11:01 pm
federal prosecutors, they have now filed three felony charges ,six misdemeanor counts against the president's 53-year-old son, hunter biden. >> all of this related to the alleged scheme to evade taxes on a massive of income these years between 2016 and 2019. quote, rather than pay his taxes, the defendants spent millions of dollars on an extravagant lifestyle. well, remember, hunter was previously indicted on federal gun charges in delaware. now, of course, the doj's original plan. let's take you back in time was to not charge hunter at all with nothing. they wanted to sweep all of all of hunter's misdeeds, if you will, under the rug, the biden family, misdeeds under the rug. and for a while, it was all going according to plan. >> remember, federal prosecutor david weiss? he'd been investigating this for years. he dragged on what appeared to be a fake investigation, allowing the statute of limitations. >> this is very important tonight as we go through all of this, to actually run out
11:02 pm
on several serious tax crimes alleged that corresponded with the burisma years. >> we'll explain that. >> and then he seemed content to just, you know, wrap up the probe without any charges at all up until the point where two whistleblowers, brave whistleblowers at the irs sounded the alarm. and according to six separate witnesses, david weiss said that his hands were completely tied in regards to his investigation. remember, they took contemporaneous notes. remember, david weiss told them, i can't charge him in california. i can't charge him in d.c. i can't charge in other jurisdictions. he said he lacked the authority to do so, to override local authorities. biden appointed prosecutors those whistleblowers. >> gary shapley, for example, he took contemporaneous notes at the time validating his claim. it's all contra addicted, by the way. the sworn testimony of the attorney general, our country, merrick garland. and later, by the way, a later
11:03 pm
statement by weiss himself. he was on both sides of this issue. and one letter to one senator, one letter to another congressman. >> now, weiss and the doj then moved on to plan b, remember plan b? >> that was a sweetheart plea deal for hunter masquerading as justice. never before in the history of the country has a deal been sweet. but the one that they were offering hunter no felony charges. a slap on the wrist after what all these other charges get swept away under the rug. it wouldn't happen if your last name was trump, i'll tell you that. unfortunately for hunter, the plea deal. remember, that plea deal collapsed because that federal judge, delaware, started asking real questions. remember when the delaware judge asking prosecutors if they ever, ever in their in their history they saw a deal like this before, they had to admit. no, they had not. this was all deeply humiliating for david and for the attorney general, garland, who now look extremely compromised and frankly corrupt, especially
11:04 pm
given the unrelenting pursuit of donald trump. but still tonight, the politicized weaponized doj. they still have the same goal. let's be clear here. they don't really care about hunter biden. nobody seems to care about hunter biden. this is not about biden. instead, this has always been and continues to be an effort to protect the big guy. the brand, joe biden. remember, without joe biden, there is no biden brand. how do we know about the biden brand? devon archer told us about it. tony bobulinski told us about it. now, that would mean without the joe biden part of this, there wouldn't be multimillion dollar payouts from romania and russia and china and ukraine and kazakhstan and other countries around the world. there would be no cushy job on the board of burisma, the oil and gas giant in ukraine for hunter, even though he had no experience admittedly in oil, gas, coal,
11:05 pm
energy or even the ukraine itself. there are no mysterious shell corporations without joe, no suspicious activity reports. none of this business would occur without joe. joe. this entire case revolves around the president of the united states, joe biden. >> now, on the surface, this looks bad. and the deeper you dig, the worse this gets, where payments classified as loans over and over, over again. but we don't ever get to see the paperwork as to when the loans were given, what the terms were. hunter, of course, claiming that his dad is wells fargo. that account to pay his bills. an email detailing 10% for the big guy. a mountain of evidence that joe biden regularly interacting with hunter's business partners. we learned a lot more this week that. and yet biden is lying about every bit of it. and now order to save joe and keep his campaign afloat. while hunter is likely being offered up as the, quote, sacrificial lamb, they will prosecute hunter.
11:06 pm
they will distance him and his crimes from his father and then declare, oh, justice has been served. that's what the new plan. but we know better. and to their credit, so do the house republicans. earlier today, they released the text of their impeachment inquiry. resolution, along with the following statement, quote, the biden family and associates received more than $24 million from foreign nationals. joe biden received hundred thousand dollars from his brother, james biden. the same day james biden received a $200,000 loan from a failing rural hospital operator. joe biden also received $40,000 in chinese money from his brother and his sister in law. now, it became clear that the biden well, what brand would they sell? what are they selling? what? hunter's expertise in art. i think so. they were looking for, let's see, dnc help words come to mind. anyway, that was the influence that they were using.
