and this is america's late news, fox news at night. and breaking tonight, looks like the president of harvard university will keep her job as one news outlet says, she was only targeted because she's a woman. in moments, we'll be joined by students from both harvard and mit. but first a vote to formally launch an impeachment inquiry into president joe biden is just now hours away. the house speaker mike johnson says it's a legal decision, not a political one. but house republicans have very little wiggle room. the senior national correspondent kevin corke is live in dc with more on the early morning vote. kevin good evening. >> reporter: yeah, bright and early tomorrow morning coming up just hours from now. evening my friend. now boy this time tomorrow night, trace, it is obvious that house republicans will have taken another step toward what many believe is an eventual impeachment of president biden. today, passing the resolution to do so out of the house rules committee and now tomorrow morning a floor vote on the

resolution is expected. now, this is part of a multi-prong impeachment probe digging into hotly disputed allegations about whether joe biden improperly benefited from or used his policies to benefit from foreign business dealings. you know, especially those involving his son hunter. and other family members as well. not to mention allegations that the department of justice improperly slow-walked a tax crimes investigation into hunter biden. >> we have three committees investigating this and following the truth where they lead and they have no option in doing anything else. it's ways and means, judiciary and oversight and they've uncovered some alarming facts about the biden family and their dealings. >> reporter: alarming facts. however, democrats are accusing the speaker of frankly ignoring the more pressing needs of our country out of partisan hatred of the president. >> house republicans have decided that the most important

priority for the united states congress to pursue before they go home for vacation is to start a baseless impeachment inquiry against the president of the united states. >> reporter: as you mentioned speaker johnson says it's not political, this is a legal decision. it all heads to a new level tomorrow trace. >> trace: it is a new level. kevin thank you. meantime republican lawmakers now underinging the white house to consider a deal that provides more money for border security as tens of thousands of moi grants continue flowing into the country illegally and president biden seems more focused on getting aid to ukraine. jeff paul is live with these competing priority some would say good evening. >> reporter: good evening trace and the president today saying if they fail to set aside additional military aid for ukraine they would be delivering russia a quote christmas gift. ukrainian president volodymyr zelenskyy flew to washington hoping his face to face conversations with key lawmakers would help sway in his country's

fair. zelenskyy insisted chris barroning is fighting not only for their freedom but america's as well. president biden addressed the stalemate saying it's going to take both sides of the aisle to figure it all out. ukraine funding hostage in an attempt to force through an extreme republican partisan agenda on the border is not how it works. >> reporter: just this past weekend border patrol says in eagle pass texas alone there were 20,000 apprehensions include three sex offenders and three gang members of the search was also led by border crossings reich the one in lukeville arizona forcing that one to close. republican senator john cornyn says while it's critical to provide additional funding for ukraine, it's biden who causing the delays. >> the only thing that is really holding us up at this point is the unwillingness of the white house thus far to acknowledge they're going to have to deal with the border component. >> reporter: republican senator mitch mcconnell says it would be

practically impossible to pass a funding package before christmas even if it gets through the senate before then. democrat senator chuck schumer questioned if republicans were so serious about the border, why are so many of them in such a hurry to clove. trace. >> trace: jeff thank you bring in steve hilton and erin perrine from axiom strategies. great to see you both. so i want to lay this out going back to impeachment inquiry vote by the way 8:00 tomorrow morning less than nip hours away, the house speaker mike johnson laid this out steve hilton. these are accusations against biden put them on the screen. 2014-2019 biden family members and their affiliate companies received more than 15 million from foreign companies and foreign nationals, at least 22 examples of joe biden speaking with or meeting with hunter biden's foreign business associates. president biden and the white house have lied multiple times about his involvement in his family business schemes. investigators released information showing payments to joe biden from hunter biden's

business account which was funded by payments from china. there is clearly evidence, steve hilton, regardless of what the rest of the media world says, there's evidence. >> exactly. and that's why it's so important this goes ahead in the public interest. it's actually billinger than joe biden and hunter biden because the biden family business model which is to exploit public office for private and personal financial gain, that is the swamp business model. that's why you hear so many people saying there's no wrong doing because they don't think it's wrong because they are all doing it. >> trace: yeah. >> that doesn't make it right. it needs to be exposed. we elect politicians to represent us and do things for us. not to serve themselves. >> trace: it's kind of interesting, because steve talks about public interest here erin perrine and i want to talk about the fox news poll taken back in october. but you've got 69% of people think that joe biden either did something illegal or unethical.

