8:01 am
back good wednesday morning thanks very much for joining us. i'm maria bartiromo. it is wednesday, may 289. it is 8:00 a.m. on the button east coast time for hot topic of the hour former president trump new york trial at 10 a.m. this morning everyone judge merchan will give instructions lydia hu live from new york state supreme court right now with the story lydia. >> yeah.
8:02 am
good morning there maria, this six week trial culminated yesterday in marathon day of closing arguments jurors sat until 8:00 pm to hear 8 hours worth of closing remarks, five of them came from prosecution, now under new york law, it is practical that defense attorneys go first, so defense attorney todd blanche addressed jurors first up reminded jurors this is quite simple about documents whether they've been falsified he argued to jurors there is no evidence that documents have been falsified in this case, planch honed in on michael cohen calling prosecution emembattled star witness human embodiment of reasonable doubt they concededed michael cohen has baggage with track record of lying but prosecutors still
8:03 am
insist he should be believed, some experts say prosecutors used the judge's long leach for help in making their case to the jurors yesterday just merchan allowed repeetdz references to 2018 guilty plea to federal campaign violations, listen to this. >> defense objective merchan just -- overruled it allowed the prosecutor to repeatedly state that the federal election violations by trump are a fact. and that there is not any dispute to that. and merchan just sat there he was, as useful as a ficus plant. >> court takes off 10:00 a.m. at that point the judge will issue his jury instructions should take an hour, means case should be sent to the jurors for deliberations around 11:00 a.m. this morning after that we are on verdict
8:04 am
we have to see how the 12 members of this jury are going to decide this 34 felony counts that have been charged against the former president maria i send it back to you. maria: lydia hu in new york joining us for the rest of the show rest of the hour big money show co-host brian brenberg, great to see you. thank you so much for being here i know you've been tackling this on your show all week. >> it as i franken stein case legal theory nobody can understand, nobody can trust looks like judge putting thumb so hard on scales to prosecution might sprain his thumb that is where we are in this case they trot out robert de niro yesterday to talk about what's going on here it looks like day desperation this case oozed, you have five hours of closing argument, what does that tell you as a jury when it takes them that
8:05 am
long to bring this case to landing what it tells me is they don't believe in their case they are just throwing spaghetti at the wall at this point, so a to me jury goes back, i don't see how you get unanimity on conviction i don't see on acquittal either strikes me like a hung jury situation maria, that i think is actually the worst the thing for the prosecution because looks like the mess it came in as. maria: , if a hung jury we leader from the former federal prosecutor on set with us said they are going to do another mistrial before elections go over this all over again. >> they may do that. >> -- that profoundly works to the advantage of donald trump, because if it looks like they're going to throw this at him again and again and obtain american public who don't
8:06 am
understand this case to begin with say they are obsessesed with him not justice with them that is a winner for him actually a political win. maria: i mentioned, de niro let's take a look at that bizarre press conference yesterday after weeks of avoiding trump trial biden campaign showed up yesterday outside the courthouse, for event of their own, took jabs at president trump with help of robert de niro. >> i love this city. i love this city i don't want to destroy it. donald trump wants to destroy not only the city, but the country, and eventually can destroy the world. i owe this city a lot that is why it is so weird that donald trump is just across the street. he doesn't belong in my city this city is pretty

accommodating we make room for, not a person like trump eventually runs the country, that does not work. >> trump is going to destroy the world? trump does not belong in new york city? the guy -- built some of new york city, look at skyline after the event de niro began lashing out other trump supporters, watch this. >> trying to be gentleman in this world democrats you are against them you are against them -- [bleep]. >> -- -- [bleep]. maria: wow. . trump derangement sympton somebody derangeed. >> trump derangement syndrome on professionally seeing on tell visitation firsthand we lied de niro in 90s in good fellow today showing american

