2:00 am
how much time our four year old valentina, who happens to have down syndrome, spends in front of our family scene. here she is reading to . she just there all the time when i walk by her in the house, she's there sitting in front of the nativity scene. other times brings that magic gifts. these little boxes that i have on our family altar. >> how did she know to bring them in front of ? she she will sometimes move the baby closer to herself. she talks to the statues sometimes she's just sitting in front of them, pondering, studying them. every time i see her there, which is often throughout the day, i can't help but realize how she's teaching all of us to slow down and spend some time with the baby jesus this christmas. that's it. me. i'm rachel campos-duffy in for laura ingraham. sure. to check out our podcast from the kitchen table. here's will cain. hello everyone, i'm jessica
2:01 am
tarlov, along with judge jeanine pirro. charlie hurt kennedy and tyrus. it's 5:00 here in new york city. and this the five. >> twas the night before christmas. the studio was set for the table to discuss the big topics. you bet. the stockings were hung by the cameras with care in hopes that the five would soon be on air when out of the green room arose. such clatter. it was just judge jeanine stealing a cookie from the platter. put your vote. okay, that's enough of that. and we're going to get to the news a few minutes. >> but now it's time for our christmas fastest. >> first up, sick of sad secret santa gifts. well, one man is vowing to never participated in his office like a strange ever again after only receiving a box full of assorted mini candy bars as his. charge. >> i feel like this would be a dream gift for you, actually, to get candy. it is dream gift. >> but here's the problem.
2:02 am
here's this guy very upset because he spent all this time getting a present someone and in exchange he got leftover candy, he assumes. >> which proves the point that people are not into. people are into receiving. and the sooner you realize that, the better. but i started doing a little research story. yes, but i found out that these are some of the gifts you get a secret santa. okay. you listening to iris? yeah. okay. yeah. >> one guy got a puzzle missing pieces. another person got £10 of rice. another one got a loaf of bread. i mean, these are the kinds of things that make people think twice about having a secret santa. >> i have never received a loaf of bread for a secret santa, but spoiler alert, this guy is me. >> okay, this is me. i am will. >> i will never do secret santa with team gutfeld ever again because i got a bag of hershey's candies. the ones you have to open
2:03 am
the bag individually. take them out. that's what i got. but my secret, you know, what i did receive was santa. i knew the ask. the producer loves horror movies, so i got him my on great horror movies. i did my due and then i found out little bird. everyone on the team got a box of cheese. >> i didn't get a box of cheese. oh, that's an outrage. is it not with decision. he it was his giving him out. and it's fine. >> i get it. i get the brightest star gets the least. fine. oh, i will never, ever do secret santa got out the game, and i didn't do it for this. i do it for presentation. i did the right thing. you must. my neighbor is judge jeanine. and if word got out that i wasn't following the rules. you heard how she talked to me earlier. yeah. yes. yeah i. >> i would make a mint as a dominatrix. judge. >> oh, thank you. absolutely right. all right, cindy, you are one of the more thoughtful givers that i have ever. >> that's true. do you care about what you get
2:04 am
in return? absolutely not. and then when you're santa. yes, absolutely not i don't expect things in return. i love giving people. if you expect things in return, it's like expecting something in return from the. we all know they're always stealing our tax money. >> and, you know, for for what we all give the government every year. we should be lavish with lamborghinis and trips and, furs, but we get potholes and homeless people over the sidewalks. >> so that's what it's like being a secret santa. the point is to give or you have to adhere very strictly to a dollar amount, like it has to be at $25 because $25 with a hershey's candy, i would get the diary. okay. but it wasn't it was not okay. it was the same candy that we don't pick up at. it's the same candy that dana perino and judge jeanine fought to get off the 21st floor and now the bag of it. and it's not even have nuts or anything in it. and i followed the $25 rule to the senate. well, you cannot tell me
