anymore. the problem is the democrats want her to run desperately so they have a lot of democrats signing up in new hampshire. but i don't think it will matter. >> let's be clear. democrats cannot vote in the gop primary in new hampshire. undeclared and republican voters can. people had until october to switch their party affiliation in time for the first in the nation primary. and trump slamming nikki haley is not a new tactic. we see it a lot more lately focusing his attacks on haley recently warning she is getting her support from democrats. haley tells me on the ground in new hampshire she is confident in her ground game and says america is ready to move in a new direction. sick of trump lying about her record and always been a conservative. >> just because trump said something doesn't make it true. he had a temper tantrum at a rally. what is he saying? i was never for the border. i was the governor that passed the toughest illegal immigration law in the country.

>> so let's talk about those polls. according to the suffolk university tracking poll trump 52%, two points higher than earlier this week. haley dropped one point sitting at 35. this is a daily tracking poll in new hampshire. if haley doesn't end up as the gop nominee, the nonpartisan group no labels said they would want her. >> if governor haley does not succeed in obtaining the republican nomination for president, i'm sure people in no labels would give that the most serious consideration. >> in another busy day on the campaign trail trump, desantis and haley have events. a short time ago nikki haley is saying trump does not have this in the bag. she wants people to get out and vote. >> dana: joe lieberman might need an espresso. that was a little low energy for me, i have to say. i love the guy.

come on. thank you so much. >> bill: on the board here is what we got. new hampshire coming up, nevada, south carolina, all coming up in the next 30 days or so. here is where we were eight years ago. donald trump an easy winner, won all ten counties in new hampshire. john kasich a distant second there. this contest moves to nevada, all right? you see what happened there? marco rubio scores a little bit in nevada. donald trump an easy 22.winner in 2016. then we'll move to south carolina. a lot of stuff will come quickly in february. some of it like is a month away. donald trump had a very good performance again in south carolina from eight years ago. let me try and slip over here a little bit to the calendar just so we can tell folks where we are. and where we're going. last week in des moines, iowa. on tuesday coming up next week it's in new hampshire. and then as we move into february, here is the count. nevada is a mess by the way.

we can explain it at the time. republicans hold a primary and caucus and nikki haley is in one and donald trump in the other. more coming up in on explanation. toward the end of the month in february you are in south carolina. so that's what we're looking at. a senior writer national review, harold ford junior is also with us. would you like to lead, my lady? >> dana: i would love to. i can't wait to see your explanation of the nevada situation. that's going to be great. in the meantime, president trump was very conciliatory and kind to nikki haley and ron desantis in iowa after he won and he decided let me see if i can make distinctions. here he is last night talking about how he believes nikki haley is not going to be able to handle being president. >> i tell you something, ron desantis or nicki or anybody else, if they were in my position and if they were here they would have been hit just as hard. these people play tough.

much tougher than the republicans play. the republicans have to get tougher. but i know nikki very well. she worked for me for a long time. she wouldn't be able to handle that position and would not be able to handle the onslaught. >> dana: harold ford junior here we go. nikki haley running distant second in new hampshire but still saying she can get it to a two-person way. >> he was the tone he struck ability to connect with everyday voters with everyday concerns. all republican they are expressing concerns. a couple things you have to ask. first, if he wins new hampshire by 15 to 20 points as the polling data suggests that he might, is it over? if you are nikki haley do you sigh i take the risk of going home to south carolina and losing in front of my hope crowd there where she has not garnered a lot of endorsement.

does tim scott weigh in at that point? the south carolina senator who got out of the race. he hasn't endorsed anyone. three, does nikki haley disqualify herself or has she been disqualified to be his v.p. nominee? i interpreted that tone he struck in iowa to suggest that maybe some in his party are saying she could help soften some of the rough edges he may have with suburban voters. how he performed in iowa he didn't do well in suburban. she overperformed there. critical in michigan and wisconsin and critical in ohio. for that matter georgia and arizona. i look for the margin of victory for him in new hampshire and i think governor haley will then have a big decision to make. i think they'll get over the back and forth now. this is j.v. things. >> bill: to harold's point. the day-to-day tracking number from suffolk university, "boston globe" and nbc10 out of boston.

