sheriff mark can nils. wow, first to you, art. you saw the president and former president trump today at the border in texas, what was your first reaction? trump is at the epicenter in eagle pass, biden is in browns withville. not a lot of action there -- brownsville. this is his second visit in the entire 50 years he's been in d.c. art, your take. >> president trump is down there because he wants to be to down there, and he wants to see what is actually happening down there. president biden went down there because he has to. it's the last hail mary pass to try to salvage what he's dried finish destroyed for the last three years. this administration from day one have caused this chaos at the border. they've destroyed it. and honestly, at the same time, i think president trump would be sad when he showed up and saw that all his hard work and everything that he did, all the effort that he put into securing our nation's borders has completely been reversed in a very short time by this administration right now. elizabeth: yeah. so what art just said is, sheriff, you know, the former

president's talking about crime. biden is attacking republicans, and he's -- the president, president biden is saying he's done all he can to secure the border. what do you say? >> well, liz, as my friend art a said too, we have president trump who's actually prioritized our borders as president, he's put action behind it, and he's done an amazing job of securing our border, taking his oath of office serious. opposite of that is president biden who's blamed everybody but himself. it's his administration that reversed all the trump measures to open up this border and then blame everybody because it's not secured. two different types of leaders. very simple, who actually has -- [inaudible] to secure the border and who does not. elizabeth: let's listen to former president trump who spoke at the border today. watch. >> i call him crooked joe because he's crooked, he's a terrible president, the worst president our country's ever had, probably the most incompetent president we've ever

had. but it's allowing thousands and thousands of people to come in from china p iran, yemen, the congo, syria. a lot of other nations. elizabeth: yeah. you know, art, house judiciary says more than 600,000 the criminal illegal aliens convicted of felonies in their home countries are now in the u.s. what do you think? >> and they continue to come in, i'll be honest. look, president trump is going down there, he's seeing the chaos that's aping down there. and make no mistake -- that's happening down there. biden could have gone to san diego or arizona where the numbers are astronomical. tucson alone is looking at over 1500 a day encounter. that's just what they know of. that doesn't count the gotaways. it's been a complete mess, and not only because biden erased the policies that were in place by president trump, he kid it with rhetoric alone. day one of his administration before he even pulled out the pen, you were her seeing, you

know, groups in the hundreds that were coming across in different areas. and it's people from over 160 different cubs. and -- countries. and unless we know what criminal records or we have some kind of knowledge if of the criminal record in the states, all these other countries can be releasing their criminals without us even knowing about it. elizabeth: what art a just said. sheriff, president biden when he was campaigning said, quote, we -- yes, surge the border. he said that to illegal aliens overseas. you know, president's justice department sued texas to stop its border barriers. president biden did not if invite border officials like brandon judd to his visit today, he did not acknowledge texas' successful crackdown on illegal border crossings. sheriff, i want you to listen and react to speaker johnson saying that the president, president biden, told speaker johnson he's worried about mexico for why he's not reinstating trump's policies. listen to this. >> i told him, mr. president, if you just issue an executive order that reinstates remain in

mexico, sir, the border patrol, your own agents told us it would reduce the flow by 70%. almost overnight. he won't do it, sean. he told me that he didn't have the authority to do that. i said, that's simply not true. president trump did it, why can't you do it? oh, mexico doesn't want that. well, you're the president of the united states. he should act like it. elizabeth: so that's what's going on behind the scenes. he's saying mexico doesn't want it, but the president publicly calling out republicans for saying no to the senate ukraine aid bill. there's so much is mess information out there, people -- misinformation out there, people don't understand why that senate bill was bad, why law enforcement, lawmakers did not want it. ing it would enshrine catch and release, it would still let in 1.8 million a year that the obama white house designated crisis levels, plus it would have taken away states' rights to sue over bad policy. they would have only been able to sue in d.c. courts. what do you think? >> well, liz, let me just say