2:05 am
that bag from left over halloween with 25 back here to the american taxpayer is the principle. >> it's being shorted by the government once again. exactly right. this is what's so about this guy. he just it was fake virtue because he actually started out as a kennedy and he said, you know, it's christmas time. some people don't even get a gift. and secret santa sometimes is the only gift that personal get. >> so he pours his heart into it and then it turns out he's just a cheapskate who's all p.o. because he didn't get what he wanted to get and somebody else did. but that the joy should have been in the giving. >> like with you, kennedy, i know, man. anyone who's married knows that the gifts not right. the face always tells truth. >> i lost the face. i'm not involved in that one. yes next up, a stressed out this holiday season. you are not alone. 63% think holidays are more demanding than dreaded taxing. when i talk about taxes. but if you're looking to get some relaxation from all of the holiday stress, you may want to book a vacation from
2:06 am
your. 34% of holiday party super say coming home for family gatherings does not count as a getaway. and 100% in this camp, i do not think family gatherings are restful. no, they're not. now, first thing, you're cooking for like 40. >> yeah, i know. i'm always going to have to buy the food. have to cook the food. then i have to clean the food. then i to cook the food. >> then i have to chop it before i cook it. there's all these steps, and then i clean afterwards. i don't even enjoy it. my feet are killing me. by the end of the day, they had a great time and i'm miserable. >> probably. i feel like maybe you. >> you like family gatherings? well, no. i mean, i like them as much as the next person does. >> but they're complicated. they are the sum. all complications. that's the. that's why you do it. you don't do it yourself. >> you don't do it for like you're going to the beach to hang out, sit on the in the sand and play in the dirt. >> you go for other people? yeah. especially if you have children. you go for your children. >> you remind everybody why you have a family and why
2:07 am
you enjoy working so much and leaving the out world because they need all your money also. yes. yeah. >> kennedy a lot of people like to compare children. that's the problem that i have. like, oh, a little bunny just got into columbia. >> oh, know, so that's always rough. i would like to go someone else family gathering, you know, i'm with the judge. >> you spend all this time cooking, you spend all this time taking care of people. and it is absolutely. here is the hack. here's what you do. you go to hawaii with your family and you all stay in separate rooms. >> so you only see each other a couple of times a day and you come out, you go to the beach, you go to a well, you have a nice dinner someone else makes the dinner and you combine that with the vacation, no more visiting family. how is it how, why they need your money and support and still going february. how long does a child have to be to be in their own room for right? george, i invented my so i don't have this problem,
2:08 am
that thing. >> i don't i don't have to deal with drunk uncle and grandma and grandpa. >> i invented my family, which means it's just me, the wife and the children. and if i don't want to deal with them, i just send them all on a fun trip. and dad can't go because he's too big. >> like, did the girls always go with angry? they just go. and then another. yeah, they go. and then i get to do what i want to watch. i go to disney. i fit in the world. look, i'm too tall. i can't go anywhere. were saying we're playing. so i get to do what i really want to do is sit at home and sports work out and i stay in the confines of my home. and there are and i guess what i get, i get textures and pitches in the first round. >> so much fun. and i'm like, that's awesome. back the game. >> it's brilliant. invent your own family, america. forget that blitz stuff that old saying about blood is thicker than water. >> you got to keep reading because it's telling you it's blood you got to worry about. water's fine. yeah, it's the blood. say thank a judge. if you came to my house and cooked for everybody, we would have parade in your honor. >> all right. have.
