stand in a federal courtroom in manhattan today testifying in his own defense. a $250 million civil trial that legal experts have said technically have no victims. everybody got paid. he said that over and over again and consistent with the facts. new york's attorney general letitia james claim trump and his sons committed fraud by inflating assets to get cheaper loans and insurance policies. the former president denying those allegations. >> so while israel is being attacked, while ukraine is being attacked, while inflation is eating our country alive, i'm down here. we'll win the election and make america great again. they have to take it away from the thugs and horrible people that must hate our country to do this. >> harris: we'll bring you any developments out of that courtroom as soon as we get them.

>> harris: mike tobin, thank you very much. in "focus" now retired army special forces officer robert greenway, director of the heritage foundation center for national defense and former senior director for middle eastern affairs at the national security council. all of that to say you have specific experience on how to deal with the diplomacy that's going on right now and work in the military piece. let me start with this. 32 attacks against u.s. bases and our military men and women since october 17th in the region. only one response reflects the administration's self-deterrence. talk to me about that. proportionality we should be hitting not just iran's proxies with but anybody else we think is trying to kill our men and women. >> thanks for having me on, harris, you are right. we've been attacked 33 times with only one response. all that does is erode our own

credibility. without credibility all the military assets we've placed in the theater and high-level diplomatic engagement is undermined. words without actions will undermine our position and we won't get the desired results and risk will increase correspondingly. iran is trying to force us to face an internal contradiction. either to constrain israel on the fear of war or to be able to reverse course and recognize that our policy of appeasement and accommodation has failed. >> harris: are we still so great a nation or are we getting over our skis to think israel isn't doing exactly what we have done in the past and what we would do potentially if a neighbor hit us the way that hamas terrorists hit their citizens in israel? >> there is no question but ultimately it's the fear of escalation is pushing the administration to a policy that's most likely to get us at

that escalation. they've convinced themselves the easiest path is constrain israel and ultimately it will fail and israel cannot comply nor would we want them to. >> harris: secretary of state antony blinken has been in the region since friday. he sent a warning to iran while he was in baghdad over the weekend. let's watch. >> i made very clear that the attacks, the threats coming from militia that are aligned with iran are totally unacceptable and take every necessary step to protect our people. we aren't looking for conflict with iran. we've made that clear but we will do what's necessary to protect our personnel. >> harris: let's look at this. lindsey graham and his democrat colleague richard blumenthal introduce a bipartisan resolution that puts iran on notice. let's watch. >> if the war expands, if hezbollah opens up a second

front in the north against israel in a substantial way, ire dome, then we should hit the islamic republic of iran. there is no hamas without the ayatollahs. deterrence is critical. iran is the toxic, malign influence. >> harris: i want to get your thoughts on this. the u.s. military has deployed a nuclear-powered submarine to the middle east now in a further show of deterrence. it made the rare move of publicizing the submarine's movements, clearly a warning to iran. what else does that tell us about what's going on right now in the middle east? >> it tells us we're accounting for the risk by putting in the necessary assets the result of military counsel and it makes sense. the problem is you can't have diplomacy without the credible use of military force. iranians we know from 40 plus years of history they pay no attention to our words if they

aren't supported by actions. we've been attacked 33 times. when secretary blinken was meeting with the -- >> harris: they aren't deterred. >> they are not. >> harris: the word from the president was don't and they are doing everything. they ignored don't. talk to me about what should come next if we want to be felt. is pulling a nuclear submarine and announcing it in a public relations release, is that enough? >> no. we have far more effective engagement if we destroyed the individuals conducting attacks against us, hold iran accountable and threaten to withdraw funding we'd get more attention from iran and surrogates in the region if we did. >> harris: you saw saudi arabia, they may come back to the table and talk to israel. we don't know yet. those were indications that were quiet last week. they didn't make a lot of

world and on college campuses here at home. harvard front and center again in all of this. that's a lot of tuition. wonder what they are actually teaching? no punishment announced for the mob that accosted a jewish student. the school is sure to warn students of penalties for using the wrong pro noun or expressing fat phobia priority. alexis mcadams live in new york city. >> you've been looking into what's going on at a lot of campuses including the ivy league campuses like harvard. it is a big issue so much they say it's abusive that students use the wrong gender pronoun but big powerful alumni are saying the school is not doing enough to stop major issues happening like anti-semitism running freely on that campus according to aloams. this is one of those letters center in the past few days to

harvard. from a hedge fund bill air blaming the university president for her lack of action. on-campus protestors are shouting things from the river to the sea. palestinian shall be free as they knowingly call for violent insurrection seeking the destruction of the state of israel and jewish people. he says that failure to take action puts the school's important sources of revenue at risk. he is not the only one. dozens of harvard alumni signed the petition that called the $1 pledge vowing to not give more than $1 to the school saying the university has lost its way and not done enough to respond to the october 7th hamas attack on israel writing harvard has changed in ways that make it unrecognizable. a campus culture developed where jews feel unsafe. the incident caught on camera at harvard last week. >> investigators say a jewish student was harassed by a group of pro-palestinian protestors yelling and screaming there. that incident was report evidence to the f.b.i. no update at this point. over the weekend harvard's president saying the university will not tolerate any activity that violates the safety of their community members bust it is not just as harvard. a lot of other schools. friday night at the university of massachusetts amherst a student was arrested after investigators saying he punched a jewish student and spat on the israeli flag during a vigil for israelis taken hostage by hamas. with so much going on at campuses across the country including in new york when we've been at columbia and nyu. law firms that are big, important ones will say they offer free services to jewish students who feel they are being attacked, hazed or not supported on campus or facing anti-semitism. that's something we learned in the last few minutes. >> harris: that's great support. alexis, mcadams.

