8:00 in los angeles, and this is america's late news, "fox news @ night." breaking tonight, in one hour, in a place called dicksville notch, where you are looking live, the primary votes for president will be cast and a small number of new hampshire residents will be among those who decide if nikki haley has enough support histogram. and president biden could lose, because not on the ballot. mark meredith is live in dixville notch with a preview of what's to come. >> good evening to you. the excitement is building right here in dixville notch because, as you mentioned, the first notes of the new hampshire primary are going to happen right here in this room a little less than an hour from now. there's only going to be six people voting. we have four republicans, two and declared but once they get done voting it shouldn't take long to get the results. in fact, after they take a look at the results, will be posted on a piece of whiteboard right there where you see the names for haley and trump as well as,

once this gentleman moves, for dean phillips, the congressman for minnesota who would be on the democratic ballot. but candidates from all over the spectrum over the last several years dating back to 1960, like george romney, george w. bush, have all made stops in dixville notch, eager to build on any kind of momentum. while we don't know how the results are going to turn out, the owner of this property where this is all happening insists it is important to keep this tradition alive. >> it is really gratifying to know that the democratic process is alive and well in the little hamlet of dixville new hampshire where we are going to get together at midnight and vote. democracy in action. 100% of the voters will vote and then we'll have the results at about ten after 12:00. >> so, with an hour to go until the voting begins, the remaining presidential candidates are making their final pitch to voters tonight. former president trump rallying in laconia and quite the entourage, multiple former presidential candidates including senator t tim scott,

vivek ramaswamy, and governor doug burgum trying to sell these amateur voters. and he made it clear he thinks this race is over. >> the republican party is becoming more and more unified, and it is, and you see what happened? we had a very good competitor, ron, as you know. ron desantis. ron desantis. and he fought hard and he fought well, and now we have one left. >> and that one left is nikki haley, but she says she is gaining momentum here in new hampshire. while she's backed off the earlier claims she was going to enact the state outright, she says what happens in the granite state could reset the republican race once and for all. >> but i'll promise you this: if you join with me in this, if you go to the polls tomorrow and take five deal with people with you,and you commit s back on track, i will spend evey

and abortion appears to be topic one. the senior national correspondent, kevin corke, is live in d.c. with that story. >> evening, trace. it's increasingly likely tonight the white house will not like the headlines out of new hampshire on wednesday, especially on the democratic side of the voting ledger, because the sitting president is, in effect, sitting this one out. sure, there will be signs, giving him a solid, writing his name in. but that may not help since he is not actually on the primary ballot in the granite state tomorrow. and there's also this bit of history. you will recall that biden finished a distant fifth in new hampshire's primary back in 2020, and no, it's not a surprise that voters in 2024 are feeling a little disrespected by his camp's no-show. >> i'm kind of angry about it. some people have said, why should he write his name and when he won't even give us the time of day? but he is our president, and the

i want to put this up. this is the latest cnn university of new hampshire primary poll. you got trump at 50, haley at 39, and the rest doesn't really matter very much. i'm wondering, to you, matt mowers, do you think if nikki haley comes in at 12 or 13 that is enough for her to keep going? >> i think she needs to make it a little closer. if she comes within 10, she can certainly then say, "i've been able to create something to hampshire by bringing in independent voters, having the support of a strong republican governor in chris sununu." where can we replicate that in states like michigan? can you do it in south carolina where she has a strong political infrastructure cannot but also with an open primary. you don't register by a party in south carolina so it is effectively an open primary. and there are countless other super tuesday states that are similar to that. but in order to actually show that can work, she's got to prove it here, and i'm not sure thing much more than ten points is going to be able to do that, given all the factors that are

actually helping her hear new hampshire, which includes moderate republican voters, registered independents who can vote in the republican primary, and the strong support of a popular governor. >> trace: francesca, would you agree with that? you look at the real clear politics average and you have nikki haley down by 17-18. would you think that she needs to get much closer than that to really continue this thing? >> well, even her supporters have said that they expect her to get within ten points. she's going to be able to -- >> trace: okay, let's pause will get back to her. leslie marshall, let's put the next topic on there. the most important issues, you have iowa, now new hampshire, and the most important issue at the top is border and immigration. what does that do for the biden administration for the democrats as they go into this? it really is becoming very important for a lot of people because it has caused a lot of chaos across the country. >> absolutely.

