it is 2:00 in the afternoon, the southwestern tip of iceland. that volcano we've been watching for weeks has finally erupted. look at that. there is a lot of concern for those in the area. we're on the story as it develops. i want to share that with you as we begin. first, however, got to get to our own border. it is at a breaking point. agents say the crisis is worse than ever and now the state of texas is going to try something it has never done before as we say good morning. i'm bill hemmer live in new york city. it's tuesday. hello to my partner here. >> dana: i'm dana perino and this is "america's newsroom." sit a little chilly in here. i'm holding onto my hot cup. everything is fine. fine. we want to get you to these numbers. this happened yesterday. a staggering 4500 people crossed in the del rio sector alone. the southern border saw a total of over 12,000 people yesterday. >> bill: this is part of what greg abbott calls a tidal wave

of illegal entry. he has been saying that for three years. it prompted him to sign a new law that would criminalize illegal immigration on the state level. >> dana: the law authorizes police to arrest migrants despite the border enforcement is a federal responsibility. the biden administration is expected to challenge this in court. governor abbott says the white house left him no choice. >> biden's deliberate inaction has left texas to fend for itself. the authors of the united states constitution foresaw a situation when the federal government would be inattentive to states that faced challenges at their borders. and in response they inserted article one, section ten, to the united states constitution to empower states to take action to defend themselves. and that is exactly what texas is doing. >> dana: bill melugin live from lukeville, arizona on what is happening there. what's happening in eagle pass and the new decision by governor

abbott. hi, bill. >> dana, good morning. we keep breaking records down here. cbp sources telling fox news in the last 24 hours there have been more than 12,600 migrant encounters at our southern border, the highest single-day total ever recorded in the true number is significantly higher. thousands of migrants are waiting for processing in eagle pass completely overrun yesterday. the video sent to us from a source on the ground in eagle pass last night. stunning footage showing thousands of illegal immigrants waiting for border patrol to pick them up and process them. i can tell you i spent hundreds of days in eagle pass over the last couple of years and never seen anything like this that bad in that area of the border. it is remarkable and it is still happening this morning. take a live look at our fox news drone over the city of eagle pass right now. you can still see the mass of hundreds of migrants.

the numbers are stunning. as of today, they already have 5,300 migrants already in custody. still trying to transport another 4,500 of them. they are essentially dealing with 10,000 migrants out there. the city of eagle pass population is 30,000. they have a third of the city's population camped out there that they're trying to deal with. as a result, you will see the bridge in the background, a railway bridge going into eagle pass. cbp closed down that bridge as well as one other railway bridge in el paso because they want to redeploy cbp personnel to help out border patrol and shutting down international commerce in certain areas. union pacific uses the eagle pass and el paso border crossings -- urges the eagle pass and el paso border

crossings be opened immediately. 450 rail shipments move across these annually. 1 million trucks to move the same amount of goods. these locations represent 45% of cross border union pacific business and include goods critical to the u.s. economy. shutting down international commerce to speed up migrant processing. this is lukeville last night. hundreds crossed illegally through a breach in the border wall. a lot of single adults. setting campfires and try to stay warm overnight. a couple weeks ago we showed you this. more people have crossed overnight. a live luke in lukeville. this is happening across the southern border. mixture of family units and single adults. talking to you some from guinea, liberia, bangladesh. the tucson, arizona sector getting pounded. they had more than 3,000 migrant

encounters here yesterday. border patrol resources stretched remarkably thin here and the del rio sector dealing with this in eagle pass as well. it goes to show you december is traditionally a slow month at the southern border. it used to be until the biden administration took office. we are getting record setting numbers multiple times this month. it is only cranking up, not slowing down. >> bill: last week you said i wish i could give you different words to describe what i am seeing here but the same thing every day. now with the uptick you are december tribeing today takes it to a new level. is there an explanation they give you as to why now? do they see something in u.s. policy or politics that would give them and the cartels reason to push forward? >> so we asked that question to all of the migrants who come across. a lot of answers we get they felt now is the time. we'll push them and say why is

now the time? several have referenced president biden and the policies they feel they will be released into the united states. we had that gentleman from morocco tell us i love you, joe biden, thank you for everything, joe biden. he told us he wants to go to new york city. we found out a few days after that interview he was released by border patrol and is new york city right now. they know if they get here and they set foot on u.s. soil they have a very good chance of being released. i will add cbp sources tell us as of this morning they have over 25,000 migrants in federal custody. that's way over capacity. so these mass releases are only going to crank up in the coming hours and days and more people are still coming. so the situation is just getting worse. >> dana: can i ask you one thing about the union pacific railroad? i understand what the company is saying. but are we also seeing this surge especially in eagle pass because of everybody who came on the trains last week? >> that is part of it.

