>> welcome to this special edition of "hannity." i'm kayleigh mcenany in for sean. tonight the white house is eerily quiet. the president is gone for another vacation after returning from a leisurely christmas trip to camp david paid must be nice. he'll spend the next week relaxing in sunny st. croix in the u.s. virgin islands. here he is arriving at his beachside vacation. got to be a lot of fun for the president while we are suffering here at home. biden has spent approximately 40% of his presidency on vacation. the results certainly signify the time he has spent away. here you see him relaxing in the sun. seems to be a trend. meanwhile, back at home, we have chaos at our southern border. look at the screen. as we speak, a massive migrant caravan is traveling north through mexico. already, record numbers of illegal immigrants are pouring across our border on

a daily basis. record numbers -- listen to this -- of chinese immigrants, as well, 24,000 chinese migrants have entered our country in fiscal year 2023. that is up from 1,970 in 2022. and 323 in 2021. safe to say, this is an unmitigated disaster. but don't take my word for it, cnn is calling this an unprecedented surge. and here is usa today. "as migration surges, immigration court cases backlogs swelled over 3 million." migrants are being released on u.s. streets at the border as shelters see record numbers. meanwhile, the mayors of chicago, new york, and eagle pass have something in common. they are all democrats, not happy with the biden administration. take a look. >> this is unacceptable. our city and eagle pass, we have been getting slammed with 2,000

or 3,000 people a day, and it's just an unfair, unethical situation what's going on here in eagle pass. we feel ignored by the federal government. i have called to the government that we need action. >> what i have said repeatedly is that we have to have coordination. since taking office we have had an uncoordinated approach. what i have worked to do instead of having chaos is provide structure and calm around the situation and without significant federal support this is not sustainable. >> the federal government said to new york city, "we are not going to do our job. you do our job." "you take care of 4,000 people a week, eric, you and your team." i am not seeing the light at the end of the tunnel from the federal government. and i think we can't treat this as a policy, but as an urgency, and i'm not seeing that energy. >> kayleigh: i thought they provided sanctuary. doesn't seem to be the case.

this is now a costly disaster impacting every corner of america and even democrats have taken notice. >> what do voters think about immigration right now? >> it's becoming a top issue facing the nation. the economy is still number one. it was number one in august and its number one now. but take a look at the immigration and border security, just 11% in august. look at what it's up to now. 19%, closing in on the economy. the most google searches for migrants by state. look at all the states, they are all blue states. illinois, new york, massachusetts, new jersey, colorado, and of course there's been a lot of talk about the migrant crisis in both illinois and new york. it seems like even voters in those states, very blue states that democrats win in general elections almost always, they are focusing on this issue, as well. >> kayleigh: but enjoy that st. croix vacation, mr. president. you may want to wake up. you're losing your own party.

last night our own bill melugin spotted this sign at the tucson airport in arizona directing non-u.s. citizens without passports into a special line for domestic flights all across the country. needless to say, the line was incredibly long. look at that. fox news contributor sara carter has been monitoring the situation at the border all month and joins us now with m more. there's a lot to be alarmed by, but to me, these 24,000 chineseg said one of the possibilities that came to his mind when he heard about this was either ministry of state security agents or chinese military coming into our country. your thoughts? >> oh, i can absolutely agree with gordon chang on that. he's also a friend of mine and someone i highly respect. he's traveled throughout the region. he and i have been to the far east together he's given number speak stomach speeches. we have been monitoring china and other adversaries such as

venezuela and iran, russia. they are all taking advantage of this crisis at our southern border, kayleigh. think about this, the united nations is stating for the second time that the land crossing between the united states and mexico is the most dangerous land crossing in the world, the most dangerous land crossing in the world. we have people coming into our country from all over the world. they are not getting background checks. immigrations and customs enforcement are basically throwing their hands up in the air. the biden administration is allowing them to come in, aiding and abetting these traffickers. but it's not just about the cartels. we already know this, that the cartels are being used as proxies by the chinese government to move in fentanyl. we have lost many young americans to fentanyl poisoning and overdose. chinese migrants, the surge is incredible. we can't even get background checks on them because the

chinese government is not cooperating with us, because they don't want to cooperate with us. this is part of breaking the back of america. what gordon chang is saying is important, and i will wrap up his thoughts on this. when people come into this country and disappear into the fabric of america, they could be anybody. they could be found spying on our installations, our government installations. they could be stupid scuba diving,delivering food to, acting as carriers, but really placing technology and equipment they could use to spy on us. our agencies are well aware of this. the problem is they just aren't stopping, and nobody knows how far this is going to go before we actually break. >> kayleigh: cnn is reporting that the number of migrants south of our border, north of

