ignoring a congressional subpoena to be deposed, what are you afraid of? you have no balls to come up here. hunter biden should be arrested right here, right now and straight to jail. >> sandra: breaking news at this hour on hunter biden as his attorney now indicates the president's son will comply with a congressional hearing or deposition if house panel issues a new subpoena. that is happening at this hour. i'm sandra smith in new york city on this friday afternoon. >> john: friday, such a great ring to it. john roberts in washington. this is "america reports". the change in tune comes after hunter biden defied congressional subpoenas for a closed door deposition last month. also follows a decision by the two house committees who issued the subpoenas to hold him in contempt. jonathan hunt live in los angeles with this latest news. what's it all about? >> jonathan: well, john, this is an offer to appear but when you

start looking at the fine print, it certainly comes with strings attached. at the end of a week where hunter biden made republicans mad as you saw by showing up to a house committee hearing considering whether to hold him in contempt for defying the subpoena, he is now offering to "comply" for a hearing or deposition. biden's attorney, abbe lowell, wrote to two house committees friday saying the initial subpoenas were legally invalid as they were issued before the full house of representatives voted to formalize an impeachment inquiry against the before. but lowell said if you issue a new proper subpoena now that there is a duly authorized impeachment inquiry, mr. biden will comply for a hearing or deposition. we will accept such a subpoena on mr. biden's behalf. but, and a big but, the devil

may be in the detail. he added a footnote suggesting a "hybrid process," public deposition hearing, alternating rounds of questions for republicans and democrats and with similar rules, for example, cancelling questions as is done in a closed door deposition, adding perhaps that could be the basis for our discussion, so he's saying he wants a discussion first about the rules. that would seem to be exactly the kind of language, john, that might infuriate republicans who said on wednesday amid the chaos that they, not hunter biden, or his lawyers, make the rules. so this may be a step forward but i wouldn't hold your breath for an actual deposition by the president's son quite yet, john. >> john: anybody who took a look at the letter that abbe lowell

houthi claim five were killed, six injured, scenes of mass protests as sponsor iran condemned the assault. iran has remained busy on many fronts, seizing a tanker that will be in a tangle with the u.s. over earlier sanction-breaking oil shipments. and yes, dealing with all of this alongside the u.s., the u.k. david cameron said it also sent a signal to houthi-supporting iran. >> malign influence, they back the houthis, hezbollah, hamas, we know about their influence. we have given them a clear message what needs to happen, that has not been heeded and why we have taken the steps today. >> houthis might not have gotten the message. a short while ago, word of another missile fired at a ship off yemen. no injuries reported. back to you.

>> sandra: greg, thank you. john. >> john: sandra, continuing coverage as president biden faces backlash from people in his own party over the retaliation strikes. peter doocy is live at 1600 pennsylvania with the latest. do we know why it took president biden so long to reach out and smack the houthis? >> peter: we are told president biden wanted to make sure first u.s. allies were on board with the strikes. >> this wasn't a decision we made lightly or quickly. in fact, if you go back to november, and walk your way through up until just last night, i mean, everything we have done, diplomatically and militarily, has been designed to keep the tensions down and to convince the houthis not to continue these deadly attacks. >> progressives, though, in the president's own party are steamed. ro khanna tweeting the president needs to come to congress before

launching a strike against the houthis in yemen and involving us in another middle east conflict. article 1 of the constitution. also told defense secretary monitored all this in realtime from his suite at walter reed hospital and austin did put out a statement, part says the united states maintains its right to self-defense and if necessary follow-up actions to protect u.s. forces. but that still leaves a lot of lawmakers in town wondering how, if at all, austin is going to be held accountable for misleading his boss, the president. >> we are weak in the eyes of our enemies but this idea of being down for 2 or 3 days and not telling the president you were diagnosed with prostate cancer is a breach of the chain of command. >> the president has not spoken about this at all except a written statement that was put out late last night. we saw him walking out to the

