a congress? the laws are meaningless. our immigration laws have been around for a long time. they are very effective when they are enforced. we literally have millions and millions of people coming into this country and we do not know who they are. they are not being vetted. we have people coming into this country that should not be here and are not being deported we have a border patrol that's busy changing diapers. a border patrol that's busy cutting the razor wire the state police in texas are putting in place. hence other words the non- than the things a president is supposed to do to ensure our immigration laws are being upheld are being done. that is, and all the blood a disaster as a result of it is a clear impeachable offense. what is important about this? i do not need to know about bank accounts, wire transfers i do not need to issue a subpoena i do not need to know any of that or do any of that it is

uncomplicated. joe biden is by action and word, as is his secretary of dhs of violating intentionally the constitution of the united states. undermined the power of congress. destroying the ability to enforce the protection of the border which he is compelled to do under federal statute. that is article one. article two, the power of the person belongs to congress. more specifically the house of representatives. how do we know that? because it says those. congress, more specifically the house, they determined raising taxes, raising the debt limit, borrowing, all of it. the president does not have that power can you imagine if he did? again we would not eat a house or a congress. so, when joe biden decide i'm going to forgive half a trillion or a trillion dollars in student

loan because they are my voters. for whatever cockamamie reason he does not have the power of the purse to do that. he cannot, on his own, issue a fiat or a directive that the treasury won't collect half a trillion dollars or a trillion dollars. that matters taken to the supreme court. the supreme court said joe, you do not have that power, do not do it. joe says what an extremist right wing out of control supreme court try to tell me what to do trying to uphold separation of power in the power under article one the power of the purse. i want to seize the power of the purse. i want to make these decisions so joe has actively gone around in ththe constitution, the cong, has defied the purpose and directive of the u.s. supreme court. and has now given away at 400 -- $500 billion of taxpayer dollars

in violation of the constitut constitution, that is article two of impeachment. article three, what is the primary responsibility of the president? we have one commander-in-chief. he is the commander-in-chief. what if we have a commander-in-chief that takes steps that empowers our sworn enemy? that takes steps to issue waivers that allows tens of billions of dollars to flow into the coffers of say the iranian regime. a terrorist regime which has murdered american citizens. a terrorist regime which is take an american citizen hostage freight a terrorist regime that seeks to get nuclear weapons, to point them at us. that causes the biggest sainted that makes it clear they want to topple the united states. we have a president of the united states who not only gives aid and comfort to the enemy he literally gives a billions of dollars to him by his actions

and his aunt actions. they take that money and fun hamas. they fund hezbollah, they tran the houthis sprayed this is a regime that sought to assassinate a former secretary of state. a former national security advisor. this is a regime that seeks to destroy america. today they are trying to kill american soldiers that joe biden has put overseas. they are attacking american bases overseas. who were funding our enemy. that is an impeachable offense. that should be article three. joe biden is literally funding a terrorist regime that has killed american soldiers. hijacked american citizens. has done all kinds of things and has its intention of building nuclear weapons to threaten us among others. that is article three.

case a sea of violation of the first amendment trumps free-speech rights a sea of violation of the fifth amendment when they took away his attorney-client privilege i see a violation of due process therapy a sea of violation of the sixth amendment when we have a judges us were going to ram this all into a five month period at grammatical draft criminal case they take two or three us with the discovery of everything else he said no we'll do it in five months the day before super tuesday. six mm the right to a competent counsel counsel said we can't get this done she said sure you can. also that she refuses to recuse herself giving her hyperbolic statements that she has made in other cases. but this a prosecutor seems to be dragon the judiciary along with them. he is in a rush she wants trump tried and believed convicted of four phony chargers during the course of the election to try to prevent trump from being president. so then we are fighting over whether he does jail time or not we are fighting over whether in

fact he committed these crimes. but he has done something i think really outrageous year of which the constitution and the office of the presidency on the line and this is what i want to ask you. i filed a brief with the supreme court he says look, donald trump is arguing that he is immune even today even as exit president from things he did as president he thanks he is a king. so it's not in the public interest to let this go on and on and in fact this needs to be resolved here and now. so supreme court, i want you to take an emergency appeal. and when the skip over the appellate court process because we are in a hurry. i want you at the court to take this argument and resolve it right now. given the gravity of this case, given the fact we actually want to hear from a circuit court and how they think this through the supreme court should take its time. what do you think of this? >> you are too kind to jack smith he's not a prosecutor he

is a democratic operative. operative in a position of power to basically try to create a railroad kangaroo court scenario of trying to convict president trump prior to the election of 2024 you are right he is basically trying to get the supreme court, which i hope the supreme court does not take up. they are going to have hearings but i hope this gets referred back to him to the appellate court we have to understand the rule of law is being circumvented because of politics. when people try to analyze this case and jack smith and that judge who is also a democratic operative the rule of law is being dismissed. it is being ignored. donald trump has rights as a citizen, as a president, have been violated because the rule of law and justice is not important. what is the motivation? thirty years of practicing law

what is the motivation for jack smith to say supreme court ignoring the court of appeals. ignore looking at case law their ruling in their decision-making and procedure. why are we in a hurry? because of november 2024. because a democratic party is prosecuting this case. not the department of justice but the democratic party and i find it offensive if this case is heard by the supreme court it should be sent back to the court of appeals. the proceeding should stay in the process work. donald trump was absolutely right. but they are doing to him they will do to anyone who loves this country, who believes in the constitution they want to tear up the constitution they want to ignore the constitution. you mentioned all the rights that were violated against donald trump. they do not care. they do not care because you know what it's all about? it's about power and control.

