news alert. the u.s. supreme court will decide whether donald trump can be kept off the (202)020-2024 ballot in colorado with argument starting on february 8th. the supreme court has now agreed to consider what is a very important appeal and constitutional issue. that is whether or not president trump's name will remain on the ballot until they render a decision. also tonight a big update from the biden family business as hunter may soon be held in contempt of congress. we have an update on that. the one and only dr. cornell west will join us with more of his defense which i think is indefensible of the former harvard president claudine gay. a hannity shootout tonight. tonight we begin in valley forge, pennsylvania. nearly 250 years ago during a bitterly cold and wet winter, george washington stationed the continental army on this rural plateau just outside of

divisive speech from biden before. get ready and buckle up as i said tuesday on my first show back for the new year. he will do this over and over and over again throughout the 2024 campaign. in fact, it's one of the only things democrats will want to talk about in the lead up to the election. here is their plan. watchword, notice it, observe it and embrace this. you know what they are going to do. they will focus on trump, trump, trump. january 6, generally six, january 6. by the way, without any context that should be relevant. without mention of the 2020 rients that they referred to as mostly peaceful. they will demagogue abortion and whenever possible they will dust off the usual playbook that the democratic party has. republicans, racist, misogynist, homophobic, xena phobic, trance phobic, the gop wants dirty air and dirty water. they want some prominent

republican to push her grandpa and grandma off a cliff. in contrast, here is what they won't talk about and it's a long list. they are not going to talk about the failure of joe biden's border crisis. they will not talk about the drug crisis. they are not going to talk about joe biden's inflation. they are not going to talk about the horrible educational system because of the democratic party on unholy alliance with teachers unions. they will not talk about affordable housing, bidenomics. they've been talking about it for a year. guess what? only 34% of americans actually think the economy is even decent. they won't talk about law and order and safety and security. they don't want to talk about international affairs. they don't want to talk about the war in ukraine and europe trip they don't want to talk about the war in the middle east and gaza. they don't want to call terrorism terrorism and the terror attacks against our troops. they don't want to talk about the failure of the new green deal socialism. and get this, even life

expectancy has gone down under joe biden. joe biden pretty much has failed at everything. are you better off than you were four years ago? of course they don't want to talk about accomplishments. because i can't think of any, can you? in fact you probably won't see or here a whole lot from biden in the coming months. the media will aid and abet him hiding in the basement of the white house wants again. it appears he is headed back to the basement and joe is frankly not up to the rigors of the job. nevermind the campaign. here is biden's recent schedule according to the our nz research. on december 22nd he spent a few minutes at a children's hospital in washington, d.c. about nine minutes. then he left for vacation at camp david. he remained on vacation until the 26th and then the very next day he left for another vacation. this one in the u.s. virgin islands. as evidenced by his horrific sunburn, biden baked in the caribbean heat for the next seven days during a relaxing

stay in st. croix. then he returned to d.c. on the night of january second. the next two days he appeared to do absolutely, positively nothing. that brings us to today's big event. a speech about how his political opponents are evil. in theory, biden has two very difficult jobs. one is commander-in-chief and another on the campaign trail. it certainly appears with anybody with eyes to see that biden is doing neither of those jobs and yet he wants you, the american people, to rubberstamp a second term. here with the reaction to all this big news especially out of the supreme court is the host of tomi lahren peerless. fox news contributor leo terrel. leo, i will start with you tonight. you have the legal expertise. you are a lawyer. to me, the supreme court had no choice here. they had to take this case. if there is real justice,

remember, nobody was even charged with insurrection, let alone found guilty of any insurrection. democrats want to throw people off the ticket left, right and sideways. i can't imagine anything other than a you minimus 9-0 supreme court opinion on this in trump's favor. what do you see? >> i hope it's a 9-0 vote. i can tell you right now trump is going to be on the ballot in all 50 states. the supreme court took this case and they set a very quick hearing in february. why? they want to get the message out to colorado and maine that donald trump will be placed on the ballot like anyone else. this was the most anti- democratic move by democratic operatives portraying themselves as supreme court justices. the supreme court had no choice because you have other democratic secretaries of states and politicians trying to kick donald trump off the ballot why?

because they do not want the voters, the american people to select the next president. this is joe biden's attempt to try to keep donald trump off the ballot. in summary, the supreme court will hear this case and i expect a very, very quick ruling. after that hearing in february. 3 i do too. i would hope it would be 9-0. it would be sad if it is not. under no circumstances do i see a loss. it's even on the state level. you saw what happened this week in north carolina. they voted to keep any other democratic candidate running for president off the primary ticket in north carolina. so the people that claim they have a monopoly on the love for democracy don't seem too in love with democracy. >> no. this makes me very grateful for 2016 and donald trump's victory as it pertained to the supreme court. elections have consequences.