that's a very big number, erin. your thoughts. >> that is a big number. and the house republicans here are being very cautious and careful in the words and the way they are pursuing this. they have had multiple committees working on this investigation bringing in information, about you the white house has been very clear. they have stone walled, they're refusing to provide witnesses. and so congress is going to continue as oversight is their responsibility, to continue to go and pursue this impeachment to make sure they have every mechanism available to them to figure out were there high crimes and misdemeanors. this is just an inquiry. looking into this. it isn't a formal impeachment charge but the white house made it clear they want no part of this so the speaker has to make this move in order to keep it going so the american people who deserve the truth p the biden family are able to get that without the biden white house standing in the way. >> trace: of to give it a look. so ukraine funding is the next

big thing little battle on capitol hill, a lot of republicans are against this, should they be against it or fund it? >> the unbelievable thing is the connection with the border. you have the chaos on the border and you have unbelievably biden and the democrats not wanting to take a deal which actually helps them by dealing with this big issue of the chaos at the border. that tells you how far left they've gone on that issue. as far as ukraine is concerned, they have shall right from the beginning, done exactly the wrong thing. the weakness that invited the invasion in the first place and then all along they've given enough support to ukraine to make sure ukraine doesn't lose but not enough that they win. the whole thing is yet another example of this administration's total weakness. >> trace: erin you last, steve brings up the border, you put this up on the screen, look at the bottom number there. the yearly encounters at the southern border, two million

four hundred 75,000, erin those are the encounters that has nothing to do with the got-aways. >> that's true that's just who we're able to track as of this point. let's be abundantly clear here. joe biden has the choice and it is easy to make. he is choosing to leave the southern border of the united states open and he's choosing right now to not accept the deal that republicans have put forward which is to say you have to address the border crisis and we can handle ukraine funding. so joe biden is saying, hey, this is what he's telling the american people right now. hey we're going to leave the southern border open, we are not going to take care of that because we refuse to actually do our job and that also means we are not going to provide the means for ukraine. >> trace: you're exactly right. erin perrine, steve hilton thank you both >> meantime the harvard community and the country very much split over president claudine gay keeping her job but the harvard board says it comes to free speech. kind of an odd statement from a university ranked dead last in free speech. marianne rafferty is live with the latest uproar over campus

anti-semitism. maryanne good evening. >> reporter: good evening trace, reportedly even after losing $1 billion in donations over what some may have caused disastrous testimony over anti-semitism harvard university says claudine gay will remain as the ivy lowing's president. the school's highest governing body reaffirming its support for gay saying the extensive deliberations reaffirm our confidence that president gay is the right leader to help our community heal and to address the very serious societal issues we are facing. now the harvard corporation now says calls for genocide are despicable and contrary to fundamental human values which president gay did not say during her testimony to congress. >> this is a morale failure of harvard's leadership and higher education leadership at the highest levels appear the only change they have made to their code of conduct where they fail to condemn calls for genocide of the jewish people. >> reporter: meanwhile cases of

anti-semitism on college campuses are on the rise. the trend appears to be moving to middle schools nationwide. >> uninformed students of tomorrow are the same ones that are protesting and chanting the same anti-semitic rhetoric in colleges, protests that we see today. >> now teachers a schools just outside dc have found themselves suspendeded for comments they made on line one who allegedly made reference to wealthy local jews and another who included the phrase from the river to the sea as part of their e-mail signature. tonight education secretary cardona is facing calls from republican lawmakers to do much more to address anti-semitism which now has seen an increase believe it or not at the k-12 level. trace. >> trace: we have seen it maryanne thank you >> the fox news at night common sense department is very intrigued that harvard president claudine gay appears to be keeping her job. seems the university agrees with

her that when students call for the genocide of jews that it wasn't against school policy. in fact, it was free speech. free expression. appear harvard is all about expression. free expression. the harvard president even posted on social media, quoting here, our university embraces the commitment to free expression, that commitment extends even to views many of us find objectionable or even outrageous. this is the same harvard that, before october 7th made it clear that not using a person's preferred pronoun can result in disciplinary action. misgendering is violence. genocide is expression. this is the same harvard that threatened nine professors with disciplinary action for what they said and wrote. they must have written something worse than genocide. this is the same harvard that the foundation of individual rights and expression, or fire, ranked as the worst school in america for free speech. harvard got a zero on a scale of

zero to a hundred. but common sense says america, worry no more. from now on at harvard university speech and expression is free, unless the university disagrees, then it's not free. in fact, it will cost you. let's bring in liyam chitayat an israeli student at ph.d. and jonathan frieden. thank you for coming on. put this on the screen, this is a quote, the harvard corporation lined up behind university president claudine gay the decision confirms the school's pattern of putting identity politics above liberal values and its selective support for free speech on campus and jonathan, it really is selective support for free speech. what's your take on this? >> yeah. so, to be honest, i'm really not surprised by how things have gone reason recently.