11:07 pm
that was the biden brand. they were using joe biden's name as the product, the brand. and don't forget, according to article two, section four of the u.s. constitution, the president, vice president, also officers of the united states shall be removed from office on impeachment for and conviction of treason, bribery and other high crimes and misdemeanors. >> biden he's got to be held accountable. he has a lot of questions to be answered. we know he's there as a candidate. we know he's light as a president. and let's be very clear. this is not a story about a father's for his son. this is a story about a father using a struggling son to fill the family coffers. the house oversight committee has identified over ten biden family members that benefit financially from all of this foreign money. we can't find a single service that was offered in return for tens of millions of dollars. joe, he's a disgrace. and this is now all going to be coming to light here with the
11:08 pm
full report on the new hunter biden charges out of california . our very own david spunt is on the ground with the latest. david, what do you got? >> john, good evening. well, as you see on the screen, nine charges, six of those are felonies and three of them are felony. six of them are misdemeanors. this came down in the central district of california. that's los angeles. that's because that's where hunter biden has lived since april of 2018. but according to this indictment, special counsel david weiss, he willfully chose not to pay his taxes. i want to read some of this release from. david white, it says he engaged in a four year scheme in which he chose not to pay at least $1.4 million in selfish federal taxes he owed for 2016 through 2019. and also, it says he spent millions of dollars on an extravagant lifestyle rather than paying those tax bills. that said, shawn, in 2018, he stopped paying his outstanding and overdue taxes for the year 2015.
11:09 pm
notably in this indictment, it does not include any charges on ferrer registering as a foreign agent. there was some speculation that the special counsel would go down that path given hunter biden's overseas business dealings, but he stopped short of doing that. only charging him with these tax charges. >> you mentioned at the top of the program that weiss is also taking hunter biden to trial in delaware on federal gun charges when he will appear in california. we don't quite know yet. we're waiting to see when he's going to be making that first appearance. and we've also reached out to hunter biden's attorney, abbe, still waiting for some reaction. >> john? all right. david spunt, thank you for that report. we appreciate it. joining us now, he is the editor in chief, the founder investigative reporter justin news.com, as we check in with john solomon tonight john. you have more than any reporter in this country been following this and have broken pretty much by yourself every
11:10 pm
big aspect of this story. i want to go through this slowly because i think there are so many parts of this that people don't know about and that people have missed. let's first go to the tax charges now. wasn't it, david weiss, that was contradicted the whistleblowers? didn't david weiss originally plan not to bring any charges and only as a result of the whistleblower testimony did he then bring it to another level. >> and that became the sweetheart deal that blew apart open court because of a delaware judge. >> yeah. listen, first off, this indictment tonight affirms every fact that the whistle blowers, gary shapley, joe ziegler gave, they were they've been tormented by some in the media and certainly by hunter biden's defenders. their truthfulness is 100% confirmed in this indictment tonight. and change the course of history. david weiss's team was content to give hunter biden a small ah, a small misdemeanor plea deal for hunter biden.
11:11 pm
now he's facing three felonies, nine charges, 17 years in prison. they change the course of history. also tonight, joe biden has a very bad, bad mark on his record. now, just think about this. this indictment portrays hunter biden as a quintessential tax cheat. a guy who'd rather spend money on clubs than pay his taxes, a guy who made millions in foreign money but wouldn't pay his taxes even when he filed his own taxes from time to time, he would even when he filed his taxes. >> the indictment alleges there's a very important fact here. back in 2019, i reported and i was ridiculed for reporting that ukrainian prosecutors wanted to tell the united states government that hunter biden did not pay taxes on some of his burisma income. tonight, david weiss's indictment through the grand jury for another grand jury confirms hunter biden did not pay taxes on the money he earned from burisma holdings in 2014. just like the ukrainian authorities tried to tell
11:12 pm
the united states government in 2019, but they were turned away. >> this is a devastating indictment for a president. his own son is portrayed as it's actually this is a president that time and again has told us he wants to crack down on tax. he wants to hire 89,000 more irs agents in this case here. his own son is the poster child for what a tax cheat looks like, at least in this indictment. you know, john, let me ask you this. i want to go back because the years burisma years and this is where almost from the very beginning, this tipped everybody off because it was so unusual. so let me just focus in on that one deal in particular. i wrong or right on the issue. in october of 2015, didn't it become official administration policy to give $1,000,000,000 in loan guarantees to ukraine? and that was after an inner agency investigation.
