presidential election. now, let me be exceedingly24 clear. this is the latest attempt by the far left to stop at any cost. we know this playbook, even ifth it means destroying the constitution and the rule of law. y e far leftthe 14th amendment . in 1868 after the civil war. it's only been used a handful of times, and it was used get this to disqualify confederates. but here we have a court of the united states resurrecting an obscure and tailored legal theory of constitutional law to disqualify president donald trump. but there are serious legal. problems with the colorado court's ruling seriou. ruling first and foremost, special counsel jack smith. fid over all of the factscts an and he did not even charged trump with insurrection or rebellion. that was not listed. whp withy? cause because the facts don't match the law. and in courts of lawththe law. , you've to go got to do that. take a basic law school course and you'll find that out. ic lawbut that's the strategy oe

left. first, it was russian collusion . then it was impeachment. not once, but twice. then icot was indictments. four, four of those. and now disqualification. wiping trump off the ballot. and if you had any doubt that this is the goal, just look at this. >> take a look at this map. this is happening acrossmap. be country. 31 there have been 31 cases seeking trump's removaesl from the ballot. more than a dozen remain pending. and look at these states.t look at where the cases are ongoing. texas, south carolina. tethe are red states. tho trump will most likely win those. unless, of cours of e, he's wipd off the ballot. the old adage is, if you can'tot them join them. but the left has inverted that.. the way of the left is if you can't beat them, discard them. disqu here now with reaction, fox news legal analyst gregg jarretalt and former actingherew attorney general matthew whitakerit.

matthew, i want to start with you, because in thefact s united states, the facts have to match the law. that's why to jack smith didn't charge trump on these charges. alsok smit, you at precedent, ts has been used, from what i can tell, a handful of times, to prosecuteed. was this intended the 14th amendment, section three, to disqualify someone like president trum p? e with >> yeah. caleb, good to be with you. and i thought you did a great job outlininthought eag. i mean, this is a very undemocratic, unconstitutional attempt that it really election interference by the colorado supreme court. ui this is a close call for them. it was a43 decision. y >> and when you take someone off the ballotou and disqualifyu a candidate, it should be withaf on believable evidence. >> and the facts are very thin . you know, one of the main facts they try to use pieces of evidence is the the january commission report, as we all know, was a hyper partisan nevertrump type thingrr that was donume, nancy pelosi, adam schiff and others. and they use those that factuali

finding. but you're right. you know, jack smith, who investigated this did not charge insurrection. and i think the other thins.g that we need to do is theportan historical context is very important to thet.ople that wron the 14th amendment and section three of that new what anwas. insurrection was they had just seen hundreds of thousands of their felloe seen hw citizenl in a war betweenlo the states. >> and so they knew what an insurrection was. and in this casestates, you knot there was a riot at the capitol. those people that participated wereinsu held accountable and he been prosecuted for that. an now, at the end of the day president, trump said go peacefully and patriotically and have your voicesd e have b. and this court just ignores any anything that is evidence that helps president trump and the supreme court of the united statething s will clearl the final say on this. and i expect they will reverse this rulinthsupreme e finag. >> so so we hope that's the case. the supreme e reversing this, greg, because i had a lot of folks say to me, well han't

can't we just write in trump's name in colorado? but i have a lininrump'se fromo the opinion here. the opinion in colorado says the secretaro y may not list president trump's name on the 2024 presidential primary ballot, nor may she count an y write in votes cast for him literally taking away the will of thee people. >> yes, this is election , g, kelly. it was a narrow 4 toylie, it 3 decision. >> it will almost certainly, in my judgment, overturned by the u.s. supreme court deeause the insurrection claus is in the 14th amendment, as you point out, don't apply to the facts surrecti. >> it was intended to prevent confederates who literally took up14th arms against the governmt during the civil war from go. ing office >> you fast forward now 150 years roughly, and donald trump is not even accused of insurrection underd the federal statute. and if evidence reported that,cl

