thank you very much. always a pleasure. let's get to the breaking news that the secret service had been ramping up security for weeks for president trump before the rally where the president was almost assassinated. why? because homeland security got intelligence of a plot out of iran to assassinate trump. fox news david spunt standing by live at the justice department with the details this hour. david? reporter: hi, liz. three federal law enforcement sources confirmed to fox news that at some point in recent time, there was a threat from a confidential human source to the department of homeland security about an assassination plot involving the iranian regime and donald trump as the victim passed from homeland security to the secret service. the secret service falls underneath the department of homeland security umbrella and apparently, donald trump security was increased, the secret service was increased over the last few weeks and months. critics are asking how that's possible given the fact he was

almost assassinated himself and almost lost his life during that terrible shooting on saturday night. i do want to point out the fact that thomas crooks, the alleged shooter the 20-year-old from pennsylvania is not believed to be involved in any way with this reported plot coming out of iran. there's no connection. we just happen to be learning about this today. we also can report, liz, the department of homeland security has been concerned with the trump team as of recently because of the amount of events they do outside in open areas. as you know the former president likes to get out and meet the people, see the people, often does unannounced stops somewhere. it makes them nervous, so we don't know if that security plan is going to change a little bit. there's always a little bit of tension between any campaign and the secret service but i'm told this one has been growing in recent weeks because trump has wanted to do or at least his campaigns wanted to do so many outside events, but this iranian plot is earn canning. i will note that there has been a threat stream against donald

trump as one source says from at least january 2020 when he ordered the killing of iranian general soulemani. there have been multiple threats on trump's life but this specific threat has garnered attention in the intelligence community and the law enforcement community and they felled they needed to do something, liz. liz: david spunt, terrific reporting thank you for bringing us up-to-date. let's bring in for reaction the federalist editor and chief and fox news contributor mollie hemingway. so let's break this down. a threat that is known against trump from iran to assassinate him, so the secret service could not secure a building less than two football fields away where the potential assassin took shots at the president? and now, the head of the secret service said they could not put agents on the roof of that building because it was too sloped. mollie, it's less sloped than a bunny hill and the counter sniper team would took out the shooter was on a much

steeper roof. what is going on with the security failures around the president? reporter: yeah, this story keeps going from bad-to-worse. this claim at a sudden revelation of news about iran seems a little bit like cya, while we are looking at all of these failures, at-best, that led to the shooting of president trump. today, you had the secret service director claim that the roof slope was too serious to actually put agents on. it is patently absurd. it is obviously untrue, and it's unclear why someone would say something that is so obviously untrue to all americans. you also had the weirdness with the security perimeter that had a little carve-out in the area where the shooter was positioned, and even you also have all this news that people were alerted to the threat and yet president trump was not removed from the stage. you have had nobody resign. you had nobody fired. president biden should have said immediately he's lost confidence in his secret service director that he asked for and received

her resignation and instead he doesn't even know who the secret service director is. liz: yeah, the president said it was a him. it's a she. we're going to get to that later in the show. okay we'll stay on what's happening with the security failures around the president. let's move on to this. there was thunderous applause for the president last night at the rnc as he came there, so nikki haley, florida governor ron desantis, they are going to speak tonight at the rnc. what's your take on what's been happening? reporter: well, i've covered a lot of conventions both republican and democrat and this one is definitely having a different feel. people are very excited to be here. they were very excited to see the president and they feel very unified even as these convention speakers are showing quite broadly they are showing the republican party is maybe broader than a lot of people thought it was previously. today is focused on security and issues related to crime in cities, the problems posed by some criminal elements and the illegal immigrant community