11:13 pm
they decided to not progress on the issue of corruption in ukraine. warrants the billion in loan guarantees that happened in october of 2015. is that correct? you were right. there were a series of record september and october 15 and two consecutive months. >> the treasury department, justice department, state department agreed together that ukraine and its prosecutor general's office had made enough progress on corruption reforms. it deserved $1,000,000,000 in new loan guarantees. and by the way, europe also concurred with that opinion. >> let me ask you this, john because then in december of 2015, this is the same year we're talking about hunter is with burisma executives. >> this is at the time and correct me if i'm wrong, this at the time they needed d.c. help or maybe that they needed the biden brand if you wanted to is devin archer's analogy. and at that time they were in dubai. hunter was in dubai and burisma executives were in dubai. they had a phone call with joe biden. five days later, i believe joe biden went to ukraine. that's when joe biden was bragging about the issue, that,
11:14 pm
in fact, he said fire the prosecutor got 6 hours or you're not getting the money. okay. he fires the prosecutor as a result of that firing ukraine, the loan guarantee, which was already official obama administration policy. and hunter biden, who admits he had no experience on good morning america in oil, gas, energy or coal, he continued to get paid millions of dollars for a job he clearly was not qualified for at a time where they're admitting that he was addicted to drugs and alcohol. >> is that the proper timeline on that? >> that is exactly the timeline. in october, burisma started to get worried that the ukrainian prosecutors are ramping up their investigation. hunter biden starts talking to people around joe biden of joe biden's advisers, talks to joe biden about it. the career people would recommending give ukraine the money they'd done enough. don't. joe biden, according to the washington post and the washington post, has changed his story. they now say that joe biden called an audible. you know, an audible is a change in play at a football
11:15 pm
game. he called it audible and decided he was going to withhold the billion dollars in force, the firing of the very prosecutor that was making burisma panicked. hunter biden's company was panicked and they fired viktor shokin. that is exactly what i reported in 2019. and today the evidence validates that timeline. let me go back. so then how is it that david weiss investigating this, how did he let the statute of limitations pass? on the issue of taxes involving the burisma years, because we're talking about millions of dollars there, what was that? not the timeline. well, those years that that the statute of limitations passed there, because that would have been highly unusual because they could have gone to hunter biden's attorneys at the time and said works attending this or we're going to charge you. >> wouldn't that be the normal practice? >> yes, and they do what's called a tolling agreement, which extends the statute. you keep negotiating, maybe you get a deal, but you preserve the government's
11:16 pm
ability to bring the charges. that tolling agreement according to the whistleblowers, was allowed to expire in the fall of 2022, meaning the $400,000 in income that under biden to david weiss confirms this today confirms a whistleblower's $400,000 in income that hunter biden got from burisma in 2014 could no longer be charged as a felony. tax evasion case today. they mention it in the narrative, but they can't charge him with it because of the fact that they allowed the statute of limitations to go. and i think all of this would have been swept under the rug based on all the reporting i've done with the fbi and irs and other officials, this would have all been swept under the rug of gary scharpling and joseph ziegler, didn't come forward and blow the whistle to congress. >> all right. let me ask you this next question here. joe biden has said over and over again he said it as a candidate. he said that as a president, he said it this week that he never once talked to his brother or his son or anybody, for that matter, about their foreign business dealings. now know that's not true. john solomon, we know because devon archer told us that's not
11:17 pm
true and he himself as a partner, knew of at least 20 occasions when joe got on the phone with hunter, their foreign business partners. and then, of course, we have photo evidence of joe biden meeting with a lineup. katarina, that's the russian oligarch, former first lady of moscow, three and a half million dollars deal that they did with her later leading to her investing, i believe, over $100 million in a real estate venture with them. >> but joe biden met with her at the cafe milano, didn't he? >> and he met with other foreign partners at the café milano, didn't he? >> he did, and he met with one in the naval observatory, the official vice president. when he was vice president, a guy connected to kazakhstan. joe biden is simply not telling the truth when he said those are lies. the only lies are his response to that. the evidence is overwhelming that he did meet, that he did get some money from a senate. remember, he lied, said my family never got money from china. today, david, why these documents, millions of dollars
11:18 pm
