>> dana: i'm dana perino with joe jeanine pirro, jessica tarlov, jesse watters, and greg gutfeld. 5:00 in new york city, and this is "the five." ♪ ♪ embattled harvard president claudine gai resigning is the most powerful school leader in the country. 50 allegations of plagiarism's, and that shortest presidency and the university's history: six months. gay not mentioning either of the scandals in a statement, but seems to imply that racism was a factor in her ouster. she said it was "frightening to be suggested to personal attacks and threats fueled by racial animus." it started when she cannot answer this question in front of congress. >> the answer is yes that

calling for the of jews violates harvard code of conduct, correct? >> it depends on the context. >> it does not. the answer is yes. this is why you should resign. >> dana: congresswoman elise stefanik's says "it's only the beginning." >> we have seen a failure of leadership from claudine gay, and a failure of academic integrity, which is a cornerstone of any higher education institution. i believe if we continue our congressional investigation, we will cover what will be the greatest scandal in higher education. the harvard corporation numbers themselves are complicit in this cover up of plagiarism, and most importantly, their failure to protect jewish students on campus. >> dana: no word yet from former president barack obama, who privately lobbied on the harvard president's behalf during the anti-semitism controversy. we are hearing from reverend al sharpton. "this is an attack on every black woman in this country who

has put a crack in the glass ceiling. it is an assault on the health, strength, the future of diversity, equity, and inclusion at a time or corporate america is trying to back out of billions of dollars in commitments." despite resigning as president, gay is still on the payroll as a faculty member. she doesn't have to the president's job anymore. so many different angles. one thing we should point out, i think, is that "the washington free beacon" was pointing out all of this plagiarism based on an old shoe leather reporting. any media outlet -- "washington free beacon." >> greg: that's what's funny about her -- it's not her surprised that she claims she is a victim of racism for losing her job after this moral implosion at the hearing, and countless examples of plag plagiarism, some made by black scholars, and yet it's still

racism. no, mrs. or miss gay, it wasn't racism the cost to the job: it was racism that got you the job, right? any white person had her pedigree, they wouldn't be running a school of fish. this is the problem with di and esg, is everything that it affects, it destroys. with her to academia, corporations, or the military -- if you designate a small group out of larger population as a preferred higher, you force every recruiter to go to that select group, and the supply cannot meet the demand. it's a math problem, so you end up being forced to hire what's left, even if that person is not qualified or even competent. its mathematical racism. you choose an inept candidate over someone who's far better because they don't fit the right color. that choice makes it harder for places like harvard or any company to fire someone even if

they are right for firing. what's funny, it isn't gay's fault. the system awarded her into a slot that was behind her current capabilities, because of her skin color. if you make a deal with the di devil, you are going to die by the accusation of racism, so everybody made their bed. i like the fact they have to sleep in it. >> dana: watch this take from matt, he was on cnn. >> we should note that claudine gay has not been accused of stealing anyone's ideas in any of her writings. she has been accused of -- more like copying other people's writings without attribution. it's been more sloppy attribution then stealing anyone's ideas. >> dana: judge, what's the definition of plagiarism? allegations of plagiarism. the history of claudine gay, the woman has never published a book, she has written nothing that has any seminal contributions to fairfield, according to people who have looked at her -- brett stevenson in particular. in 26 years, she has written 11 articles. it is incredible. what the problem is here is that she was held to a different standard of other students at harvard. a letter to the editor of crimson, the newspaper at harlem, and a person who was responsible for "upholding the standards of academic excellence" said it would be the worst date at harvard -- the person might cry, might be suspended, might have a tarnish on the record. she's got 50 of them. they relegated her to this system at this level where she

wasn't touched. i think her race has advantage to her, and the fact that she has in no way been held to account for not protecting others is the ultimate hypocrisy, when you see in her statement when she's leaving, she says "it is so frightening to find myself the target of threats." if she had intelligence, she would understand the reason you are where you are is because you didn't protect others over the targets of real threats. finally, we should realize harvard was started in 1698 as a divinity school. it was nondenominational. repeated numerous violations, she didn't deserve to be there in the first place, and i'm glad she's gone. >> dana: one of the things divinity schools and other schools should keep -- schools should teach is to