helicopter on the south lawn, ignored shouted questions, then he was getting off the helicopter on to his plane, ignored shouted questions. we'll try again later to get some more insight about this. john. >> john: the helicopter is pretty noisy, it's difficult to hear the question. peter doocy, 1600 pennsylvania, thank you. >> sandra: retired u.s. marine corps general frank mckenzie, former chief and commander of the u.s. central command. thank you for being here. first up, clearly this situation is escalating, the war is spreading beyond the middle east. to what degree do you want the united states to be and to get involved? >> well, what happened last night was a necessary action if we are going to keep the houthis from continuing their attacks on international shipping in a vital waterway. we have to take these actions. we didn't escalate this. this began with houthi attacks over 60 days ago against shipping in the red sea and the

strait, so we have actually tried, and i agree with building an international coalition, warning the houthis, this action is probably not the last back and forth attack we are going to have with the houthis over this particular incident as you know a moment ago, the houthis have responded. i'm sure we will probably be striking them again here in the next few days. houthis will ultimately respent the use of force, they will understand this behavior is not going to be allowed to continue and a lot of people are watching the u.s. reaction here, including i would argue the chinese as they contemplate the strait of taiwan. >> sandra: a really important statement. biden administration has faced criticism as you know over its handling of iran. here is john kirby defending how the u.s. has been handling this. listen. >> everything we have done diplomatically and militarily has been designed to keep the tensions down and to convince the houthis not to continue these deadly attacks.

>> sandra: from your view, do you believe this administration is prepared to deal with this escalation? >> i think last night was a sign that we are willing to take the action that's necessary. i think we all recognize the houthis are supplied, and supported by iran. and we need to recognize that the problem emanates from tehran, and ultimately you have to deal with the core of the problem and there are ways we can do that. we can work to prevent shipment of arms to the houthis in yemen. we can work with our allies, with the various united nations sanctions imposed upon iran for that, deportation of lethal weapons, we can do a number of things to make the flow of those weapons harder to get to the houthis down there in yemen. but at the same time, opening vital maritime points is a key national interest of the united states and last night was a good step in that direction. >> sandra: a high ranking

senator, lindsey graham, made the case he believes the proxies will not stop, general, until we hit iran directly. listen to that, your reaction. >> it was strongest, most significant to date but it won't change the problem. it won't change the equation. iranians could care less how many houthis die or how much from hamas die. you will never get iran through their proxies to back off until you hit iran. >> sandra: your thoughts on that, sir. >> i think hitting iran would be a big step and carefully consider that. i believe there are a lot of actions on the table to take against iranian proxies in syria and when necessary in iraq and as you noted in yemen. i would also note that iranian proxies in lebanon, though, don't appear to be particularly eager to enter the fray. i don't discount the low level attacks back and forth with israel, and those are concerning but i think lebanese hezbollah

30s in terms of temperatures when you add in the wind chill factor and the wind's starting to kick up, already under a blizzard warning, expected to be the coldest caucus night in modern history. as you just mentioned, all the iowans we have been talking to say they are going to be out there monday night. >> growing up in iowa, the weather has never stopped us. cold, rain, snow, it doesn't make any difference. >> i think most rural iowa will still turn out no matter the weather. >> it would take a lot not to go. >> it depends how passionate they are. i will be here to caucus no matter what the weather is doing. >> bill: and this is video of nikki haley campaigning yesterday. all of her campaign events today are going to be virtual rather than in person because of the blizzard warning we have in effect out here right now. she's been seeing a surge in month -- momentum.

>> sandra: developing right now, faa says it's ramping up the audit into boeing after a panel flew off one of its jets during an alaska airlines flight. the agency is looking deeper into the manufacturing of the 737 max 9 jet liners to finds out where the breakdown of the parts could happen. they say the issue is in the manufacturing, not the design. the faa plans to continuously monitor them. >> john: turning back to the

major news on hunter biden, his lawyers now saying that he will comply for a hearing or deposition if the house panels issue a new subpoena. it comes after the house oversight and judiciary committees recommended to hold hunter biden in contempt of congress after he defied congressional subpoenas for a closed door deposition. meanwhile, hunter has pled not guilty to tax-related charges. our next guest was in the courtroom and has been extensively following the story. josh boswell, daily mail.com senior reporter. great to see you. hunter biden tax court issue on hold for a second and your reaction to the latest offer from abbe lowell to the oversight and judiciary committees for hunter biden to sit for either an open hearing or deposition if they issue a new subpoena. apparently the letter to the committees comes with a lot of footnotes about some suggestions

