university leaders. >> free speech is an important part of enlightened self-governance but so is learning the american principles and holding true to those values. there is a difference between rights and what is right. it is sad and disappointing and heartbreaking that after an atrocious terrorist act against the nation of israel and against its people, we can't call it for what it is. >> dana: senator kirsten gillibrand will join us for reaction to rampant anti-semitism on campus and the mind blowing response of presidents. we'll talk to the u.n. ambassadors about the war and the miracle of hanukkah. >> bill: the story is moving and changing by the day at harvard. good morning, there. >> good morning, bill and dana. leading politicians and we just showed some of the leading academics across the country are joining the core use of voices

including students and donors with their loud denouncements of the december monies given by presidents of mitt, harvard and u penn after stefanik asked if calling for the genocide of jews was against school rules. the three women simply did not answer yes. instead equivocating offering lawyerly responses. the condemnation has been clear. the pennsylvania governor said the u penn board has a serious decision to make regarding university president liz mcgill. >> i found her comments absolutely shameful. it should not be hard to condemn genocide. genocide against jews, genocide against anyone else. >> mcgill has set to clarify her remarks. >> i want to be clear, a call for genocide of jewish people is threatening, deeply so. it is intentionally meant to terrify a people who have been
7:03 am
subjected to hatred for centuries. >> gay released a statement writing some confused who have confused a right to free expression with the idea that harvard will harbor calls for violence against jewish students. calls for violence are vile and have no place at harvard. those who threaten our jewish students will be held to account. white house deputy press secretary released a statement saying it's unbelievable this needs to be said. calls for genocide are monstrous and antithetical to everything we represent as a country. any statements that advocate for the systematic murder of jews are dangerous and revolting and we should all stand firmly against them. >> bill: they had their chance. could have been done two days ago. thank you, molly, in cambridge. >> dana: israel's ambassador to the united nations. great to have you. on the campus situation in america your take on the fact
7:04 am
that it took them a day to have to realize they had to figure out a way to clean up the mess they made? >> frightening. i don't believe them. we expected to see moral clarity but we got moral depravity from all of these presidents. that's the reason why i insist on traveling now from university to university and screen the hamas horror footage. if their -- their institution can't support israel. every american should be frightened. >> dana: have you had people coming to the screenings. >> hundreds. they are shocked after they understand who their colleagues and peers are chanting in support of on campus colleges. and i think again words -- i
7:05 am
mean, are not enough right now. we have seen thousands of people chanting in support of these terrorists, supporting the genocide of the jewish people. right now we expect university president to expel students, to fire professors. we need actions. empty words are not enough right now. >> bill: at the moment you have 138 israelis held hostage, we believe seven to nine of those might be americans. their lives and their situation and circumstance gets lost in all this. i don't know if they are still with us. i don't know if they are alive or dead. i don't know if they are coming home yet or not. john kirby made a comment about the international red cross. it is their job to insist with the leaders of hamas to get access to the hostages. he said this from the podium at the white house just yesterday. >> hamas is not allowing red cross in to visit the hostages and it is unacceptable.
7:06 am
one of the things you keep asking and rightly so about the condition of the hostages. we don't know a lot. >> bill: the truth is that the red cross has largely escaped our conversation for two months now. we have had a father on last week he hasn't heard from his son since the 7th of october and imploring the red cross to get verification of the lives of these hostages. it hasn't happened. >> i think that now we commemorate 60 days from the beginning of this terrible war from october 7th and one of our lessons is definitely the u.n. with all of its buddies and agencies is morally distorted and morally corrupted. the u.n. that was founded in the wake of the holocaust cannot prevent atrocities. if anything, they insure atrocities. you gave one example, the failure of the red cross. it is not only the red cross. it is the security council, the
7:07 am
general assembly. all of the u.n. buddies failed to unequivocally condemn hamas. they failed to demand accountability from the terrorists of hamas. the people in gaza would hear they suffer first and foremost only because of hamas that is using them as human shields, maybe we could see a change in gaza. but the only hope of hamas to survive against the israeli defense forces, against our military, their hope is the u.n. and the international community. they expect them to tie our hands. >> bill: one thing about the future of gaza and what happens with the 2 million palestinians still living there is what does israel do? does the idf occupy it and flood the tunnels, can you destroy the tunnels? when do israelis feel safe enough to live in the southern part of their country again? all these issues, they are big,
7:08 am
too. have yet to be decided. what happens? >> it is quite clear today for all of us after 60 days that we have made a terrible mistake in the past. genocidal organization like the nazis, like isis, like hamas cannot be changed with economic incentives. they must be eradicated. the time the people of israel and the jewish people, we feel a sense of unity we never felt before. we are willing to pay the ultimate price and we are paying it. our soldiers are paying it every day in order to eradicate hamas and release the hostages. and we will continue in this mission and this war until hamas is eradicated and until our people can go back and live in -- near our southern border and northern border. we have 250,000 people who were displaced since this war started because they don't feel safe going back to their homes and we
7:09 am
are committed to insuring their security and that's why we will continue until hamas is eradicated and i promise you, it will happen even if it will take another month or two, it will happen. we will achieve our goals. >> dana: mr. ambassador, happy hanukkah to you and thank you for being here. >> happy hanukkah and light, as you said, will be victorious, yes. >> bill: good to see you. thank you. lower manhattan we have what we call the pool camera, right? inside the courtroom from moments ago with the former president back at a familiar seat at a familiar table. he does not take the stand today but may do that tomorrow and if there is no court tomorrow, maybe next week. but he did have comments going in and we'll probably get comments at lunch break, too, momentarily. that's what you have. i don't think we saw le tisha