mexico, could be as much as 15,000 migrants on top of these record numbers. >> absolutely. i just spoke with a source who was saying the same to me, that they are expecting that this new caravan will swell. remember, maduro in venezuela is very active looking at what he can do. and this is not just me saying this. we have u.s. intelligence officers investigating this right now in central america looking at how he's handling this, losing people. we don't even know if some of these people are coming out of prisons. we don't understand how they are forming in these large caravans and moving and collecting people on the way. this isn't just about our own national security. for democrats out there that have concerns about the humanitarian crisis, and republicans, there are children in these caravans that are losing their lives on the way to our country. it will never make it. they are being taken by these

cartels in these human traffickers, being sold into the most heinous and nefarious -- i don't even want to say pedophilia rings, that's the only way to discredit. in the united states, many of them disappear. like i say with tom homan all the time, and he says this every time he is on this show, what is so good about leaving this board are wide open? wise our government doing this and why is nobody stopping it? >> kayleigh: why is the question. sara carter, thank you. today both secretary of state antony blinken and h secretary ella how do my argus went to mexico city to beg the mexican president to do something, anything to stop the massive flow of immigrants constantly traveling north through the country. president obrador predicted the failures of the biden presidency from the very beginning. you may not remember this, but this is 2021.

mexico's president described just how migrants viewed president biden. he said "they see him as the migrant president and so many feel they are going to reach the united states." and voila, they have, in record numbers. he was right. at today's meeting with mexico's president, notably listening was biden's border czar kamala harris. she will return to office until january 3rd. here with reaction is tom homan, an expert on all of this, along with byron donalds, who has put forward legislation to stop what we are seeing at the southern border. let me start with you, congressman donald's. i'm sick and tired of hearing people say republicans do not have a plan. he passed hr2, did your job and house. here are all the things that republicans have done, and you can read it as we go along. security fencing, 22,000 minimum

border patrol agents, and much more. congressman? >> first of all, kayleigh, it's great to be with you. you are absolutely correct. house republicans have a plan and we had one for a long time. i have a plan that adds to this and creates an exit by electric system, something that the 9/11 commission recommended that we do. the federal government still hasn't completed that work, but this is bigger than that. you have an administration, joe biden, kamala harris, everybody else. they don't want to do the simple job of securing the border, so now when you have a massive catastrophe, which they created, now they're going down to mexico to see what can be done. the answer is simple. follow house republicans, it's the plan. let me be very clear we have been telling this to democrats in the senate and joe biden, i don't even to us about ukraine until the southern border is secure. secure america first and then we can have conversations about everything else. but this must be done.

it simply cannot wait. >> kayleigh: tom homan, you and i both worked for a former president, president trump, who got action for mexico. he said you are getting tariffs unless you secure the border, and they did that, they sent 6,000 troops to the border. what do you think when you see them meeting went on today n0 deliverables for mexico to be announced? >> they don't need any more meetings. it doesn't mean squat. you are right. president trump didn't go to mexico and begged for help, he didn't go to central america and beg for help. he didn't give the millions of dollars. this administration is getting mexico millions upon millions of dollars. president trump was a game changer. he didn't give them a dime. he told mexico, you're going to put military at the southern border in the northern border and participate in the remaining mexico program. if you don't, i will tariffs the hell out of you and they did in

days. i'm not going to pay to create opportunity zones down there. the money goes to the people and never goes where it needs to go. i'll tell you what i'm going to do, i'm going to take the international aid away, and they came to the table. if this administration is serious about securing the border, which they are not, they haven't done a single thing to slow the flow, it is easy. dust off the plans. it's not even a question if the policy will work. we proved it worked. anybody can go look at the numbers. under trump, the most secure border in my career, three and a half decades. the data is clear. we proved it worked. if they want to secure the border, they have the plan. brush it off and put it in pl place. >> kayleigh: i couldn't say it any better myself. that plan is embodied in hr2. we know senators met today trying to craft a plan with foreign aid combined with immigration measures. what do you think is going to be acceptable to the house?

anything short of hr2, or do you need that in there? >> what's acceptable to the house is hr2. it is simple stuff. we know it works. what we are not going to do is negotiate against ourselves for some ham-handed deal that gets negotiated in the senate. we have seen senate negotiations occur in this country before. they are basically weak sauce, not worth the paper they printed on. the politicians in d.c. say, this is great, look what we did, america! and the reality hits home that nothing really changed. this is the starting point. the senators can negotiate all they want, but nothing is moving through the house without hr2. >> kayleigh: tom, where does this end? you have 15,000 migrants, this caravan, chinese nationals. will there ever be a wake-up call? even democrats have said they need to do something. we showed the cnn clip. >> first of all, what the congressman just said, this needs to be passed 100%.