2:09 am
>> yeah, we do like. oh, thanks, judge. yeah. finish those dishes. and then your parade. yeah. yeah, but that's why i've little kids, and i'll send in to do it for you. >> you got it. all right, i'll do that as you get older and watch, the classic christmas will be home alone. many of us find ourselves thinking, what did kevin's parents do for work to be able to afford that house and a holiday trip to paris for 15 people. well, now we finally have our answer. and the "new york times" crunched the numbers on the family's finances and said the mcallister's would have had to make at least $665,000 a year to afford their lifestyle putting kevin's family in the top 1% retires. i look at that. i looked at the house. i assumed they were 1% up. >> this roller coaster right here, this a first world problem. >> this is this is what tv is. this is what is called the failed "new york times". you've got time for this. well, let's figure out how many years they're going to put on grinch for breaking and entering whoville 100. and judge, how many years would
2:10 am
you give them for each house, each home based on mine to last 25 to life, do you think? because he brought it back. it's all good. but that's the real story. look how many years we stacking on the grinch or we gonna let him go because he was the only green man in the town. what are we doing here? you're the "new york times". why don't you go out and find a source and a real story? >> like, who cares and tell us who source is not anonymous? or at least give three. remember that not three sources ? yeah. yeah. the fact you're wasting time trying to figure out what a fake house cost. >> just give me the. i'm not. i'm not giving you the journalism. >> i what is your mccallister? take? >> i don't care. great. you. it's really wonderful. those who are for the show in the block? >> ready? you watching this movie? the takeaway is that you make less money than these people. and you couldn't afford to do this. >> then i think you're kind of missing the plot of the movie, right? >> i mean, shouldn't the parents been arrested for abandoning the child? no, no, no. social services cult. yeah. what's it say about the police
2:11 am
department where a child called? >> they did not know the daughter wasn't the child calls 911 they not. oh, he's not home. >> yeah. i wouldn't want you kick the door and this is a horrible die hard. >> die hard. yes. why are we not celebrating the virtues of capitalism here? you know, here's a family who worked very hard and they're enjoying the spoils of their hard work. how do you and your baby. they're trust. is it just uncle working hard? >> was you don't want to buy the tickets and made the kids coach. >> the new york times is jealous. the is like, oh my god, it's so lame. the mcallister's it's so much money and i can't even go to the hamptons. >> i didn't read that part of the article, but i'm there with investigators no, he reported insurance or something. >> he got it from his family, so they say. >> straight ahead, a massive wave takes a cruise ship. >> the video everyone is talking about next on the five oh five giants

2:17 am
>> the daily mail video shows the tense moments. >> waves smashed into the ship before a giant one nearly takes it out. completely controlled bridge windows were smashed. power was lost to the entire cruise liner. >> it happened in the middle of the north sea, one hundred miles from denmark's west coast. >> the ship lost its ability to navigate gate and the radars kicked off, flying around 400 passengers and crew on board. >> thankfully, main engine is still working, allowing the ship to be manually steered. >> the ship is now being aided to port by two civilian support vessels and is currently traveling to germany. it is expected to arrive britain's coast today. i got to tell you, that sounds i mean, charlie, have you ever been on a cruise? >> no i avoid cruises at all cost no matter what. >> all right. i don't want to talk to you. >> no, no, no. but no, but. but i love nature and.
2:18 am
>> i think that this is a really great, instructive thing to remember that no matter what you do in life, you can. you can get on a ship. >> you can build the biggest ship. you're whatever you want. you cannot defy nature. >> nature will come and find you. and i think that that is absolutely riveting. >> i spent a lot of time fishing, you know, on not not on cruises, but on much smaller boats. but you have to contend with everything and you have to be prepared for everything. >> there are no safe, safe spaces on this planet. and not only in particular with fishing. not only do you have to deal with the weather and, all that sort of stuff, which is incredibly dangerous, but then you catch stuff and you have to be you know, you have to deal with that stuff as well. >> but i think i think an antibiotic, it's a tool you get. >> and antibiotics aren't going to help you unless. >> but, you know, some of the diseases this is this is petrifying. >> you're on a cruise. you go on a cruise because you want to be on vacation. you're to relax. >> and this is like the titanic revisited. you don't what the end of this story is going to be.
2:19 am
>> kennedy well, you don't know. i mean, there apparently there were passengers who were sliding around the floor from one side. >> i've been following the story since it broke because this really is terrifying. a lot of people think i'm going to take a nice voyage, you know, denmark, norway, scandinavia, what a beautiful place to sea in, the winter fjords. and they think they're going to be safe. >> you have a false sense of safety because the boat is so big, but you're the north sea in december. and to charlie's point, it's incredible unpredictable. but thankfully, they were able scramble some of the civilian vessels together to get this boat to safety. and it'll be there shortly. but can you imagine how those passengers are feeling when it's going to it's got to just agonize the cruise industry because every something like this happens. people go, that's why i don't go on cruise ships when 99.9% of all cruises, i go on them all the time. >> do you do cruises? i've never imagined being with that clearly on a cruise.