i've always said this and i said it back in 2020. it's a huge issue. for some people it is more important than the economy. everyone says it's the economy, stupid. well, if you live in a border state, immigration is your economy. immigration is very important. however, he talked about it, we heard kevin talking about abortion, and that is one thing democrats are going to put forth, and they should because of the success in the midterm election, what we saw happen in ohio, what we see in numbers, especially with those white educated female voters in the suburbs. >> trace: you think only abortion, leslie? i've got to go come of it on the abortion, because it seemed in 2022 that was the big push and how it seems they're going back. the economy isn't really working for them because the polls are not that strong, even the recent polls, and i want to put that up because here are some trump supporters -- will get back to leslie in a moment, but i want to go back to you if i can, matt. here are some trump supporters on dissent is dropping out and what that means. watch. >> are you supporting trump?

>> i think it's a good idea. >> ron desantis votes will go to trump. stick instead of her ron desantis next time around. he'll be better off. >> i like desantis and i've always liked him. i think desantis that i don't like that trump beats him up. i think -- but i don't like the fact that desantis went against trump after trump helped him out. >> trace: but now it looks like desantis is back in the same team. is he back in the veep steaks, in your estimation? >> i don't think ron desantis is a second in command kind of guy. and you notice he was not on the stage at that rally in laconia unlike some other former candidates. i think it'll take some time to mend some wounds there. but he deserves political viability for four years from now. despite being on the receiving end of almost $46 million in negative ads, where than any other candidate in this race, including president trump or

president biden, his numbers with republicans had actually been pretty strong. the challenge for him is that a lot of those voters chose donald trump over ron desantis despite having some affectionate feelings for the florida governor. >> trace: francesca, i think we have her back now. i want to get your take and then we will go back to leslie. do you think using the abortion issue is a good strategic move for them? >> abortion rights in the polling that "usa today" has done, and democracy, our two really big issues for democrats' inflection and it helped them carry races around in the country in 2022. so it's no surprise that vice president kamala harris and president biden are campaigning on that issue this week. as we are talking about before, they can't be here in new hampshire because in new hampshire the dnc would punish them, essentially, for being on the ballot here and for campaigning here. so instead they going to virginia and wisconsin this week. >> trace: it just seems to me,

leslie, when you talk about abortion, they're going to try it. but you wonder, is a resonating connectivity need more than just abortion and anti-trump? >> you can't just be anti-candidate. that doesn't work on either side. to francesca's point, i would agree with her, how important it is to the democratic voters, the threat to democracy. many independents and even some republicans who view donald trump as a threat to democracy, they look back at january 6th. there are people that voted for donald trump the first time, they didn't vote for him the second. will they vote for him the third? will have to see. but they can't just be a 1-issue campaign. nobody can be a 1-issue campaign and nobody should ever be "vote for me because i'm not them." bill and i had 15 seconds for you, matt, to close this out. would you agree with that assessment? >> eyelid. you can't have a vision of what you're not going to do, just what your against. that's the case for both

nominees. >> trace: thank you all. meantime, breaking tonight, a closely divided supreme court has ruled that federal agents can begin removing razor wire along the southern border. we are talking about a chunk of federal land that texas has taken over, and the lone star state is apparently not backing down. bill melugin is live with the latest on the border battle. good evening. >> trace, good evening to you. this is a temporary ruling while the merits of the keys are being litigated in the supreme court. but, look, it's undoubtedly a huge win for the biden administration, which has sued texas virtually every single time they have tried to secure their own border. in a 5-4 ruling today, the supreme court decided that the biden administration border patrol can resume cutting and removing the razor wire texas has deployed at the border in the eagle pass area, at least for now. justice john roberts and amy coney barrett, both sided with the court's three liberal justices to rule in favor of the biden administration and allow

the razor wire to be removed, while conservative justices clarence thomas, samuel alito, neil gorsuch, and brett kavanaugh all opposed the decision. texas governor greg abbott reacted to the ruling on x this evening, writing, "this is not over. texas' razor wire is an effective deterrent to the illegal crossings biden encourages. i will continue to defend texas 'its constitutional authority to secure the border and prevent the biden administration from destroying our property." the border patrol union also responding, telling fox in part, "the supreme court decision today is going to undoubtedly encourage more illegal immigration. agents support what texas was trying to accomplish in the absence of true border security policies from this administration." trace, listen to this -- we are also learning that a sanctuary jurisdiction in fairfax county, virginia, recently released from jail, without notice, a honduran illegal immigrant charged with sexual abuse of a child. this was after they ignored