it's a great plan. it has a lot of the policies in it. fully, or nothing. i'm shocked the democrats are willing to let ukraine and israel suffer because they want open borders so badly. these are going to be processed and released in the united states. catch and release. when the cartels see thousands being released every day, that gives them a selling point. they don't need a public affairs officer or a consultant to sell their services. the u.s. government's actions every day, you cross the border illegally, you get released quickly, you get flown to the city of your choice on the taxpayer dime, a hotel room, three squares a day and free medical. why wouldn't it connect because we are not enforcing the law at the border. kamala harris, you can call her the border czar, she hasn't done a thing. she wants to find underlying reasons. she is and we need to walk down the hall to the oval office and

she will find the reason, the millions that come across the border because they were made promises by this administration. >> kayleigh: congressman donalds, where is the president? he's on vacation. he sends antony blinken off, he sends alejandro mayorkas off, no deliverables, he's on vacation 40% of his presidency. >> let's be honest, this man is the most unaccountable president in american history. if you combine that with being the worst president in american history, he's probably taking a nap as we speak. i know it's after 9:00 eastern, he's already gone to bed. we have a problem, america. joe biden is awful at this job. he's not a leader and he is a radical being led by radicals in that administration. they all need to go. for america, listen, mean tweets, no meme treats, let's get somebody back in the white house who knows how to do the job and execute and put our country first.

♪ ♪ >> kayleigh: welcome back to this special edition of "hannity." we have some breaking news tonight. the colorado republican party has asked the u.s. supreme court to overturn the colorado ruling that banned former president donald j. trump from the state 2024 ballot. the party says the colorado supreme court has denied the voters the ability to choose

their chief executive through the electoral process, and "engaged in an unprecedented disregard for the first amendment right of political parties to select the candidates of their choice." the u.s. supreme court will now decide whether to take the case, and for democracy's sake, they should. meanwhile, this morning, the michigan supreme court ruled that trump can remain on the state's 2024 ballot, saying the colorado decision wasn't relevant in michigan. here with reaction is fox news contributor jonathan turley. jonathan turley, lee expected this appeal. i have the writ of cert for the supreme court right in front of me. they say section three of the 14th amendment is not self-executing and that president trump, as a president, does not fall into the text of this amendment. what do you think? >> it's a very strong appeal. it's frankly the moment many of

us have been waiting for. for months, this dangerous theory has been replicated throughout the country as challengers try to find a judge or a court that will give credence to this theory. many of us believe it is fundamentally wrong, from a historical and legal persp perspective. they found some justices who are willing to do this. that court had seven democratically appointed justices and three of them refused to sign on with this and said it was clearly wrong. they were able to eke out a 4-3 win in colorado. that's a known outlier. you have the michigan supreme court following other ports in refusing to disqualify the former president. so it is right for the supreme court to review. there's a conflict among the states, and it's a very weighty issue here, obviously, for the

country. >> kayleigh: it is. you look over at michigan, one of the big victories, and you pointed this out on twitter, now known as x, that democrats actually helped to stop trump from being removed from the ballot. these are justices appointed by democrats. >> right, and i think that's important to remind people, because in this age of rage we often make assumptions about people we don't agree with. it is important to know that this theory has been rejected in various states by democratic judges, judges appointed by democratic governors, or judges that are in fact democrats who ran for office. they showed they could resist temptation, that they have greater fealty to the constitution then they do their own views and their own political preferences.

the question now is, will the supreme court intervene? i believe it will. what is interesting about this filing is it doesn't raise the right to free speech and it does not raise the factual determination that this was an insurrection. that will be raised presumably in later appeals. instead they are focusing on the threshold issues of the removal of this name from the ballot. i think it's a very strong appeal. >> kayleigh: professor turley, i just have a moment here, but should they rule on this, is this the biggest case pertaining to a presidential election since bush v. gore? >> yes, and it's an important to raise. that was destructive for the court in many respects. many of the justices spent years trying to repair the divisions on the court itself. i think the chief justice is going to try to get a unanimous decision here. i hope it can speak with one voice, and that voice should be

to reject colorado's decision and protect our democratic values, to show the public that the court itself is divided ideologically, that they remain unified on these basic values that define us. >> kayleigh: it would be a great day for democracy indeed if it were 9-0. professor turley, thank you for your brilliant analysis as always. turning now to a different legal issue facing donald trump. the doj case surrounding januare appeal courts consider the eighth claim of presidential immunity. but that has not stopped special counsel jack smith from filing motions. just today he asked the court to bar trump from criticizing biden, his possible 2024 opponent, of course come over political interference in his case. keep in mind, this is very important, so take a look at this. as "the new york times" route dominic wrote back in april, he thinks trump should be prosecuted for january 6th.

