>> we have a hunter sighting, oh, boy, backing to complain about being compelled to testify but still in defiance of the subpoena. >> political theater. >> you want to publicly testify, no problem. but first comply with the subpoena for the deposition and then publicly testify. >> john: hunter biden back on capitol hill crashing a contempt hearing after defying a subpoena last month.
11:01 am
republicans are branding his surprise appearance as a p.r. stunt. peter doocy asked the white house about this moments ago. >> the last time he was on the hill he said the president was certainly familiar with what his son was going to say. >> i did say that, and what i'm saying today. >> president biden does not help him with his business deals but does help him skirt congressional subpoenas. >> that is not even true. that is a jump tha incredibly-- >> john: "this hour has seven days," and that's an old canadian television show, and that's the way it feels this afternoon. >> sandra: sandra smith in new york, "america reports" hour two. any moment now the house oversight hearing, wow, did it have some fireworks. it is expected to resume as the committee considers a resolution on whether to move forward with
11:02 am
contempt proceedings for hunter, adding another headache for the president's son as he is expected to appear in a los angeles courtroom on tax charges tomorrow. >> john: let's go live across the street to capitol hill where our hillary vaughan caught hunter biden while he was storming out of the hearing earlier today. hillary, intrepidity showing again today. >> thank you, john. hunter biden essentially crashed the party, showed up to capitol hill, shocking everyone, unannounced and uninvited but did crash the house oversight committee hearing where lawmakers are debating whether or not to hold him in contempt for being a no-show at his closed door deposition that was requested weeks ago. house republicans and democrats tangled over whether or not to hold him in contempt, republicans say he defied a congressional subpoena, democrats say republicans gave him a choice between a closed door interview and a public hearing and hunter chose a

public hearing. >> mr. moskowitz, mr. biden doesn't make the rules, we make the rules. >> mr. chairman, you make the rules and the rule you made is that he can choose. >> the rule is -- >> those were your words. reclaiming my time, mr. chairman. after he took you up on the invitation to come, and then oh, no, no, no, my god, what did i do. >> hunter biden has been to capitol hill now twice since he's been under congressional subpoena. he has yet to take any lawmaker questions on those two trips and until today he didn't take any reporter questions until he talked to me. >> mr. biden, why did you put your dad on speaker phone with your business partners if he had no involvement in your business. >> you have a dad? does he call you? >> yes. >> you answer the phone? >> yes. >> ok. >> why did you need to talk to him during business meetings if he had nothing to do with the
11:04 am
business. >> and john, that was an interesting new nugget of information that we got out of hunter biden, he acknowledged that in fact his dad was on the phone during some of these business meetings and he also pointed out that it was his dad, joe biden, that was calling him, so two new developments out of that quick exchange, john. >> john: you managed to get what others do not get, and hillary, we love you for that. thank you. appreciate it. sandra. >> sandra: great job, hillary. we thank her for that, and now this fox news alert. the racketeering case in georgia brought against donald trump facing scrutiny. allegations of an improper relationship with the special prosecutor in the case. trump and a co-defendant are now asking for the indictment to be thrown out. jonathan serrie is live with more on this. who is the co-defendant in
11:05 am
question? >> jonathan: michael roman, a former trump campaign official and this week he filed a motion to disqualify the two top prosecutors in the georgia case. it alleges that fulton county district attorney willis became romantically involved with attorney nathan wade prior to appointing him special prosecutor in the case. d.a. willis, according to the motion, has failed to remain independent and impartial in the performance of her official duties because she specifically awarded lucrative contracts to her boyfriend from which he now benefits financially through personal trips, hotel rooms and the like paid by wade. legal experts are split on whether the claims against willis if proven are serious enough to overturn the case. >> if you if there is a substantial conflict found and judge mcafee thinks it exists,
11:06 am