and those are big issues for republicans heading into the election because of how biden has opened the border. liz: we're showing images of nikki haley and ron desantis. they are expected to speak tonight. it has been quite a few weeks for president trump. a judge tosses out his classified documents case. you had president biden's botched debate. the supreme court immunity ruling in his favor and then he picks j.d. vance as his runningmate. let's watch this. watch. >> he just said look, i'm going to go save this country. i think you're the guy who could help me in the best way you could help me govern, win, you could help me in some of these midwestern states like pennsylvania and michigan. i don't hide from that. i was certainly skeptical of donald trump in 2016 but president trump was a great president and he changed my mind. i think he changed the minds of a lot of americans because again, he delivered that peace and prosperity. i bought into the media's lies and distortions. i bought into this idea that somehow, he was going to be so different, a terrible threat to democracy. it was a joke. joe biden is the one whose

trying to throw his political opposition in jail. joe biden is the one whose trying to undermine american law and order. >> a single mother who works two jobs to support my family. i know americans can relate when i say that every time i fill up my gas tank, go to the grocery store, and try to pay the bills, i think who doesn't miss the trump days? >> [applause] >> in addition to the economic pain, the democrats open border policies have shattered my family. liz: that's a single mom speaking last night. your reaction, molly. final word. reporter: well, i think j.d. vance does speak to this change in the republican party that has been accomplished over the last eight years or so. a concern for multi-racial, multi-ethnic working class group of people and that appeal will help in the short-term but it also shows that trump is interested in building a permanent legacy of that make america great again movement and that j.d. vance is weapon for that as well.

liz: mollie hemingway you are terrific. pleasure having you on. great to see you again let's get to this story. we'll stay on the story of former president trump and his runningmate senator j.d. vance at the rnc focusing on crime, the economy, and making america safe once again. let's get to grady trimble live at the scene at the gop convention in milwaukee. grady nice to see you. reporter: nice to see you too, liz. the democratic mayor of this city tried to get ahead of what we'll hear from republicans inside that building behind me tonight. he held a press conference this morning downplaying crime and saying that it's actually a winning issue for president biden rather than former president trump but the slate of speakers we'll hear from tonight i'm sure will offer a forceful rebuttal to that. here are a few. the list includes a handful of trump's former opponents in the gop primary, perhaps most notably former south carolina governor nikki haley who stayed in the race the longest and we

actually didn't know she'd be speaking here until after the assassination attempt on former president trump over the weekend. in addition to those politicians, we'll also hear from relatives of victims of migrant crime and advocates for criminal justice reform, and while we will have to wait until wednesday for trump's runningmate to speak, senator j.d. vance told shawn hannity why stopping the flow of fentanyl across the border is such an important issue for him. >> we have to talk about the fentanyl problem because this is something that i note extremely personally and we have close to 100,000 americans dying of drug overdoses every single year, most of it is brought in by mexican drug cartels manufactured in china brought in by these cartels. reporter: and a little bit more on what we're expecting to hear from former south carolina governor nikki haley tonight. we expect her to appeal to voters who are uncertain about trump. she certainly was trying to appeal to that voter in the primary, but now she says

you're protectee leaves the venue bleeding from a gun shot wound you've got to talk about the failures and certainly there were failures that occurred. there were also some successes. i think we saw the trump detail the agents right around the former president act heroically, jumped up and got in the way as bullets were flying and we saw a counter sniper team that ultimately did their job and did it effectively, but it certainly is hard to not use the word failure when your protectee is struck by a sniper's bullet. liz: we understand secret service agents really care about their jobs. critics are saying why wasn't a building less than two football fields away secured where the shooter took the shot at the president and the head of the secret service said they could not put agents on the roof because it was too sloped. again it's less sloped than a bunny hill, a ski hill. the counter sniper team took out

the shooter on a much steeper roof. does that excuse play? >> yeah, i don't think so. i don't think that be the reason why personnel weren't put on that roof and certainly, when you go out to do in advance the architecture of that security advance is going to look different every single day, every single venue that you go to. you go and secret service is very collaborative in their nature, so your collaborating with state, federal, local law enforcement to effect a security plan and so how you secure that building is going to look different than maybe a different venue in a different city, so i really don't know what they did to secure that building. obviously, they didn't prevent anyone from scaling the building with a rifle and getting rounds off into a secure area, so i'm very proud of the reaction by secret service agents surrounding president trump, but prevention is the name of the game with security, and

