maria: good thursday morning. thanks for joining us, i am maria bartiroma, it's april 4th. time for the hot topic of they are, department of homeland security re-arresting three of the 8 illegal venezuelans who were squatters in new york city. they were arrested last week on gun and drug charges but they returned to the squatter homes they took over in the bronx after they were released without bail. one of the migrants charged with attempted murder last august. peter doocy asked the biden administration why so many dangerous offenders keep being released back into the community. >> 8 person crew four crossers found guns, six of them are out on bail. does president biden think policies like that are making the country safer?

>> anyone found guilty of a crime should be held accountable. we been clear about that. >> do you think some big cities in this country have a liberal das that are too soft on crime? >> we welcome local law enforcement support and cooperation apprehending and removing those who pose a risk to our national security or public safety. maria: she read that talking point very well. immigration authorities launch to detain a quest for the four other migrant squatters held in local custody, one still is on the the loose. to hear care jp answer with of these talking points speak such arrogance in my opinion because people are feeling this, you're walking around scared you are going to lose your home and she is reading talking points. >> talk about a total disconnect when people are really concerned, you come out and say we are going to change the bail laws, that was then.

the fact that you don't take into account the hundreds of thousands of migrants that have come into this city and it sounded like could they come and get a gun now? they have weapons, they committed these crimes, not being taken off the streets and going into people's houses. this has become so incredibly personal, not a vague notion that crime is getting worse in the city, this is coming to a home nearby you and you made the point, our parents now leaving, they go away and for 22 days then they lose their house. >> you are out of home and property. it is a mess because if you look at this aggregate, the largest transfer of wealth from one generation to the next is that home so it's the dream of the very well-to-do end of every person who was a blue-collar worker on main street that they can transfer

agents arrested 182 chinese nationals in the san diego sector tuesday. they've been apprehended at the southern border this fiscal year and you can see we've got all the years in front of you. in 2,020 one, it was 322, 2,020 to 987. in 2,023 it was 24,000 one hundred 25. this fiscal year it is 22,233. biden campaign ads told the washington post the president does not talk about shutting down the border, he is not advocating shutting down the border. >> the president has the authority to shut down the border and they remind us publicans shot down the wonderful deal to secure the border, they don't want to secure the border, they want as many people to come yearly illegally as possible, you can speculate on the reasons why they want that but there's no shortage of them, trying to turn them into voters in new york city, they realize they

87 and the s&p, 18.4. the dow closed lower yesterday for a third straight day, s&p 500 broke a 2 day losing streak after fed chief powell's comments yesterday. interest rate around 4.3%. jay powell signaled the base case remains 3 rate cuts are coming beginning in june. listen to this. >> reporter: these recent data, and strong but rebounding, inflation moving down 2%. maria: harder than expected numbers. >> i'm not surprised. palace turning everything back to normal.

we've had conflicting data and service numbers are down, and investors react what they are expecting. that's driving movement in the market. that is why think between a great first quarter and expectations that powell was not going to lower rates was what happened with the markets this week. maria: what do you think in terms of the second court. will we see momentum continue you think? >> second quarter, we have a great second half in terms of growth of the economy. it is difficult to keep up the pace this first quarter and there are opportunities in the market and ways to position your portfolio in order to take advantage of where we are.

i would say things like unicycle bonds. i'm not sure about anyone else but i can't see taxes going down. i can see taxes going up at some point in the next 12 to 24 months and if you have a higher tax basis, you want to leave that in a portfolio of tax efficiency and in-depth investing as well and the index of the market, passive investing, getting active management or impact your portfolio and stock collection which we are very positive on, being selective about valuation in companies that have strong potential earnings growth and the fees that are growing and earning, not necessarily the ones that are cutting, you want to see growth long-term. maria: speaking of stock selection, disney is want to watch. the proxy fight against activist investor nelson peltz, shareholders reelecting the

nominees, they did not get peltz and his team two seat on the board, stock is up 31% year to date but pulling back a bit. your reaction to what came down yesterday? >> a case example that exemplifies what is wrong with the stock market today. if you look at the biggest owners of disney stock, you've got vanguard, black rock, state street, combined, they are 19% of disney. nelson peltz's partners on 1.76% of disney. right out of the gates, he is 18% behind. when you look at vanguard, black rock, state street, these are passive etf and mutual fund shops. they should not be actively involved in corporate governance. that's not part of their investment objective, they are passive. when i said those three companies owned 19%, let me be clear, that's not their money, that is our money.