coming from china to his family. and tomorrow morning, we're going to provide some new evidence showing that joe biden is right in the middle of this scheme with the help of senator ron johnson. we're going to be able to tomorrow. there are six suspicious activity reports that came in from banks that were flagging two possible criminal activities, human trafficking and money laundering. that list joe biden's delaware residents as the source and origin or origination of the financial transactions that result in their concern. joe biden's house was sort of a crime scene for these banks reporting money laundering and human trafficking. his home, the home that he allowed his son to stay in for some time. it's listed six in six banks. $12 million of transactions in these six suspicious activity reports is the first time we knew that joe biden's house is in the middle of what banks thought were money laundering and human trafficking schemes. >> that's going to come out tomorrow morning. wow. unbelievable. and your reporting has been
11:19 pm
dead on accurate. i will tell you, there also is this issue of david weiss contradicting himself in separate letters to, i believe, to one senator, one congressman, and also the comments, merrick garland. didn't merrick garland testify before congress that david weiss had the authority to charge in other jurisdiction ? that was what david weiss was telling the whistleblowers, that he not have he did not have the authority to charge. in other jurisdictions, but he said something else, 2 to 1 branch of congress and something else to a different branch. >> correct. >> the house and the senate, not, you know, different houses . >> there's a lot to sort out here, but other witnesses affirmed the whistleblower story and rebuked both the accounts of merrick garland and david weiss. david weiss i think now, has given a more complete account. when he finally sat down with jim jordan and he acknowledged this and i got turned down by the biden appointees in washington and california. i then let the statute of limitations go. i couldn't even do things without getting the approval
11:20 pm
of the tax division that was run by joe biden's appointees. so weiss has gotten the story right now. his story matches the whistleblowers. it matches the irs and fbi supervisors and others that jim jordan and james colmer have interviewed. but early on, there was a lot of fast and loose. the only people that turned out to be consistently accurate, the irs. and by the way, you have been following the story of kevin morris who apparently made a loan of $4.9 million. but as of that, didn't you discover that one of the reasons he thought it was important to help hunter out financially was because the issue of taxes would be front and center in the 2020 presidential race? >> yes, he actually an email saying that there's going to be political and personal peril for hunter biden if he doesn't start paying his taxes. this occurs right in 2020, right? he meets hunter biden at a joe biden fundraiser. those emails came out yesterday. kevin morris is mentioned as an unnamed person here. the david weiss confirms that kevin morris was starting
11:21 pm
to pay an unnamed person. but we know and b, kevin morris started to pay hunter biden's bills, including his rent and his tax bills, starting in the 2020 timeframe. so that story has now been affirmed, too. there's a lot to dig in in any other presidency. if a donor came in and started giving millions of dollars to the president's son or children, wife or brother, it would be a big scandal. most of the media have tried to ignore this over the last few weeks, but david weiss puts it front and center tonight in this indictment. >> is joe biden really the of the spear here? in other words, we wouldn't be talking about any this, would we, if joe biden wasn't the brand. if joe biden didn't lie to the american people repeatedly, why lie if you're not involved? right. wild life, you did nothing wrong. but joe lied to the country repeatedly, is lying again. even this on this very issue. is it true that that the center of all of this is the president of the united states? it involves, let's say, 150 some odd suspicious activity
11:22 pm
reports, all of these shell corporations, all of these biden family members, including grandchildren that are being paid millions of dollars from some of our top geopolitical being paid into this family. no evidence of any services that we can find rendered in exchange for that money. >> is that where we are now tonight? john, last question. we are. >> and listen, hunter biden himself admitted this in an interview two years ago. a lot of things came his way solely because of his last name . that's why he got hired. yes. that's why millions came into the family. and they lied about it in 2019 and 20. certainly, joe biden didn't. and today the american public have a much clearer example of a grift screamed a scheme that the bidens ran that involved tax evasion. now and also money laundering concerns at the banks. and joe biden's, home is in the middle of it. that's going to be the big thing tomorrow. joe biden aided evaded this scheme for a long time. his family rich off it. now, the last remaining question for james comer, jim jordan.
11:23 pm
how much did joe biden personally benefit from it? that i think the impeachment will ultimately be able to answer? >> yeah. i wondered now if he will use this as an excuse not to appear before. james kohler's committee. we'll watch that in the days to come. as john solomon, thank you. here now with reaction, fox news legal analyst gregg jarrett, along with harvard law professor alan dershowitz. greg, we'll begin with you tonight. you've been following the story. you've been writing columns after column. i want to go to the heart of this issue. i have been calling the joe biden bribery and money laundering scandal allegations. does this take us one step closer tonight to two? >> joe biden, the president and his involvement and his lying to the country? yet does his complicity show on the evidence is mounting. >> joe biden, as you say, actively aided and abetted his son's schemes. >> he's been lying about it all along and everybody knows that and even lied about it yesterday.