are hearing. >> i've heard hundreds of students chant globalize intifada. it's known to be calling for violence against jews for hundreds of students to just chant this, i want to believe that they don't even know what it means. but it is crazy to me that my peers and professors are chanting this violence. >> harris: david, columbia university, a friend of mine you may recognize meghan mccain tweeted this weekend she is ashamed. can't believe what her alma mater has turned into. >> i can't blame her at all. i want to thank you for having us on and doing this segment. this is something the entire country should be aware of and a national issue. what it turned into is a cess pool for jew hatred and not limited to a small group of people. the faculty and students. radical calls support for hamas.

on the nuance of what is happening in the courtroom. as we hear about things this morning become heated and the judge telling defense counsel to get ahold of their client. as a nation we all have so much interest in what's going on in the courtroom but we're only getting sound bites and bits and pieces. donald trump as he is trying to defend himself is also having to defend himself through headlines and speeches outside the courtroom when what we really want to know are the answers to the questions and the way in which all of those answers are coming out. >> harris: with what you know about this case, what would you say are the points where the president and his defense team really have to concentrate to protect him? >> they have to focus in on the fact that the numbers weren't correct from an accounting perspective in many regards. now, donald trump has come out and defended himself to say his properties are very difficult to put a value on any one of these properties and that you can't do so until they are actually sold. that each one of these companies

had an ability to do their due diligence and nobody has lost money. when it comes to the numbers as letitia james was talking about. some are inconsistent of what a detailed accounting would reflect. that's something that has to be explained. his degree of knowledge about those numbers and what was being submitted all have to be vasheously defended here. >> harris: would the accountants hold culpability as one of his sons said in court. >> don junior made a strong case for the fact he relied upon the accountants and lawyers. i have to agree with him. i think absolutely these are business people who have professionals that they rely on and very normal. at the end of the day it is the executives in the companies signing these documents and there is responsibility that comes along with that. that line in the sand is something that is a very nuanced legal issue. again donald trump i think has a strong case where there are no victims here and there are no losses as a result of the

>> harris: can they fix it? look at these numbers for president biden when it comes to his re-election bid. axios headline sums it up. trump set to romp biden. a new poll shows president biden is trailing former president trump in all but one key battleground state and trump leads in five states. biden only up in wisconsin by a couple of points. if you look down below, that's really just a hair outside the margin of error, 1.8. the president is facing overwhelming concern over his ability to carry out a second term. 71% of voters say he is too old to be an effective president. a majority within his own democratic party agree with that. a "wall street journal" editorial titled a five alarm biden re-election fire. power panel. mark penn, former clinton advisor and polling expert.

david avella, gopac chairman. david, i start with you. too early to probably plan for a different candidate do you think across the aisle? >> certainly president obama is casting his vote. the fact that david axelrod said what he did we know president obama wants someone else as the democratic party nominee. you add to what even the president said this weekend undercutting his own vice president, now president biden's own foreign policy with what has been said. all of that to say, harris, the biggest challenge for president biden is americans believe life is harder and it is his policies that have made it that way. that purchasing power is down. that $1 hundred gallon of gas is 160 because of inflation. the 120 gasoline bill is now up 20%. food bill is now up to $126 over

100. life is harder under biden and americans know it. >> harris: you mentioned the former obama senior advisor david axelrod is now questioning biden's re-election. i want to show everybody what he posted. only joe biden can make this decision. if he continues to run he will be the nominee of the democratic party. what he needs to decide whether it's wise and in his best interest or the country's. mark, that is harsh. is he right? >> look, i was pretty surprised by that post. i think he is right if joe biden continues to run, he is the nominee and only he can make the decision whether or not he wants to make a lyndon johnson-type decision given the world situation. he will devote his time to that instead of election earing. there is no sign of that. despite these numbers, i think they are looking at can they improve the economy, close the

border? he will have to do things to raise these numbers or it is going to be a really tough election. >> harris: 169 people on the terror watch list known to have come into the united states. not just under his watch but in the last fiscal year. all of that with the back drop of two wars. russia going to war against ukraine and now israel having to fight back terrorists and hunt them down after they hunted their citizens, hamas terrorists. key voting groups that backed biden by a landslide in 2020 are now peeling back their support. this is perhaps the biggest sign of a fire in the hole really. biden is leading among young voters by only one percentage point, which means if any of them sits this one out he is in trouble. women still favor biden by a slimmer margin, men prefer trump by double that. those numbers reverse the gender

advantage that has historically fueled democratic victories. biden's lead in urban areas is half of trump's edge in rural region. biden's lead among hispanic voters is down to single digits. 22% of black voters are backing trump. that's a level unseen for a gop presidential candidate in modern times. david. >> this is why the talk of third party candidates is particularly detrimental to president biden especially if he gets into the battleground states of michigan and wisconsin and pennsylvania and arizona and georgia. that it becomes much harder. the path for biden becomes much more narrow. he can't lose any of those states and still get reelected. you made an excellent point about the border, harris, in that as national security becomes more of a concern for voters, until americans believe their nation is secure, that we know who is coming into this country, you add that to the inflation problems that biden
