joe: democrats voting for republicans, polls show members of state legislators on the republican side coming into the new year. people are fed up with the craziness. will: it's got that kind of feeling and only two days left. rachel: the biden kind of feeling. pete: the old smell of let's put that over here and get rid of it feeling. two more days of this, then 2024. good to see you. let's begin with this. the first hour of "fox and friends" starts with donald trump fighting to keep his name on the ballot in the presidential election. rachel: he is expected to appeal the decision in maine and colorado the took him off both state ballots, trump survived recent challenges in california and wisconsin. joe: alexandria hoff has details. good morning.

>> reporter: multiple sources confirmed the trump legal team has her sights set on tuesday to appeal the ballot decisions made in colorado and maine. police in a dozen states seek to bar trump from the ballot, they are looking at it differently but utilizing a civil war era clause in the constitution to argue a person involved in an insurrection can't be elected to public office. what makes maine unique is this is the first state where the secretary of state took action unilaterally as opposed to colorado where the decision came from the state supreme court so here is how she respond to criticism over the solo judgment. >> the criticism is that it's not your decision of whether someone can be on the ballot. >> every elected official swears an oath to the constitution which i swore an oath to the main constitution and the united states

constitution, main election law requires me to hold a hearing of this sort. >> reporter: pending the expected appeal from the trump team in colorado, trump's name will appear on the primary ballot unless the supreme court affirmed the decision to remove him by the state supreme court. the gop front runner in's name is printed on california's primary ballot where the secretary of state declined to remove him telling the la times this, quote, i have to basically continue to abide by the rule of law and for me not to do that that, i am no better than trump and i must be better than trump. if you do the loose interpretation and implementation then you open us up as a state at a nation for us all being vulnerable simply because we have an opinion and point of view. she mentioned this interpretation, the way this insurrection clause in the constitution is being used is

seen as section 3 of the fourteenth amendment was originally designed to prevent former confederates from holding office. will: it was used in 1919 to prevent a socialist from being in congress but that's the last time it was used until january 6th, but we have a lot of socialists and communists in congress now which is an interesting thing because i think mutually assured destruction is the only way to end this madness. for so long republicans have been like we want to keep the rule of law and do things by the book, because we want to preserve the system but it's clear that on the other side they don't care about that. what did she just say? she said maine law requires me to make sure republicans can't vote for who they want to vote for? pete: she's appointed, unelected, not a lawyer and

ultimately here is low thing. she's able to get her 15 minutes of fame. the ruling has been, they stated in colorado, still on the ballot unless the supreme court chimes in on behalf of those states which this supremes and of -- supreme court will not do. he is going to be on the ballot but it is an instinct of what you know the left would like to do to trump and others if they could, we don't agree with your views so you're off the ballot. joe: the california secretary of state saying the rule of law doesn't allow her to take trump off the ballot, the main secretary of state who wasn't a lower, she was appointed by democrats and the maine state house, she says the law makes her take trump off the ballot and colorado the law itself being the supreme court they are apparently has tried to take him off the ballot but none of them have him off the ballot in the next few weeks, the two in colorado and maine

are saying we believe in what we are doing but we don't believe in it enough so we keep him on their. this is greg jarrett analyzing what the main secretary of state is doing? >> she managed to embarrass herself in her bid for 15 minutes of fame, she launched a full frontal assault on the constitution and our democratic principles. this is brazen election interference, ballot rigging, disenfranchisement of 300,000 voters in the state of maine than it is happening because democrats read the polls, they know president biden is in deep trouble so they are willing to do anything to ensure that he wins by hook or by crook even if it means vaster rising the 14th amendment insurrection clause. it doesn't apply to the office of the president. it specifically spells out who it applies to, representatives, senators and electors, the

president holds a different duty, takes a different oath as chief executive. jackie: at the root of this they are using this insurrection, at the root of this is the fact that we never got to the truth of what happened that day so they are going to keep using this that there was an insurrection attempt on january 6th, until we get all the tapes and figure out what actually happened that day, christopher wray won't tell us how many federal agents were working that day as well. part of it is not knowing the truth of what happened that day. pete: it will fuel his lead in iowa and won't work in taking him off the ballot and make him more popular among republican voters and the general electorate as well.