that's correct. some of the trains coming up through mexico we've been showing the videos, thousands of migrants will try to hitch rides on them and that is part of the reason they are shutting the trains down. however, union pacific is saying you are also shutting down half of the traffic that comes into the united states when it comes to goods, automobiles, different types of commerce that come into the country. and critics will say well, the mexican government should be taking more of a pro-active approach to get people off those trains and stop letting the trains come up through mexico with thousands of people on them. once they get here to the united states we can continue international commerce. it is a disaster right now, guys. thousands of people trying to get processed, trains being shut down, commerce being affected. it is not just affecting the border areas. the trains go deep into the united states and spread products across the united states. yes, if this continues to keep going on for the coming days and weeks the u.s. economy will take

a hit as a result. >> bill: thank you. james freeman and "wall street journal" fox news contributor. here is what we find most important issue facing the country on screen number two is immigration. the border now at 19%. i imagine, james, that would be higher if more people covered it. >> yeah. they are starting to. we've seen over the last year obviously done a lot of great reporting on this. other networks and the white house had to pay attention. what's still puzzling is the president's response here. this is not good politics for him. nobody likes chaos and lawlessness. the excuse or the explanation a lot of people have given is he has to cater to the far left of his party. well, early in his term wanted to prevent a primary challenge, maybe, now deadlines have passed to get on ballots. i don't think he has a credible fear from marian williamson, why is he still refusing to address

this issue? >> it's not that they haven't refused to address it. they haven't dealt with it in a way that's helpful. they have actively worked against the governors in arizona or texas to make this problem worse. texas governor abbott tried to put that buoy in the water. the government sued. border walls being built outside of the federal jurisdiction they sued in arizona to take those down. he has abandoned this issue for the sake of politics but he actually has been working overtime to make this harder for governors to deal with. meanwhile, this issue is bleeding into every other part of the country whether it's cities, local budgets, economy, healthcare systems, education systems, travel. you want to know why airline tickets are so expensive? the federal government is buying a lot of them through the ngos and supplying and demand is more expensive for people going home on the holidays.

>> dana: we find out today there is angst among even the biden family about the poll numbers and how bad they are. call for number four shows that 68% of people are dissatisfied how things are going in the u.s. but james look at this one. democrats see a 27.increase in dissatisfaction as well since april of 2021. this issue is one republicans said we're willing to deal with you. we'll allow you an opportunity to help solve this problem even if it helps you politically on the border and it looks like that's not going to happen at least not before january. >> it is mysterious. he now has, as you say, this great opportunity if he wants to say to the left i had no choice where the foreign aid bill supporting our friends around the world is now the leverage and why he is not choosing this moment to take a win, as your polling shows would be a win for him among democratic voters

along with everybody else. it is bizarre political behavior. i can't explain it. >> one thing that stood out in the polling that was very interesting. not only are people dissatisfied with their economic situation, but by a 32-point margin they believe they have been harmed by joe biden's economy. that's different than just feeling like things could be a little better. they believe this administration has been harmful to their family and not better off now than four years ago and looking at that on top of this immigration issue which is affecting everybody inside the country whether you live in a border state or you live in new york city. >> bill: the other number is that only 14% of americans think that biden policies have helped them. i don't know if it's ever been lower than that ever. >> bill: his approval number is getting close to -- the low 30s in a lot of these polls. dangerously close to the high 20s. democrats are worried about it. >> dana: they are not hiding they have some anxiety in the white house, and they should.

see you on "the five." >> we're just securing the area and closing every road to the area. >> this is just fascinating to see nature in action. i just -- it's like something from a movie. >> it is still amazing to see but yeah. that's kind of a bittersweet feeling at the moment. >> dana: back now to the volcano in iceland. bryan llenas has the latest on this. you were there for quite a few days. you must understand what they are feeling when he says bittersweet. >> absolutely. we were there about a month early and yeah, i can understand what he is feeling. the people there. this video and images for the rest of the world are breathtaking. for the past 16 hours the world has been watching live as lava spews from this 2 1/2 mile long

