court decision that blocked the student loan forgiveness plan. how does he plan to get around this before the election? >> reporter: they are going with their plan b option. the student loan forgiveness plan will be established under the higher education act and it will consider hardships as a basis for forgiveness. to survive a legal challenge the biden administration is trying to stay in compliance with aga rules, holding a rulemaking session with public comment at the end of this month. what qualifies as hardships, what is potentially being

considered are bankruptcy, pell grant recipient and having a history of minimum-wage income. those in opposition say the supreme court already ruled student loan forgiveness is unlawful without congressional authorization. that's exactly what the president is now pursuing. >> if the press is going out to try to cancel the balance of anyone he deems to be in financial hardship, he's going to be running afoul because the preexisting law does not allow cancellation of any amount of principal balance. >> reporter: even without the next step the biden administration has been able to forgive $136 billion in student loan debt through various measures they pursued after the supreme court struck down the first initiative. this could be the latest and largest move at the end of this month, the education department is expected to release

dreamers which i thought even trump was looking to do. what they are now, people worried about that. when you come to the border, the only way to get in is if you prove your life is under threat, it's next to impossible. you turn back around. now you get your case heard in 6 months. instead, 5 to 7 years. that is improvement. it's not everything. $650 million is 50 miles, it's not another 350 miles, it's not everything. right now there's 19 senators, three democratic senators who don't like it. if they want to work on it they work on it. here's the problem. ukraine aid, ukrainians in desperate need of military aid and the israelis are desperately in need of military aid. if you don't like the border bill, all that aid is offered

separately which is different hurdles. for me, it's a step in the right direction. murphy had to give in a lot. it is also telling that border patrol weighed in for it. as i told byron york, he doesn't think there's a political risk of republicans walking away with so many holes in it. it does show improvement. people don't think mayorkas and others will follow through with tough asylum criteria. the next president, if it is trump, well, but if not, they won't. what changes? stuart: on the same note, some migrants suspected of beating new york city police officers were found and arrested in phoenix, arizona. my question, why on earth where they released in new york in the first place? brian: wise new york peddling a grand jury to look at the case to find charges on these guys? new york, in case you are