2:20 am
>> how would you feel? >> majority of them are completely fine. so i think i would just be exhausted. >> but in this situation, i would just think that were going to die and you'd just be spending your final moments saying whatever it is that you have to say, telling your family that you love them. it's one of the more petrifying things. i love being on the ocean, like in a catamaran. basically, you go as far out as that. i can see maybe a whale and like a huge turtle. but the cruise industry is basically just getting back on feet after covid obviously got here by cruise and everyone was not going, obviously. >> and i'm sure that it's going to be another huge hit to them that this is going on. and this is a fancy one, right? yeah, it is a fancy one. and, you know, tyrus radar goes off line. now, forget about the passengers. >> you know, the captain and the whole crew is in a mess. obviously navigation a lot to do. but listen, culturally, i don't do ships culturally, i don't do ships, especially.
2:21 am
i want to know when is when it's going and when it's due back. that's always a big issue for me. and this is one of those magical things where i would send the family to because, quote, i don't fit. so it's a giant hotel in the water. so, again, unless i swim and can see, i can walk back to shore. >> tara going, because it's not just seasick, because why are you trying tell your loved ones you love them, you're throwing up on each other. then goes over, then, oh, i'm in the water. >> and then the best case scenario is you drown. worst case is you're doing the dance with mother nature, which is sharks and other going around me. if we if i had a pair gills, i'm all with it. but until then, rule of thumb. see the ocean. make sure the beach is close. >> well, i've said. but you know what? it sounds like everybody's. it's being towed to another port and everything will be fine. thank god i get on a cruise right away. straight ahead and early
2:22 am

2:26 am
no, you're doing it wrong. let's go. can we talk now? it's our visit about vaping dormant for tips on when and how to have the big whether outside is frightful. but the is so delightful. and since we're place to go, let the lucky. welcome back. former president trump just got an early christmas present. the supreme court has denied special counsel jack smith's request to expedite a ruling on whether trump has immunity in his federal election interference case, allowing the lower court hear the case first. it could prompt a trial until after the election. that is the gift. meanwhile, joe biden's plans for 2024 are about as aimless as him trying to walk off stage.
2:27 am
>> biden allies are getting a little nervous heading into the new year over the president's non-existent agenda for a second term. 26-year-old freshman congressman frost worries the president's lack of plans cost him the youth vote. but biden's he isn't hitting home with his ritzy donor base either. turns out when it comes time to declare their support for the president's reelection bid, celebrities are running straight for the hollywood hills. i'm right. are you supporting the president again in 2024? i'm just here to celebrate this event. >> is here to celebrate. >> you get a non-answer and you get a non-answer, judge. first, let's talk about the supreme court ruling. >> what does this mean for the former president? well, it is good news for former president donald trump. and jack smith got a little down. >> and i don't know i've said this before, whether his is more absurd than his ignorance.
2:28 am
>> the truth is for for jack smith to assume that, because he's got a case that the supreme court should hear it right away, that we should avoid due process and the regular process appeals going to the appellate process, and that the united states supreme court should bend to his wins and his trump derangement syndrome. he's been slapped down and the supreme court basically said, we're getting involved in this. >> make no mistake that now the issue of immunity will go from the district court where they are right now to the d.c. circuit court of appeals and then possibly to the supreme court. >> so the trial is scheduled for march 4th, is never going to start on march 4th because they've got litigation with the circuit court of appeals. >> and, you know, the supreme court has is basically saying, look, we don't want be a part of this. >> we don't want to be a part of any of this respect. >> the supreme court is down since the obama days when obama first started trashing supreme court justices at that state of the union.