this, the bill was never shared with veries, mayors -- sheriffs, mayors. this is all about communities and their safety. where president biden has failed and where the majority of congress has failed is they forget who they're serving, and that's the communities, us in these communities down here. president biden,. gene, it's good to have you back on. what do you make of the democrat and media outrage over delays in cases against trump? we're talking the supreme court taking up trump's presidential immunity claim in the federal 2020 case. that's causing delays. georgia's 2020 case is delayed because of conflicts of interest involving fulton county d.a. fani willis. the classified documents case could be delayed too. there's a hearing tomorrow on that. what do you think? >> look, they're upset because their plans are unreallying. unreallying. right before their -- unraveling. they coordinated this behind the scenes including with the biden white house, and they orchestrated this entire takedown or attempted takedown of donald trump, and if they are for flailing now. they are freaking out because if they know that all of their plans to manipulate the law, to manipulate the system and to target donald trump for things that no other american would be prosecuted for are all coming apart before if their very eyes.

apparently, when you manipulate the legal system, it doesn't always work out the way that you think. elizabeth: okay. let's watch the reaction. >> i mean, to me, it's disappointing, it's troubling just because of the delay. i think that that would have been a very easy thing for the court to do. but instead they've thrown a monkey wrench into the schedule. >> there are just a lot of reasons to be very pessimistic. the ultimate decision is almost irrelevant, because even if they were to say that a president is not immune, or by delaying it so much they are defacto saying that this former president is immune. >> however, now, i do think this makes a trial before the election unlikely. >> the cravenness of the court is evident in what they are doing with the pacing here. elizabeth: craven? do they have access to what goes on behind the scenes at the supreme court? you know, the media's upset, but it was special counsel jack

smith who brought this to the supreme court. he, it was special counsel who asked scotus to take it up. so is the media -- are democrats and the media saying the entire point of this prosecution is to influence the election when they claimed it was not political? >> it certainly seems that way. and, again, what they are so upset about with the timing here and name-calling the court for taking up a case involving legitimate questions that really ought to be settled. is the president immune from criminal liability for acts that he undertook while he was in office? i think the answer to that has to be yes. everyone understands that, they've already recognized that in the civil unity context. but they're the upset about the timing because this is all affecting their plans to manipulate the election in 2024. that was their ultimate goal, that's what they wanted to do. elizabeth: you know, it really is about the veracity and integrity of the legal process. and so when it's been

manipulated, voters see it. voters don't like it. the judge overseeing the federal classified documents case against trump, holding a hearing on friday, tomorrow. widely expected that's going to get delayed. now, the fundamental issue is whether presidents are fully immune from prosecution over anything they did in office even after they've left it, but there's a bigger constitutional problem, jeep. those attacking -- gene. those attacking trump won't anytime to this problem. reagan's attorney general ed meese along with constitutional scholars pointed it out in an amicus brief saying jack smith's office is unconstitutional. he was never appointed by the president, never confirmed by congress, congress never established jack smith's office. so can any attorney general out of the blue a appoint a special counsel with powerful prosecutorial authorities like this to attack a rival party's leader? is that what america's about? >> it's certainly not what we're about, it's what the democrats want it to be. it's what the biden administration wants it to be.

and, look, that brief signed on by former attorney general meese raises a lot of very important issues that we must confront. there doesn't appear to be an active operating statute for appointment of the special counsel. and so, again, what we have is a situation where the democrats in the biden administration are manipulating everything. they're manipulating the law, they're manipulating the system ises of government to go after one person. donald trump. elizabeth: got it. and he was impeached over january 6th. he was impeached twice. gene hamilton, thank you so much. it's good to have you on. tonight, congresswoman kat cammack, former doj official francey hakes, the head of an etf with fast growing in popularity,st the american conservative values etf, the president, tom carter, will join us. and fox news contributor joe concha. we are monitoring biden and trump's dueling visits to the border throughout the hour. this just coming in, an illinois judge kicks trump off the illinois primary ballot, but she made this disturbing statement in her court filing.