crack in the earth's surface. at one point the fountains of lava shooting up 330 feet into the air flowing at a rate of 66,000 gallons of lava per second. that has since decreased this morning to a quarter of that. here is the moment the volcano erupted at 10:17 p.m. iceland time. 5:17 new york time yesterday. it took place 37 miles from the capital and 2 1/2 miles from the village. the town of 4,000 people was fully evacuated on november 10th after thousands of earthquakes caused damage and raised fears of an imminent eruption. iceland is monitoring the lava which at this point does not appear to be flowing toward the village. the government says there is no threat to life. over the last two months the country raced to build defensive walls to divert the lava around

a geo thermal power plant that powers 30,000 households and the blue lag own is there. those walls are 80% complete. no disruptions to flights to and from iceland. international flying routes are expected to stay open because there are no huge flumes of smoke and ash. winds are forecast to push the sulfur dioxide gas away from the populated area. iceland is feeling quite lucky how it shaped up so far this morning. a couple things to monitor, how long does the eruption last? it could stop today, could be weeks. whether that crack expands. a lot of seismic activity in the last few years. this is the largest volcanic eruption they've seen in that time. >> dana: good point about the air travel as well as everyone gets ready to head out and about for the holidays. thank you, brian. >> we feel like we're being

>> bill: mark your calendar. hunter biden has a court date on the california tax charges scheduled to make his first appearance in l.a. federal court on january 11th. arraigned on nine charges including filing a false return, tax evasion and failure to pay. three felonies. it's part of weiss's investigation after the plea deal on the gun and tax charges back in delaware fell apart. stay tuned for more on that. >> dana: republican lawmakers pressing on with their probe of the first son's alleged influence peddling scheme. they now want to speak to president biden's brother james after hunter defied a congressional subpoena last week. that happened on our air if you remember. alexandria hoff live in washington with more. >> we're seeing the brother's brother james more prominent in selling the family name for cash. a chapter 11 trustee told the house oversight committee yesterday that james biden was

given a $6 hundred thousand loan while his brother was vice president for failed promise to secure funding from the middle east through the use of his last name. separately the "washington post" is reporting that famed mississippi attorney scruggs paid james biden's consulting firm $1 hundred thousand in the hopes of swaying then senator joe biden. a quote from that report. scruggs deal with james biden highlights how president biden's brother has for decades benefited financially from his proximity to his powerful sibling. a relationship relevant today as republicans investigate president biden assisted his family members' business deals. here is james comer. >> he deserves due process as you know. the facts remain this family has had the reputation for a long time of being for sale. we know the president's family is in trouble because the son continues to get indicted in multiple courts and we have serious questions about our national security.

>> hunter biden has been accused repeatedly by house republicans of an elaborate foreign influence peddling scheme and what makes it very interesting, particularly right now. any day now president biden is expected to sign off on the recently passed national defense authorization act. in it is a new provision that makes it criminal for foreign official eaves to demand bribes from companies hoping to do business with them. while the white house is pushing to fight bribery and corruption abroad, republicans think that democrats are ignoring the problem much closer to home, dana. >> dana: thank you for that update. >> sure. >> there are a number of significant issues our colleagues are still working to resolve. the effects of years of failed border enforcement are compounded. >> bill: they're still working on it. senators held a rare meeting on sunday on border security. they did not reach a deal. in exchange for more aid for

ukraine. the live look in eagle pastels you this issue is not going away. it could get more heated come election year time. james langford is the top republican negotiator. senator, good morning and thank you for your time. last week you said you look at one issue and there are 100 other issues underneath it. characterize for our audience how you see your measure of negotiation thus far. >> we are making real progress on this. we have everybody at the table and admitting it is a national security creels is we have to address. that's progress that may seem shocking but it is a long time to get to this point. we had the highest september and october in his and november and this will be the highest december in history of any crossings of any time on our southwest border. it is spiraling out of control as you have highlighted over and over again. our focus has been on how to get it back under control. setting caps and limits.

dealing with how we process asylum. we aren't just releasing people to be able to do asylum later. they have to do the qualification right there and turn around people that don't qualify to get this under control. we all know it. it is getting common agreement on it. >> bill: i wonder how many democrats will sign on to that. here is what i'm thinking, right? joe biden is under pressure from the left. the open border policy is something that he essentially supports. we've watched that for three years. i don't think you disagree with that, in fact. the left has never liked the wall. meanwhile republicans say the wall is where you need to start and if you are that far apart, in an election year, will anything be solved in 2024? >> yeah, it has to be at this point. it is reaching such a large volume that even those on the left are stepping out. the interesting thing this issue is only political in washington, d.c. everywhere else in the country this is not a political issue. everyone sees it for what it is.

