>> with to this special edition of "hannity." we begin with breaking news, the colorado supreme court has just removed former president donald trump from the 2024 ballot. in a 4-3 ruling. they have found trump ineligible under section three of the 14th amendment. breath taking. this amendment disqualifies sworn officials who engaged in insurrection, orders, four unelected judges are trying to preempt the will of the voters in the name of democracy that they are under mining democracy. incredible and using a so called insurrection as an excuse. the case will certainly be paled in the supreme court setting up a high-stakes battle to define the course of the 2024

presidential election. let me know exceedingly clear, this is the latest attempt by the far left to stop trump. the 14th amendment was ratified in 1868 and only used a handful of times. it was used to disqualify confederates. we have a court of the united states with a constitution of law to disqualify donald trump. there are serious problems with the ruling. first and foremost, jack smith looked over the facts and didn't even charge trump with insurrection or rebellion. why? because the facts don't match the law. in courts of law, you have to go this. take a basic law course and you will find that out.

schiff and others. the other thing we need to do, the historical context is very important. the people that wrote the 14th amendment in section three of that knew what an insurrection was. they have seen hundreds of thousands of their fellow citizens killed in a war between the states. they knew what an insurrection was. there was a riot at the capital and those have been held accountable. president trump said go peacefully and have your voices heard. this court ignores anything that's evidence that helps president trump and the supreme court will have the final say and i expect will reverse the ruling. >> so we hope that's the case. a lot of people say, can't we

write in trump's name in colorado? the opinion in colorado says, the secretary may not list president trump's name on the 2024 presidential primary ballot nor may she count any write-in ballots cast for him. literally taking the away the will of the people. >> this is election rigging, kaylie, it was a narrow 4-3 decision. it will be reversed by the supreme court. the insurrection clause in the 14th amendment was designed to go against confederates who took up arms in the war. you fast forward and donald trump isn't accused for insurrection.

certainly jack smith, the special council would have charged him with it. to remove trump from an ballot for an offense he hasn't been tried or convicted of, what is that? that's violating his right to due process which just happens to be guaranteed by the very amendment, the 14th and elsewhere in the constitution. there's another factor here, kaylie, you know this is a lawyer under past supreme court rulings the language used in the insurrection clause doesn't apply to the office of president or anybody running for it. colorado officials here have i think brazenly manipulated the clause for purely political reasons, another example of election interference by trump oppo opponents. this is an effort, make no mistake to deprive american voters of their right to make the decision as to who should be president. it is anti-democratic, it's the

equivalent of rigging the ballot box. and it will surely be seen that way only inflaming voters and i think boosting support for the former president. >> matthew, greg makes a really important point. there's been peer-reviewed articles. josh blackman down in texas made the point greg made. this is not intended to be applied to section three. you're confident the supreme court overturns this? >> i am. to that point, this talks about officers but lists of many, senate, congress, many offices that could be held and specifically excludes the office of the president. the supreme court of colorado says officer includes the president. there have been other state supreme courts that have looked at this. there have been other courts that looked at this issues and

no one has been willing to go out as far as this supreme court of colorado has. the left is celebrating this today, but just remember, you know you have seven democrats that were appointed by democratic governors. i just see this as a completely partisan attempt. if you think about what the left is trying to do, they know that joe biden is very weak, the polls are not good for him. his policies are not working especially on the southern border and so many other places. so many americans are dying of fentanyl, this is an attempt by democratic activists judges in colorado to give joe biden a boost. >> matt whitaker, jarrett. thank you. >> jonathan, turley, thank you for joining us professor turley. tease this out with us. because january this ballot has to be finalized. there's a january 4th date listed here.

how does this play out? >> well, it puts that on a rocket docket for the supreme court. they have to get involved first of all because there's not much time to make a final decision and also have to get involved because this is dead wrong. i think they are dead wrong on the law. i just published a piece in georgetown for this theory. i think it's fundamentally flawed. both in terms of the language of the constitution and the history. what is striking kaylie about the opinion is there was a series of barriers in applying this provision to bar trump. they had to adopt the most swe sweeping interpretation on every single issue. the only opinion that's not sweeping is when they get to the first amendment and free speech, then they adopt a narrow

interpretation. they suggest trump doesn't have free speech protections. in order to establish he was engaged in an insurrection, they go back to speeches in 2016, and they basically daisy chain these speeches to say, look he's been at this for a long time. i think the factual and legal basis of this opinion is really so pourous that the supreme court will make fast work of it. >> do you think this could be something stronger than a 5-4 ruling? i think the partisan make up of the court you could argue based on who is appointed and where they land. do you think a justice appointed by a democrat could say this is bogus? >> yeah, i hope so. you know this country needs some heeling. and what the colorado supreme court did is they basically took a blow at democracy in the name of democracy as you mentioned.