what we're seeing is inflation month over month if is actually going up a little bit in this pce inflation report. we're seeing the economy sort of bouncing across the bottom at the moment. if you look at pce inflation month over month, november, december and january is, it rose .3 percent in january. year-over-year though, the number's coming down, and this directly affects interest rates. rafael bostick felt the first cut would come the end of the year, but inflation data showing a general trend of decrease caused him to change his mind. listen. >> i started december. i've now moved this forward six months because of experience. experience will ultimately be our guide, be my guide in thinking about what's appropriate. we'll have to see what happens over the next several months. that will really determine when that summer expectation appropriate or whether i should pull it forward even further. >> reporter: so that would put the first rate cut possibly in june. maybe may.

now, the former federal reserve board member, james bullet ard, says the fed -- bullard, says the fed does need to have interest rates come back down as inflation eases. >> so you should be able to take some of that onboard and move the policy a rate somewhat lower. but exactly when the committee will get the that is what everyone's arguing about. >> reporter: now, president joe biden needs the rate cuts sooner because that would boost the economy and have the markets do a little bit better, and then people would feel better about their financial situation. as you know, the economy or the prices under this president since he's student thed his policies have gone up -- institutes his policies have gone up 18%. elizabeth: edward lawrence, thank you so much. let's welcome "forbes" media chair, steve forbes. it's good to have you on, steve. >> good to be here. elizabeth: so what do you make of this story, this breaking news? california state lawmakers now want to investigate california governor gavin newsom. he reportedly gave a break, an exemption to california's new

$20 minimum wage hike to his buddy, a mega-donor, greg flynn who owns panera bread chains out there. is that fair? >> no. [laughter] it's sort of the old phrase pay to play? this is may to not play. pay -- pay to not pay. that guy figured out if you pay the politician, you can save money. it's cheaper than paying workers. and it's just so blatant. they got the unions to go along by saying, hey, this is the price of getting this through the legislature. and the thing is he was originally opposed the rise from 16 to $20, and so is gavin newsom said, okay e, i'll make an exemption. suddenly, the guy was onboard. elizabeth: so this guy, greg flynn, he's the largest restaurant franchisewith e in the u.s.. >> yeah, he's a billionaire. elizabeth: he's got thousands of apple bees, pizza hut, taco bell, wendy's. he's donated tens of thousands to governor newsom if including

to fight a recall push. gavin newsom is thought to be a stand-in potentially if president biden doesn't run again. do you think this is the damaging to gavin newsom? >> well, we'll see if he has the kind of a trump shield where something comes along that you to don't like, but your supporters are still there. i don't think it's going to be the case with gavin newsom. and the question is, when did -- does biden get pulled out. new. >> is the front-runner, big state in the union, ask and as you alluded to, big money gatherer. big money goes for him, so he'd be able to help fund the campaign. the fact of the matter is gavin newsom is the front-runner, and who else is going to challenge him? if governor whitmer of michigan? elizabeth: yeah. >> i think one of the things that could happen is the democrats may go for a completely unknown, somebody with no baggage like jimmy carter back in 1976. elizabeth: interesting. >> and that way they hope being an unknown you can beat donald trump. elizabeth: yeah. this is really damaging to gavin

newsom, but he's trying to play it down, you know, as a just, oh, you know, sausage making and making the laws. >> it was bismarck who said two things people shouldn't see is, law making and sausage making. and that they go right together. elizabeth: yeah, they sure do. [laughter] the governor told reporters, well, i'm just, you know, just ignore this, this is just part of politics. let's listen to what gavin newsom said when he was confronted about this late last year. watch. >> there's a provision in this bill that exempts bakeries, essentially, places that the sell and bake bread on site. so carving out, essentially, a pa ifer in rah and boudine, why did, in the agreement, did you all decide that those workers should not be within the umbrella la of this? >> that's part of the sausage making. that was part of 257, the original bill. and we went back and forth. it was part of the negotiation. it's the nature of negotiation. elizabeth: wait a minute -- [laughter] that's complete nonsense. because mcdonald's is not exempt. they're going to get hit every