7:11 am
america's most wealthy foundations and individuals like billionaire george soros. who according to charity watchdog capital research center funneled tides more than $22 million for different causes. >> if the left does it, tides funds it. >> they granted jewish voice for peace that co-sponsored the protest $650,000. 710,000 to a justice project that organized this demonstration on capitol hill. 86,000 to the group if not now, organizer of the protest outside the dnc. 38,000 to the center for constitutional rights which sued president biden for failing to, quote, prevent genocide. 600,000 to the mass liberation project which accuses the u.s. of ethnic cleansing. and 132,000 to west pac sponsor of students for justice in palestinian which organized this protest at columbia. >> the tides has sent well over

the republican party is deeply unserious and unable to legislate. he is a democrat and will say that. it doesn't work when you pulled the fire alarm to try to stop the vote to avert a shutdown to make the republican party look back. i wonder how many lawmakers care about being censured. thumbing the nose at it. i talked to chad pergram earlier and asked him. he said some lawmakers embrace it. they can say i'm working so hard for you and look at what they are doing, wasting all their time attacking me. i'm sure that is what bowman will say publicly. privately when the vote is going down it is uncomfortable. i'm sure he will feel a little silly. this was a silly thing to do. >> bill: amazing gas lighting moment when you can say this is actually a badge of honor. simple majority takes to go ahead and censure him. there is a good chance it happens. we'll find out momentarily.

ironically trump believes biden is the easiest democrat to beat. >> bill: one of the more recent surveys cnn on the approval/disapproval of nobody. they have biden at 63% at the end of the november. well under the 40% that a lot of people look at. how does it work over the next 11 months? do you dig out of that hole? >> i would not want to run for re-election with a 63% disapproval rating. you need the opposing candidate running on a platform of spreading stds. you need a weak opponent in a circumstance like that. things are expensive. inflation year to year might change but people still remember what prices were in pre-pandemic 2019 and myself the good old days. until that's fixed biden will have a low approval rating.

