which there are a lot of them up there, believe me, a lot of them in place. he cannot find his way off of a stage when he makes a very short speech, and yes, it is short. can't be long. >> jeanine: trump isn't the only one taking shots at biden. listen to when andrew yang had to say about president biden, while endorsing the democratic presidential challenger and congressman, dean phillips. >> a lot of americans have made up their mind about this president, and this economy. telling them that it's better is not a working strategy. the second thing is that the president is 81 years old periods going to be tough to reinvent grandpa periods not going to become a new candidate. >> that grandpa line has to sting, because it's true. joe biden acts like a grandpa all the time. he was just drinking a triple big milk shake and searching for a congresswoman who wasn't even in the room.

hospitals, and crime is out of control without any solution in sight. >> martha: i think back to president trump's inaugural address. where he talked about the things that were hurting in the country. he used the word carnage. i think then, people understood that the country was headed in a direction that was scary, troublesome. we had four years, had to deal with covid. it appears the current president is not ingesting the feeling of the country, so yes, i think if you ask a lot of people -- and i think it's evident in many of the polls -- that people are concerned the country is failing, falling behind, that our great cities are not what they once were. that they are worried about the fact that our children aren't educated. you can graduate from high school in this country barely able to read. he failed often -- to meet the moment where people are in the country. if he could speak to people in a

way that reached to them and had that kind of bill clinton "i feel your pain --" people believed him when he said that, that he understood what was going on around their dinner table. there is a disconnect. i think you sense it's all the time. that's why he is at 33%. that's is an abysmal approval number. now, what happens in a head-to-head to trump/biden? that's anybody's guess. interesting match up once again. we will see what the swing state polls look like. they look good for trump, but i think you've got to wonder if there is a third party who kind of throws a wrench into some of the ballots on these numbers, and we will see what happens. >> charlie: piers, he says joe biden can't put two sentences together, doesn't know which way to walk off stage. what do people in europe think of of joe biden and to the fact that he has got these issues? >> piers: i know i'm in the official liberal chair tonight, but i've got nothing. into a ludicrous situation. democrats think he is too old, two-thirds of the party. he is insisting on doing it. doesn't want to give up the most powerful office in the world, i get that, but joe biden to me as a dead man walking. if the democrats do not wake up fast to the reality of their candidate, the incumbent, barely alive president, against a resurgent donald trump who has just had the biggest win of the iowa caucus in republican history -- and by the way, 2016 when he became president, did not even win in iowa. if that doesn't ring massive alarm bells, then i don't know what does. of course, the dynamic is so different for 2020, because when joe biden ran against trump than that, it was on the back of a room and this pandemic which had ruined all of trump's calculations, and would have been incredibly difficult for anybody actually to win.

incredibly difficult. and biden ran as an anti-trump canada's. he has to run on his own record. as martha said, 33%. i think any incumbents in history has one mic without rating. -- history has won with that approval rating. will they get a new candidate in? maybe it's too late. they have done it twice before when they have had incumbent democratic presidents. since world war ii, who have stepped aside. i think they should do that. otherwise, i got to say, i do not think i would be saying this a year ago. i didn't. i thought trump was done, and then when you think 91 criminal charges, he has to be done, but it's like king kong on top of the buildings here. the more they are into his back, and the more powerful he's got. i look at trump, and i've known him a long time, my god that guy has got resilience. he has a gate, a wind behind his gate, which says to me he thinks

he's going to win, and i think honestly, i suspect he will be here in november, and of joe biden is up against him, trump wins. >> charlie: tyrus, if biden thinks trump is the next herbert hoover -- i mean, he does not understand numbers. his numbers on the economy are 30%, where trump's was always 50 or over. >> would have loved someone to follow up because there are no follow-up questions. how so? how is he herbert hoover? i don't want to talk about vacuums. he has no clue what's going on. right now, take the polls out of it. america, we are a cowardice nation right now. we don't respect women. we have morning women in the senate talking about their children. our representatives didn't show up. they were attacked, and that was the status quo. no reason to give up power because he's not in power. andrew, who i respect -- you cannot reinvent grandpa, because