2:29 am
i remember it. and specifically, i think it was looking at alito. i forget who it was. >> but what the supreme court knows that it will very soon be deciding the issue of. the woke justices on the colorado supreme court one from harvard, the other from yale, the other from penn, the other from the who decided that the president cannot be on the primary ballot because they don't think he should, based on their mission to or protection of the 14th amendment. >> so this report knows they've got decide that soon. it is essential that they do. and they don't want to get involved in the immunity issue. >> and so inures to the benefit of the president. and it makes jack smith look not so smart. >> all right. so, jessica, you go from excuse me, the former president who's having legal troubles to the current president, who's having political troubles. >> do you agree with this young congressman, maxwell brock, the six year old, that the president has not been transparent enough outlining plans for 2024 and beyond?
2:30 am
i think that there's certainly more work to do and there's ten months to do it. that's i mean, the biden campaign has announced in the beginning of january it will be official who's in charge of every state. he has been frustrated with his own team, saying we've been slow to do this. >> so i think it's good and i think it's great that maxwell frost became the youngest member of congress ever elected at. orlando is talking about these issues. he gets what gen z is concerned about, and the president should hear him loud and clear and. >> but the framing of this is all doom and gloom for president biden doesn't really work when you look at arguably the most important issue, which is cash on hand. so you may say celebrities are running from him, but their pocketbooks are still open. he has $71 million on hand. the dnc has 20 million, which is the most they've had, and the rnc has less than 10 million. so, ronna mcdaniel, everyone is looking at you about your fundraising. and then we have the detroit press, right, who released or
2:31 am
the news came out that there is audio. ronna mcdaniel and president trump on tape pressuring two michigan officials who had already voted to certify the election in 2020, saying to them you should flip your vote. and a runner chimes in and says, don't we got you. we got you handled on the attorneys front. we'll get your lawyers covered. so now you have brad raffensperger for the 11,000 plus votes that he needs. you have the michigan call and who knows what else. so the election interference case is getting more and more solid. i understand your perspective on the colorado case. i just want to throw the mix the fact that the judges who wrote the majority opinion ,those losers from the ivy league and all of that cited, neil gorsuch, right in his decision and from colorado. yes. and it was a case in the colorado where he affirmed the state's right to take someone off ballot if they are ineligible. and in section three of the 14th amendment, nowhere does it say that he has to be convicted of insurrection or
2:32 am
rebellion. i'm just saying i could see. i think that's why i say that that's i think that's where they have a legal. i'm sure. and hugh hewitt, i know you know, i'm not a lawyer. i never said i was a lawyer on tv when you were having a problem with what i'm saying. i'm just stating facts about how they defended their position. and they also engaged with the fact that the dissenting justices said, no due process, but didn't talk at all about the five day bench trial that president trump got where there were a slew of witnesses for all of this. so to say this is a good week for him with the audio tape. and what in colorado, just because this might get pushed back to jail. okay. it will. it will. but the d.c. circuit has been also moving incredibly quickly. >> oh, oh, i'm not like lightning. >> well, i think the election's going to be weird no matter what happens. charlie, to this point, are republican donors waiting for the entire thing to coalesce? i'm talking about some of the court cases. or are they expecting that that someone else will come in like
2:33 am
nikki haley and steal the former president and somehow as a very dark horse, get the nomination? >> well, i think without a doubt, some of the big gop donors definitely are still looking for an alternative to donald trump. and increasingly, nikki haley appears be that that person, especially as ron desantis has run terrible campaign and they're losing faith that that he'll be that alternative. but i don't think but you know big picture wise you know you talk about cash hand, you know, who does not have cash on hand. >> american voters. and i think that that that issue is going to dog president biden throughout the reelection. >> we see he's got you know, i always dismiss polls, especially early. you can get him to say whatever you want to say. the one thing that i do think is always valuable is watching with the gallup polls, where you can watch trends. and if you see movement, all that's really important and, you know, joe biden is looking at the lowest approval rating of any president since the gallup polling has been registering
2:34 am
this stuff. right. you know, it's, you know, 15 points below what, you know, george h.w. bush had and. >> he went on and he went on to lose, of course. and so, you know, i think it's terrible, you know, in terms of what you know, in terms of the court case and the jack smith thing, i think jack smith is really sort of shown his hand here, the idea that he was so adamant not only to pursue these charges, but also the fact that he wanted the supreme court to step in so immediately and to do it before the election proves that all he wants to do is put donald trump in jail before the election. >> i think that they will go by any means necessary. and if that's not if that's not bringing an election, i don't know whether that's a nixon standard, though. >> and i'm just reading back on this that they pushed it. >> i mean, the judge can comment on the incident in, say, nixon and but that was a precedent that he was relaxed. >> yorba linda, right? yes, that's right.