franchise location,ing? like a quarter million in extra costs. sorry, forgive me, there's also a more. it's chipotle, all the fast food chains are going to get hit but not a paer in a rah bread with because the owner gave tens of thousands of dollars to gavin newsom's campaign. he's a mega-donor. he's a high school class a mate too. the national if restaurants association chief now advising, you know, fast food chain owners, listen, you need to have political relationships. >> well, that just goes to show pay to play or pay to not pay. in this case, not pay your worker. the fact of the matter is in terms of this whole thing, what california's doing is completely unconstitutional. they have now set up a special board to dictate to restaurants how they manage their restaurants, what they pay their workers, working hours and things like that. shul wrong, going to be thrown out by the courts. elizabeth: yeah. this is going to be wild to see. this story's got legs. it's hitting gavin newsom hard.

problems with this case. kelly o'grady live from new york city with the latest. >> reporter: that's right, liz. another big development in this case. trump's team was looking to post a $100 million bond for that appeal process, but the appellate judge has ruled the form former is on the hook for the nearly half a billion fine. they had a argued, quote, the exorbitant and punitive amount of the judgment coupled with an unlawful and unconstitutional, blanket proif hix on lending transactions would make it impossible to secure and post a complete bond. trump's team did get some significant concession ises here. the judge paused the 3-year ban on him and his sons running their new york businesses and, more importantly, stayed those restrictions on trump borrowing from any new york banks. that is key because it could help him secure his $450 million a appeal bond. it is not stopping new york attorney general letitia james from gloating on twitter. she's keeping a track of the running total including $87,000 a day in interest payments that the former president owes.

james has been forthcoming about her intention to seize trump's properties including 40 wall street if he isn't able to pay that fine. her office arguing his unwillingness to post that full amount is a concession the former president has insufficient assets. even teasing a possible eighth amendment defense, but the headline is that he is going to have to put major financial strain on his assets. back to you. elizabeth: kelly o'grady, it's always great to have you on. thank you so much for your work there. joining us now, former federal prosecutor francey hakes. sit tight for just one second. we'd a like to get your reaction to former, you know, top legal pro jonathan turley. there are constitutional problems here involving due process and eight ath amendment issues. -- eighth amendment issues. let's listen to this. >> at some point, its confiscatory just in order to bring an appeal p. and, you know, the example is that if you're contesting an order or taking your home, you shouldn't

have to sell your home to appeal that order. but people like attorney general james were talking about precisely that. she was actually naming properties that he, that she might seize or he might sell just to get the court of appeals to look at this opinion. so it is a mixed victory for trump. but it does give hem some more options he didn't have before. elizabeth: what do you think, francey? >> well, i, i almost always agree with jonathan turley. this entire process, liz, has been unsavory, unprofessional and unconstitutional. look at letitia james post things like that that on her x at. account. it's ridiculous. the job of a prosecutor is to seek justice, not to exalt if her victories, but to seek justice. and here this is anything but justice. i think it does violate the eighth amendment. it's an excessive fine, it's confiscatory in addition to

being unconstitutional because of the entire process. the worst part to me as a former prosecutor who prided myself on ethicalling behavior, i find letitia james' behavior simply appalling and disgusting in this case. you should never celebrate when you get a victory that you think is justice. that's for the people. that's not for the prosecutor. elizabeth: you know, francey, turning to this, cook county judge tracy porter kicked former president trump off of illinois' primary ballot, but she made this statement that the illinois board of elections must, quote, cause any if votes for trump to be suppressed. what's your reaction to this? >> well, i thought it was trump who was supposed to be the threat to democracy and republicans and white, rural voters are supposed to be the threat to democracy. what we have here is a single judge who has apparently illusions of grandeur when she says that she wants to up is press the people who have a

constitutional -- suppress the people who have a right to vote for president trump. this is no more constitutional than the colorado or maine decisions, and i expect it to get slapped down by the supreme court. and i think this was purely political for weighing in at this time when the supreme court has already had oral arguments and will be weighing in shortly. i just can't think of any if reason besides a partisan one for her to have ruled now. elizabeth: or the. -- all right, so she put her own order on hold, right? she is actually telling the board of are elections to suppress the vote for trump, a judge, a sitting judge is saying that. but, you know, she stayed her own order until in friday, you know? she's expecting a likely appeal. i mean, trump is going to be on the ballot in colorado. the supreme court took up the colorado ballot ban for trump. maine is trying to do it. but to say suppress the vote for a judge to say that, have you ever, ever heard that?