develop character, and being accountable for your actions is one of those things. harvard is defending her, and the pain is not going to end for the school until they acknowledge the wrongdoing. there's the plagiarism issue, but it's almost as if the anti-semitism was -- fine -- was excuse after the hearing, but the pleasures and got them in the end. >> jessica: i think she suffered from -- and i think all three of the presidents who showed up at the hearing -- suffered from an attack of legalese. they want as if they had no soul, and this is with the lawyers who prepped me -- and i would encourage everyone, an interesting piece in "the new york times" about how the president of columbia has avoided falling into this, because the campus was rife with pro-palestinian protests or professors that were speaking up. she was setting the ship. one thing she ended up doing was not going to that testimony. she was invited to sit there with the rest of them and had to be the climate change conf

[laughter] >> jessica: it was about how different her trajectory was, that she was not subject to that line of questioning. getting the opportunity to use talking seminal scott you. two elements of claudine gay's statements. first and foremost, there was no apology, and they teach you to apologize and also how important forgiveness is, in that we are a forgiving society. we are going back to divinity school words. there was no apology about letting down the academic community. that is really important. it's a small club, the ivory tower. some people at this table like to make fun of the ivory tower, but people work really hard to get there, and they take low-paying jobs, and they kill themselves to publish multiple papers a year to get the kind of

credentials to go on to those jobs. the second part was no apology over what i imagine she feels is a misunderstanding of her stance on anti-semitism and the jewish community. to that turn, the state -- that turn to the statement into something about something about immutable characteristics. guess what? the kids are being harassed because of their characteristics, not getting into whether judaism is a race or religion or whatever it is, but you are born a certain way. you are born a jew. they are having this chanted at them because of the way they were born. i thought that was a missed opportunity. all future presidents of these universities need to be subject to this level of scrutiny. >> they will be now. probably. >> and ellisdon people -- >> this is an opportunity where president biden could have a moment and say "this was wrong," but he can't come out and talk about patriotism. >> he can't talk about anything, dana.

[laughter] >> that's also true. >> my sources at harvard told me my powerful monologue on harvard at december was the breaking point, and the trustees had contemplated and reflected over the christmas vacation. it was time to eliminate her. >> dana: power. >> jesse: my other sources are saying this is about money, and harvard is like a hedge fund that happens to teach classes. they have a $50 billion endowment, and she just lost them $1 billion in ten days. that's what you call bad quarter. harvard loses its reputation but can't lose its money. d i.e. --cancer, and we have to root t out through sunlight and expose it for what it is. it's by discriminating against gender, race, and ideology. we have to get back to what made america great: merit and judging people on their actions. al sharpton, a fraud who is defending a fraud, is out there saying this woman was fired because she was a black woman who cracked the glass ceiling.

she used someone else's had to crack it. she stole half of her scholarly work: eight out of the 17 published articles were plagiarized. then, barack obama, who actually saved a man from a plagiarism scandal, is lobbying to save another person from plagiarism? wire black leaders in this country rallying around other disgraced black americans? just because they are black and? it is an embarrassment. is this like the "o.j. is innocent" situation? we have to get back to its work for 100 years in this country: judging people on what they produce. she has produced nothing. she has produced a loss of $1 billion, and i'm sorry, harvard did the right thing. they told everybody it's really about merit and not about skin color, and now, jesse jr. will be applying early decision.

getting their hands on that shocking video. beverly hills 90210 star getting into a melee with a gang of people writing many motorcycles. at one point, they changed they changed "shark nate hall's title actor through the streets of hollywood boulevard while the actor's daughter was in her car. it's murky how it started. they say it's because bikers got aggressive and hit his car while weaving through traffic. he got out to survey the damage but then it became a physical altercation and he had to protect himself. he is ripping the city's lawlessness and hooliganism. when i first heard the story, i thought it was a gang of female bikers, just so consumed with passion overseeing him after so long to being and seeing that they couldn't control themselves. >> to -- >> greg: to borrow a phrase from a friend, dad's home. this is the perfect analogy, encapsulation of a country of

