i'm dana perino along with jesse watters and greg gutfeld. it's 5:00 in new york city. this is "the five." america, just when you thought you'd seen every scandal out of washington, there's this. a staffer, ben carter, is out of a job. it comes after a graphic sex tape was filmed in an historic senate hearing room. capitol police are investigating how it was allowed to happen. the senate sex tape was recorded last week but the time of day is unclear. it's the same esteemed place where supreme court justices had their confirmation hearings, where the 9/11 commission uncovered what happened there and where's james comey testified against former president trump. the identities of the people involved in the video haven't been confirmed but legal experts think they could face criminal charges like trespassing. meanwhile, some of the media are really spinning this story.

um, it does make it on the serious note really hard for people who are actual victims of homophobia or discrimination in any way whatsoever. he had had problems with this before with the social media post. i know he's trying to reference back as well. he had made some comments about free palestine, etc., that obviously the gay community in palestine is not thriving. certainly wouldn't get to do it at work like that and only lose your job for it, but it does make a mockery of people who have real discrimination going against them. and he should be investigated to the fullest extent, whatever the law is about that. i doubt they have something on the books. >> we'll have to create -- there ought to be a law, maybe. the other thing, remember just a few months ago, there was this uproar about the relaxation of a dress code on the senate side so people still want the place to be revered as a place of dignity where we do the people's business. >> well, i usually try to do a lot of research to come to the

wanted to get pardoned after that meeting because he apparently has a temper. the way i read the article was not so much he was mad at them but that he was concerned about them not towing anything about it my concern -- them not doing anything about it. my concern was about the staffers. what do they do? they must have thought the economy was going great. you can read any mainstream media article about how americans seem to not understand how great the economy is. why don't they feel so good about it? other thing is in the recent polls, he's even under water on an issue like climate change. even though he's gotten so far to the left, it's never going to be enough for them. that's become a vulnerability for him not just with democrat but with independent voters as well. on the barack obama thing, if you read the article, it says that a person familiar with barack obama's thinking said that he's concerned that biden could lose. that's really only two possible people. it's either obama himself saying

he doesn't sell his own product. the biden campaign isn't doing much in the states where they need to be campaigning really hard. they're taking for granted they're going to win these swing states. now, new polling shows trump beating him in all of these places. they assumed the far left mandates would be accepted like the electrical mandate for example in places like michigan because joe biden agrees with the working class and his blue-collar joe. none is working. instead of being at the white house working on these things or out in the country really selling them in a genuine organic way, everything is very calculated and scripted. he just doesn't show up. you can't really expect people to be buying your product if you're not the one selling it. >> bidedonomics has become hidenomics. jesse, this motorcade accident is a metaphor for his administration. care to expand on this analogy?

black knell loves to wear t-shirts that say police are trained to kill us. here is the kicker, she once boasted about being a looter herself during the rodney king riots herself by saying, "i was a looter in 1992 when the opportunity arose. we took some [bleep]. don't come on my page complaining about protesters or looters." so, greg, isn't this just another step in d.a.'s -- george gascon -- tearing down the current system to replace it with his own? >> it's weird. when communities [indiscernible] they simply hire more radicals that enhance division. there's an underlying fear if blacks, whites and browns wise up and band together to throw out these radicals, they need to stress division even more, and that only makes the cities worse. it's a vicious cycle so they make it about race. they make it about identity to keep the citizens divided and therefore powerless. but this, again, is a what/where

keeping the community safe? >> i don't know why we're seeing shortages in almost every major city. you hear the press conferences from the chiefs of police who most of the time are democrats as well talking about how there's a tremendous disconnect going on and that they can't rally the troops to go out there and to do this job and people are taking an early retirement. it's a huge problem. but there also is -- it kind of connects back to what we were talking about in the last block -- a big disconnect on how people are feeling and the actual stats on the grouped. the fbi released their data for the third quarter of 2023 and compared it to this time last year. no one would deny, of course, there was a surge during the covid period but violent crime is down 8%. property crime is down 16.3%, at its lowest level since 1961. i've been talking about the drop in murder rates. not in washington d.c. that's ant outlier but in the major cities like new york where we are, in chicago, in los

angeles, and it's not getting any traction, that story. i understand that crime is a what-you-feel problem. it's definitely a what-you-read problem. gallop has 77% of americans across democrats, republicans and independents who think crime is going up. you look at the fbi data and you think how is this disconnect, the chasm this large? >> dana, isn't that a lot like saying inflation is going down? >> it's the same issue. >> look at the statistics and say the stock market is up and there's more job openings than ever. why do the people feel so bad? well, take one thing. what do people have to buy every single day for survival? food. food is up. they will not forget that. also there are consequences for some of the crime that hurts everything else. for example, washington d.c. losing the two major sports teams to go to virginia. what did that mean? that means that that area which was just redeveloped with a lot of money and was a great place to go, now what happens? they leave.

that means nobody else is going to come. no one will rent the hotel rooms, go to the restaurants, the small businesses, so you start to see the quality of life go down. that's a big issue with this one with gascon. one of the things this woman had done before in her career, it was reported in 2020, she went behind the backs of the prosecutor and the victim's family and worked with the defendant in order to get him a sweetheart deal, a plea deal. that worked. so as a public defender, it wasn't to defend the public, it was to defend the defendant and make things easier for them. gascon i think is a victim of this idea that if i surround myself with people who agree with me, then i'm going to get better. that's not necessarily true. actually in our next block, you're going to listen to a great leader who has a very different management and leadership philosophy and that's why he's been successful. >> jesse, picking up on dana's point about the criminals that they don't want to be in prison, child sex offenders, cop killers, people who kill and attack nurses while they're waiting for the bus to go help

other people in the hospital, these are the kinds of people that they are defending and keeping out of prison so they can reoffend and hurt more people. >> they need sixth and seventh chances, katie. don't you understand they're victims of the white supremacist criminal justice system and won't heal until we empty all the prisons and defund all the police. there's only three options why he hired this woman, one, he's in love with her. two he didn't vet her. three, he vetted her and thought i'm going to hire a cop-hating looter. now, when we do hiring around here, i look deep. i go into the instagram. i go into the facebook. i go into the my space if i have to. i look at t-shirts. i look at what kind of alcohol is sitting next to them. i look everywhere. if i see one thing that makes me suspicious, red flag. we don't hire them. >> remember that time you broke into that house? >> do you remember? >> yes. >> then we moved stuff around and made it look like we weren't in there? >> yes!