>> well, it puts this on a rocket docket for supremeave to court. they've got to get involved. they've got to get involved. golved first of all, because ts not much time to make a final decision. get and they also have got to get involved because this is dead wrong. i thin k they're wrong on the law. i just published a piece in georgetow n on this theory, and i think that ithi is fundamentally flawed a, both in terms of the language of the constitution and the historynsti what's striking clearly about this opinion is that thert e was a series of barrier, a couple of which you just discussed in applying thisthis provision. it's a bar trump. they had to adopt the most sweeping interpretation and every single issue in order to get where they wanted to. >> the only part of the opiniont that is not sweeping and broad is when they get to the first amendment and free speech. then they adopt a narrow interpretation.
11:11 pm
they suggest that trump doesn't have free speech protections, but in order to establish that he committeh d or was engaged in insurrection, they go back to speeches in 2016 and they basically s daisy chain these speeches to say, look, he's been at fore. a long time. >> i think the factual and legal basis of this opiniona is really so porous that the supreme court will make fast work of itcour. >> do you think this could be something stronger than a54 ruling? >> i understand that the4 u co partisan makeup of the court, you could argue based on who is appointed and whereul w they. but do you think that a judge justice appointed by ais i democrat, could come over and just say this is bogus? yeah, i hope so. you know, this country needs some healing. and what the colorado supreme court did is they basically took a blow democracy in the

name of democracy, as you mentioned. we'vu e never needed. the democrats and the democratic process more. >> we need voters to be able to make a decision because at some point we've got to comeo back together. >> and i'll note, you know, yeah, there were four justices here that they finally found a majority to accept this dangerous theory. but there were three democrats on the other side that refused to sigfuse n off. >> and some of those judges in other states that reject this theor y were also democrats. >> and they didn't do it because they had affinit thytrum donald trump. they did it because they had affinity for the constitution. p nstituti.and i'm hoping that e that same profile of courage ond and, the u.s. supreme court, because we need to speak as one voicoice re right now and to sap that what the colorado supreme court direurt did is wrong. >> this is not what we'reo doub about. yeah, there's no doubt about that. you know, i've read a lot of your work on this, and one line really stood out to me, professor turley, you've such

ballot cleansing is common prof wherees like iran citizens await to learn which opposition candidate such bas we allowed to run. >> those are strong word is. they are. and i don't want to contribute.t to reckless rhetoric, but i think it's warranted. i don't think it's reckles ts at all. the what they're invading herevg is for red states and blue states to engage in this tit for tat type of contest where conservative states cane l knock off biden off the ballotot and others can knock off trump. >> off that's the slippery that the colorado supreme court is putting us ong us, and thatsn is the reason we have to speak as one voice. this is not what we came thisfan far in this long to achieve. has the path that this court has o put us on could not be mored no dangerous. >> now, professor jonathan turley, well-said, as always, thanktu said as you. joining us now with reaction, ohio senator j.d. vance.

senator vance, great to have you this evening . i'm going to ask our team to pull up this map. the map we showed at the beginnining tosk thi tg the shoa there have been 31 such caseves thross united states. no coincidence they want to do this in places like texas, ed south carolina, because you lose a solid red state. it becomes exceedingly to win natio a national election. is this yet anothenar rendition of the russia hoax hunter biden laptop designex?d formatin all in an effort to stop donald j. altrump. >> it clearly it's an effort to stop donald trump, not tru ballot box because right now they don't think they can beat donald trump at the ballot box. >> but dt o lawfare to use the legal process as politicalca weapon to take rights away from american voters? >> i will repeata again and again, this is not just about donald trump. this is about millions of american voters who are being told by judgesnsn in colorado, you don't get todoo vote for the candidate that you would liket ge to vote for. >> how is that democracy and how is this in any waynsiste
11:15 pm
consistent with the howls of republicans allegedlyntg being a threat to democracy? and then left-wing judgesat are tellin td leftg americans,ac you don't get to vote for the candidate that you want to vote for? vo it's preposteroust toe . >> kelly here's another thing, just to make a political point. it's had brilliant legal analysts. you re question, i think, fo republican voters is do we let left-wing radicals choose our nominee? >> they are staring us in the face saying, we dareradicalr select donald trump as your nominee. i think we take bet and weminee? go with the guy who's showing that he's not opposition. >> if we are letting these s people selechot our nominee forl us, what good are we as a party? there are some t people running, but this is now, to me, an assault not just on one man, but on the republican party's ability to select nominee for the general election for sure. and to that end, i want to pull up this tweey t. >> so this is vivek ramaswamy.
11:16 pm
we don't have it, but i'll read it for you. ramhe basically says he is removing his name from, the colorado ballot in solidarity, not just with trumpn but with, to your point, republicans picking ren nominee and he'scallin calling on the rest of the contenders in the party to removest e their names from the colorado ballot. >> your thoughts on that. ado good for having good for somebody for actually standing up a competitor of donald trump in the primary, for standing up and saying this is completely unacceptable>> g.. >> but the one thing i've been heartened by, kelly, is the response to this is not just trump allies, but across the political spectrum, eveni ha a number of democrats are saying this is just crazy. i >> ds o the american people get to decide who their president is or no noy.t? because these judges are saying the answer is no. we decide fo arer you and we'vet to stand up and push back against this stuff. uff. >> yeah. senator vance, last question, professor. black men who i referenced in our previous with our