he's not grandpa. he doesn't claim his own grandchildren. there is no reason -- because democrats aren't running the country. these are not democrats. i have no problem losing an election to a current -- everything might not go my way, but they are democrats. this is socialism, and progressivism, using an elderly man who can't remember what day of the week it is as their puppet. that's why he only has two that she cannot put two sentences together. he puts three or four, that's the problem. he is just a puppet. there is no way in blue hell they will give that up. they are getting stuff that even 50 years -- that he has been in government, he has never been this far, but he has no clue it's going on, so there's no -- and they are not going to run against trump. there will be no debates, because he's not going to debate with a criminal. i've said it over and over, they will use all the stuff they have set up to not debate him. they are going to run them what they think will get him to the finish line. the problem is the emergent

people do not like being known as cowards -- the problem is the american people do not like being known as cowards. in the middle east, if england didn't do something, we did it. when we are left to do something, we don't. we blow up empty buildings, and that's the problem. the economy, it doesn't matter. americans don't feel good about this country right now. >> jeanine: charlie, martha brought up the issue of no labels, and the possibility of a third-party candidate. do you think that's going to happen? >> charlie: i think we will probably see something like that happen, whether it is -- what is interesting is if you do see that, what is the third party candidate going to do? they are going to try to run on entirely trump's agenda, because that is a winning agenda. if you take the personalities out of it, donald trump wins this election by -- with a 60-70% of the votes. everybody agrees with donald trump on all of the issues. some unsolicited advice for joe biden: don't get into a

trash talking contest with donald trump. nobody fares well in those things with donald trump, especially not you, joe biden. not going to end well. when joe biden talks about how trump is trashing the country and says what a failed nation, and -- no, he's not. that is like the political version of a human shield, where you say he is attacking american -- no he's not. he is saying you are a failure. you know what? you are a failure. [laughter] when he talks about the economy and how trump wants the economy to fail. no, he is predicting that the economy is in shambles, as you point out, martha, and they are disconnected from that. you can look at the stock market and say it's setting new rec records, and that's a classic mistake that the failed politicians, politicians like you want to lose, always make. they say "the stock market is doing great." it's not if you can't afford groceries, and people are complaining about it, and it can be tied directly to your

♪ ♪ >> a shocking new twist in the fatal "rust" movie set shooting. alec baldwin could go to jail now that a grand jury in new mexico has indicted the actor on involuntary manslaughter charges. the death of the cinematographer, who died after

the actor's prop gun fired a live round of ammunition on the film set. a dramatic turn of events. just months ago, the charges were dismissed. baldwin hasn't stood by the claim that he did not actually pull the trigger. >> i let go of the hammer of the gun and the gun goes off. i let go of the hammer of the gun and the gun goes off. that was the moment the gun went off. >> it was not in the script for the trigger to be pulled. >> the trigger was not pulled. i never pulled the trigger. >> so you never pull the trigger? >> i would never point a gun at them and pull the trigger. >> baldwin's lawyers say they will fight the new charges in courts, but what changed? apparently, special prosecutors did a new analysis of the gun that was used and concluded that the trigger had to have been polled or depressed. judge jeanine, everybody looks bad in this case, obviously, and the fact that the case was off and back on again.

what is your take? >> jeanine: well, that alec baldwin was indicted based upon evidence, he is now under indictment. two counts of involuntary manslaughter, which basically means that he willfully disregarded the situation and the damage that could happen, and he says "look: i cocked the gun, i pulled the hammer, and i would never pull the trigger because that was the training i had." according to the fbi, that's a lie, and every cop i've ever worked with her spoken to, it's a lie. first of all, you've got -- the hammer is cocked. unless you pull the trigger, the round is not going to come out of the gun. there was only one person who was pointing the gun at them, only one person whose hand was on, pulled the hammer back, and had to pull the trigger. what happened is they took this gun, and they decided that they were going to do everything they