the democrats, the left wing at the progress of one power and control. if we do not keep our eye on the constitution that will tear it up, they will destroy it and say where is it? we lost it. they are not interested in the constitution. they are not interested in keeping this country unique and separating us from being a banana republic. mark: wels i don't want to emphasize a particular constitutional point to the american people as well. the president is immune from prosecution not because the constitution says so because that is been the position of the department of justice for half a century, why? because the president is the executive branch. if you allow and i don't like to prosecute i don't like to judge they are not elected jury. to charge eight president to try a president may be convict a president but even the process where an individual just a common individual has spent an enormous amount of time to protect their liberty to protect

massive, wouldn't it? what's it would be horrendous. the key here is why were they taken up? there is no need to take it up. there are three supreme court justices on that bench we know who they are, who were solid, who believe and understand this should be sent back to the court of appeals. but there are some i am concerned with i do not want to mention any names the chief justice i'm worried about him. i am worried that he may look the wrong way and not recognize the importance of the constitution. i am concerned. the key here is this they are in the position to set this country back basically create a chilling effect on the executive branch of this government. we have to make sure this does not happen. they also are going to take up the generate six cases involving some of the defendants which affect the 300 individuals. mark, what i do not understand is jack smith had a loss it does

not apply to the actions that were taken. he is using a clan a statue against trumpeters using enron statute against trump because he's trying to purport the law to somehow convict trump to prevent him from running for president. the supreme court has an affirmative obligation to send this case it back to the court of appeals and let the normal process take place. why did he wait 25 months to pursue this case? it is to upset the november election to upset 2024. to prevent donald trump from running for the white house and to prevent him from winning the white house. it's not going to happen but this is the game plan of jack smith. this is a game played of the democrats. mark: there is absolutely positively no constitutional, legal, national security or other reason for this rush.

this emergency to the supreme court's for this early date of the trial, none except a political. you are one 100% right and here's the problem as far as i am concerned in addition to this. this prosecutor is dragging the district court, the circuit court, and might drag the supreme court into this hole. it's the job of a judge certainly the job of the supreme court to uphold the constitut constitution, separation of powers to do no damage to one branch or the other. and i want to suggest this to you and i would like a response. if this court that was so reluctant to get involved into pennsylvania cases during the election, serious constitutional challenges, who gets to make election laws? the legislature of the board of elections on the governor. they would not take that case up let alone jump it over to an appellate court. why would they even consider taking this case up rather than

say no, you go through the process. we are not here to serve the interests of the biden administration, the d.o.j. in this rogue prosecutor. do you think justice roberts and the others are intimidated by the media? or do you think they understand if they do what is fundamentally the wrong thing in both process and substance that the supreme court will never again. never again have a reputation of being objective and honestly interpret the constitution. approximate think about that, yes i am scared. between the two of us we have over 60 years of practicing law. we cannot be naïve about this. if we are going to look at this a purely as a legal hates question there is no doubt about this should be sent back to the court of appeals. but mark, we cannot beat naïve is the supreme court impacted by the politics? are they impacted? they shouldn't but if were going to be upfront and honest i am

nervous about the political impact the court is looking at or looking through in order to make a decision. they should not they should keep their i am focused on the constitution the checks and balances. ignore the political pressure that's what i thought the supreme court was therefore to ignore the political pressure. you just mention the pennsylvania case. there is no basis for them to take this case up none whatsoever. but that political impact has been around for a long time. the supreme court completely immune from the put up a quick pressure? i do not know but it scares me because our country is at issue. the supreme court has a fundamental right to ignore it and to focus on what is right. what they are obligated to do under the rule of law and that is what concerns me. mark: let me suggest the supreme court takes this case up and rules the way the government wanted to rule and joe biden when he's an ex-president could face criminal prosecution for a

number of issues whether it's the border and so forth and so on. let me go even further as we wrap this up we have the appellate court that ruled reald trump is subject to personal civil litigation from a policeman on generally six as well as a member of congress. let me explain something here. you know what that means, leo? that means every single person who has been adversely affected by an open border policy whether family members have died, bent rapes, their properties been destroyed, their business has been destroyed, some expense as a result of that circuit court decision to washington d.c. street single one of them has standing to sue joe biden personally. break him economically and break him otherwise. that is what happens when you have judges issuing stupid rulings because they don't like the defendant or the complainant's.
