different loans and mortgages taken out, $4.2 million in cash taken out. john is working on the documents. mark, looks like they were take ago credit line on both homes every 17 months. we can confirm, we tried to independently verify and couldn't get all the documents, but we confirm there have been numerous mortgages and actions on the delaware property. what do you think of all this, mark? >> what bothers me the most, coming to running our business in the country, joe biden seems like a simpleton and his opinions is the most labyrinth of schemes and even the brilliant john solomon has trouble following, 35 shell corporations and 35 mortgages and donald trump never had as many mortgages as joe biden. most scandals can figure it out, menendez, i need money and here's regulation. biden we can't figure out what he's up to with these things. liz: stay on that for a second. what mark just said, john, it's

unclear how exactly these 35 loans are being paid. john, this is just speculation, but bear me out, senate and house reports they set up, hunter biden and his business partners, multiple off balance sheet shell companies to take in cash from overseas and from places like china. could money from those shells be used to pay the mortgages then joe gets second mortgages where the interest is tax free only if it's used to buy or improve a home so tack out those lanes often and get the homeowner tax deductions and keep the loan money and maybe that's what's going on? we don't know, it's speculation. what do you think? >> yeah, listen, that's exactly what james comer has been trying to do with the bank records i think, thus far haven't found that level or pat congressperson have found things like money coming from james biden after getting paid from china and going to joe biden and marked as a loan and no paperwork showing there was a loan. if not a loan, what's that money for? income, tax dodging, help buy a house? keep in mind another thing, in

2017, right after he left office as vice president, joe biden paid cash for a beach house. i think it was about $2.75 million. that was the number. not many people can shell out middle class joe elsewhere in america. can't shell out $2.75 million for a beach house and there's a lot of questions about how did joe biden get so wealthy on a public servant salary and those are all big questions that comer said he'll answer. see if he'll get answers at some point. liz: wonder if house impeachment managers can subpoena these bank records and see what's going on; right? maybe that'll happen. you guys are great tonight. thank you, mark simone and john solomon. we've got former deputy i assistant tom dupree and big legal warnings that the big supreme court ruling hitting the 2024 race and ruling on form riprap's claims of immunity from criminal process -- former claims of prosecution and we'll

former president trump's claims of immunity from criminal prosecution could hit jack smith and other cases, it is looming over the debate tomorrow night, what do you think happens. >> this is an amazing cosmic coincidence of ports, something never -- sorts something never before seen, leading two presidential candidates debating over a supreme court decision that will probably come out tomorrow morning in real-time, the stakes couldn't be higher, if the supreme court decides this case tomorrow morning, that is topic a at the debate tomorrow night. both sides trying to interpret that decision in most favorable way. if supreme court does not decide it, it will decide it friday morning, tomorrow night's debate will be a preview of coming attractions. >> why do you think it coming out tomorrow morning. >> court puts its most important cases at back end, it will either be tomorrow or friday, can't know for sure, my money has been on

tomorrow, i don't think they will leave it for last day of the term, at the end of the day none of us knows what the supreme court will release this decision. >> what do you think they will rule? supreme court has ruled former presidents cannot be sued in civil cases for what they did in office but they never weighed in on criminal immunity. >> right, i think they will come down somewhere in the middle, i don't think they will grant trump the blanket immunity he wants for everyone but i believe they reject jack smith 's position that he has zero immunity. they will say, it is okay to prosecute for private conduct but not for public. it will be a difficult line to draw, it will be left i think to lower courts to apply it. >> how does this hit the public and private conduct. how does this bridge the

cases -- hit the cases brought by jack smith. but maybe liable for what is not their presidential duties. backing up, could it be that the high supreme court just kicks the case to lower courts to help draw that distinction. >> i think that e court will articulate the rule but leave it to lower courts to apply the rule in the context that these facts and these cases, that is where the hard work will come in parsing the allegations in jack smith's c complaint. >> if they kick it back down to the lower courts it could be a win for trump, he wouldn't go to trial until after the election, and biden, wanted to bring up the cases in tomorrow's night debate. >> that is right. i think if the court does the way i think they will go i think that trial before
6:00 pm
the election is a virtual impossibility there is no way that the trial judge could go through all of the allegations, figure out which can be prosecuted and then give trump time to prepare his defense before november. i don't see that happening. >> tom, we're on new ground here before. tttom dupree thank you for joining us. we'll stay on more news for you tomorrow, it is debate night, we have congressman john james and steve forbes will join us and jason chaffetz, taking on the issues that affect the viewer, folks out there, middle class, working class voters you name it, it is about you the viewer, i am elizabeth macdonald thank you for watching "the evening edit" on fox business, right now we go to "the bottom line" with dagen and sean. >> thank you, emac. >>