all the viewers at home that have money in those etfs or mutual funds, that is our money. in 2022 there was a piece of legislation that failed to get through congress called the index act. what the index act would have done is would have required the 19% owned by those 3 companies i mentioned, that they pass through the proxy votes to the retail investors that have money in those companies that failed to pass. we need to get back to it because disney had a series of mishaps that nelson peltz wanted to fix. look at the disastrous box office result of 2,023. antman a bust, indiana jones, haunted mansion, marvel's which all best, the other one that was a winner, guardians of the galaxy. go woke go broke. maria: nelson peltz was upset they kept redoing bob iger, the only guy who can run this coming, take him out, somebody

else comes in, not good enough, bring bob back. this is what we are talking about. >> when you look at what michael eisner did until 2005 he was focused on great content creation. bob iger went after lucasfilm, pixar, integrated woke concept in the last few years that backfired. maria: are there areas you want to be in in this soft landing we are expecting which is what the fed keeps telling us that those areas will do better than others? >> look at the valuations, financials, anything that does well when interest rates go down because we know that is coming can. reposition yourself early on. that's where you want to be.

this is a serious investigation, president biden is in a lot of trouble, he needs to answer these questions. the two best options moving forward are criminal referrals and then impeachment. impeachment is still on the table. there is still an overwhelming majority of republicans in the house of representatives that agree with me that president biden has committed impeachable offenses. maria: that was james comber with saying president biden has not responded to his invitation to testify in front of congress. the biden family has taken in $25 million from foreign sources and impeachment is an option. they have yet to identify any actual services the family provided to warrant accepting that money. republicans are now looking beyond impeachment describing the investigation as fizzling.

nancy mase of the veterans affairs committee, thank you for being here. is this investigation fizzling? >> i don't believe so. we are actively investigating. we recently got an american express credit card statement because of information during an op deposition of hunter biden. is there enough votes for impeachment? that a legitimate question to ask. i don't know that the votes are there which is why they are looking at a criminal referral. of folks watched the last oversight hearing, i took time to show how president biden was involved in his son's businesses. i believe he was the closer. every time he had lunch or dinner or a phone call, met with the client of hunter biden, millions of dollars came into hunter biden and the biden family. i consider that play to play, bribery. these are things that take time to investigate.

i commend jim jordan and james comber for the work they are doing. maria: they sent this letter to president biden and in the letter he says the committee has accounted for $24 million that flowed from foreign sources to you, your family and business associates, the committee identified no legitimate services, you repeatedly denied playing any role in your family asked business activities but the committee has amassed evidence including bank records and witness testimony that contradict your position on these matters. james comber told me the $24 million here is conservative. what's the real number? >> we've talked about this. i believe it will be north of $50 million, more time to add it up and have the bank records, the reason there were so many bank accounts is they wanted this to be complicated and didn't want to be found out, they wanted to make it difficult if anyone was going

to investigate and i sat there during hunter biden's deposition, and the testimony of hunter biden's business partners and business associates contradicts his and his father's position which is why it is stunning that hunter biden for months has begged on bended need to go before oversight and when he gets the chance most recently decides not to show up. there's a reason he's hiding and running and president biden has lied almost every time he's been asked a question about his son's business partners in those meetings. president biden has failed to tell the truth to the american people. maria: to prove this unita winning partner in the department of justice and you know the doj will not pursue this. are you hoping president biden loses the election, donald

trump is in at a new doj takes this on? >> that is certainly an option. i want to see criminal charges regardless who was in charge of the doj because the american people deserve to know the truth. they can go to the ballot box in november and decide whether president biden is corrupt or not and whether they want a corrupt president to continue to be there president because through and through every time we have looked of this we know president biden was involved. we know he was on dozens if not hundreds of phone calls according to business partners of hunter biden and hunter biden has lied under oath about this and president biden lied about his involvement, communist chinese party monies it came to hunter biden, the debate in 2,020, lies from hunter and joe biden and criminal charges are warranted and the american people -- maria: in terms of the money from communist china do you believe that is why president

biden has not reacted to so much undermining of america by the ccp, looking at the chinese citizens club attempting to cross the san diego border, 200 chinese citizens caught attempting to cross the san diego border this tuesday, 22,000 chinese nationals encountered at the southern border since october 1st and it is about 60,000 over the last couple years. is this why president biden hasn't mentioned this? he accepted money from china. are you connecting dots to what's going on in terms of the undermining of the ccp of america? >> it is a fact president biden and his administration knowingly intentionally allowed a chinese spy balloon to fly over nuclear sites in the united states, the entire country before they shot it down. you have to question whether or not what the intention was but certainly there was pay to play

with china, there was pay to play with russia, there was pay to play with 3 ukraine and romania. all that is there and evidence even though the mainstream media denying any of it, right there in black and white. maria: a wall street journal polls shows donald trump leading president biden in 6 of the 7 swing states, arizona, georgia, michigan, north carolina, nevada, pennsylvania but first lady jill biden is getting defensive about these polls, she says she's not buying it. watch this. >> i feel that joe will be reelected. >> when these polls like the wall street journal, he's losing the battleground states. >> is not losing and all the battleground states. is coming up and even doing better. once people start to focus in and they see their two choices it is obvious that joe will win this election. maria: is it that obvious? >> not at all, not one donald