11:24 pm
>> there's documents, testimony, white house logs, emails, text messages that prove that he talked by phone with hunter's clients, he met personally with his sons overseas partners. he even attended their meetings that were closely guarded. >> you know, joe biden appears to be complicit in pushing the biden brand, which was selling access to him, promises of influence. >> devon archer confirmed that joe sent signals and operated as for all of that money, millions of it. so it's obvious that hunter was selling his dad to the world and the family was getting rich from it. >> it doesn't matter whether joe pocketed a single penny of it under the bribery is still a crime with the money goes to any other person or entity other than the public office. >> and of course, as you pointed out earlier, bribery
11:25 pm
is impeachable offense. >> and by the way, there's no statute limitations on impeachment as. there were in some of the charges that david weiss allowed lapse intentionally. >> professor dershowitz, i doubt you would disagree with us on the issue of joe biden lying. it is now clear that he lied to the country when he said he never spoke to his son, brother or anybody, for that matter, about the father foreign business dealings. but it's bigger that. but as hunter in his own laptop, the very real laptop not not the fake laptop that the media claimed but he implicates his father half his incoming complaint goes to pops. he had to pay for pops his home repairs. that is backed up by emails we learned this week with hunter. i'm sorry with joe biden himself directly with eric sherwin. who was the money person in the corporation. and then, of course, emails with hunter and eric sherwin on what account should i pay pops his home repair bill this time complaining hunter complaining about paying home
11:26 pm
repair bills for 11 years and then, of course tony bobulinski the big guy money set aside for this. none of this would be happening but for joe biden. but if you on one issue professor this is what stands out in my mind. hunter biden said he had no experience in energy, oil, gas, coal or ukraine. now, if you look at the burisma ,he's paid millions in that case. >> we know joe biden leveraged $2 billion. >> then we have that. what's at message. this involves cfc, that is the chinese oil conglomerate. again, no experience in energy. i'm sitting here with my father. we're wondering why you did not fulfill your commitment between every book. >> he won't use everybody he knows and my ability to hold a grudge. >> you will regret not following through with what you agreed to a few days later . $5 million shows up in one of those bank accounts.
11:27 pm
professor what james colmer is calling shell corporations. >> tell me, professor, what does that look like to you? well, first of all, let's remember who's responsible for all of this coming out. we have to give credit to judge noreika. judge noreika made sure that this was not all covered up by a deal that made no sense since i predicted on your show and other shows that judge noriega would not accept the deal. i was trashed for it by many academics, by cnn, by many other media. but she did the right thing. she sent it back and the result has been now much more information coming to the american public, as i've said before. i hope that this results in the appointment of a real, real special counsel outside the justice department looking the president of the united states. because if it becomes just the impeachment concern, then
11:28 pm
half the country won't believe and she will. the same thing happened with trump. but if there's a special counsel who's credible and who can get to the bottom of this and either clear president biden's or accuse president biden, i think the american public. professor, let me stop you here, though, because we have merrick garland, by the way, contradicted by david weiss and david weiss contradicted by merrick garland, by the whistleblower testimony originally. we know that mr. weiss planned on bringing no charges, that evolved into that sweetheart deal with no time in jail that fell apart in front of that judge that you rightly praise who said to the prosecutors. you've never seen a deal like this before. okay. prosecutors had to admit, no, they never did. okay. now we're back at the drawing board. but merrick garland then appoints the guy that allowed the statute of limitation opens on the very important tax year of the burisma to expire.