eight nights that commemorate the jewish retaking of the city of jerusalem. they thought they had enough fuel for one night to light the lamp and it lasted eight nights and hence you have the eight candles you see on that menorah in that town. here we go. the holiday is underway and what a holiday it is for jewish people all over the world in light of what happened two months ago today. >> dana: indeed. stunning number of women's groups failing to condemn the rape and mutilation of israeli women at the hands of hamas and angering many people including my next guest. kirsten gillibrand you spoke at the united nations and your voice with clearly heard. we had a guest on last hour a former miss world of israel. a rape victim herself from many years ago and at the event. here is what she said last hour. >> it is me too unless you are a jew. hard for me to say that but this
7:48 am
is the truth. what women organizations did they took it to the political side. it is not about political or free palestinian. it is not about which side you are on the map. to use rape as an act of war is unbearable. >> dana: senator, the women's groups are still silent and i know you know a lot of them and their leadership. what have they told you behind the scenes? >> i haven't spoken to them. when i saw the list at the u.n., i couldn't believe it. i was so aghast and so furious. i don't understand how we cannot have solidarity amongst all women in the united states and globally that using rape as a weapon of war is unacceptable. it has to be condemned. the fact that the u.n. has not called hamas a terrorist organization and condemned the horrific violence on october 7th is unacceptable.
7:49 am
they are not even enforcing international law or calling it out as a violation of war. >> dana: one of the things the groups spoke out when people -- the jewish women feel abandoned. will you call upon these groups to say something to stand in solidarity with other women? >> i did in my speech. it is an outrage and i think women's rights groups in the united states should care deeply about women around the globe and should not turn a blind eye. they should not keep their head in the sand. they have a moral responsibility to have moral clarity that rape cannot be used astor tour and cannot be used to destroy whole communities. that's what is being used as a weapon of war. >> dana: did you go to the opportunity provided in congress to go and watch the video that the israeli government had provided? >> i did. and it is unspeakable. the horrific acts that were
7:50 am
committed in the most heinous and evil ways you can imagine. beheadings, dismemberments, mass rapes, shooting of babies and children. it is something that should never, ever happen and it has to be called out by not only the u.n., but by the world community. >> dana: i ask because i think it is important for somebody like you to be able to tell the people who are denying it or suggesting that it never happened so that they can hear from somebody who has actually seen the video, that is you. >> and dana, they did not show us the victims of rape and they did not show us the videos of rapes happening because they thought it was too horrific for congress to see. but we should see it and these films and these photographs should be made public because the world has to condemn this because right now rape is being used as a weapon of war around the globe by many of the
7:51 am
terrorist organizations and has been used by terrorist organizations for hundreds of years and we cannot stand that women's bodies aren't worth being protected and that their humanity is not important and not worth us fighting for. so we need clarity. we need moral clarity at this moment from our leaders and from all organizations that purport to represent women. >> dana: we're dealing with the after math of the three university presidents on the hill this week who could not find it in their core or prepped not to say that calling for genocide is wrong and against the policy there. bari weiss pointed out today at harvard being fat phobic constitutes violence but globe liesing the intifada requires
7:52 am
context. a supporter says those three university presidents should resign from harvard, m.i.t. and u penn. >> i think their statements were abhorrent and trying to contextualize what constitutes harassment. jewish students are terrified on these campuses. they were barricaded into rooms and students are told we cannot guarantee your safety so stay in your dorm room. that's the definition of harassment to instill fear and to not have a climate where kids can thrive and go to school and feel protected. they are failing in the worst way as college presidents but so are these colleges. if you look across the board at what statements presidents made in the after math of october 7th it's unacceptable. you cannot call for the genocide of the jews, the genocide of any group of people and not say that is harassment and creating an
7:53 am
unsafe environment for kids and students that live there. >> dana: i'm sure they will be glad to hear and reassured you are on their side indeed. senator gillibrand, thank you. >> bill: we're watching the censure vote. it is now underway on the floor of the house. you need a simple majority to get there. remember the majority at the moment is 218. you are at 205 and chad pergram has been watching this. we'll dial him in in a moment as we watch this all goes back to bowman, the democratic person on camera who pulled the fire alarm during a major vote on a saturday morning. >> dana: have you ever walked by a fire alarm and thought what would happen? i would never do it. i'm so terrified of getting in trouble. but you can play out in your mind all the bad things that could happen if you do that. the stampeding, right? people getting hurt or injured. there is a reason it's against the law. he said he took immediate