trump is winning 6 of 7 battleground swing states in this country and we are talking about the economy, taxes, spending, the border, immigration, donald trump is up higher than he's ever been over president biden on the issues that matter to voters and i will tell you i represent a purple district, the number one issue we are seeing for voters in our district is immigration and border security. followed sharply by the inflation spending woes our country is facing in through and through donald trump is winning on issues. maria: on the business at hand, where are you on mike johnson? do you want to see change in terms of the ucrs? marjorie taylor greene says she's ready to take a motion to vacate the chair? where are you on this issue? >> i don't support the motion to vacate. the motion that was filed wasn't privileged so we are not even going to vote on it and mike johnson was doubt that

expected to focus on the green energy plan and trade relations, yellen making brief remarks yesterday had of those discussions. watch. >> my trip to meet with my counterpart should be seen as a continuation of the dialogue we've been engaged in and deepening ever since president xi and biden met in bali. president biden charged me with attempting to stabilize our economic relationship, to deepen our communication with the degree that it is important to both of us, that we don't want to decouple our economies, we want to continue and we think we both benefit from trade and investment but it needs to be on a level playing field.

maria: looks like the dialogue is 1-sided. just hours after president biden spoke with xi xinping on the phone tuesday china sent dozens of warplanes and naval ships around taiwan. joining me is senior policy advisor and former senior advisor to mike pompeo, merrier kissel is here. your reaction to another trip janet yellen is taking, has taken, on the ground in china. i don't see them coming here all the time but feels like the us is begging for this relationship with beijing, feels like it is 1-sided. how do you see it? >> great to be with you. we need to unpack what the treasury secretary just said. she used the word dialogue, that was the catchphrase of the obama administration, lots of strategic dialogues but what we should be focusing on is china's behavior and that is only worsening with things like the counterespionage law, the

detention of foreign nationals including dual citizen chinese americans, raids on american businesses. that's one aspect of this, you have to look at their behavior but secondly, she mentioned the word decouple, china's trying to decouple from the united states, while it is nice the treasury secretary says that, it doesn't really reflect the reality of the relationship. thirdly, the biden administration has made a huge push for electric vehicles in the united states. that has made us more dependent on communist china because they are makers of car batteries and cheap chinese cars which by the way are creating a problem there. so she's going to fix problems of our own making. maria: yesterday we spoke about this and one of my guests

mentioned the fact it was senator haggerty from tennessee mentioned china is building what looks like a porsche to complete with chesler. this is exactly what john radcliffe has told me the strategy of china is, rob, replicate, replace, that is what they do. do corporate ceos not get that? >> many corporate ceos do get that. many clients are left diversified and gotten out. looking at the foreign investment numbers, they've dropped to the floor. the reason xi xinping, general secretary, i hate when they call him president, he was not elected. general secretary xi jinping is desperate for foreign capital because the measures he has taken in china are destroying their economy. he needs us more than we need him. it is odd to see us government officials acting as if the relationship is the other way around. instead of going and being a

supplicant to china, don't know what she will do on a four day trip and tell the chamber of commerce in china. instead of doing that, we should be using an offensive strategy to go and open up trade with our friends, to put incentives in place for american businesses, to diversify their supply chains which many of them are doing. we saw that embarrassing trip last week with the qualcomm ceo and feudal, at the end of the day china's strategy is to decouple from us, the dual circulation strategy, we talked about this on your show before. that's just the reality. so you see that sinking in with the fti numbers, the us government if it wanted to do something helpful could put tax incentives in place and trade deals that would aid the process but that's not what they are doing. maria: maybe the mission is to shore up chinese finances and

the perception that it is not a good place to invest. go ahead. >> it is just a confused policy. we haven't got to the point we are treating china as the enemy that it is. a dialogue with beijing, we need to have a military dialogue with beijing, not an economic dialogue to bailout xi jinping. we are looking at a country before hundred nukes, biochemical weapons programs, hypersonic missiles, they attack our satellites every day. soon they will have the world's largest air force, the world's largest navy. these are the problems we need to address with china and we need to not make this about the us and china. that's not a point. china wants it to be about the bilateral relationship to make us the bad guy but china's vision is to become a global hegemon, that means not just against us but against the free world. that's the context here. we need to use our leverage, defend american interests and talk about the things that

really threaten us. on the economic side as i've been telling our clients, it's not going to get better. there trajectory is only going to get worse so take action now and get out of there. maria: hope she went with the food taster, last time they went to china they fed her psychedelic motions and she laughed about it as if it was no big deal. imagine if there people came here and we fed them psychedelic mushrooms. what that would do. it's a real thing. >> it is showing their dominance. we got the us ambassador taking tourist photos going around the china. not bad to have a dialogue but we need to get something in return for it. to their credit, they kept the trump tariffs, to their credit they expanded the quad but a lot more needs to be done. maria: let me ask you about israel. president biden and benjamin netanyahu will speak on the