over 700 faculty members signed on to keep president gay. harvard does not want to be influenced by the public or outside people, they want to make their own decisions. and at the end of the day they believe that the testimony in congress was right and was correct and you've mentioned this before, just before i went on, but if you actually will at president claudine gay's apology after the congressional hearing, she doesn't say that what i said was wrong or that the content was wrong, she apologizes for hurting people's feelings. >> trace: yeah, right. >> and i think that's what's really important to highlight is that the university believes that they're right, but the reason why is that they're trying to take public free speech laws. right? so in the public, according to the constitution, you are allowed to say hateful things, and that's totally fine. hate speech is okay and they're trying to say that should also apply to universities.

now maybe that is fair but what's not fair is the way it is a being applied. as you mentioned, there's a double standard. you can't only apply absolutist free speech to some people. also, a lot of the things that are happening on campus are not just speech. there's actions. >> trace: yep. >> there's conduct. >> trace: yeah. >> someone on campus a jewish student got surrounded and they were chanting in his face and restricted his movement and on camera saying don't touch me. 's conduct not just free speech. >> trace: you're exactly right jonathan. i want to bring liyam here for a second. this is what you said on social media and i'll let you kind of expand on that. watch. >> tell me, when is the right context to respond to reports of students facing blatant anti-semitism by telling them, well, you can try talking to police, you can go to therapy or you can go back to where you came from. >> trace: liyam you are right,

there is no context for genocide. there is no context for how people said this. expand on that if you would for me. >> well, at mit we've seen our administration double down on this attainable position. they probably think that after the winter break everything is going to blow off and everything will be all right but i know exactly what's waiting for me when i come back. just like jonathan said, this double standard condoned and supported by the administrations and the governing bodies of harvard and mit show case that jews get a lesser treatment than any other identity group. we know this wouldn't be tolerated against any other group so why against jews. >> trace: very good point. i want both of your take very quickly. what's the remedy on your a jonathan? i have about 15 seconds for each of you. what's the remedy going forward at these universities? >> yeah. i think that that's the question we're all dealing with. i think number one they need to

start enforcing their own policies non-discrumbtory and number two systemic change and look inside and realize how anti-semitism has found its way into so many facets of what's going on in the university. >> trace: and liyam, your idea of a solution going forward? >> well, i couldn't agree more with what jonathan just said. i mean, we already have rules in place. we just, brunn university just arrested 41 students for violating the rules. we had a similar occurrence here at mit. why can't our governing board, mit corporation do the same thing. the second thing is remove the double standard, remove the double standard. we're as human as everybody else and there shouldn't be selective enforcement of rules not on college campuses. this is the anti-semitism causing more and more toxic harassment on our campus. >> trace: liyam, jonathan, thank

the european union, it has europe. it has most of the world supporting it but they're starting to lose that support by the indiscriminate bombing that takes place. five or six similar comments by this administration made in just the past few days. international pressure, they're losing support. what do you think about this colonel. >> i think that's an element of route to that because prior to going back into the south after the pause for the hostage release, secretary of state blinken said that the united states is putting pressure on is real that they've got to be more careful to the innocent palestinians going in there and they said they can't go in the south the way they did in the north and so far that's what's happening. on the other side, you see benjamin netanyahu saying hey basically that they're telling us what to do but we're going to do whatever we feel like doing. he was pretty blunt in his comments today. >> reporter: i want to know what you this i about the north because an israeli official to the wall street journal said the following, i think we are a

mistake away from escalation. i don't think hezbollah really appreciates how the israeli's psyche has changed since october 7th. this back and forth is getting worse, more severe. >> yeah, absolutely. and that's what i'm watching the closest because that's the closest possibility of an escalation. because hezbollah has been increasing theory attacks into israel. israel has been increasing their attacks and now that you've had the minister of defense and netanyahu in the last two or three days say hezbollah does not move about 25 kilometers back to the north, to the litani river they may go in there. so israel may start a northern offensive not be caught waiting for it to happen. >> trace: come i have about 15 seconds, we're in the 90s feels like this houthi thing is not getting a response. should the response be more