11:29 pm
now, why would he why would he appoint that individual who also contradicted what he himself, merrick garland, said? merrick garland said he had given the authority to mr. weiss to press charges in other jurisdictions. >> well, according to the whistleblowers, took contemporaneous notes. >> they said david weiss said just the opposite. so why would he be appointed unless somehow they're looking to protect the bidens? >> well, that's why we need to have a special prosecutor who's above reproach. my suggestion has been that a group of very distinguished people recommend five people to garland and tell him to pick from those five people. nobody from inside the justice department, nobody involved in politics, people of the stature of archibald cox, who was the special prosecutor appointed in the next few days. everybody believe that what we need to do is for credibility, criminal justice system, not make our criminal justice system into a weaponized
11:30 pm
prosecutor. >> can you explain, professor, you're so you're such a smart man and you're an honest man. >> can you explain to this country tonight how it's possible that somebody that is admittedly addicted to drugs and alcohol, somebody that has no experience, is making millions of dollars from all of these these countries and even our top number one geopolitical foe? why they be paying him that kind of money if he has no experience, does that make any sense to you or senator, because it doesn't make sense to me. >> well, it makes complete sense. they want that access to the president. it's called the american system of lobbying. you pay people to give you access. there's no doubt that he not qualified to have any of these positions. >> there's no doubt. but let's look at it legally is are they then paying for influence and is that a crime professor? >> well, they're paying for influence.
11:31 pm
that's clear. it's a crime for the person paying for the influence, whether it's a crime to the person who was to be influenced . >> that's something that has to be made. let me rush you further. when joe biden went against obama policy on the billion and loan guarantees and he leveraged them to get the prosecutor investigating burisma fired in 6 hours after he had spoken with those executives five days earlier with his son when they were in dubai together. and in fact, son of a , he got that guy fired. my question to you is, did he take an official action as vice president? and that resulted in a financial gain for his own. and if he did, what would you call that? greg jarrett, i think, called the bribery. >> and if i'm wrong, will correct me. remember, it's beyond the statute of limitations. now, you don't have a statute of limitations in impeachment, but can you impeach a president who committed an impeachable offense while vice president? that's an interesting issue. >> what do you think, greg jarrett over kids,
11:32 pm
burisma, as you have. >> explain is exhibit a in bribery 18 u.s.c. 201 and also under the impeachment clause in the constitution. >> but there's far more than that. investing. >> gators have tracked at least 24 million from beijing sent to hunter, then funneled through this lab warrens of shell companies and eventually to his family members. >> that figure is actually a fraction of the total cash haul factor in millions from china, millions from ukraine, kazakhstan, romania, half a dozen other countries over which joe biden exerted influence. you're probably closer to 15 million dollars bank. >> the bidens in these suspected influence peddling schemes. >> i think, frankly, you know, the committee has only spent a few months uncovering mountains of evidence, but it
11:33 pm
may just be the tip of the iceberg. >> this may be the largest bribery influence peddling scandal in american political history and shameful . >> do you agree with that, professor? if the evidence supports what the investigations have shown by gregg, by john solomon, and you there is a smoking gun here and that's why we need a special prosecutor to look into this, because this made a very, very significant matter. but we have to get evidence. it can't be based just on allegations and it can't be based partisan investigations. the american public deserves to have a person of great integrity and reputation. look into these matters. >> but what we bring now, you admit this is influence peddling. based on what we know the facts. we know the words of joe biden, the words of hunter biden have no experience. ah, son of a . they fired him.
11:34 pm
we know what the policy was. we know when the phone calls took place. pretty, if you ask me, professor, but i do appreciate you being with us. we do have some breaking news breaking just moments ago. thank you, greg, as well. house oversight committee chairman james is now crediting the brave irs whistleblower. as for holding the justice department accountable and, forcing them to take action, he's 100% right. >> anyway, here with more reaction is former speaker of the house newt gingrich. they said two brave whistleblowers, gary shapley and joseph ziegler, placed their careers on the line to blow the whistle on misconduct and how things have been politicized in the hunter biden criminal investiga ation. the doj got caught in its attempt to give hunter biden and unprecedented sweetheart deal. and today's charges against hunter are the result of mr. shapley and mr. ziegler's to ensure that all americans are treated equally under law. every american should applaud these men for their courage

to the truth. irs whistleblowers also revealed that investigators were prevented from following evidence that could have led to biden, the house oversight committees investigation of the bidens influence peddling schemes. reveals how joe biden knew about participated in, benefited from family cashing in on bidens name. in fact, hunter biden's corporate entities implicated by today's indictments funneled foreign cash that landed in joe biden's bank account. and unless u.s. attorney investigates everyone involved in the biden's fraud schemes influence peddling, it will be clear that president biden's doj is protecting hunter biden and the big guy. your reaction to that? >> newt gingrich? well, look, i think at a practical level, when you look at all the information, what you have is essentially what i call in a recent newsletter of the delaware sopranos. this is a crime family.