trump at 52. up two points. haley is down a point at 35. >> if you are nikki haley you are hoping for a polling error. we haven't seen one so far in the cycle. polls have closely mirrored the results, at least in iowa. to harold's point nikki haley hoped for a better performance in iowa, didn't get it. we saw pronounced drop in turnout across the board in the state. really pronounced in suburban places like dallas county and other urban counties. i don't know if it's because of the weather or the contest wasn't that tight. maybe it's because of the fact that suburban aren't turning out for republicans in a way they had been a decade ago. they used to count on suburban voters, pretty well educated, that was the bread and butter. now they have a different theory of the case. the theory of the case is donald trump can remake the electorate and energize parts of the

electorate, special election shuns what have you but turn out in a general. that's a thin reid, it's a language fall if you are wrong. >> dana: "wall street journal" has been following nikki haley for a couple months now and he had this in the paper today. nikki haley could win a new hampshire primary but then what? he says to win the haley campaign will have to do when john mccain did in 2000 and 2008 when he attracted enough independents to pull off an upset. he was very critical of her stump speech. there is no fire. there is no drive. he doesn't feel like people are globing onto it. >> if she wins new hampshire. i haven't heard her trump speech in a while. if she wins new hampshire we'll have a different conversation come next wednesday. her going to south carolina then has a tremendous amount of momentum with all due respect to the column. you can't ignore what noah is saying. that's the flip side of this. if you are going to nominate

donald trump, you can't ignore these numbers and the turnout amongst voters that have really delivered victories to republicans over the years. can he turn up a number of voters that vote who are his base that maybe will come out in bigger numbers? does he make it up with minority voters? ordinarily republicans don't. i like to say about donald trump, he is like jason bourn, one of my favorite characters in a movie. you can't underestimate this guy. don't know what he may do. that tone again in iowa shocked me and i thought he would spike the football and he didn't. it will be interesting to see how all of them behave, each of them behave come next tuesday night. >> bill: on his initial point, is this over next wednesday? are we onto the general election possibly? >> if that poll mirrors the results it's over. republican party has spoken. you can feel the balloon deflating from 100,000 votes in iowa straw poll. it has nevertheless sucked the

much the tailpipe emissions can be, which is going to not make us any more capable of handling electric vehicles while taking away those internal combustion engines. so the problem in order to be able to make these electric vehicles operate the way they need to, you need lithium and a lot of other rare earth minerals that we don't have, we can't process and allow the chinese to control the flow of that in order for us to be able to have the vehicles on our roads. and that is -- that's what's fundamentally wrong with this process. it is not electric vehicles per se. it is that by limiting how much the tailpipe emission can be, you are not increasing the electric vehicle capability in the united states while decreasing the internal combustion and making us more reliant on our biggest potential enemy. >> dana: even more concerning

the reliance hinges about china's goodwill to export those minerals and manufactured goods to the u.s. this will open the u.s. up to economic manipulations by china. identical to what russia is doing with ukrainian grain experts and a major threat to our national security. i found that to be one of the most persuasive pieces of the letter. i should point out we have reached out to the epa and had no response at this time. do you think you'll get a response from them? >> no. >> dana: what's the point of the letter? >> the point of the letter is to raise the visibility of how bad this issue is. and how bad this regulation is. the epa may not respond to us but will take into consideration what the public is thinking about this. if the public is saying you have a solution that is in search of a problem that doesn't exist right now but you will make a lot worse problems. they will make driving a lot more expensive for americans and a lot less reliable they may

start to listen. >> dana: do you think anybody in the biden administration who sees this point maybe hasn't raised their hand so much but people -- are there people in the government who agree with you? >> there are people in the government who don't want to get -- don't want to get the biden administration in trouble. americans are not able to drive their cars because of these regulations that do nothing to give a new type of transportation, then that will make people really concerned. i think there is plenty of people in the government that say sometimes you just don't have -- this idea just isn't ripe for prime time and that's what we're trying to do. we're trying to say you guys are getting ayinde head of yourself, way ahead of the economy and putting us in a much worse position >> dana: don't put us in danger. we'll get there when the technology is ready. it seems simple but not apparently for the government. shoe bob, have a great weekend. love the bow tie. >> bill: and the time.

for criminal trespass after they crossed through the razor wire. one man was from ecuador. also today the texas national guard is scheduled to install hundreds of yards of additional fencing and razor wire to bolster this park's border. this is pretty much in defiance of the lawsuit between the biden administration and texas. federal government wants full access and ability to remove razor wire as it sees fit. all this is happening in maverick county. we talked to a democratic candidate for county commissioner, she is also the former democratic mayor of eagle pass. she tells us she gives vice president harris a quote negative 30 failing grade as border czar and she says most people in the region would praise republican governor abbott for seizing this park. >> he is helping a lot more than anybody has here, you know. again, i know that's a controversial issue here because i know there are a lot of people