can to see if there was a way that the gun would actually shoot the round, that live round that should never have been in the gun in the first place. the only way they could have that happen is if you actually pulled the trigger. he is lying, according to the fbi, when he says he didn't pull the trigger. the truth is they had to take a mallet to that gun to get the gun to fire. unless they did that testing with the actual gun, which has now basically been destroyed -- which is the argument the defense will use -- as a prosecutor, my response to that is "you've got to use that gun you can't use another gun. you have to try to figure out what makes this gun shoot." it's like dna. if you have dna in a criminal case, you only have one bit of it. you've got to call the defense in if you are going to destroy the dna, and analyze it, because there's no other way. >> tyrus, you are comfortable around guns and no guns. one of the things that annoys me in this case -- they talk about

prop guns. it was not a prop gun, it was an actual gun. this argument they make about how "oh, no, we were just funning around, filming a shoot, so i pointed a loaded gun at somebody and it went off." if you were a hunter and your excuse was to the police after you shot somebody "we were just playing around, pulling the trigger, pointing a loaded at one another." you would go to jail for that. i've never understood this excuse. >> tyrus: dick cheney would probably argue that. [laughter] i know alex would never do this for me, but that's not what i'm about. gun smith, gunsmith, gunsmith. i've done four movies. i've done movies where i had to hold guns. a gunsmith using the gun. they open it, show it, they say it's hot or cold. hot means it's got blinks in it, cold means nothing in it. once they hand you that gun, their reputation, their job, is that they are handing you a safe gun. if he said to him it's a hot gun, and here is the deal --

actors fiddle. they sit there, he pulls the hammer back. one of the golden rules is you never pull your finger. you keep it on the side. then, the director goes "it doesn't look real." points his finger, pulls it back, doesn't take much to pull the trigger. key 1000% pulled the trigger, but that's not the issue. he could have pulled it eight times. when that gun -- and this is what happens with equity hires: nepotism. unqualified person who -- out of the live rooms get in there? that's the question. somebody was having target practice the night before, didn't clean or check the guns, and then a dirty gun was handed to alec saying it was clean. the argument is if he, the producer and director, grabbed the gun himself, didn't check it, and then fired it. like i said, i'm not the judge, but then, you have motive and all on him.

goes back to the gunsmith. >> charlie: i think you are being generous. if that guy was taught how to hunt, he would be taught there is no such thing as a safe gun. there is safety. you treat every gun -- >> martha: they are creating a scene in a movie with a gun, and i agree with you. my question in this case has always been the custody of the ammunition. the night before, there have been stories that they were outside. this person was in charge of the guns. i want to know step-by-step what happened. how did that live round end in that gun that ended up on the table? there are so many witnesses to all of this. their witnesses to what happens the night before. a lot of people were in that room who saw it. did they know for a fact? where they rolling when he said "this gun is called, you can use this gun now?" if you are an actor and are told to pull the trigger and point it's, you have to rely on the people around you. he produced the movie. if he created in an unsafe film set and somehow, they got their hands on this gun the night before and were messing around

with it, then i could see -- >> piers: can i be mr. unsympathetic to alec baldwin, who i think is a lying, sniveling little wretch? who has also spent the next two years after he killed this woman dashed -- not deliberately. not deliberately but he pulled the trigger. i'm not a gun experts, i think americans know that. i do know that he did that, he pulled the trigger, he killed her. he is responsible for her death in that action, but has always said that all of these self serving interviews "i'm not responsible. i don't feel guilty." really? a young woman on a movie set, which by the way, wasn't just an actor. he is a producer of the film, responsible for the safety onset as well, like all producers. they were already having a lot of issues with safety. he must've been aware about. if he wasn't, he should have been. >> tyrus: which goes back to that. >> piers: he is negligent as a

