of you on the other side it is a compromise and what the appeals court is doing is not ruling or presuming anything on the merits of the case really but there is a balance that has to be struck. on the one hand there is a presumptive validity to a judgment and a creditor go ahead and begin enforcement efforts before the money is gone or other creditors common. on the other hand there could be the view which is really chilling litigants right to appeal if you take all the assets away from them. david: i just have to ask in some way this is a release relief or letitia james even though she's desperate to get trump scalp. how is she going to sell all of his properties that sounded easy thing to do. >> not at all. >> is low hanging fruit with cash. but mr. trump i assume of asset counseling i'm sure you got the time to figure he's not going to leave all the money right here on the bank at park avenue in

july 7. it's going to be argued in september. if he loses there with the argument yes opportunity to ask to appeal to new york's high court, the court of appeals they may have a view on it as well and i would not rule out the possibility of the supreme court accepting this argument if he loses in the new york state courts, it is an argument that is going to be out there, we're going to watch it closely and who's to say whether it'll prevail or not. >> the whole political nature i know you don't like to get involved in politics but you been to new york a long time and you know how things work. i remember morgan, he was one of the best prosecutors in american history, he was the da in manhattan for over 30 years i believe, he never got political he never went out for somebody he went out for the criminals to find a crime at the great bcci case which he brought down a very corrupt bank in new york, again it was not about getting an individual it was about going