obviously, that was not prevented. liz: yeah, the news that law enforcement were inside the same building as the trump rally shooter who got up on the roof, that he was spotted about a half hour before he opened fire, no one stopped him until it was too late. the question is, did trump security team have enough resources. there are multiple probes facing now the secret service faced that. if trump was assassinated this would have triggered a national crisis of historic proportions. watch the head of the secret service in an abc interview. watch this. >> the president and homeland security secretary said today they had 100% confidence in you but there are some members of congress calling on you to resign. >> i appreciate the secretary's comments and we're going to continue to be transparent and communicate with people. >> do you plan to stay on absolutely? >> i do plan to stay on. liz: she plans to stay on. she's going to testify before congress. if you were to ask her questions, kenneth, what would you ask her? >> well, i really want to know

and ensure that the priority of the secret service is protection. this is what we do for a living. we protect a limited number of people at the highest parts of our government. liz: but sir, forgive me i'm so sorry. why would you feel the need to question that? >> because i think priorities are the name of the game. that is what's going to drive the resources that you allocate for the mission. it's what's going to drive your personnel. when you lead by that example, so i think what your priorities are are critically important in your role in leadership. liz: you say they don't have their priorities right, that they're not protecting the president enough? >> no. i'm saying if we're going to question whether or not she should remain in that position, the question is in her leadership what are your priorities? and if you don't have your priorities right, then we need to put someone in there who does. liz: too much dei? >> well, fine question. you know, i've been gone for four years, don't know about

liz: welcome back to the show. joining us now fox news contributor and town hall.com political editor the one and only, the terrific guy benson. guy, it's so great to see you again. wonderful to have you back on the show. hey, liz. liz: guy, what do you make of this news that joe scarborough threatened to quit today after msnbc pulled his show, the morning joe show on monday. they were saying they could get somebody else to host the show so guy, what does this move tell you about what nbc leaders are thinking? >> i have no idea what they're thinking. this is bizarre. this at least looks to the world and media watchers like the brass at nbc or msnbc don't trust their own

signature shows anchors to handle something like an assassination attempt appropriately, and, you know, in a subtle, thoughtful way, and i'd seen some of the social media posts over the weekend from joe scarborough and others that seemed appropriate. i don't know exactly went on behind the scenes but this was a very public, at least appearing humiliation of some of the top-most sort of famous serious at least by that network standards anchors they've got and i really don't blame them for being pretty mad about it and then coming out and kind of going off, back restored to the air the next day, and using that platform to go after their own bosses, obviously i don't think this was thought through terribly well. liz: they really attacked their bosses today on the air. it was really an unusual moment. and then there's also this , guy. we're going to move on to this story. we don't know if the following

tv hosts and pundits in the media have been talking to the biden campaign, but guy, we like to get your reaction. you're going to hear them pretty much repeat the same democrat attack lines on j.d. vance, president trump's now runningmate. the same attack lines that we've heard from the biden campaign that j.d. vance is inexperienced in government or extreme. watch this. i do also love the republican ticket is now a real estate developer and a venture capitalist. >> they picked someone who has quite a lot less experience than she did even when she ascended to the vice presidency. >> he is a radical authoritarian. >> he's now picking a vice president whose pledged 100% loyalty to the cult of donald trump. liz: what do you think, guy? is the media picking up the biden campaign attack lines on j.d. vance? >> i mean, the media repeats the democratic party line on everything always, so of course. i mean, it's like it's a mind