♪ >> trace: disturbing new video appears to show two separate incidents of drivers targeting pedestrians, hitting them and then laughing. seattle police asking for your help tracking down the suspects. here is the senior correspondent dan springer. >> reporter: according to a business owner in the area seattle police received these disturbing videos of the crime being committed from a person who wished to remain anonymous. in the first one, a passenger in the back seat records on her phone as the driver swerves to the left and slams into a woman walking in a driveway. security video shot across the street shows other people running to help the woman as the car speeds off. it happened around 2:00 a.m. 11 blocks away, police think on the same night, a passenger in a different car records on a phone as the driver hits a pedestrian in the bus lane. the victim rolled over the top of the car. in both videos people in the vehicles can be heard laughing.

>> our detectives recently obtained videos of the callous crimes which occurred on aurora, in each video the driver targets random pedestrians. tonight i'm asking for anyone with information to please come forward. >> reporter: the seattle crimes are very similar to a fatal hit and run in las vegas back in august. that video was posted on social media. the driver and passenger, ages 16 and 17 at the time, were caught and are being tried as adults for murder. a crumb monthly gist at seattle university partially blames the negative influence of social media. >> the more people are interacting with meade why and media violence this way, just creates opportunities to objectify other people. it makes it easier to harm them. >> reporter: according to the national highway traffic safety administration, hit and run fatalities are way up since 2020. there were just over 1500 in 2014, which was the average for the last 30 years. in 2021, there were nearly 2800,

inexplicable really. hard to imagine what was going through their heads. in the case of las vegas that was their third hit of the day. they didn't kill the other people but then as you point out they get to court and they think it's funny. the seattle one, one of the stranger aspects to me is that they can't find the people who were hit. >> trace: right. >> if you saw that guy he goes over the car and is injured pretty badly. that tells you something about seattle they canvassed all the hospitals and can't find him. >> trace: it is bizarre. president to see if this is a segue, because k-12 california test scores just came out and you can see right here on the screen, 46.7% proficient in english, 34% in math. i mean, what they're saying is half can read properly and a third can do math properly, bob. this is about as bad as education can get. >> the learning loss in the state has been off the charts sense covid. and california actually has an

education budget that's larger than the budgets of many states and yet we're still seeing these tests just plunge through the floor. and there's a lot of students missing. that's another thing that doesn't get discussed, a lot of them never came back after covid when they were sent home for two years. >> trace: private schools? private schools could refill their enrollment rolls twice over if they had the space they just don't have the space so a lot of kids are home schooling. i want your take, this is lebron james went to his son's usc basketball game bronny tonight someone post order x. following lebron james, casually we don't have the video casually walks into the video while the national anthem is playing and takes him a seat. zero respect for in the country that gave him the opportunity to to be a basketball star zero respect for the credit i that allowed him to be a billionaire, zero respect for the men and women who defend the country so he can live his life.

bethany while you're talking but you look at this and at what's happening in youth sports and what's happening with kids around the country and test scores and so forth and you think what in the world are we doing to our kids. >> you had to bring in the resident mom here. every house with a lot of children like mine, i have six kids, of these fights every day but it's disturbing to see this coming from adults. piggybacking off of your point just now, i think that it's all part of the same problem of adults prioritizing their feelings and failures. these folks at the game the referees decided they wanted to fight and they did not care about what was best for the kids and he so they fought. this is sort of representative of what a lot of adults, especially since covid, have decided to do, to prioritize themselves over the needs and best interests of children. >> trace: it is such a great point that, you know, you talk about the whole thing when the

teachers union we saw this, they didn't care, didn't give a hoot about the kids, they cared about themselves. the la times write some 70% of athletes drop out by age 11 primarily because sports aren't fun anymore and 80% of referees quit within two years. there's a reason, right? who wants -- when i played, you couldn't drop out because there were only a few kids. you had to keep the team together. you now it's just a totally different situation. >> yeah, i mean, when i was a kid i remember the refs giving all of the kids and the parents and talking to about proper etiquette and fast forward now an undisclosed numbers of years since my childhood, now it's the referees who are doing this stuff. it's representative of the total societal breakdown we're witnessing with members, people of authority of all kinds from the government down to like youth referees. >> trace: and that's exactly right, it's people with authority we look up to those people the coaches and they're the ones fighting. here's the thing the national