when, in fact, they had nothing to do with it. >> our statement is consistent with d.o.j.'s filing. as a d.o.j. filing. >> dana: the d.o.j. filing was wrong and the white house instead of saying our bad, sorry, they decided to double down. i wonder how people in texas feel about that? >> they're upset and regretfully shows the symptomatic nature of the white house position on having this open border policy that leaves states like ours to fund securing the border. since this incident broke out i have had a chance to visit with several law enforcement officials on the ground who consistently day in day out risk their own lives to preserve the life, liberty and property of texas residents and residents in other border states. so i know that federal officials, local law enforcement are still working collaboratively as we speak to try to enforce immigration laws we know it because we know the white house is in its own world. it is completely disconnected

with the facts on the ground and as has been pointed out, the evidence shows that mexican authorities recovered the bodies and for the white house to blame texas and this governor is just sick and vile and it's political. we need good public policy. new leadership that will enforce the existing laws on our books. >> bill: washington the house has been having hearings this week about the effects of fentanyl in american communities today. and even in new hampshire they are reporting with the big primary coming up tuesday opioids is a big deal in that state. eight and ten years of that issue in new hampshire, in that state. here is a woman who blames mayorkas for the death of her own child. >> i understand that the mission of the department of homeland security is to secure our nation's air, land and sea borders. to prevent illegal activity while facilitating lawful travel and trade.

in my humble opinion, mr. mayorkas's border policy is partially responsible for my daughter's death. >> bill: her daughter was josephine. if you impeach mayorkas does that change anything? honestly it's not mayorkas's policy, it's president biden's? >> well, it's a vote of no confidence. so the house committee does deserve credit for that. but you are right, we need a new president, we need new federal policy but at a minimum enforcing the law as they stand. the human toll of what's occurring on the southern border is affecting big blue cities, small red communities, our entire country including states like new hampshire with fentanyl being among certain age groups in the country the largest cause of death. human trafficking, the undo influence of cartels and their wicked works to transit fentanyl

controversial transgender youth bill. molly line is live in newton, massachusetts with much more. hi, molly. >> good morning, dana. this bill which critics argue would protect teenagers who travel to maine without parental consent seeking sex change medical care is stuck. this new working session has yet to be rescheduled before the state judiciary committee. the bill is titled an act to safeguard gender affirming healthcare. critics view it as a trafficking measure to turn maine into a sanctuary state for minors seeking transgender care from hormone therapy to surgery even without parental consent. the bill's sponsor says that amendments are in the works but republican state representative warns the bill as it stands could affect any child in the country. >> if that child runs away from

>> no, no, i did not. and i had nothing to do with her disappearance. you use the word murder, yeah, that is -- that is a possibility. it is not one we're ready to accept and it creeps into my mind late at night. >> bill: the los angeles innocence project is taking up the case of scott peterson convicted of killy his wife and unborn child. she went missing in december of 2002. her body was found five months later and her husband was then arrested. peterson was found guilty in 2004, sentenced to die the following year. the california supreme court overturned that sentence in 2020. he was then resentenced to life if prison and continues to say he is innocent. criminal defense attorney jonna spilbor with me now. a statement from peterson's lawyer reading thrilled to have

the incredibly skilled attorneys at the la innocence project and expertise becoming involved in the efforts to prove scott's innocence. jonna, i ask you, you are a defense attorney. you know the evidence against him. they found his dead wife's body. is this a hail mary or how can you help justify trying to prove his innocence based on dna, which is what the innocence project is all about? >> scott peterson has had a couple of failed appeals already. is this a long shot? you bet. but it is still a shot. here is the thing. it's kind of a big deal. the innocence project doesn't simply take any case. they usually take cases where there is forensic or scientifically-backed reason to try to overturn a conviction. now, without sounding too gruesome, i think i know which dots they are going to try to connect here.

if you remember 20 years ago now, the main theory of defense that was really cut off at the knees, mark geragos was not allowed to go down this path. the defense was to be some other dude did this, a third party defense. not just anybody. there was some evidence that a satanic cult was running around modesto at the time. police didn't go down that road. the judge wouldn't let mark geragos go down that road. but fast forward to the time when they found lacey and her son's body. she was decapitated. her son, she was eight months pregnant. her son was found a mile away from her in the san francisco bay. the theory being how did that happen? was there a satanic cult that somehow extracted this baby from her body that was not really explored but it was a theory of the defense? i think those are the dots, bill, that the innocence project. >> bill: very well done. let me go back to the late great

barbara walters interview from 2004 with his parents. >> what did you think when you learned your son was the prime suspect? >> couldn't believe it. we thought they were joking. >> just disbelief. here is a missing woman and within days you are focusing on my son and you should be out looking for his wife and baby. >> bill: then she says it is just not in him. it is just not in him. the defense is claiming, this project is claiming there were items never seen and unable to locate or access and there have been a burglary near their house two years prior to her disappearance and death. now, the innocence project has a pretty good reputation, one could argue, but have they always been right, jonna? i'm not so sure. >> no, of course not.