reducer. >> tyrus: the murder she wrote theory. whoever put the bullet in the gun -- just before he is responsible. >> tyrus: -- if he didn't follow the protocol which i have a sneaking suspicion he didn't. >> piers: most doctors i've talked to have said to me that they think -- >> piers: most actors i've talked to have said that they think he is responsible and wouldn't have done what he did -- pulled the trigger. whoever told you that is hogwash. you don't take the chance. >> martha: rehearsal. >> jeanine: it was. the amazing thing is they have had problems with guns on that set, shootings, live rounds on the set. he had noticed. he was in charge of the production. he should not have relied on anyone. his finger should have been nowhere near the well over the trigger was. for him to come out and say someone "is responsible, but not me." it's a sad commentary. his inability. >> piers: he and his wife -- the constant instagram victim retorts. i don't want to hear it periods before this person's son was

son. paying reportedly $5 million of hunter's tax bills, housing, legal fees. according to a report, he told house investigators he visited the white house three times while bankrolling the first family. he's also paying hunter's ex-wife, and the mother of his young out of wedlock daughter. morris denies there is any political motivation for any of this, saying in part "i did not and do not have any expectations for receiving anything from hunter's father or the biden administration. my only goal was and is to help my friend and client." meanwhile, hunter is ending his months of defiance after finally agreeing to a private deposition behind closed doors with house republicans. that's going to happen february 28th. it's a major shift, after he was seen pulling two political stunts. one of which where he showed up for his deposition only to blow it off and bash the investigation. >> there is no fairness or decency and what these republicans are doing.

almost $7 million. by the way, i just have to make a comment. for hunter biden talking about the republicans not having decency, for this guy to have decency -- more coming out of his mouth and we have seen every part of his body that we don't want to see his stunning. >> the gall of that man, though gall. the gall. >> the gall of that man. [laughter] >> here's the thing: i don't care about kevin morris. the only thing i care about. he is a lawyer, for the people who write "south park." he purchased hunter's share or stake in a china-backed investment during joe biden's the first year, allowing the first family to claim they had divested themselves of any connection to communist chinese money. he gets his share, then gives them money. that's a problem for me. other than that, i could careless about the sky.

>> martha: i'm intrigued. why is this guy doing all this? why is he trying to clear the decks for hunter biden buying all of his artwork after they only knew each other for a few months? >> charlie: anytime you defend a sugar brother in politics, you are losing badly. this may be the least terrible scandal that the biden family faces. i love the statement, talking about how he had no expectation of something in return for all of his money, which sort of reminds us of all of the other areas where a hunter biden -- was collecting money from china, ukraine, mexico, all these different places. they are saying "there was no expectation of something." yes there was. it makes you wonder whether or not -- it is almost like the white house wants to talk about this, because they don't want to talk about these other things. where joe biden is completely involved in. and of course, you have the white house advanced team, since joe biden out to go speak today at a high school. unfortunately, they picked hunter high school.

it's on fire. mom. >> piers: shocking new video showing flames shooting out of the engine of a boeing 747 cargo plane which had just taken off from miami last night, making an emergency landing minutes later. nobody was hurt. a hole was found near the en engine. this after growing scary airplane incidents. high wind this afternoon. authorities investigated the emergency landing. no injuries there either. this door got blown out the alaska airlines flight earlier this month which also was a boeing plane. speaking of someone flying back to england on a boeing engine plane tomorrow, i will set this out. judge? what's wrong with our airways? >> jeanine: a boeing -- they have had 12 major equip and events in the last 12 years. then, two with the door. the door plugs flying off, then one last night. in japan, a boeing airline had a problem where five people were killed. my new mantra was if it's boeing, i ain't going.

[laughter] it's not fair. the surgeons and the team of scientists put that thing back together again. it is scary. i wouldn't want to go to her concerts. again, this is what happens when people -- they get in this lifestyle and can't let it go. i don't understand why no one grows old gracefully. i'm letting the gray role. why not? to charlie is letting it go, you are letting it go. >> charlie: judge, the madonna verdict? >> jeanine: if i go to a concert and it is two hours and 15 minutes later and she comes out at 1045 when she is supposed to come out at 8:30, i would sue too. the problem is a lot of people -- i think in brooklyn they could not get transportation home. they had the work the next day. that's rude. i have seen her years ago. i have seen her in ivory with martha -- you have to grow old