i.c.e.'s detainer request. i.c.e. then went out, found him, and rearrested him, and they said during the process he actually assaulted one of their agents. >> trace: part of the recent immigration is number one issue in iowa and new hampshire. bill melugin, thank you. tsa now facing major push back concerning a story we broke here on fox news. illegal immigrants getting special treatment at u.s. airports, being allowed to go through security checkpoints without i.d. or without having their pictures taken by agents. jackie ibanez has new development in this. good evening. >> good evening, trace. there is increasing backlash, as you said, tonight over signs posted at u.s. airports that appear to tell migrant they do not need to show proper i.d. to get through security. instead, illegal immigrants can use a customs and border protection app called cbp one, and no photo is retired. retired chief patrol agent chris clam says he is offended by this seemingly preferential treatment migrants are getting, telling

"the new york post," the administration mentality is to try and make it the most humane and pleasurable experience for these poor people under distress. many of them just came from the middle east, traversed seven countries, used apps to get here, and were supposed to believe phoenix airport might be all too much for them. ridiculous." the comments come on the heels of a congressional push. for more information about the practice, republican senator josh hawley sent a letter to tsa administrator saying, not only does it undermine the rule of law, it raises significant security concerns. he's not the only one worried about security. listen. >> we have a bunch of foreign nationals coming into the country. many of them, we don't know who they are. at some point in time, if we figure out that someone is here for nefarious reasons, we should have an updated photo. >> the department of homeland security told fox that

immigrants over the years, and document immigrants, people without insurance. i have volunteered at l.a.'s biggest county hospital for a long time, so i've seen that. i've actually volunteered my time to help people. but the overall health care system is not generally staffed by volunteers. it takes a lot of money. when hospitals get someone coming to the emergency room who is sick, by a federal law, they can't turn them away. so when you have a hospital, even a private hospital with people showing up to the emergency room in need of care, whether it's a stroke or appendicitis or heart attack or even just a bad cold, guess what? they can't turn them away. someone has to pay for that. generally it's either the taxpayers or the other patients who do have insurance who are going to have to pay a little bit more, or a lot more. >> trace: the migrants on the "chicago sun-times," it's a looming crisis, and it goes on to say getting help can seem impossible, and that is if you know help exists. it really is, it's the same problem. it's the resources.

chicago complains, everybody complains he cannot get in and see a mental health professional because they don't have enough. >> exactly. mental health professionals are already pretty scarce for our citizens here. so it's even more of a pressing issue for immigrants. remember, their experience is a little different from you and i. it depends on the country of origin and the path they took to get here. they are facing different kinds of mental and physical problems. they are put in shelters which are cramped, usually, exposing them to communicable diseases. they are also facing poverty, social discrimination, inequality with increased chances of poverty and homelessness, which increases chances of known communicable diseases. so they are a very at risk population. but it's always better to prevent all that stuff from happening than treating it, because you're going to end up using a lot more money to treat. >> trace: is a part of the reason that immigration is the number one issue in iowa and the number one issue new hampshire? is it because of health care? because all these problems in

new york and chicago and across the country? >> absolutely. the migrants have to go and live somewhere affordable to them, ultimately. i lived in new hampshire 11 years ago before moving to l.a., and guess what? it's a lot cheaper over there. so you will see people dispersing throughout the country to areas like new hampshire and iowa, and it will increase the cost of care, increase the cost of housing, and ultimately the people who are there already may not like that too much. >> trace: i want to put this sound bite up on the air, because this is peter doocy talking with karine jean-pierre today about concerns about the president's mental watch. >> why do you think it is that more and more people polled feel that, over time, president biden is getting less and less mentally sharp? >> it's poll is this? >> abc has president biden's rating for health, since may, down five points, and for mental sharpness, down four points. >> trace: the public hasn't diagnosed him. but what is it that the polls keep going up for, his mental

sharpness going down? is it his cadence? is at the walk? what is it that you think is happening here and why are the poles reflecting it? >> i can't comment on his mental state, but we do know that, with age, there is a risk of disorders which we have to take. trump is not that far in age from biden. why are the polls showing he is still popular? i don't know. that's another political problem. >> why are they showing at his mental sharpness keeps going down? what are people looking at? >> with age, every five years or so, the chance of dementia and neurocognitive disorders doubles. as he gets older, it happens when you elect an older president. so i'm not surprised. >> trace: you look at things, age is always one of the key factors. thank you both. coming up, it is among the most popular burger joints in america. high praise, considering it is really only in the west.