on how this could happen. >> yeah, that's right. and it's kind of interesting here. i can't help but see this as a bit of a climb down from abbe lowell, hunter biden's attorney there, wrapped up in legal bluster, he's done a u-turn, saying hunter would sit for a deposition. republicans response is likely to be fury, he is facing the consequences now. so see how it will play out eventually but seems like lowell and biden are on the back foot here. >> john: you know, and that is a point of contention to your point about a valid subpoena because abbe lowell is claiming the current subpoena is not valid because the house had not voted to launch a full impeachment inquiry but that if another subpoena was launched

under that resolution, then they would comply with it. >> yeah, it seems here that there is -- that's where the legal argument lies, right, and i would assume that the house republicans would say well, no, you know, we have the majority in our committee, and we offered a sit-down chat with hunter biden not under subpoena, he didn't respond to that and declined, and so we issued a subpoena through a valid vote. that's going to be their argument here, and they would say it is valid and abbe lowell is saying no, this isn't valid because you haven't voted for impeachment yet. it seems like there is a legal wrangling here yet to be ironed out but on the face of it that congress is in the right here, right. they do have the power to issue subpoenas if there is a majority vote on that by a house committee. >> john: if there is a legal wrangle to be had, you can bet abbe lowell will be wrangling

it. the tax court, what was the mood inside the court, who was hunter biden's demeanor like. >> fascinating in the courtroom, six months ago hunter was about to strike a sweetheart plea deal with the delaware prosecutors and yesterday when he walked into that courtroom, i mean, it felt like the weather in iowa had entered los angeles because the reception was frosty. completely different to the sweetheart situation he had a few months ago. they didn't even acknowledge the prosecutor sitting opposite them. hunter was shaking hands and smiling with some court staff but then as they sat there waiting for the judge to come in, ten minutes or so before the judge came in, hunter was looking nervous, pushing back his hair, wiping sweat from his upper lip it looked like and looked at the prosecutors and adjusted his collar and took a

deep breath in. looked like a man under pressure and nervous but trying not to show it. >> sandra: if we can put up the video of him at the congressional committee hearing the other day, seated with him was his attorney abbe lowell and the other side kevin morris to his left, who is known as his sugar daddy, paid his tax bill and footing the bill for a documentary to be made on hunter biden. he was not there yesterday. give us ten seconds on the unusual nature of that. >> very significant i think that he didn't show up at this hearing yesterday where he did show up in congress. it's because the investigation has got uncomfortably close to him, i believe. in the indictment against hunter he's referenced as a personal friend who has loaned a lot of money to hunter biden. i think he wants to try and distance himself from this prosecution. >> john: all right. we'll be watching going forward. court date set for june 20th. josh boswell, good to have you

subfreezing temperatures are blasting the midwest. severe weather causing concern in iowa with just three days to go until the all important caucuses there. daron shaw is part of our fox news decision and polling team standing by to talk about the impact this could have on voter turnout in iowa. but first, our fox weather meteorologist, aptly named amy freeze, is live in chicago. amy, how is it there? >> it's absolutely frigid, john. we are awaiting the blizzard here that put a foot of snow on the ground in iowa. it's already snowed about a half foot in the chicago suburbs, much more to come and worse later today. what it's done in iowa is interesting. near blizzard warnings for the entire state of iowa, but near i-80, east and westbound, a complete shut down. 80 had about 50 stranded vehicles, and terrible driving conditions. even worse, this is extremely cold weather.