it would be tried by another d.a. office in the state of georgia. >> also contains invoices from special prosecutor wade billing the fulton county d.a. office for an eight-hour meeting with white house counsel in may of 2022, and 8-hour interview with d.c. white house in november of that same year. the white house has yet to confirm such meetings took place. the d.a.'s office says it will respond to the motion through appropriate court filings. neither prosecutor has commented publicly. the "wall street journal" reports willis has been subpoenaed to testify in wade's divorce case. fox news has learned that details of that force case have been sealed under court order. sandra. >> sandra: all right, a lot to be watching for there. we'll see where all this goes next. we'll be following it. thank you very much. john. >> john: sandra, for more on this, ben, get into the
11:07 am
relationship in just a second, ben, but another aspect to this, and that is that according to documents that were obtained by fox news digital, the special prosecutor nathan wade billed the fulton county d.a.'s office $4,000 for two meetings with white house officials. is that suggestive in your mind of coordination? >> it absolutely is, john. i think there is serious questions that the white house needs to answer and also obviously in fulton county we need more answers as well. we have seen some of these investigations in the past as i'm sure you are familiar with investigations in the past as i'm sure you are familiar with into political corruption actually become, you know, complete liabilities when it comes to the offices of the investigators. based on the personal interactions in this case allegedly romantic interactions
11:08 am
with people charged with the task of incurring very important roles in this kind of process. ones that should absolutely be looked at when it comes to the kind of contractual agreements in place, the amount of money exchanged here and a big problem for fani willis and the case to proceed forward if it turns out to be as serious as it looks like on the face of it. i think you could see a real push to have this prosecuted by someone else. >> john: well, certainly donald trump believes this is a problem for fani willis, what he said yesterday. >> event yesterday as you saw in georgia where the district attorney is totally compromised, the case has to be dropped. they went after, i guess, 18 or 20 people, they wanted to go after a lot of other people, after senators, she was out of her mind, now it turns out that
11:09 am
that case is totally compromised. it's illegal, what she did is illegal. we'll let the state handle that. but what i want to say -- what a sad situation it is. >> john: so he says the case is compromised, it has to be dropped. i don't believe either you or i have a law degree, so we don't know what the veracity of that is, but does not seem as though the case would be dropped, but handed over to a different prosecutor? >> that's likely what would happen, yes. and what i would say is that look, one of the things we know from the former president's approach to all of this, he will seize on the weaknesses and the violations of law of the people coming after him who put themselves forward as standing up for law and order, normalcy, and yet it turns out time and again they flaut regulations and requirements in pursuit of him
11:10 am
in so many different instances. it's becoming a recurring thing we see in the pursuit of him via this law fair tactic. >> john: so many times in the left leaning media, a story like this would probably just fall flat or not reported on, but even this one has caught the attention of the "new york times," jonathan swan and maggy haberman, "allegations against prosecutors bolster trump's criticism of georgia's case," and they say it was a very unusual choice for fani willis to pick a suburban attorney, nathan wade, for this position, but apparently he was a mentor and she really trusted him. but the allegations are that he was far more than just a mentor. >> absolutely. and i think one of the things we have in common in terms of the thread between this and the situation that you are seeing with hunter biden is that these are a lot of things that are creating headaches for democrats that they would prefer not to have. they would not like to go into a
11:11 am
situation where you are pursuing donald trump in a key way in this georgia case and have this type of thing that you now have to answer for. when it comes to the behavior of hunter biden on capitol hill today, as much as it creates a circus and a circus-like atmosphere around this, i think people would prefer hunter had kept his head down and not gone through the role of turning this into a p.r. nightmare for a lot of democrats who would have preferred that he just kick the can on everything and stayed quiet through the november election. >> john: it would seem as though he and his attorney have a far different agenda than others. great to catch up with you. thank you. >> good to be with you. >> they should not have remote learning. they should find other options for the migrants. >> sandra: the mayor of new york prioritizing illegal immigrants over some of the city's school children. so, how did that happen?