a national security issue. no one can look at what is happening on the border now of 100 to one of agents to people coming across the border and think it is good for the country or safe for the agents and that's a situation that is sustainable. whether you are in chicago, new york city, or whether you are anywhere else in the country you look at this problem and understand this is absolutely spiraling out of control. we're trying to say to democrats listen, this has to be solved. you don't want to solve it. we'll actually push to get it solved and it will be politically beneficial for democrats to get it solved and take the issue off the table. >> bill: this administration has shown its hand repeatedly. it sued texas to get the floating barriers out of the river. sued arizona to get the shipping containers removed a year ago. you just said even the left is stepping out. what does that mean and who? >> yeah, you've got the far left that they are for open borders.

they don't want to see any limitations at all on this. you have a significant number of democrats coming on board as you see in all the nationals polls now the number one issue in the economy and number two is illegal immigration across republicans and democrats alike. they see it as a major issue that has to be resolved. so there are more and more democrats coming on board sayings i may not like the solutions but you have to do something to be able to solve this. we're trying to pull that group of democrats saying come on, let's solve this issue on this and be able to protect the nation. >> bill: clearly it is going into january, we can say that, right? >> it clearly is going into january. we can. >> bill: we shall talk in january and see whether or not you have been able to roll the boulder further up the hill. have a great holiday when you get it. >> merry christmas. >> bill: thank you for your time today. >> dana: republican frontrunners and his rivals barnstorming

trump lost the iowa caucus. his campaign making sure it doesn't happen again. reuters was quoting a new campaign official from the trump campaign who said, quote, trump's campaign team projects he could clinch the republican presidential nomination by march 19th given his lead in the polls in the early voting states. overnight iowa's republican governor reynolds who is supporting ron desantis told voters trump is trying to mislead iowans with ads showing past comments she made praising trump. >> now he is using me to mislead iowans as if i'm endorse being him. i want to be clear. i supported president trump in 2016 and voted him and supported him in 2020 and agreed with his policies. it is a different day. it is a different time. and we need a leader that doesn't have -- that's not distracted. >> former u.n. ambassador nikki haley who also backed trump in

2020 has been making multiple stops in iowa stepping up her criticism of governor desantis telling voters he is lying about her record and that she plans to be more aggressive in her response. i think that's been the most notable headline in the last 24 hours of haley coming to iowa has been becoming more aggressive not only in attacks against desantis but later on today probably with trump. another candidate doing more events than anybody else in iowa in the final week before the holidays. vivek ramaswamy has seven events on the calendar today. a lot of gas to barn storm iowa. >> dana: back and forth, up and down. >> bill: in the meantime video is tough to watch for some viewers here. five high school students in parkland, florida facing charges in the brutal beating of another teenager. i mentioned the video may be tough to watch. here is part of that now. watch. that fight happened in a parking

lot of marjory stoneman douglas high school. the site of one of america's worst mass shootings in 2018. four of the suspects and victim attended the school. quite a fight there on that blacktop. >> quite a fight. disturbing images outside that school even after theed iting that we did just so that you didn't have to see some of the more graphic content there. all of it captured on cell phone video. in it you see several attackers flipping a high school senior to the ground and what you don't see, what we don't show you, is where his head strikes the movement. a friend says the vick tm suffered a cracked skull and taken away in an ambulance. his injuries were not life threatening. the attack happened after school last tuesday in the student parking lot located in a corral springs city park next to marjory stoneman douglas high school in parkland, florida. police have arrested five

students, two 16-year-olds, two 17-year-old and a 15-year-old from another high school each charged with felony battery. it occurred in the shadow of the 2018 mass shooting at the school where a former student entered the school and opened fire on students and staff killing 17 and injuring 17 others. now, corral sprains police are asking for the public's help in identifying a sixth suspect. another male teen seen in that video. they have published a still photo of him on the corral springs police facebook page. back to you. >> bill: tough to watch. hope it all works out for that kid. jonathan serrie, nice to see you. >> dana reads sports. >> dana: if you stayed up last night you saw a last second shocker in seattle. seahawks stunned the eagles