we never needed the democratic process more. we need voters to be able to make a decision. at some point we have to come back together. yes, they were four justices here they finally found a majority to accept this dangerous theory. but they were three democrats on the other side that refused to sign off. some of those judges in other states rejected this theory, they are also democrats. they didn't do it because they have an affinity for donald trump but for the constitution. i'm hoping that will see that same profile of courage on the u.s. supreme court because we need to speak as one voice right now. to say what the colorado supreme court did is wrong. this is not what we're about. >> yeah, there's no doubt about that. i read a lot of your work on this. one line stood out to me,

want to get your reaction here to the breaking news of the night. colorado supreme court of course saying trump you're off the ballot, an obscure legal theory. we have jonathan turley on here. >> it's an abomination from a legal and moral point of view. what about the people from colorado? don't they have a right to voit for the candidate of their choice? these things are just power plays designed to be antidemocratic. i can't stand it because what one party does it, the other party will do it. they keep breaking the norms and republicans match. but the democrats keep breaking the norms first. >> that's right. and it is quite a norm to be broken saying president trump we're going to put you in the same camp as two confederates.

mark penn, coming to you on this report of the president's age. i think it's highly unusual for the first lady to be involved in scheduling. it may have been over blown. the report we know is true, when you look at polling. apnorc. 77% of americans say president biden is too old to be president. how are you guys going to turn that around? >> look apply polls too show age is a real concern, but hey, i am used to first ladies having something to say about the schedule. so i don't think that's much of a news story. look, i thought the good news in report is president biden is ready to get out there and campaign. the aids were holding him back. that's a much better story than the reverse. when they want to get him out and he says i'm too tired i can't do it. i'm not sure that wasn't planted as a story, hey, he can't wait

shouldn't put him up for this. as far as this being a planted story and aids are saying he should rest. any way you spin the story, it doesn't look good. it means his aids are not confident in his ability to speak or perform. you see them white knuckling it every time he's allowed to go off prompter even had he's using the prompter, they are terrified what he might say and what hunter might say. everybody wants joe to go back to the basement including jill and that didn't bode well for him or his poll numbers. when kamala harris is keeping up on you, you know you have a real problem at home. >> ari, you and i both were white house press secretaries. you know how journalism works. there's anonymous sources and stories leak. they were few leaks in the biden era and seem to have their staff under control. lately, look at these headlines.

all these headline says of aids who might see the bad polling. reluctant to accept his old abling aids say. biden said to be increasingly frustrated by dismal poll numbers. emotions running high at the white house as aids report frustration with israel is growing. is there this correlation between poll numbers down and aids leaking? >> there always is. people don't want to take the blame themselves. they're going to leak and say someone else deserves the blames. if only people listened to me. the leak about the staffers who oppose the president's policy on israel? who cares? they're staffers. they're not the elected official. they are privileged to be in the oval office and white house. you can give your advice. if your advice isn't listened to, that's the way it is.

for them to squawk about it is just absolutely out of bounds. i'm kind of shocked anybody in the white house, any staffer would think so much of themselves to do that. as for the president's age, kaylie, we all know 80-year olds and god bless them they think they can play golf and do things they used to do when they were younger. you want that attitude when they are 80 years old. not when they are presidents of the united states. when you think they still have their swing down. put the country at risk and that's what happens. that is increasing what would happen when you have 81, 82, 84-year old president if joe biden stays in the race. if he gets reelected. >> mark, one piece of reporting i picked up on. it was last year. it gets to the interaction between biden's age and campaign strategy. we know he stayed in the basement last campaign.

we know there was one time during covid. that maybe a strategy they intend to repeat. check this out. this is from on politico. they believe trump or any other republican nominee will be reluctant to work on presidential debates because of a head-to-head debate. is biden scared to debate? >> well, i certainly am very pro-debate. i think it would be terrible for the country if there wasn't presidential debates. it seems to be a pattern. the less we see of donald trump, the better he does in the polls. the more we see of president biden, the more trouble he has with his polls. between these two, i don't know whether they get together or hold a debate. it sure would be good for the country if we had presidential debates. that's what america really needs to stay since kennedy and nixon, it's been a tradition that has