>> not. but, you know, because of trump, everyone has gone completely crazy on the other side. and it won't shock me, liz, if even if the supreme court if rules for president trump on this issue and basically puts down an order that has him required to appear on all the ballots in which he lawfully is on the ballot, it won't surprise me to see people like her and people like the maine secretary of state refuse to comply with the supreme court order. they'll cite democracy, they'll cite how wicked trump is. but i won't be shocked at all. i hope i'm wrong. elizabeth: i mean, this is complete law will-lessness, and and voters don't like it. it makes them feel unsafe. francey hakes, thank you so much. it's good to have you back on. with now google, let's turn to google, google is now in crisis mode and damage control can. it's lost nearly $100 billion in market value, $70 billion alone on monday after its artificial intelligent chat bot called gemini if generated by woke --

bizarre woke images, historically inaccurate images like black vikings, female nhl hockey players, diverse versions of america's founding fathers. hillary vaughn on capitol hill with more. hillary. >> reporter: good evening, liz. well, senator josh hawley wants the google ceo, sundar pichai, to come here to capitol hill and testify under oath after google's a.i. bot gemini blew up in controversy. senator hawley saying that it's time for congress to repeal section 230, the law that gives platforms like google legal immunity for things happening on their platforms. hawley saying this, if conservatives want to rein in google's gemini, there's only one way, repeal section 230 and allow americans to sue these a.i. companies. if we don't, they'll soon control everything; news, information, our data, elections. hawley 's demand for a public hearing comes after google's ceo tried to do damage control, writing a letter admitting that they messed up.

quote, i want to address the recent issues with problematic text if image responses in the gemini app. 9 i know that some of its responses have offended our users and shown bias. to be clear, that's completely unacceptable, and we got it wrong. we'll review what happened and make sure we fix it at scale. but google's gemini is not just catching the eye of lawmakers. state attorneys general general are also saying tech platforms should be held accountable. >> it creates an opening to sue might be -- suppose that on facebook or some other platform there's something that slanderers you or libels you. that might be something you could sue for. >> reporter: and, liz, congress really is not -- has not passed any meaningful tech regulation in recent history. and any regulation that they would pass is mostly reactive. but repealing section 230 would be proactive, a way for lawmakers to make sure tech companies have to think first before releasing products because they could get sued. liz? elizabeth: hillary vaughn, really interesting.

know, google, facebook. microsoft is reportedly probing its own artificial intelligence co-pilot. co-pilot told users, for example, claiming to suffer from ptsd, quote, it didn't care if you live or die. and the chat bot accused another user of lying and said please don't contact me again after this person was sharing information about their depression. when you have, you know, these tech companies that basically are responsible for a lot of the return on the s&p 5050 and the nasdaq, how do you make a return then if you don't invest in them? >> well, it's a great point, liz. and what we do is we overweight other company. and certainly, we can't eliminate the whole tech sector to get performance. we are doing do our to get performance in line with the s&p 500 while not giving to the worst performers when it comes to the woke liberal agenda that a lot of these company are practicing. and so we do have tech companies

you know, decriminalization of drug use, you know, de-- busting down into misdemeanors felonies, repeat offenders set free with no bail, murders, robbery, rape on the rise in baltimore, chicago, san francisco, new york. and, by the way, congresswoman, if they're so great, why have so many weak on crime prosecutors either have been ousted or left office even after getting millions of dollars in donations from billionaire george soros? >> that's exactly it, liz. and you think about the fbi crime statistics a alone, you have 44% of all agencies out of 18,000, only 44% of all law enforcement agencies in the country are reporting their crime data, and it's still hoeing that violent crime is on the rise. that is a massive problem. and that has consequence withs beyond just the immediate danger to the community. think about communities where these company like cvs and