11:24 pm
ari? hey, ari. , firstso first, i want to getr your reaction here to the breaking news of the night.lorao colorado supreme court's course saying, trump, you're off the ballot. an obscure legal theory. we had jonathan turley on. >> he laid that all out for us. >> it's an abomination. it's a abomination from a legal poinere.t of view and mostly fra a moral point of view. what about the people of coloradotia ? don't they have a right to vote for the candidate of their choice? fon'ey havwhat all the down balt candidates in colorado who are going to be affected as a resultat of if it went through not having donald trump at the top of the ticket? >> these things are just powert plays designed to be anti-democratic. and i cannot stand it because when one party does it, paito itr party will d and they keep breaking the norms and the republicans match. but the democrate democrats breg the norms first. >> that's right. and it is quite a norm to be broken, saying, you know, you president trump going to put you in the same camp as two confederates and usee 14th amendment, section three. mark penn, coming to you
11:25 pm
on this report on the president's age. i think it's highly unusuas l fr a first lady to be that involved in scheduling. >> perhaps it was overblown. the who knows?n. but that is the report. the report we know is truetrue is that when you look at the polling ap, norc , 77% of americans say biden is too. old to be president, and thatbi includes 69% of democrats. how are you guys going to turn that arounis o d? >> well, look, my polls to showa that age is a real concern. but i used to first ladies the having something to say about the schedule . >> so i don't think that's much of a news story. and look, i thought the good news in the report was that president biden was ready to get out there and wanted to g outo and that the aides we holding him back. when's a much better story than the reverse when the aides want to get him out here and he says i'm to to geo tired and i can'to it. so i'm not so sure that wasn't even planted as a story that, hey, he can't wait to get out, there and donald trump.
11:26 pm
>> you know, tommy, i mean, it's a fair point. people plant storiesa in order. to get a narrative out there. and the narrative certainly was. you know, biden wantit wass doeo more than what his aides are allowing him to do. but the story also say s aides are are rolling their eyes. joe biden's having to stop him from getting out on the campaig n trail. there's a vicious cycle. we all see it play out. your thoughts about joe c biden controlling biden's schedule? >> well, i certainly didn't vote for joe biden, but i don't think anybody voted for joe biden. and i'll jiay this. it's nice to see that she's showing some concern's about heu husband, any wife, no matter what side of the political aisle you sit on, should show concern for their spouse, for their husband. >> but she political aisl should show the same concern. and if she feels like he can't do the job, she should ask him not to do the job. she should ask him not to run for. if she's really so concerned, she shouldn't be putting him up to this task not only for his health, but for the health
11:27 pm
of our natioconcern and as far . this being a planted story that he's raring to go and aidear as th planteds are sd he should rest. either way, you spin that stortt doesn't look good because it means that his aides are not confideniss art in, his ability to speak, his ability to perform. you see them white knuckling wht every time he's allowed to go off prompter, even when he is usin eveg the prompter, prom they're terrified of what he might say. they're also terrifiedptre of wt hunter might say. so at this point, everybody just wants might joe to go back to the basement, including jill. and that doesn't bode well to t him, certainly not for his poll numbers. when kamala harris is creeping up on you, you know, you've gotp a real problem at home. >> yeah, you do. h all right. you know , you and i were bothe pres white house press secretaries and you know how journalism works. there's these anonymous sources. they run with stories and were a lot of leaks during the trump era, but there were very few leaks, i would argue in thehe very beginning of the biden there. >> they seem to have their staff under controll. in that regard. but lately, look at theslatelyey
11:28 pm
headlines, all these headlines of aides who might see the badpl polling for president biden, biden's reluctance to accept his old agctant toe aides say. biden said to be increasingly frustrated by dismal, dismal poll numbers. that was aides. again, emotions are runnin y dismalgat t at the white house, as some aides report frustration with israee asl is growing.l is is there this correlation between? >> poll numbers down, aidesn pol leaking? >> the >> yeah, there always is,re because people just don't wantis to take the blame themselves. so they're going to leak and say somebody else deservesee the blame if only people listened to me. >> that's the story of what happentened to s. sta but, you know, the leak about the staffers who opposed the president's policy on israel. >> who cares? their staffers. they are not the elected official. their position is immaterial. >> you're privileged, privileged to be in the oval office arein the to be in the whitead house. >> you can give me advice. and if your advice isn't listenedvice.vice liste to, thas is.
11:29 pm
and for them to squawk about it' is just absolutely out of bounds. i'm kind of shocked that anybody o in, the white house, any staffer the thinks so much in himself that they would do that. >> as for the president's age, kelly, i will sa agey we all knw 80 year olds and god bless them if they think they can go out and play golf, that they're healthier, that they can do things that they used to do when they're younger. >>ings use you want that attitude, ane 80-year-old, but not one. >> they're the president of the united states. presidents of the united states put are not ag states.when youek they're you still have their swing down, put the country at rise k. s that's what happens. that was increasingly what wille happen when you have an 81, 82, 83, 84-year-old president. if joe biden stays in this race, if he gets reelected. >> you know, mark, one piececkeu of reporting i picked up on, it was out it was last year.s to and i'm curious, it gets to the interaction between biden's age and his campaign strategy. and we know he stayed in the basement last campaign. the there was one debate that that didn't happen and that was
11:30 pm
because of covid at the time cov president, trump had covid. >> but what's interesting is that may be a strateg maybe h they intend to repeat. check this out. this is from politico senioris private take on biden. he's too old. the biden folks believe, trump or any other republican nominee will be reluctant to work with the reluission on presidential debates, lessening the chances and risk of a head to head debate. is biden scared to debate? >> well, certainly am very pro debate, so i really think it would be terrible for the country if there weren't presidential debates. i meanre was, look, it seems toe a pattern. the de s we see of donal trump, the better he does in his polls. the more we se the moree of president has biden, the more trouble he has with his polls. so between these two, i don't know whether they can get together or hold a debate. it sure.e would be good for the country if we had presidential debates, becauseerc i think that's what america really needs to see. and since kennedy and nixo nee n, n