hive. this is what they do. they were all waiting around to see who trump was going to pick. no matter who it was they had their attacks prepared. i think some of them would have been harder to attack than others but setting that aside, once the sort of party line goes out on social media and you see a few ads they put out on social media and certain journalists spring into action digging up certain quotes or whatever they all work together. this is very much part in parcel of what we have seen from the left, which includes very much the democratic party, and almost all the news media working together, hand-in-glove which is the default setting. it's only almost news worthy and surprising when they don't. when they were clashing, for example, recently over joe biden's fitness and whether he should stay in the race. that's the aberration. that's the abnormality. this type of thing is just par for the course. liz: the other thing too is why,

so what that it's an entrepreneur and a venture capitalist when we have a leader whose been in office for 50 years. the border is in a state of collapse. we've got crime. we've got deficit-fueled inflation ripping through american households. we're tens of trillions of dollars in debt. social security and medicare is on the brink. he's been there all that time and didn't make any of the fixes to stop it and in fact people are saying he made the situation worse with things like electric carman dates that people can't afford that are destroying the auto sector so there's, what do you make of that analysis and where is the analysis that j.d. vance, you know, he can take on how biden's policies have hurt the working class with inflationary spending. that it's going to reinforce trump's strength in the industrial and midwest states, he lost to president biden in 2020. >> well i think vance does have to prove himself. most people have never heard of him. they might have heard of his best selling book. most americans have no idea he's

try five hour energy today. liz: welcome back. okay, we love having on gop pollster lee carter. she's really smart and a great writer. great sharp analysis. great to have you back on, lee. it's gooded to see you again. so, we got this new report out of politico. nancy pelosi is still working behind the scenes. working the phones to get biden to dropout saying that "biden's legacy cannot be destroying the democrat party." lee, is what pelosi saying borne out in the polls that you're seeing? >> well i think there's some big trouble there about 56% of democrats now believe that biden should dropout of the race.

that really gives weak support among his base and when you look at the swing states, really important he's not doing well. he's not doing well in pennsylvania. he's not doing well in the states that he really needs to be able to win in november if he wants to win the election. now the polls aren't as significant as many of us would have expected but i think after this weekend's events and then after the whole convention of this week we're going to see even more of a separation between donald trump and joe biden and it's very clear, i think, to most voters that joe biden isn't up for the job and he hasn't done that and with the voters i've been talking with many have very valid and very real concerns about the president's ability to fulfill a second term. liz: you know, so the question now, the strategy has been, lee, do more tv interviews one on one, but lee, you've got to wonder if this interview with nbc lester holt helped or hurt biden. let's first sit back.

let's watch the president claim he's not using overheated rhetoric, to attack trump and separate from that you'll hear president biden indicator claim he was "a bystander in charlottesville" at that march he's criticized trump over. he was not. then you'll hear the president get aggressive when questioned about his confusion at the debate with trump. listen to this. >> called your opponent and existential threat on a call a week ago you said it's time to put trump in the bullseye. there's some dispute about the context but i think you appreciate -- >> i didn't say crosshairs. >> have you taken a step back and done a little soul searching on things that you may have said, that could incite people who are not balanced. >> look, i've not engaged in that rhetoric until i watch what happened in charlotteville, virginia. those folks coming out of the woods with torches, singing

the same nazi accompanied by the kkk, and i was a bystander. >> what happens if you have another episode like we saw during the debate? >> what happens? >> what are you seeing what they saw which was moments of frankly of it appeared to be you appeared to be confused. >> lester, look. why don't you guys ever talk about the 28 lives he took. where are you? sometimes come and talk to me about what we should be talking about. okay the issues. >> is it acceptable you still have not heard at least publicly from the secret service director? >> oh, i've heard from them. liz: um okay, lee. the secret service director is a woman. his tv interview is not working. lee just sit tight for a second. we've got news coming in. a substantial number of congressional democrats refuse to do an early nomination of biden as early as july 21 by way of a virtual roll call.