2:35 am
>> you know, number one, i don't even know her. so tyrus, so who has a bigger problem on their hands? >> well, they both have problems, but the the thing everyone seems to be missing, and it blows my mind. >> but then again, i'm i do differently. biden's campaign is right now and it's running full steam is he doesn't need he doesn't need agendas he has it. trump is an insurrection it's who who needs to be in jail. don't vote for this guy. that's what he ran. that's only one last time. nobody voted. if you go to a lot people, i'm like, hey, who is biden? your favorite? they're like, oh no, they won't have i love joe biden sticker, but they'll have a f trump sticker. so it it worked for them once they got him impeached twice on we already the russian stuff all that b.s. now the whole thing is he's not going to debate with trump. why would he debate with an insurrectionist who's looking at jail time? >> so he in the in the course as i'm standing president, if he allows trump to debate with him, he would be saying
2:36 am
it's okay for people to be insane. he will be saying that six should be seventh, eighth, ninth and 10th. >> so his. he doesn't need to say, i'm going to put a fish in everybody's pot. he's going like, if you elect me the monster, the dictator who's going to steal your rights away won't get in. >> so he's not he's not going to do anything. so donors are going to get upset. they're going to say all these kind of things and he's going to be hurt in the polls. but look what he's got. colorado, he's out. even the supreme court reverses it. people don't have faith in the supreme court anymore. every person who was was insulted or affected by the supreme court's abortion ruling that changed the red wave to a blue splash. and when the supreme court comes in, let's say that supreme court is let's say it's 8 to 1. right. and they change it and trump goes back on the ballot, it's not going to change any of the minds of the americans who don't trust the supreme court anymore. >> some conservatives we need to look at the fact that we're outnumbered, maybe not our class, but we are outnumbered. and what looked a little smile.
2:37 am
she knows it's true, but they've done effectively is they painted the picture of the monster. >> the facts don't mean anything. him getting embarrassed and saying you can't just beating trump, it's still going. it's all part of the thing. and unfortunately our president trump falls for these baits where he wants to fight them when he should be reminding us of his deeds. but so there will never a joe biden train campaign where you stop in in town. boy, i'm going to fix this. i'm going to fix that. all he's going to do is have a picture of darth vader that is president trump like we have to stop this guy. and america voted for him, even when they weren't comfortable, he was in he's been in more than 50 years. and every time he ran before it was dismally a horrible vp for president biden for president barack obama. but his message was we got to stop him and eight broke. and they keep kind of new things and they have judges willing to say that he's an insurrectionist when he hasn't. >> even unless i missed that i work a news place. i'm not that very newsy. but i think him being convicted of being is rex would make
2:38 am
the news. so what we're seeing is that's the game plan and it's effective. it worked. once they think it's going work again. but his numbers keep going up every time they can. then they can charge him civilly. they can charge him criminally . >> they can try to keep him off the ballot. the more they come after him, the more america says, why don't you let us make the decision? also in all of those polls, it does show that if he is convicted and he should get his day in court, joe biden, he wins in the popular vote. he wins all of the swing states. he wins the electoral college. so the trial dates, obviously, in all of do matter a lot. >> but that's an important lesson. also, he doesn't the reaper road rage for the holidays. the out of control video is talking about we've got for you next. did you ever stress us having three kids now?