11:36 pm
they were willing to sell out the interest the united states, as somebody said the other day. you now have, in effect, a chinese russian paid agent sitting in the oval office. it's very hard for me to think that in a normal person looking at the amount of evidence that every single day gets bigger. and chairman colmer has been a part of that and has done a good job of digging into this. you also have people of the ways and means committee. you have people, our jim jordan at the judiciary committee. every day something new comes out and presumably you're going to have such an enormous amount of evidence that it's going to be very hard for reasonable people to not at least say, we need to know what's going on. i'll be very curious if all of this develops, whether there won't be some democrats who vote for the impeachment
11:37 pm
process when it comes to the floor of the house. and i can't imagine, given everything which has been surfaced, why any republican would vote against them or not. this is not a vote on impeachment. it's a vote on investigating and using the system in order to bring those surface things that at least today look like they're amazingly criminal. >> i won't repeat all the details that i gave professor dershowitz, but in the case of burisma and the case of cfc chinese oil and gas conglomerate and the sheer amount of millions we're talking about and no experience at all and joe's direct involvement in both of those cases with china, the whatsapp message in ukraine, in leverage, the billion dollars to fire the prosecutor ,i think that's pretty big evidence that he was involved. and of course, big lie that he told that he never once talked about these issues with his son, brother or anybody for
11:38 pm
that matter, that's been blown out of the water. >> and he made that same lie again yesterday. look, there are a couple of clear things here. first, joe biden is a liar and a crook. second, there was an amazing amount of foreign influence pouring into this country from kazakhstan, romania, ukraine, russia, china. i mean, this is clearly the biggest presidential scandal in american history in terms of sheer influence peddling. in addition, it's very clear to me at least that they built an entire structure, have to say to yourself, why would they have all of these shell companies? why would they have this elaborate system of trying to hide what was going? we know more and more that there were all sorts of emails . i saw one report today that joe biden as vice president may have sent several hundred emails to various people who worked for one of the companies
11:39 pm
that hunter had set up. but -- but here's the bigger picture. you didn't go around, you know, go out this early for that leaf . you can argue about this tree or that tree, but when you see the whole forest, it's pretty hard to reach any conclusion except these people methodically set out to make money doing things that they knew were wrong to take money from foreigners, including our major competitors in the world, and then to methodically lie about it. i mean, it's very hard to look at the bigger picture and not reach that. >> you know, it's amazing. without two brave whistleblowers and one brave judge in delaware, they would have gotten away with all of it. pretty amazing. speaker newt gingrich, thank you, sir. when we come back, a lot more to cover. tonight's breaking news, hunter biden indicted nine new federal charges in california. when we come back, we'll get jonathan turley stake. straight out. do you have kids in your family

sellers and wolfgang puck go to ship station .com slash try and get two months free. all right this is a fox sizzler breakinga tonight. if you are just joining us,us, federal prosecutors have just filed nine new charges against d hunter biden, all related to a tax evasion scheme. but the pressing question of the night is, well, what does this mean for the president? what he know?
11:46 pm
>> when did he know it? by the way, when our favorite charges ever going to be filed, will they be filed? here with analysis, law professor and fox newsfox news contributor jonathan turley. co, you have been one of the few honest democrats that hav e been pointing out this is a very real scandal with real implications for joe biden. and even thougr joe biden.h peoe media want it to go away, people in the democratic party want it to go away peopl. you've been warning them it's not going away. and i thin k all roads now leadad back to 1600 pennsylvania avenue. and joe biden has a lotfo to answer for, starting with why he lied repeatedlr yg t to the country, including yesterdaery. >> wel >> well, i think that's true. you know, the fact is that this a is a circle that's getting tighter aroundt is the president >> i mean, it's clear that the e president has lied. he obviously lied during the first campaign when he said he had no knowledge of these dealings. hunter himself contradicted that. >> hunter's associates
11:47 pm
said that it was utter nonsense in recent statements, . his testimony. >> he also said that his son didn't make an thatney in china. it obviously is not true. obvio usbut there's a more serious problem here, and that is what e the president knew of was not p business. it >> i wt was corruption. that's what influence peddlingis is. the united states has pushed international agreements.ited sa to stop influence peddling in other countries. the united states believese peds is a leading source of destructive corruption. and if the president knew that his family was engaging of co that type of corruption, of course it's serious. seri looking at two events nexte week. king aone is when hunter biden . supposed to appear that may now be effectively scuttled. >> hunter may be able to use this to plead the fifth to refuse to answer questions. >> but the second is that is the expected vote on