♪ ♪ >> trace: the fox news at night common sense department was not surprised at the far left "los angeles times" endorsed the far left los angeles to see attorney george gascon for reelection. the times says the he is doing what he promised him which is hard to argue with considering he promised not to prosecute criminals, and he's not. but the times says the backlash to his crime policies is a "maga fairy tale." interesting, because common sense is pretty sure that, when ruben ramirez got his compton bakery rammed and robbed two days ago, he didn't feel very fairy talish. he felt genuinely violated. in fact, we watch people commit crimes every day in los angeles and they don't seem to have that prince charming appeal. despite what the times will tell you, they also don't appeal to be segments of right-wing

rampant just like here in l.a. in-n-out burger says despite repeated efforts to create safer conditions for their workers and customers, both are regularly victimized by armed robberies, car break-ins, theft, and property damage. a spokesperson said that, though store 193 remains busy and profitable, the closure is the first of its kind throughout their 75 years operating. saying in part, "our oakland store will be the first location we have closed. we feel the frequency and severity of the crimes being encountered by our customers and associates leave us no alternative." the crime stats speak for themselves. robberies in 2023 were of the 38%, burglaries up 23%, and vehicle theft up 44%. many blame alameda county district attorney pamela price for the chaos they say is a result of her soft-on-crime policies. a recall campaign has been in motion since last year with organizers saying last week they have already locked in the

minimum number of signatures to qualify for the ballot. once submitted, alameda county will have ten days to validate the recall signatures and 45 days to schedule an election. in the meantime, what happens with that story? the oakland in-n-out plans remain open until march 24th, 2024, where all the affected associates will be given a choice to either transfer to a nearby location or receive a severance package. >> trace: a shame to have to go over the bay bridge to get the animal fries. that's the whole thing, it's a crime they're taking that away. let's bring in megan mccarthy and talk radio host jason rantz. thank you both for coming on. so, in-n-out worker daisy nunez valenzuela said this to "cbs news," quoting, "it's terrifying because it also puts us in danger. the thieves look around all the time and then they see the police department leaves for a second and that's when they take

change the name of sex offenders up in your neck of the woods to something else. the executive director of the washington state group called "washington voices" said the following. look. that's not the one. you have the sound bite, greg? okay. >> for far too log, our public policy has treated people who have offended sexually as of the liver be able to control their actions, as though they are moments away from reoffending. this simply is not true. the vast majority of people that have been convicted of a sex offense never reoffend never reoffend. >> trace: so let's not call them sex offenders. >> yes, let's use person first language so they're not stigmatized and they are not defined by this one act that they committed, an act that of course ruins lives, that causes great fear in communities. the idea that we have to do something with sex offenders who come out of jail who have had

their punishment, i think that's a valid conversation to have. because obviously, so long as we are not pushing them in one direction, they are less likely to reoffend. but this idea that we have to celebrate them, that we have to really do their advocates, that we have to pretend that they are on equal footing as the people they have hurt, that they have harmed, is absolutely ludicrous. there is too much glee associated with these people. i don't want to destigmatize people who have committed rape. sorry if that makes me controversial. that i think that should be stigmatized. >> trace: i think it's a fair assessment. the "l.a. times" address this a little bit, pushing, endorsing george gascon who was almost recalled, and other saying he's the one that's going to control crime in l.a., and the numbers just do not say that. >> i would love to know what world they live in, i mean, have even been to l.a.? have they been to california? two they live on mars? what kind of policies has he done to help the community?

he has revictimized victims, he has enabled this behavior. so for them to reendorse him means they are reendorsing criminal behavior and they don't care about their community members becoming victims of crime. >> trace: jason rantz, tell me about washington state house bill 20 2:30 eight that says, "this act intends to impose a sales and use tax on ammunitions statewide." >> it's worse than that. that's on top of any kind of sales tax, any additional tax a city might impose. so they're obviously trying to make purchasing ammunition very expensive. but what is part of this law is that it reclassified ammunition as a privilege, meaning, you don't actually have a right to purchase ammunition. which of course is ludicrous because it would render our second amendment prote protections -- here in washington state we have much stricter permission to use weapons and defense.