7:54 am
responsibility. that is definitely not true. >> bill: by my count here 12 republicans have not voted yet but by my count, three democrats have voted yes. so chad pergram says it is all about the math. how is the math now, chad? >> well, it looks like jamal bowman will be censured. the 27th member of the house of representatives to be censured. there are a number of present votes on the board now. we're trying to filet the vote in realtime. susan wild from pennsylvania who is the top democrat on the ethics committee, andy harris, a republican from maryland here, we also have glen ivy voting present right now. they need a simple majority. it is not expulsion like we had last week. a simple majority. the fact they had a majority vote 216 members to 201 and one voting present susan wild yesterday to not block, to not
7:55 am
table this censure resolution, that's why this is going to pass and we'll see this cross that threshold. just a simple majority that they need. not necessarily 218 as we know right now. they are at 434 members after the expulsion of george santos. kevin mccarthy is still a member now but he did not vote yesterday. >> bill: two things here. if he is censured he goes on the floor of the house and they read a statement. i don't know if it's been written yet or not. if he is censured, it clearly shows the rashal and excuses he was using for the fire alarm didn't fly with the majority of lawmakers in congress. >> that's right. what happens, this was not in the censure resolution in november for rashida tlaib but what happens is you have to present yourself in the well of the house, the area in the lower part of the chamber in front of the dais and stand in front of the speaker and read the resolution and say you are here by censured and you wrap the
7:56 am
gavel. that's what happened with charlie wrangle 2010. former representative from new york and adam schiff earlier this year. a lot of democrats rallied around adam schiff and it was raucous. kevin mccarthy read the resolution, said you are censured, hit the gavel and nobody could hear it because of the din inside the house chamber. we don't know what this will look like in the case of charlie wrangle. he was looking down with hands folded. house speaker nancy pelosi read the resolution. she never really made eye contact with him and hit the gavel. mike johnson, the speaker, is reading the vote total. jamal bowman has been censured. the 27th member ever censured. >> representative bowman present himself in the well.
7:57 am
by its adoption of house resolution 914, the house has resolved that the house of representatives sen shares jamal bowman from the 16th congressional district of new york and representative bowman present himself in the well of the house of representatives for the pronouncement of censure and he be censured with the public reading of this resolution by the speaker. >> dana: pulling the fire alarm. there you have it. jamal bowman the congressman from new york censured for pulling the fire alarm and pled guilty. that is a crime. and so basically you heard -- bill heard it. i didn't catch the language. somebody sounded like they yelled sham or shame. >> bill: or maybe both depending on which party you are in,
7:58 am
right? >> dana: it could have been. >> bill: we watched that history there. gratitude to chad pergram for taking us through it. jamal bowman deal is now over. >> the gentleman from missouri seeks recognition. >> bill: back to new york. lower manhattan donald trump is inside that courtroom. he will not testify today but he is back in court. first time we've seen him show up even though the civil fraud trial has continued in his absence. so he is back. this was the pool camera in there in the last hour and we haven't had a lot of information right now on the read-out but this is his opportunity to defend himself and say what you are doing against me here is beyond the pale and all this is a crock. he says it every time he goes inside court. >> dana: we'll pay attention and get you to this as well. the president of the ncaa now backing a plan to pay athletes

directly. kelly o'grady is here to explain it to me. i need the explanation. >> great to see you. this is stunning coming from an organization that has fought tooth and nail to preserve student athletes amateur status. the ncaa president suggesting three changes that universities should be allowed to enter into endorsement agreements with student athletes. there should be no cap on education related benefits and that they should create a subdivision of the richest schools and each commit $30,000 per year for at least half of their student athletes. the proposal argues it will help level what is fast becoming an unlevel playing field between men and women. student agents leitz. schools are required to abide by existing gender -- it would accelerate the shift.

alabamas, michigans can start playing by different schools and smaller schools will get -- we spoke to a former athlete turned agent saying this is necessary. >> i think it's something that has been needing to happen. i wish it happened when i was playing. i think it's a great way for the players not only to earn compensation for themselves but a lot of these guys are from humble backgrounds and they want to help out their family. >> dana, regardless of where you stand, pandora's box is open and we haven't seen the last of this. send it back to you. >> dana: thank you so much. >> bill: good to be with you, my dear. >> dana: a fast couple hours there, bill hemmer. >> bill: i shall see you friday, all right? better show up with bells on. >> dana: harris faulkner will take you through the next hour. it's julie banderas. >> julie: actions have consequences. that is true. believe it or not the house just