men finally hitting their limits. dads put up with a lot. you can mock them in every commercial, every sitcom, you can tell everyone they are racist or sexist or question their parenting values, but when you endanger the family, dads going to fight. there is no politics in self-defense. only your right to protect your daughter or your son. it doesn't matter who the assailants are. that doesn't care what color they are. they will fight like nothing else matters. we should take this as a sign that that is coming home, and it's long overdue to clean up this mess. if i were bud light, i would sign them on and call the new promotion "dad's home after a day of defending his family, give him a nice cold beer, because he earned it." we are so redderless as a country, it's refreshing to see his. also he is 59. this should be an inspiration to everybody in the new year: that dude is in his sixth decade. even though he was running, he

bike. >> greg: yes. >> dana: i agree. >> jeanine: this guy is the guy who assaulted them first, and his statements are so legally vetted it's not funny. known. >> jesse: he threw the first punch? >> jeanine: not only the first punch, they were on their bikes when he was out of the car punching them, and he literally knocked a guy off the bike. i'm a prosecutor at heart. everybody, as far as i'm concerned, violates the law goes to jail. this guy says he got out to assess the damage to his car. he had no damage to his car. if he was worried about his daughter, stay in the car. if you are worried about your daughter, don't get out and start a fist fight with people on bikes, then run across the street while she is alone in the car. >> greg: drew them away from the car. he's a hero. [laughter] >> dana: have you ever been in a city when a biker gang is common? it is scary to me. >> jeanine: you have to slow down. >> dana: one of the scariest things. we don't know what happened before, there's no video of where they surrounding the car, where they harassing him and he felt the need to do that? i don't know. i do know this: it's traumatic for his doctor to see this. it also shows that he is, i think, a great dad. these children, they look small. maybe they are short like us. >> greg: one is in a barbie jacket. [laughter] >> dana: lack of parenting there, but also the knowledge that they can get away with everything because no one is getting prosecuted for things they feel like they can get away with it. i think this adds to the chaos. when the white house says "crime is down, america, what are you complaining about?" you see videos like this which include someone who is famous. >> jesse: if he's not safe, none of us are.

quite regular that he does this, which i think is a service to democrats, to just say this especially pertains to the black male vote, not so much black women, but black men have been expressing this certainly through the trump era and when biden was running in 2020, that it just wasn't that exciting to them. they unleashed campaigns. the whole barbershop tour, which ended up being successful. president biden was obviously elected. there was a poll today that showed a staggering loss amongst black voters. lowe '60s. -- in the low 60s. i don't think anyone being honest about that things biden is going to end up losing 20% of the black vote off of what he got. it is a concern. the disappoint -- the disappoint with kamala is something i understand. i wonder if their vice president's out there that people are particularly jazzed

about. like "i loved this guy." joe biden, his eight years as vice president, the real shining star example of what he got done was getting gay marriage passed. that was his portfolio that he was going to be part of lobbying after there was a huge moment for the country, for the party. kamala harris has been put in charge -- i know, the border, but in terms of the messaging about the dobbs decision and getting out the youth vote. that has been hugely successful. we want all of these ballot referendums. there was huge turnout in the 2022 midterms, and there is excitation that that will keep up. i don't know if not paying her in that way as -- speech of the dobbs decision was a gift. you didn't need kamala to do that. come on, jessica. georgia, which is a swing state of black voters, he loses georgia, which he needs. those numbers right now, 20 points, blacks 87-63, he dropped to 24, you may not believe that that's how it's going to end up, but -- for him to lose a swing state. the amazing part of this is that biden had the benefit of abortion, the benefit of climate change, yet young people in this country are not into him. they would rather vote for trump. trump as i had a biden when it comes to young people. it's clear. young people, 37% drum, 33% biden. for all the gifts he has had, he's too old. his wife had to remind him "your favorite food is ice cream." really? >> greg: dana, once the media accepts the fact that biden is still going to run, are they going to have to reverse gears and push all this good news? before, they were okay with the

[car honking] anti-israel of its traders were disrupting travel at new york's jfk airport on its busiest day. the crowd causing massive disruptions like a two hour long gridlock of traffic for people just trying to get on their flight on time. "the new york post" front page calling them blockheads for hamas. dana, this seems to be getting stupider and stupider, and further and further away from the alleged cause. >> dana: you have the right to peacefully protest, not disrupt travel. i'm glad it went through newark and not jfk yesterday. i would've lost my mind. at probably be in jail today trying to call the judge to get myself out. also, where is the secretary of transportation on this? he gets a press conference anytime there's going to be a snowstorm, natural thing.
