i'm along with rachel, jessica, and jimmy. it's 5:00 in new york city. this is "the five." >> well, democrats creating more election chaos as they try to stop americans from voting for donald trump. maine disqualifying the g.o.p. frontrunner from its 2024 ballot. and it's all thanks to the state's democrat secretary of state. she decided to follow colorado's lead and find trump to be ineligible under the 14th amendment's insurrection clause over his actions surrounding january 6th. she makes no secret she's a far left hack by routinely posting selfies with joe biden and barack obama. she is also an outspoken supporter of trump's second impeachment and of course, immediately ran to the liberal media to spike the football. >> first and foremost, it's important to know, my oath to

the constitution, my obligations to the constitution and rule of law come before any other consideration. no other factors could weigh on that decision. and did not. >> i reviewed section 3 of the 14th amendment very carefully. and i'm determined that section 3 of the 14th amendment does not say conviction. it says engage. and the weight of evidence that i reviewed indicated that it was in fact an insurrection. and mr. trump engaged in that insurrection. >> it looks like liberal political activists stick together. colorado's secretary of state is gushing over the unilateral move in maine to go after trump. >> i do think secretary bellows is brave and courageous. she is the first individual by herself having to make this decision. and we are acutely aware of the threat environment that we work in. so i commend her for her actions, and we'll see how the

litigation inevitably plays out in the state of maine. >> even cnn thinks maine's reasoning is legally weak. >> i think there's a question there with regard to what maine did because if you look at the hearing and she details this in the ruling, they heard from one fact witness, a law professor. she based her ruling on a lot of documents but also you tube clips, news reports, things that would never pass the bar in normal course. she's not a lawyer, by a way. smartly written decision, it's chosen by the state legislature but not democratically elected. >> so you've been covering politics for a long time. you have a plethora of experience. what do you think about this new age we're in with pulling candidate off the ballot based on single opinions? >> yeah, it's kind of bizarre trying to protect democracy by absolutely destroying democracy. it doesn't really make sense. i think democrats are terrified of one thing.

they're tire tied of the fact that donald trump really is going to probably win the republican nomination and go on to win a general election. and their only response to it is to gather as that guy on cnn just pointed out unelected officials going and rigging the election so that donald trump can't face an election to -- in front of the people. and it's worth noting. i do think it's kind of significant that she -- that bellows was elected by the legislature and not by the people. she's never faced voters. saying that the colorado supreme court, so just all of the optics if you're putting all the legal questions aside, step back and look at all of the optics, you actually have major actors inside the democrat party trying to preserve democracy by destroying it by removing somebody from the ballot. >> rachel, a lot of these rulings are coming at a time when joe biden is actually

russia big impeachment, 95% negative media coverage. they banned him from social media for two years. now we're here at taking him off or banning him from the ballot. what are they so afraid of? what is the plan that they have for us that they're so afraid that donald trump is going to disrupt? and i think when you look at those numbers on those polls and what those issues are, what they have in store for us is a globalist borderless world where only the elites rule. and this is an example of it. by the way, i study latin america. that's where i got my master's degree in latin american cities. this is all so familiar. this is all communist type things where you go you're not allowed to choose who you want to vote for. we're literally not going to give you that choice. it's really scary. what's interesting is even though the conservatives aren't out protesting and we all know why because they're afraid of

primaries. so this is the next way to do this. like they basically said joe, get off the ballot and he was like no way, i can beat president nixon. and they were like, we don't know that you can beat president nixon, joe. dang it, he's not leaving. get out the lawyers. that's basically my take. but i do laugh at the whole argument of we're saving democracy by destroying it. imagine i said to you, we have an arson problem in this town. and i'm going to protect you guys by burning down your house. that way, the arsonist can't get to your house. that's what's going on here. and that's where i'm scared, ok? is for some people, ok, i don't want to put this on every democrat. for some people, ok, they have this unhealthy hatred for trump that's denying them self-awareness. what i mean is when you're operating from a place of emotion, you're unable to see how crazy you sound to rational people. this is crazy. he didn't get convicted. she said the threshold is engaging, ok? but we don't know that he engaged either. we would almost need a conviction to tell us he did. this is the equivalent of getting mad at somebody for something they did in their

dream, we'll do that to an election? i don't think it's healthy. and i think they've become children where they're fighting so hard for control of the toy they don't realize they're breaking it. >> jessica, the senator from maine issued a statement today disagreeing with the secretary of state's decision saying that they had this impeachment process and although he voted to convict, he doesn't believe it should be up to a secretary of state in any state. it should be up to the voters. and it seems like that's what democrats have been advocating for, for years about democracy and yet, now they're throwing donald trump off the ballot. >> it should be noted as well that gerald golden, congressman from maine also said the same thing. he said i voted to impeach him twice. i don't think he should ever serve near again but this is not the way to do it. add susan collins to the pile. someone who has been very critical of donald trump herself even though she's a republican. a lot of people do feel this way.

i see a real distinction between what happened in maine and what happened in colorado. and i take your analogy, jimmy, this kind of -- i know people and i have been accused myself of flying off the handle and just say trump. and suddenly i'm a different color. and everything is awful. but in colorado, they did have a five-day bench trial where evidence was presented from both sides and trump's people have a chance to it. and they found he did engage in an insurrection. if you look at, it's true, rachel. >> rachel: there's no insurrection! there was no insurrection! >> people with zip ties just hanging out. ok, then it gets kicked off to the supreme court. and if you look at the opinions from all seven justices, the four who voted to take him off the ballot and three who didn't, no one refutes the fact that he engaged in insurrection. there's a difference of opinion of whether he should be able to stay in the ballot or not. that's different than one person and this is how the procedure works in maine. she didn't break the law by doing this. i think it's a faulty procedure. that's a very different thing

from going to a bench trial and the colorado supreme court and should be noted as well that in the majority opinion, they cited neil gorsuch himself on the court of appeals because he's ruled before that someone -- a state can remove someone who has engaged in that. >> what about the condition of the country, though? in terms of the democracy and voting and whether we should move forward as a country and the way people are so polarized, is this a good idea for secretaries of state to take a single action to take people off the ballot? >> california said no. california the opportunity to do it and said no. i know the country looks a hell of a lot better than it did on january 6th. and i do know from what -- >> honestly, i don't know. >> really? have you seen the footage? >> have you seen the border, have you seen gas prices? >> i have and they're down! >> yes. there's a precipitous -- >> what is better? oh, the economy is better. crime and safety is better. the border is not better.

something needs to be done. their organization has preyed upon people. mostly nice white people that sent in a lot of money, right, and should be donating. and ended up with these gardens and the leaders of the organization that bought $6 million homes in los angeles and they could really help people out who were living in these encampments. i think it's terrible and does an disservice to the social justice movement allegedly behind the organize but for me, really the turning point was whenever there was a homeless encampment with a lot of prostitution going on across the street from a preschool in los angeles, like if you can't see that these things are completely unacceptable in our civilization, then we have nothing to talk about. and the story is correct. they're preying upon members of this community who are good