it's been a tradition. >> i think that's been invaluable to voters has, no don tomi lahren, do those debatesub, happen. and >> i would like to say so, but unfortunately, with donald trump but i hate to say this, but with him not showing certain to any republican debates, it gives the democrats an easy ou nott. it gives joe an easy out to say he's not going to debate donald trump. so that's why i really wishd sh donald trump would show up and debate his republican up ae s. on the i know he's way ahead in the polls. he shines brightly on a debate stage. there' polls.s reason for him notw he to engage. we know he loves to talk. he loves to talk to tho talke american people. he needs to show up. if none other reason, then he needs to not give joe nt give that out. we need to hear from our presidential candidates, no oug tr how old or youn they are. we need to see them on the stage. we need to see them debating. i certainlheng.ainly y hope to . but don't give joe the donald trump. please show up and show them what you've got. and we have seen, i believe, clinton folks who works for the campaign, the biden campaign, say that rationale that you just mentioned the last t question to you, ar

as. masses of thousands upon thousands of illegal immigrants waiting for border patrol to pick them up and process them. we haven't scenes like this since over two years ago, since all those haitians gathered under the bridge in del rio and this scene continued until today after the sun came up. take a look at these images. our fox news drone in the air as those masses of migrants again were waiting to be apprehended of them, hundreds of them, potentially thousands of them waiting, for border patrol to pick them up and take them off for processing, many of them coming from venezuela. ultimately, a large majority of the folks you see in this video will likely be released into the united. and it's not just happening in texas. take a look at this video we shot right here in louisville, where we are, arizona, early this morning, another mass incursion through a breach in the wall. hundreds of single adults crossing illegally, coming from all over the world, walking down a road looking for a border patrol processing area. some of the guys we talked to,
11:39 pm
liberia, guinea, senegal, another from bangladesh as this tucson, arizona, sector had more than 3000 illegal crossings yesterday alone and back out here, kaylee, it's gotten so bad that multiple sources tell me federal bureau of prisons personnel have now been sent down here to the southern border to help border patrol with transportation of illegal immigrants. bureau of prisons confirmed that for me in a statement telling me that their support is, quote, limited. >> we'll send it back to you, thelma louise, and thank you for that report. >> now, with biden completely abdicating his responsibility at the border, some states are taking matters into their own hands, like texas governor greg abbott, who just signed a bill that allows state police to arrest illegals for breaking immigration laws. so give state judges the authority to order deportations. ultimately, biden's decision to ignore the border may come to him if it hasn't already. democratic. that's right. democrat texas congresswoman
11:40 pm
veronica escobar says she's afraid the border crisis will hurt biden's reelection chances. i think pretty sure that's common sense. here now with reaction are former acting director tom homan and fox news contributor sara carter. tom, beginning with you. so texas is now going to take matters into their own hands. white house press secretary karine jean-pierre. she was asked about that today. listen to her response. >> so i think, look, this is extreme law that will not and does not make communities in texas safer. it just does it. and i think to to that is that it is very much in line with what republicans, so many republicans like to do or tend to do is do deep d demonize immigrants and also dehumanize immigrants. >> this is part of this is texas law dehumanizing. >> you know, she don't tell.
11:41 pm
she's about humane. you know they say trump policies inhumane. so joe biden's been president. >> over 1500 migrants have died on u.s. soil. an historic record, 112,000 americans dead from fentanyl come across an open border. >> sex trafficking of women, children at all time, right up 600%. >> right. and the no inspector terrorist on the president trump in four years. >> we got 11 in september this year. they got 18 last year, 227 on the southern border. >> at the same time, 432 on the northern border, 659 in one year. people on the terrorist watch list and trump 11 in four years. she don't know what she's talking about. they're proud. you're inhumane. people are dying every day. women get by the cartels every day. children, our children are dying on the border every day. so, you know, and to sit there and see this republican mess know they are the most secure border in my lifetime and they purposely unsecure the border. joe biden is the president in the history of this nation who came into office in unsecure at a border.