administration for ignoring questions doubling down on plan to welcome refugees from gaza into the united states white house says it has already helped more than 1800 people leave gaza, with many of them coming here to u.s. state department responding to alert from senator ernst about its plans for refugees claiming quote any individuals from gaza who have travel or would travel to the united states are thoroughly vetsdz as safety and security of the american people is our top priority, joining me now woman here's iowa senator joni ernst, senator what do you make of that response to your letter? they say the safety of american citizens number one priority yet the actions don't prove that given the wide-open border. >> exactly, maria. thank you for having me. we have flared the administration, that they want to bring thousands and thousands of people from gaza, into the united states, and
8:15 am
this doesn't make sense to me if we look at afghanistan, follow fall of afghanistan we saw supposedly vetting a number of afghans allowed into the united states but investigation since then we've seen horrible failures, without being processed so take people displaced allow them to come into the united states, i think is fool's er ands risks our national security. so there are a number of countries much closer to israel where these georgians could be evacuated to if truly concerned about their safety the state department should be working with other arab nations potentially allowing gazans to enter i am concerned about national security this makes no sense to me. >> they said anyone travels here getting vetted thoroughly
8:16 am
they used that word thoroughly do you have any idea how vetting process is taking place. no maria, not come to brief us in congress, so i think the president is throwing this idea out there, of course, close to general election perhaps will appease some folks hamas supporters those folks on the very far-left bring them into this is camp again, we are risking national security bringing these folks in, until they explain how they are going to vet these people, we should not allow them to enter into the united states brian brenberg brian: what scares me you said 1800 refugees into country before you wrote the letter the process is already in motion, and if you were to pick up on it nobody would have picked up on it tells me it is probably more than 1800
8:17 am
probably half million ways that we don't even know how do we get a handle on the administrative state that does what it wants when it wants it doesn't want anybody to find out about it. >> that is all very, you look at the southern border as maria pointed out we have people that are poring into this country not vetted, there are millions over 10 million people that have illegally crossed into the united states. so do i think that the state department is thoroughly vetting appease fem from gaza no, i don't believe it i think the goal to admit as many people as possible, under dark of night, but we can't allow that. maria: why? what is the goal? >> well that is a good question. you would have to ask biden administration i think we can speculate all day long as i

8:19 am
don't want to see israelis as we say smash into rafah with large units over large pieces of territory. we still believe that, we've seen seen that at this point but going to watch this, of course, very, very closely. maria: yeah, watching it closely, senator but new york congresswoman alexandria ocasio-cortez is claiming israel's rafah attack was done in open defiance of biden's red line calling for president suspend all military aid to israel right now, senator we know, that already the biden administration held back weapons. >> yes. this is a concern to me is that here we are as united states of america dictateing to another country, how they are going to defeat terrorists. i am certainly -- would be adamantly opposed if another country came into the united states of america how we should debate terrorists, israel has a right to exist we know will always be threatened
8:20 am
as long as there is a thread of hamas remaining, so i think the president needs to back off of this but, again, here he is, just, allowing the far-left to dictate to him what he says and does in support or not in support of israel. we need a new president, we need a president that will support israel, their rights exist. >> senator i am curious if when you look at biden administration response here, if you see some failings in our ability to get the military where it will needs to be with gaza pier sayings failure or bad situation or military not prepared. >> i think our military is always prepared, god bless them, we have the best servicemen and women anywhere in the globe they will strive to do best they can being with whatever task they are given unfortunately this was a

fool's errand the president, humanitarian aid into gaza that is noble we know as that is delivered going to be taken by hamas, it will not get to the palestinians that are most vulnerable, it will not get to palestinians women and children we know hamas is taking it i think this was an projection by this very week president to try once again show far relatively he has a heart but unfortunate we know the realities of war, in war those that are strong are -- taking from weak hamas as i terrorist organization. and they will continue to prey on innocent palestinians that means taking everything that palestinians need for themselves. >> senator you are the ranking member of the small business committee wanting more