joining us is lieutenant darren porter. what do you know about the story? >> reporter: good morning, this is a troubling narrative to say the least because it begs the question of how is the social contract being upheld not just for us as new yorkers but the prisoners on rikers island, this is a colossal failure that has been ongoing for years on end because the administration, more specific to the mayor has failed to uphold public safety. when we have an individual like this harming people in our subway system it reflects a failure and what we are supposed to do from the perspective of policing, the cops are willing to do what they are supposed to do but it is the administration that is often holding them back. we had this dangerous individual on rikers island and he did what we expected him to do and harmed other individuals, now we have to do an after action review to see what went wrong to ensure this doesn't happen in the future but i don't believe that after

rachel: donald trump fighting a political battle, the republican front runner expected to appeal colorado and maine ballot decisions this tuesday. will: a dozen states attempting to remove trump from ballot, the supreme court faces mounting pressure to make the definitive ruling ahead of the election. joe: we were just talking on the couch your that if this goes all the way to the supreme court which we don't see why it wouldn't there's two issues at play here, one being an interpretation of the clause, the other being was donald trump guilty of insurrection to begin with? someone made that determination on their own to invoke this clause. >> that's right. the first thing to understand. it's very interesting that both

out of colorado and maine, you have political statements more than legal documents, keep in mind to the colorado supreme court in a 4-3 decision said donald trump is an insurrectionist who should not be on the ballot but they allowed him on the ballot unless the supreme court ask. if they don't act, people remain on the primary ballot in colorado. and maine, the same concept applied here. the secretary of state says i think donald trump is an insurrectionist and is not eligible to be on the ballot but i'm not going to effectuate my decision. i will wait until january, until a maine superior court makes a decision to agree with me or disagree with me. right now these look to be a lot more like political statements than real legal, binding documents but only time will tell what the supreme court does because technically speaking the supreme court for the moment doesn't have to do anything on donald trump will remain on the ballot. rachel: in order to be accused of inciting insurrection, it

has to been in insurrection and there's still a lot of evidence that hasn't come out. mark johnson hasn't released all the videotape. more videotapes come out, the less it looks like there was really in insurrection and there appears to be other actors involved and things so will this in some way necessitate us putting to rest the idea that there actually was and insurrection before anyone can attempt to take someone off the ballot for inciting one? >> those are great points. the fourteenth madman talks about insurrection but there's a lot of legal hurdles the democrats need to overcome before donald trump could conceivably be disqualified. the first is that donald trump is essentially already been tried and found in osan, acquitted, involving his alleged role in the insurrection because he was impeached in january 2021 and acquitted, specifically for engaging in and insurrection so

in one sense he has already won the question whether he was involved in the insurrection and found not to have been so. the second thing, pretty clear that a hyperpartisan department of justice run by jack smith, the special prosecutor has been aggressive in charging not just donald trump but anyone touching fingers with january 6th with all sorts of crime some of which are in front of the supreme court. if anyone had an incentive and basis for indicting donald trump to be associated with an insurrection or engaging in insurrection it would be jack smith and he did not do that which tells us quite a bit about how serious this is which is not serious at all, these are political maneuvers by the democrats to knock donald trump off the balance with a hail mary pass in the court system, allowing courts to decide who the republican winner is and not the republican voters or alternatively to make the supreme court look partisan which is part of another agenda which is to embarrass the supreme court and try to get supreme court reform so they

explain what happened and what your perspective was here? >> this is a bear that i call be 33, that was his tag number. in 2019, i was documenting him when i caught a video of him that showed a tracking collar growing into his neck, so i immediately reached out to fish and wildlife in nevada, the department of wildlife, knowing it was there collar, and we removed the collar saving his life. so i have been documenting his life ever since that time for the last five years. he has been in the same spot for the last four winters. this year he moved and i haven't seen him since early november and the other day i got a call about the bear under a house in a neighborhood where i went i wonder if that is him and there is be 33, my buddy. we know each other pretty well. i have gotten him out of some