11:42 pm
wow. if i just heard that right, sarah. 1500 migrants have died on u.s. soil. >> so this is the party of compassion and love and respect. and we care about the migrants . oh, wait. but migrants are dying on u.s. soil as they try to come here incentivized by this president. >> yeah, absolutely, kelly. absolutely. look, the united nations has declared the u.s., mexico southern border the most dangerous land crossing in the world, and that has been designated twice. and this is under the biden administration. we have never seen anything more horrific than when i go down to the border. i look, i build illusions. video is stunning. the fact i know he must have been in a state of shock as he watched all of these people, mostly military age males coming across the border. i've seen it myself in central america. i've seen it on the border, but never to this magnitude.
11:43 pm
and i can tell you this, kelly, i'm talking to sources down in the region, in central america. i'm talking to sources that are keeping their eye on venezuela, keeping their eye on colombia, and keeping their eye on el salvador, nicaragua, guatemala. and they say those numbers are going to be exponentially larger in the coming months and weeks. and as the presidential election nears, as 2024 gets closer and closer and, we get closer to that election in november. believe me, the drug cartels, the human traffickers and everybody else, they're going to be using that to their benefit, telling people more and more, you got to move in. you got to move in before another president reelected because they're scared that that spigot is going to cut off. but i think the question we all need to be asking, kelly, is why the biden administration putting everybody's life in danger? >> americans are in danger now. we have a wide open border just like tom said, where people are coming in that are on the terror watch list, where criminals are coming in, where our children are dying,
11:44 pm
and we're by the way, taxpayer dollars to the tune of hundreds of millions of dollars are being spent on illegal migrants while we have veterans dying in our streets. this is a huge problem for president biden. he is not going to get reelected on this alone. >> i predict, you know, tom homeland. >> so you have migrants coming from senegal. we just heard vilma lujan say that coming from liberia, from bangladesh, coming because of biden, because president obrador called biden the migrant president. that happened a few years ago. but what do you make of the bureau of prisons now having to send personnel to the border? has that ever happened? >> no, it hasn't. and they sent u.s. marshals down there, too, but not to do law enforcement or not to secure the border to process quicker and release quicker. and when you do that. >> it just brings more. look, we moving across the border illegally. they get processed within a day. they get a free plane ticket at taxpayer expense to any city
11:45 pm
they want. they get put in a hotel, get three squares a day, get free medical. >> they're going to stop coming. matter of fact, what? >> bill moyers is doing a great job. he deserves an emmy because he's taught to speak toward the scab off this whole thing. but here is the issue that people need to know. >> while these bombs are coming in every day. 12,600 the other day, a record for this country. it wasn't just hundreds on the record, 12,600 a 24 hour period. and what happened every? single border patrol agent in that sector was pulled off the line in the process. >> not a single european for hundreds of miles of our southern border. you don't think the cartels took advantage of that? this angers me because while we're talking tonight, while we were all talking on this, a child is going to die tonight. >> women are being tonight. i'm going inspector church will cross that border tonight. it's just words. the secretary. where is the borders? why is the president on tv and talking to the american people about the biggest national security threat in this nation? that's a self-inflicted wound. he did it. he has.
11:46 pm
he has the trump playbook. all he's got to rush off the trump playbook, put little trigger point policies in place. he could fix this in a week, but they don't want to fix it. >> this is by design. no. and that's our compassionate president biden, right to your point a child will die tonight because of these inhumane policies. >> sad. todd sarah, thank you. well, straight ahead, the iran backed houthi rebels in yemen continue to launch a barrage of attacks on u.s. forces in the middle east. general jack keane reacts as a special edition of "hannity" continues with goldberg. e body pl termuss. retinol overnight means the smoothing benefits the smoothing benefits of retinol are now your whole body flat, fast working great corrector diminishes wrinkled skin in just two days. >> gold by champions your skin a must in your medicine cabinet call coming on side cam the number one cold shortening brand highly recommended people loves that cam's unique