volcano is erupting in iceland happening as we speak. the plume is going north to northwest which means it will not cause any sort of toxic situation for highly populated areas there, nor will it disrupt air travel at this time. but they're very concerned that other seams could open up. we're watching it and keep you posted. carley and joe have been studying the film. he has a way of being there. >> it's incredible. when alec baldwin saw a mob of people approaching he probably thought are these all my children? can we address the irony of asking him to support a cease-fire? a little late on that. but i don't like alec baldwin but i have to take his side on this because he was minding his own business and they came to him. i think this is a dangerous precedent we are setting in new york. mobs can approach you and demand you say a political opinion. he has a right to walk down the streets without being asked questions. >> penn station he was going to an acting class where he was volunteering to teach. what do you do in that situation? he is a recognizable person. these protestors just swarmed

him. one of the protestors shouted do you denounce israel or something like that? his response was no, but i want peace in gaza. which should be a reasonable response. pretty good answer that could have appealed to them but you can't appeal to these people because they are not rational. they are angry. i also don't really think they're legitimate protestors. they are in a way out there marching and protesting, but protesting is supposed to appeal to people and they are just annoying people. and just really quickly the "new york post" had a great op-ed on this. the editorial board writes this approach is the exact opposite of the one taken by reverend martin luther king senior who aimed at order lie and peaceful protests to appeal to people's better angels of america's soul. a great point. >> bill: that thing wrapped up. you want to do this thing on tiktok? we did a poll wanting to find

out. >> dana: how many people are using tiktok? it is a lot. how many people are in favor of banning it? it has a majority. over age 65 is 50%. there is a generational divide on this. >> bill: i was actually surprised at 33% of people under the age of 30 supported a ban for tiktok. pleasantly surprised. i would have thought it was lower. so many young people are on it. i thought the interesting breakdown was by political party. 71% of people who consider themselves very conservative are in support of this ban. and then very liberal 35%. so watch out for 2024 if the republican candidate wins what he does with it. >> bill: what do you think, joe? >> when they had whatever meeting they had of america's enemies. china nailed it. they said we'll make an app that wastes everybody's time and it

watches, very popular. >> dana: it's very interesting. a little company can say not so fast, apple. apple might back off. wanted to bring you this story. volunteers are the lifeblood of nonprofits. according to the u.s. census fewer americans are taking part in charitable activities. that number dwindles over the last ten years down to 56%. the need is still great. joining us now is nathan dietz with the do-good institute. people most likely to volunteer. age 45 to 54, 27%. call for number one there. nathan, what do you put this down to in terms of the decline in people participating in charitable activities? >> well, i think right now people are noticing what's happening within the nonprofit sector because of the effects of the pandemic which are still

going on. at the do good institute we started studying these issues a few years ago. what we noticed is a decline in the percentage of people who volunteer, adults who do any volunteer work actually started more than ten years ago. probably about 2012, 2013 we started seeing slight declines in the volunteering rate and kept happening. i think people didn't notice those because they were so small and seemed -- the sector has been concerned about what's been happening with the volunteer rate ever since then. >> dana: do you have any information why there has been a decline? are people working more hours or wanting more time with family? >> i think -- you know, the usual factors i think that people might be -- might have in mind when they think about why people don't volunteer. people working more hours, the fact is people who are employed full-time have always volunteered more than people who don't work at all. people who work part-time

volunteer more than people who work full-time. some factors, i think, have always been constant. the length of time that you have to spend commuting to work every day takes you out of the community in which he live and makes it harder for you to commit time to volunteering. i don't think that's changed very much over the past ten years. >> dana: are people still being generous in terms of the financial giving to a nonprofit where you might find some volunteers or is that down as well? >> that is down as well. that's something that another group of researchers focus on volunteering first pointed that out. in that case i think you see the same dynamics as you see with volunteering. i don't think people really notice the decline in the percentage of people who donate to charity because the total amount of money going to char itable organizations hadn't declined in general. >> dana: what's the practical effect of the decline on some of the places that need volunteers the most?

>> well, i think when you hear them talk about what happens with the decline in volunteers, i think it just disrupts business as usual and makes it harder for them to do what they always have done. the longer term impact on the decline and people participating in voll tearing and giving feel less attached to their communities and civil society is weaker as a result. >> dana: if you look to volunteer, does your heart and community good, where can they find information on where to go? >> well, almost every large community has a community foundation. there are united ways throughout the country and websites, one is volunteer match where you can find volunteer opportunities. in general i think talking to other people about that. >> dana: ask your friends and co-workers. >> that's always been the most effective. >> dana: thank you, the do-good st