so, there is no learning today. >> sandra: there is no learning today. those were parents fired up after students at one new york city high school were told no school today, stay home. nearly 2000 migrants were moved into their classrooms. that's after powerful storms threatened to destroy the migrant tent shelters paid for by, by the way, taxpayers. the school we just got word will be reopening tomorrow but nyc officials are under pressure for putting those children last. dagen mcdowell, why would those children not be prioritized, why were they not in school today? >> dagen: because individuals who break the law, illegal migrants who break the law to come into the united states and biden and his cohort who allow them to stay here rather than deporting them, they take precedent. they are the priority over
11:18 am
people who are here legally and over who pay taxes. they are priority over those children, and at james madison high school out in brooklyn, more than half the students at that high school are minority students. they are latino students, they are asian students, and they are not important and that's the message. >> sandra: and it's hard, we learned through the covid pandemic, it's hard on parents when the kids are not in school, parents don't know where the kids are if they have to go to work, nothing planned for them, creates chaos. peter doocy had a moment to ask karine jean-pierre just a few minutes ago in the white house briefing room about this. >> if a working parent had to call out to stay home with their kid today, isn't this biden immigration policy literally taking money out of people's pockets? >> that is something that new york city needs the answers to, that is a process they took, so they have to answer to that. and as it relates to migrants
11:19 am
and what's happening at the border, look, the president has taken the issue seriously and the president has taken action to deal with this while house republicans do not. they get in the way. >> sandra: hold on, how are the two disconnected, what's happening at the border and happening to new york city. something new york city needs to answer to? they are getting an in-flow of migrants they didn't ask for. you know, they did say we welcome all, perhaps they shouldn't have done that, but this is a problem at the southern border and the migrants are coming from there because of federal policies. >> dagen: how long will they stand up there and lie to the american people and think they can get away with it. someone asked me that earlier today. why do the democrats, why do biden and company think this is a winning policy and i said to this person on the phone, only think it's a losing policy when they lose because of it. and from the top down. here is biden's policy, when
11:20 am
they say this is, has been a problem for decades and decades, during the first year that biden was in office, from the customs and border protection, they show border encounters tripled to almost 2 million. tripled from the prior year. the percentage -- this is just according to immigrations and customs enforcement. the percentage of illegal migrants deported has been under 5% every single year that biden has been in office. it was 3%, 2.6%, 4.4%. those are the deportations. in 2018, under president trump, it was 39% deportations based on the numbers from immigration and customs enforcement. let me just lay out the financial disaster this is. oh, and in, here in new york
11:21 am
city they refer to these illegal migrants as guests. no, guests leave. they were referring to the guests staying at floyd bennet field. no, anybody who has ever had people stay in their home know guests check out and leave. these are residents, and that's how they are treated by the biden administration. they are planning on them staying here forever. and the financial disaster that's looming, california expanded state medicaid to all eligible illegal migrants. now at the federal level, the federal government will not pay, will not reimburse the states for covering illegals under medicaid. however, so the states have to pay for it. and $60 billion budget deficit just in california while the actual taxpayers are -- >> sandra: declare a budget emergency. >> we both know money is

2016, santorum, 25, huckabee, 40, george bush high point, almost 41%. bob doyle, if donald trump goes above 50, that will be historic. >> bret: it will, and you know, we are going to have that town hall tonight in des moines and we expect a lot of folks to come out and ask the former president questions. he has not done that q & a a lot, he's had a number of rallies obviously in iowa, and fascinating to see how he answers things. we are going to obviously cover the news of the day and what's happening in all of his, what's been happening in recent days, but really it's about hearing iowa voices and citizens and we have done that over the past two nights with nikki haley and governor desantis and listened in here at the town hall and did an interview with vivek ramaswamy about substance, and you know, there are smart voters in iowa.
11:45 am
they have been through this process a lot, care about a lot of things and if you went down the list, it would be a lot of the things we see in polls of the key issues that people around america care about. >> john: no question that iowa voters do dig into politics in a way many other people don't, which is why the campaigns like to keep it first. also media dollars go further in iowa than in california. in terms of whether or not desantis or haley or even chris christie or ramaswamy -- 37% are hard maga based, vote for trump no matter what. 35% are persuadeable and 25% never trump. how many do you think are really up for grabs? >> it's a great, great question, john. i think that's what each campaign is trying to figure out. i think nikki haley is betting on new hampshire, that independents and democrats will help in the formulation.
11:46 am
i thought jonathan martin with the "new york times" had an interesting piece, he called donald trump's supporters beer drinking and other pinot sipping. and fascinating in iowa how it breaks down. i think there could be surprises here but tonight is a big night for answering questions for the former president. >> john: your town halls have been great. we expect nothing less, bret. >> sandra: who is mr. beast? and why is the 25-year-old youtube mega star rejecting elon musk? we'll have the story for you next. introducing ned's plaque psoriasis. he thinks his flaky, red patches are all people see. otezla is the #1 prescribed pill to treat plaque psoriasis. it can help you get clearer skin. don't use otezla if you're allergic to it. serious allergic reactions can happen. otezla may cause severe diarrhea, nausea, or vomiting.