11:48 pm
the impeachment inquiry and this indictmen easight make it easier for hunter not to speak. huntebut it may make itore more difficult for president biden to avoidt for pr that inquiry. you know, the fact is that this indictment shatters years of denials by the bidens and frankly, by an enabling medibidensa, it shows these mase amounts of money going to hunter biden from romania, ukraine, all these sources. >> and it also shows knowingows and continual effort to evade taxes to commit criminal acts. now, if this circle gettingth closer to the president, then he has to answer some. the s >> so it leads us to this very simple question for next week. is any democrat going to standta upnd and have this moment of courage in to say, you knowy
11:49 pm
what, enough, you know, weknow can't say we're against corruption and influence coy don'tnquiryen sae agai even want to do an inquiry asking whether there was.n yo >> so when you look at thet th lies, we start there. then you look at the sheer number of suspicious activity report sheers. then you look at the identified shell corporations with no real business except to move moneymo around. then the sheer amounaroundt of , tens of millions of dollars with no of any services rendered of any kind. stio and then the big question is like, for examplen is,, in tf case of burisma, did joe biden as vice president take official action that financially benefited his family offic becae 18 usc, i believe it is 201. usc that's the bribery statute. 2jonathan turley bribery, high crimes and misdemeanors. >> i think you know where those words come from. that's. i
11:50 pm
and when i testified in the first biden impeachment, one ofg the things i emphasized was this speculation of whether president benefited from this money is absolutely absurd in federal cases, is well establishey absud that if people money to your family, it can be bribery. >> and many of the democrats are just simply ignoringt fact that fact. >> but there's also a collision and problem here with hunter biden in the hunt in the gun charge ha his counsel has said, you knows what? here he came outt? an addiction around the time that he signed that form. m. and so he was signing itwa truthfully becauses he hadclart clarity. >> well, the problem is a lot of these crimes occurredy.lem ig that period. so did he have clarity with the tax evasions of being committed during the same period? >> amazing. a lot of questions to be answered. karine jean-pierre. his job just got a lot tonight . we'll see what she tries to say tomorrow to spin out she of thi.

hunter biden implicateuntry.s hd numerous times, half his income to pops. ps paysfact that he has to pay for pops home repairs and other corroborating evidence that we have. how bad is this for joe tonight ? look, this is utterly devastating, sean. the indictment is really it's a vindication of everything we've been reporting for the last three years. it's a vindication of jamesa colmer and his fellow republicans in the house and their investigating and thatthe they've been doing this year. and it's especially good vindicationinr of those is whistleblowers, gary shapley and joseph ziegler, without whom hunter biden and joe biden would have gotten away scot free. >> and i think it's put thiszigl indictment is also an indictment of david weiss, even thougherthisso his name is on t, because that sweetheart plea deal that he tried to slip past the american people that wouldra have given hunter immunity from any other charges was such
11:58 pm
a disgrace. when you look at the depth and breadth of the crimes that are alleged here. re, i mean, hunter biden iso accused not just of failing to pay his taxes, but of fraudulently trying to rip offp the tax office, for instance, tryinge ta to claim his chateaue marmont hotel room charges when he was on a crack or his or his children's college fees. tm and this was at a time when the indictment says that he hads ample money to pay his taxes. he chose not to. instead, he chose to spend the money on himself. i mean, there's he had $400,000 that he spent just on clothes for himself. there's 800,000 he spent on what's euphemistically on various women. he wass paying 175,000, $17,000

and to cheat the system. so even if joe has nothingli to do with this highlyfest i, wh unlikely, this still looks bad. but sean, in the opening you saidhis, i that hunter might be the sacrificial lamb for joe. i don't think so the. i think hunter is a sacrificial lamb for the democrat party becauslamb for pe this, i beliew they get joe to step aside. >> they don't want don't joe toh be their nominee. they're going to turn up the heat and turn the screws tto to get joe to walk away. this just might be the thing that does it. tommthy if, in fact, democrats flip and go for the impeachment inquiry, that will be a good sign that they want the off the ticketf . great point, miranda thank you. tommy thank you. that's all the time we havee left this evening. thank you for being with us. please set your dvr so you never, ever, ever, ever, ever miss an episode of hannity. in the meantimn epise i've got e got great news. let not your heartbeat trouble. why greg gutfeld standing by to put a smile on your face. thanks for being witonyoh usur.g >> have a great nigh