you can see lining these up because they are frivolous. they are so likely to lose on the merits that we will shut them down with an injunction. the reason for that is every day that it appears as if donald trump might not be on the ballot. if that goes on for three or four weeks that affects the minds of the voters as they prepare to vote. the accusation alone ask people think maybe he is guilty of something. you think it wasn't planned that they use the words insurrection for two years? we had a riot were some people this behave violently and some people should have been punished on january 6. there was a bunch of people milling around her probably 80% were milling around being curious. one young man walked in and never said a word to anybody ever was in the capitol for a minute and a half and he gets taken and thrown down to the floor in an airport arrested and accused of a crime. we know this was a ploy from the very beginning. why didn't they call it a right? we will use the 14th amendment. we have this plan and will call it insurrection.

they so overplayed the hands. january 6th was not the civil war. nobody believes that the more video we have seen of some of these people, the shaman walking around saying can i go in that room? people showing him around and policeman saying please don't go in there. you will get in trouble. the more we see this was not some sort of violent riot from the most part. it was not an insurrection. the more the people say the democrats are crazy to say they can think they can win an election on this. then they want to add to it. we will not have trump on the ballot. they want to add to it. >> in 2020 in the summer of the mostly peaceful riots that took place, 574 with a couple dozen dead americans and thousands and injured cops. they were pelted with bricks, rocks, molotov cocktails. a ton of evidence that nobody ever looked at. you could have arrested every person involved. maybe you can call that insurrection.

resulted in a reduction of revenue. but now you went up 26 spots in terms of people moving into your state. people are attracted to arkansas and ways they have never been before. you might be outperforming your dad very quickly here. i'm sure he is very jealous. in all seriousness, were you able to make up the difference for those massive tax cuts? >> you know, our economy has never been stronger. we are booming in every sense of the word. i think we are on track to continue cutting taxes here in the state of arkansas. there is nobody more excited about my record as governor than my dad. he is very happy to be the second-best governor in the state of arkansas history. as an arkansas a resident he would like me to keep cutting taxes. thanks we are doing here are obviously working. we are excited about the success we have here and we will continue keeping our foot on the gas.

i think 2024 will be an even better year for arkansas than 2023. >> it really isn't that complicated. if you keep it to the basics. keep taxes low eliminate burdensome regulations. if you have good schools, you have law and order and embrace the simple things. it seems like that is attracting a lot of people. this is now a real phenomenon. people are abandoning blue states in droves. they are moving to states like yours in droves. i don't see it stopping anytime soon. it's a very divided country. how does this end up in your view? >> i think states like arkansas and other red states across the country continue to excel and do well. this bodes well for the election coming up in november. i think president trump is on track. i think there is such a great contrast to what is happening in blue states led by democrat governors. you look at blue cities led by

held in contempt. and now we hear that is sugar brother kevin morris has given him money. they want to do a documentary on his life. we see him as the great father that he is but for the child and the woman that he doesn't like. what a great painter and great worker he is. this is all about pr and hiding from the truth. >> democrats now are trying to claim that while donald trump owned a hotel in washington, d.c. and people from countries like china, saudi arabia, qatar or whatever actually went to the hotel. c, donald trump got paid by foreign governments and nikki against the clause. the only problem is there is a big difference between joe biden going against obama administration policy after taking a call from hunter and two burisma executives that desperately needed d.c. help because they wanted the investigator in ukraine fired.

that's kind of a big difference that he leverage the billion dollars. as a result of his official actions, hunter continued to get paid for sitting on that board with no experience at a time when he was addicted to pretty hard drugs. any comparison in your mind? >> there is absolutely no comparison. donald trump wasn't involved in the business wants he became president. the bottom line is he had properties and was entitled to have someone else monitor those properties and make money from those properties. okay? now let's talk about hunter biden. hunter biden was supposed to register under the foreign agents registration act. anyone who represents a foreign country interest in the united states is supposed to register. in fact this lawyer named beretta ends up retroactively registering as a foreign agent because he as a lawyer represented the president of burisma at exactly the same time

that hunter did. the fact that hunter didn't register as a foreign agent and this guy registered retroactively, i can show you another example of the inconsistent justice. paul manafort tried to do the same thing. he said let me register retroactively and they wouldn't let him and he ended up going to jail. the truth is that hunter biden not only was representing a foreign interest in the united states, he called his father as soon as the owner or the head of burisma called. he said dad we've got to get the prosecutor off this case are not going to be able to make any money being on the board. three days later joe biden goes over and leverages our tax dollars. that was a billion dollars of our money to get the prosecutor off. together, they end up making sure that the biden family gets all the money that they need. and you want to call that corruption, it's a violation.
