larry: hello, everyone, i'm larry kudlow. robert herr's special report and the investigation to the uncovered evidence that president biden was willfully retained and disclosed for materials after his vice presidency was a private city. citizen and report called biden an elderly man and poor memory and diminished faculties and is the 25th amendment now on the table to remove him from office. we're going to ask congressman byron donalds and claudia tenney later in the show and how he's going to stop biden's $95 billion ukraine aid package and senator katie britt taking what joe biden said regarding prime minister. first up, let's go straight to our own edward lawrence standing by at the white house after a

very roucous news conference. reporter: yeah, it was interesting and you've been on the other side of some of the big questions smear there were a lot of big questions and news conferences as well as white house press secretary and press briefing and the president defiant over how the special council robert herr characterized him in that report over mishandling classified documents and in the report, he described a man being sympathetic, well meaning, elderly man with a poor memory. here's the response from the president. >> i'm an elderly man and i know what i'm doing. i'm president and i put this country back on his feet. i don't need his recommendation. >> how bad is your memory and can you continue as president? >> my memory is so bad i let you speak. speak. reporter: yeah, the white house did damage control and president biden met another world leader

and the ubiquitous note cards to help him remember what he's saying and >> they've naturally caught headlines for all the attention and inaccurate. reporter: president biden made two missed cued already and mixed up cc calling him the lead r of coax and he got confused. every memorial day we hold a service remembering him attending friends and family of the people who loved him. reporter: today, the president probably wishes he got charged in that report or out of the report from the special council because the defense would not have been that he's an elderly man with a poor memory. larry. larry: thank you, edward lawrence. folks, just a couple thoughts

from me on this whole point. the one point in the biden special council report that i don't think has received near enough attention is the fact that u.s. senators and/or vis presidents do not have any -- vice president haves no legal authority to take classified document withs them or take them home or take them to a private office, period. full stop. it is illegal. the great victor david hanson and joe biden was guilty of violating national security laws and removing classified documents after examining them and senator and vice president biden some 15 year habit of removing classified files to his offices and residents.

they were stored in unsecure fashion, period, end of story. biden has no municipal punitive right as did president trump and declassified files and took them home and it was more secure than biden's ricky old garage the it was covered by the presidential act and authority to declassified documents and transport them into a safe and secure location. only presidents have that authority. nobody else has it. therefore what mr. biden did was unlawful for a period of 15 years taken documents from the senate and vice presidency and the law further states that if you want to use classified documents for a book or whatever and you can read them in a secure skiff in the national archives building. the herr report cause say the

vice presidency and keep those document knowing he was violating the law. biden discovered these classified documents back in 2017 when he was talking about the topic with his ghost writer. so coming to tell the justice department and archives and then listened and just another biden truth and he'd been pulling there are if 15 years going back to the senate days and donald trump was accused of willfully retaining classified materials but again under the presidential

records act, he didn't do anything wrong. it's a two-tiered justice system. now, former prosecutor andy mccarthy says, and i'm going to quote. if you're going to use what a jury would say and there's enough evidence to indict the person and enough evidence perhaps to let the jury decide the case. that's her musing and potential juries and kind of reminds you of james comer's merry go round with hillary clinton. biden's so-called limited memory and get off in front of the jury. that raises a point and can't remember anything and the president and commander in

chief. i turned to andy mccarthy who said herr's findings contain evidence to invoke section 4 of the 25th amendment that empowers the vice president along with majority of those in the cabinet to remove a president from office if he or she is judged to be incapable of fulfilling presidential duties. "his fitness for office is a major issue here". mr. mccarthy told fox news that. all the biden white house attempts to discredit the herr report are going to fall on deaf ears around the country. believe me. joe biden is in a heap of trouble and trying to untruth his way out of it. i'm going to predict it will not work. the biden presidency is broke

and florida congresswoman byron darnolds. talk about the -- florida congresswoman claudey tenny and byron donalds. synergy home is the 25th amendment applicable? >> first of all this, is so clear, the prosecutor is a binary choice and you either are competent to stand trial or if you're not, then you have to face a 25th amendment charge. it's not one or the other, it's -- that's it. it's if this prosecutor as you stated had reasonable grounds to determine and make the conclusion that you cited for mandy mccarthy -- andy mccarthy, we could have gone to a jury and they would have found him kindly and guilty he was guilty of a crime and knowingly and willfully handling of classified

documents and if he knowingly did that and he's guilty, put him in front of a trial. that's a doubling standard and two-tiered justice system so if he's add -- if he's that incompetent mentally, he can't be command fertilizer chief of the united states and someone that oversees our forces and this is dangerous. he's dangerous now. this is not about an elderly man in cognitive decline. american haves died whether it's due to poor decisions in afghanistan and #what's happening in the middle east and and didn't wait and have time to put a script in front of him and

see this as well and they know how terrible this is. look at end of the day it is incumbent upon joe biden to present himself for the american people and demonstrate his faculties and not a political point and this is serious business. we have men and women who h aren bases around the globe ask in harm's way and if the commander in chief doesn't remember leaving the vice presidency and can't remember the names of world leaders, how will he make the tactical decisions at a moment notice they need for lives to be protected? that matters more than republicans and it matters more than democrats and that is critical to our nation. it is clear now after reading this report they've chosen to

weaponnize the justice department against president trump and all the while making sure they did everything possible to protect joe biden because your lack of mental capability does not protect you from prosecution. larry: yes, of course. some ru rues that biden -- rumos that biden fires merrick garland and the 25th amendment point and it's important and i don't want to belit that will and at the top of my riff, i want to make this point and the presidential records act stipulates that only presidents have the power and authority to declassify and take documents with them after they leave office and go into private life. there's no debate about that. biden blowing smoke and decommission and rewrite the law.

away shape or form and that's going on here and president biden has done this for so long and decades and willfully decade and probably the most important and most difficult job where you need to been o top of everything 100% of the time to do a good job than what we face on this world. it is dramatically bad and my son serves in the marine corp. right now as reservist and this is dangerous to our country to have someone like this making final decisions and the general whether he mines it or not, they have to abide by those decisions and the guy next to him has a nuclear code. this is extremely dangerous, which is why i can't emphasize enough and the democrats may actually throw him under the bus, which they should.

we ship $100 billion of our money overseas and i meet no one in kentucky and no conservatives across the land for this and leadership of the senate under mitch mcconnell is more concerned with sending your money to ukraine than they are with the invasion of the southern border and i've had enough and i'm going to do everything in my power to slow down and stop this and i told them they can vote when hell freezes over because frankly this isn't in the best interest of our country and the money has to be borrowed. we don't have $100 billion sitting around. we borrow $1.5 trillion and they're going to borrow another $00 billion. we essentially -- $100 billion and certainly we're asking china to send money to ukraine. makes us weaker and bad for the country and mitch mcconnell, joe biden and chuck schumer are wrong on this and i'm going to do everything i can to slow them down at the very least and possibly there'll be enough of an uprising of people calling in