in other words, trump is putting forward the evidence that is where worth asking questions about. he wanted merrick garland to take "decisive action" here with more is fox news legal analyst gregg jarrett. he said he didn't want president trump presenting evidence that would impugn his political opponent, but "the new york times," the gold standard of all reporting, for liberals across the globe, says biden has opinions. in the past, mr. biden told his circle that trump posed a threat to democracy and should be prosecuted. >> that was the equivalent of taking out an ad on national television and running it 24/7. look, many people believe, including donald trump, that jack smith's case is politically driven. but the special counsel wants to

silence trump from arguing what he believes. so the irony should be lost on no one. smith's accusing trump of injecting politics into a prosecution that already reeks of partisan politics. trump should be free to present a defense of his own choosing. that is fundamental in america. but jack smith is afraid of that. he wants to be both prosecutor and dictate the defense simultaneously. in other words, let's not bother with a trial at all, let's just move ahead to the hanging. that is exactly the kind of thing that got jack smith spanked unanimously where he mangled the law to engineer a wrongful conviction. he was overturned with an exclamation point. the question here, kayleigh, is whether trump is the victim of what is called in the law

selective prosecution, that he was specifically targeted because of who he is. in the law, that constitutes an affirmative procedural defense arguing that a biased or discriminatory prosecution that is forbidden under the fifth amendment equal protection clause. if it is successful, it negates the charges. i readily admit it doesn't prevail very often. nevertheless, trump is allowed to make that argument despite what jack smith said today in his court filing. >> kayleigh: that's a fascinating theory, the affirmative defense he could u use. i want to get your expertise on the breaking news. we expected the colorado republican party would appeal this and say you cannot disqualify trump from the ballot. it potentially goes to the supreme court. what next? >> the republican committee in colorado does have standing to

appeal the supreme court, because it is directly harmed. as they say, denying their party's ability to choose a candidate of its choice. i agree with professor turley, i suspect the supreme court will take this case because it is too important not to. i would also expect the high court to overturn the colorado decision on the very grounds cited in today's petition. kicking trump off the ballot, that is a violation of his constitutional right to due process. my goodness, he hasn't been charged with insurrection or tried or convicted. the colorado court removed him from the ballot by fiat. and you have to look at the 14th amendment itself. it spells out who can be removed from ballots. representatives, senators, electors. president is not included. why? because a president holds a uniquely singular position as chief executive. indeed, he takes a different

the party anymore. he was fired from msnbc and has only just resurfaced a little while ago. obviously hillary clinton is somebody incredibly important to the party and i have defended her comments in the interview talking about the fact that democrats are so far from being in a cult. on a comparative basis, it's actually laughable. then i do really struggle to find it in my tiny liberal heart to feel terrible for republicans when we get called things like communists, socialists, thugs, pedophiles. donald trump called every name in the book. it's in the playbook to demonize us and make it seem like it's the end of the world if democrats are in power. so yes, will chris matthews' statement be cut up and put into ads? sure. will he have a problem with white working-class voters, especially if he's the nominee on the republican side? yes, 100%. but that doesn't mean there isn't merit in what they're

talking about in terms of how the republican base feels about donald trump and that they think we are a party of just coastal elite sitting around drinking our lattes laughing at them in our electric vehicles. which is not how it is, but that's their reputation. >> kayleigh: charlie, i worked for donald trump and i don't recall him giving an equivalent to the blood red maga speech where he said, as biden said, maga, you are a clear and present danger, a threat to the foundation of our country. i just don't recall a moment where trump gave a speech quite like that. >> the fourth of july. >> that right there is the primary difference between, of course, donald trump and joe biden. donald trump attacks the party leaders, even republican party leaders, oftentimes. he attacks washington, the bureaucracy, but he never attacked the voters on the other side. whereas you have joe biden

openly -- and a lot of democrats -- openly attacking voters on the other side. it's not that people get their feelings hurt, it's just a really stupid way to do politics. it's not a good way to win people over. as jessica points out, chris matthews is kind of a has-been. he's billed himself as the least insane person in the cult and tries to say things that are kind of true, such as when he talked about obama's speech, giving him a thrill up his leg so much that he couldn't even give words to describe it, he was so passionately moved by it. but that is who chris matthews is. but what he said here, this to me kind of goes over into something that is very dangerous. when he starts comparing trump supporters to terrorists, to our combatants in afghanistan and iraq, and then we do a poll and find out that young people think

highly of usama bin laden, well, gee, you think maybe there is a line that connects the two? >> kayleigh: jessica, some of this rhetoric, you had bill maher calling house speaker mike johnson, comparing him to the maine shooter. i realize these aren't members of the democratic party, per se, but t "the daily beast" is left-leaning, comparing them to the taliban and iran. this is pretty extreme. >> i happen to think that mike johnson's beliefs are pretty extreme and that it is dangerous to have a speaker of the house he was perfectly happy -- >> kayleigh: not iran. >> i don't use language like that. the only people who are terrorists are actual terrorists, and i think you do need to be careful about that. but there is extremism on some of the left but definitely on some of the right that has made