des moines could be facing and likely facing the coldest caucus in recorded weather history. previously it was 2004, the temperature was 16 degrees. i got a chuckle out of you describing beach weather for iowans. they may say that but they have not felt temperatures this cold in mid january in 20 years. tonight and into tomorrow morning, the wind chill goes to 20 below for west of i-35, that's in iowa, and then reinforcing cold air. monday to tuesday, wind chill of 45 below. the ball really dropped after december had their warmest december on record in iowa. they have had squall line warnings for snow, blizzard warnings come in and now looking at this incredible cold that's coming. it is going to be one where i guess if a candidate comes out, you might just want to give 'em a vote because they were so bold to get out in weather like this. back to you. >> john: amy, i remember one year, might have been 1996, when

the low negative 14° and when you look at previous iowa caucus days, you are looking at temperatures way below than what we have seen in recent elections. so what are these numbers you are looking at? >> ok, well, in the nerdquarium, we have been asked to figure out what's going on. republicans, 72 through 2016 and how well wind chill predicts turnout. it explains everything else equals totally naive models, but all equal, 35% of the turnout by weather. naive model, and what you find is for every degree you lose in wind chill, you lose about 1500 caucus voters. so if we are 20° below the normal, we could lose 30,000 caucus-goers. instead of 180,000, you could have 150,000. >> sandra: that is fascinating.

this is a sampling of what some of the caucus-goers are saying how the weather will impact them. these are the people, this is what they are saying. >> the weather has never stopped us. even blizzards, cold, rain, snow, it doesn't make any difference. >> warm the car up and put an extra coat on. >> i'm a lifelong resident i'm used to it and planning on going unless it's a major weather event, i think the turnout will be great. >> sandra: that's what they are saying, let's dig into the numbers. if the caucus was held today, your first choice by suffolk university in this poll. 54% trump, 20% haley, 13% desantis, and then vivek ramaswamy. >> three tickets out of iowa, what we have always said, there may only be two tickets out of iowa. expectation that trump will break 50%, whether he likes it

or not, judged whether he does that, maybe the weather is an impact whether he gets a majority or a plurality, and the race for second. looks there's a break towards nikki haley but ramaswamy, and the desantis people talk about how they have done, what do they call it, the full grassley, all 99 counties and vivek has done the double grassley, 99 counties twice. work on the ground, organization matters, especially if you've got a weather issue, so we are still looking at that race second, third and fourth, thes critical. >> sandra: turnout in iowa has been getting stronger in recent election cycles. you look at 2008, 2012, the build to 2016, 187,000 votes, 29% of gop voters. also looked at this question, when you think about your choice, which candidate quality matters most, ok, among iowa republican caucus-goers, can the candidate defeat joe biden, ok.

this is a really, really interesting look at what people are thinking, what's in their minds when they are out there showing their support for their candidate. >> we have, you know, the distinction in political science between viability and elect ability. can they win the nomination, can they win the general. people thought ted cruz was a viable candidate in 2016 but not electable one. nikki haley, is she viable. republicans think she could actually win and the data is she looks strong against joe biden. how much do republicans really want to win, are they as hungry as the democrats were in 2020, we'll see. >> sandra: can't wait to pick your brain more through the election cycle.

>> sandra: texas taking matters into its own hands to bolster border security. the state now using an emergency declaration to seize land along the rio grande and limit migrant crossing. matt is live in eagle pass with the latest on the unprecedented move. what are they hearing, matt. >> sandra, behind me is shelby park in eagle pass, and if you've seen the footage from eagle pass, most has come from inside the park. why, the rio grande river cuts through and where migrants arrive into the united states. in this unprecedented move, governor greg abbott has ordered the fence to be put up and you can see the texas national guard blocking the entrance to this park. texas is arguing that the biden administration is perpetuating illegal immigration so texas is going to handle this property from here on out.

hundreds of migrants are still arriving to the park or in and around the area every day. we have video that appears to show federal border patrol agents processing migrants outside the park, not how this usually works. typically border patrol is in that park and processing migrants in there. now, it's not clear if this move by texas is going to help or harm illegal immigration here because texas national guard is still going to have to turn these migrants over to border patrol to be processed, so essentially adding an extra step. in an overnight filing, the federal government confirmed border patrol is being blocked in the park and writes texas' new action demonstrate an escalation of the state's measures to block border patrol of ability to patrol or even surveil the border and be in position to respond to emergencies. adding to another layer here, the mayor of eagle pass says he was completely caught off guard with a phone call, he does not support his own park being taken over and closed and he is looking into his legal options as well.