they are worried about him at the top of the ticket. they say this will stop them from naming someone else. lee, what's happening here? >> i think what we're seeing right now is that the democratic party is really split and there are people who are standing by joe biden and i think he's got some support there but there are some significant number of people who don't think he's the one that can win this election. in fact they think he's going to cost the election and what's such an interesting dichotomy in this moment is to see the two different candidates where donald trump used to be the very divisive candidate and now he's uniting the party more than 90% of republicans are excited to vote for donald trump. we see nikki haley even coming to the convention right now. the republicans are coming together. meanwhile the democrats are extremely divided. there's all kinds of talk behind the scenes about what's happening but we're even seeing things publicly where democrats are not supporting the candidate that was elected to be their candidate and it's going to be really problematic. they will have to figure this out quickly. liz: lee carter, pleasure. wonderful to see you.

we'll have you back on again soon. let's bring back into the show we welcome former deputy assistant attorney general tom dupree. tom? so let's first get to the news. it's good to see you. the news today that senator bob menendez was found guilty on all 16 felony count charges including briber you, so why did senator chuck schumer keep in mind senate for epidemic foreig, after charged he was getting briefings on the mid east, russia, taiwan, what did you make of the verdict? >> well the verdict wasn't a surprise for those of us who followed the trial closely and i did the evidence was overwhelming and it's not surprising the prosecutors basically ran the table on menendez. he didn't have a defense. the jury saw everything he did in terms of peddling influence, obstructing justice the whole nine yards so the verdict wasn't a surprise. i have no doubt he will try to challenge it on appeal but i don't think he will be successful. this is a jury that took its job seriously, deliberated on it and

looked at the evidence and rendered the verdict of guilty. liz: tom let's move on to this story. do you think special counsel jack smith has a chance at appealing judge aileen cannon's decision to toss out to dismiss the trump classified documents case. the judge said jack smith's entire office violates the constitutions appointments and also the appropriation clauses. what do you think? >> well, i think that jack smith is going to have a bit of an up hill battle. look judge canon issued a decision that frankly was unusual. in other words other courts have looked at this and upheld the appointments of special counsels but keep in mind. her decision was long. it was well-reasoned about 93 pages and most importantly, she clearly took as a guide to her opinion, the opinion written by justice clarence thomas of the supreme court in the immunity case that the supreme court decided a few weeks ago where justice thomas basically laid out a road map identifying his concerns as to why this special counsel, jack smith's appointment was unconstitutional. so i think judge canon actually had a lot more legal substance and legal authorities and legal

precedent in her corner, supporting her conclusion that a lot of people are giving her credit for. liz: and we see analysts at cnn hitting the sealing but it's really constitutional issues case. congress did not create his office. he was not confirmed by the us senate. he was not a us attorney. he was a private citizen called into prosecute a former president. the judge saying this violates the constitution also it gave unlimited funding to jack smith without the approval of congress. so, you know, the judge said smith had unchecked power. you can get into the holloweds discussion about inferior or principal officer, who reports to a.g. garland. the fact remains what's going on in america in the government is from 2001-2016 there was one special counsel. since 2007 there have been seven, so that's a lot of people or maybe since 2017 there have

been seven. 2017. so do we really want administrations appointing special counsels outside of congress to go after their political rivals ad hoc and on the fly? >> well that's the thing. look, our nations recent history shows to your point, we have really had a proliferation of these special counsels. they are so frequent they aren't exactly special anymore and what judge canon wrote was i think very important. you put your finger on it is that this is a constitutional defect in his appointment. she pointed out there are ways you can appoint special counsels, con consistent with the constitution but the justice department didn't do that in jack smith's case and one thing a lot of courts from the supreme court on down are now recognizing is that agencies can't just do what they want. they actually have to find legal authority, constitutional authority, for making appointments of this nature. liz: it sounds good. somebody's trying to keep the government on the rails according to the constitution. so are you tom good to have you on. great to hear from you again. we'll have you back on we hope.