administration did it back in 2021. p adbut the biden team, i did20 the label as soon as they took over and for their part, the houthis seem unfazed. one of their leaders told "the washington post s", quote, no matter how many alliances america mobilizer hosmobili our operations will not stop. here now with reaction is fozeax news senior strategic analyst general jack keane. hegeneral keane. so trump lists the houses as a terror group on january 15th.rai the biden administration delist themst k, but on february 4th of 2021, what could their possible reason have been ? >> well, i think they were trying to placate iran and also trying to reinforce the truce that. the saudis were trying to work with the with the houthithe is but it doesn't change the houthis behavior. they should be held accountable for the terrorists that they really are. and, listen, they should be designate d as a foreign terrorist organization to be sure that will have absolutely noreign on them.n
11:53 pm
of course, they're going to continue to attac, k that. the multi national task force that's been put togetherationa and something that should be done. and so i give the administration solely defense department credit for doing it, but that will not stopdone adminis from attacking. >> i mean, the reality is and you can see what's happening here, there's over 100 attacksgt against the u.s. bases in iraq syd syria by iran's. the houthis have now attacked over 100 times with missiles and drones on commercial shipping and our ships as well. so what is reall droney goinghe? on here? iran has a strategic objective to drive the united states military out of the region ut and, also to dominatet and control the region and weaken the statero of israel and eventually force it to go away. >> that isaway the work that irn has been on for 43 years. and these houthies and whats an they're doind whg is about that work. that's the reality of what
11:54 pm
is taking plac.at he here. and if you want to stop it, take away the capability that they have. reagan figured that out. he organized escort ships in the eighties to get the oil out of the persian gulf and wanted iran to. they started attacking it. it. what did reagan do as a result of that? did he just defend the ships and the commercial shipping? no the. he took down their oil o platforms in the gulf and he attacked the bases and the ships ans to attacking them and destroyed them. what happened after that? notroyed more attacks. that is escalation. and decisive and it achievesisi dominance. >> that is what, we need here. >> this administration is paralyzed by the fear that if they escalate what's going to happen, iran may escalate even further. and we could be at a war with irae atn. that makes no sense whatsoever, that makes no sense whatsoever, given the 43 year history of iran. great analogy.
