i want to put this up. this is the latest cnn university of new hampshire primary poll. you got trump at 50, haley at 39, and the rest doesn't really matter very much. i'm wondering, to you, matt mowers, do you think if nikki haley comes in at 12 or 13 that is enough for her to keep going? >> i think she needs to make it a little closer. if she comes within 10, she can certainly then say, "i've been able to create something to hampshire by bringing in independent voters, having the support of a strong republican governor in chris sununu." where can we replicate that in states like michigan? can you do it in south carolina where she has a strong political infrastructure cannot but also with an open primary. you don't register by a party in south carolina so it is effectively an open primary. and there are countless other super tuesday states that are similar to that. but in order to actually show that can work, she's got to prove it here, and i'm not sure thing much more than ten points is going to be able to do that, given all the factors that are

actually helping her hear new hampshire, which includes moderate republican voters, registered independents who can vote in the republican primary, and the strong support of a popular governor. >> trace: francesca, would you agree with that? you look at the real clear politics average and you have nikki haley down by 17-18. would you think that she needs to get much closer than that to really continue this thing? >> well, even her supporters have said that they expect her to get within ten points. she's going to be able to -- >> trace: okay, let's pause will get back to her. leslie marshall, let's put the next topic on there. the most important issues, you have iowa, now new hampshire, and the most important issue at the top is border and immigration. what does that do for the biden administration for the democrats as they go into this? it really is becoming very important for a lot of people because it has caused a lot of chaos across the country. >> absolutely.

i've always said this and i said it back in 2020. it's a huge issue. for some people it is more important than the economy. everyone says it's the economy, stupid. well, if you live in a border state, immigration is your economy. immigration is very important. however, he talked about it, we heard kevin talking about abortion, and that is one thing democrats are going to put forth, and they should because of the success in the midterm election, what we saw happen in ohio, what we see in numbers, especially with those white educated female voters in the suburbs. >> trace: you think only abortion, leslie? i've got to go come of it on the abortion, because it seemed in 2022 that was the big push and how it seems they're going back. the economy isn't really working for them because the polls are not that strong, even the recent polls, and i want to put that up because here are some trump supporters -- will get back to leslie in a moment, but i want to go back to you if i can, matt. here are some trump supporters on dissent is dropping out and what that means. watch. >> are you supporting trump?

president biden, his numbers with republicans had actually been pretty strong. the challenge for him is that a lot of those voters chose donald trump over ron desantis despite having some affectionate feelings for the florida governor. >> trace: francesca, i think we have her back now. i want to get your take and then we will go back to leslie. do you think using the abortion issue is a good strategic move for them? >> abortion rights in the polling that "usa today" has done, and democracy, our two really big issues for democrats' inflection and it helped them carry races around in the country in 2022. so it's no surprise that vice president kamala harris and president biden are campaigning on that issue this week. as we are talking about before, they can't be here in new hampshire because in new hampshire the dnc would punish them, essentially, for being on the ballot here and for campaigning here. so instead they going to virginia and wisconsin this week. >> trace: it just seems to me,

leslie, when you talk about abortion, they're going to try it. but you wonder, is a resonating connectivity need more than just abortion and anti-trump? >> you can't just be anti-candidate. that doesn't work on either side. to francesca's point, i would agree with her, how important it is to the democratic voters, the threat to democracy. many independents and even some republicans who view donald trump as a threat to democracy, they look back at january 6th. there are people that voted for donald trump the first time, they didn't vote for him the second. will they vote for him the third? will have to see. but they can't just be a 1-issue campaign. nobody can be a 1-issue campaign and nobody should ever be "vote for me because i'm not them." bill and i had 15 seconds for you, matt, to close this out. would you agree with that assessment? >> eyelid. you can't have a vision of what you're not going to do, just what your against. that's the case for both

nominees. >> trace: thank you all. meantime, breaking tonight, a closely divided supreme court has ruled that federal agents can begin removing razor wire along the southern border. we are talking about a chunk of federal land that texas has taken over, and the lone star state is apparently not backing down. bill melugin is live with the latest on the border battle. good evening. >> trace, good evening to you. this is a temporary ruling while the merits of the keys are being litigated in the supreme court. but, look, it's undoubtedly a huge win for the biden administration, which has sued texas virtually every single time they have tried to secure their own border. in a 5-4 ruling today, the supreme court decided that the biden administration border patrol can resume cutting and removing the razor wire texas has deployed at the border in the eagle pass area, at least for now. justice john roberts and amy coney barrett, both sided with the court's three liberal justices to rule in favor of the biden administration and allow

the razor wire to be removed, while conservative justices clarence thomas, samuel alito, neil gorsuch, and brett kavanaugh all opposed the decision. texas governor greg abbott reacted to the ruling on x this evening, writing, "this is not over. texas' razor wire is an effective deterrent to the illegal crossings biden encourages. i will continue to defend texas 'its constitutional authority to secure the border and prevent the biden administration from destroying our property." the border patrol union also responding, telling fox in part, "the supreme court decision today is going to undoubtedly encourage more illegal immigration. agents support what texas was trying to accomplish in the absence of true border security policies from this administration." trace, listen to this -- we are also learning that a sanctuary jurisdiction in fairfax county, virginia, recently released from jail, without notice, a honduran illegal immigrant charged with sexual abuse of a child. this was after they ignored

immigrants over the years, and document immigrants, people without insurance. i have volunteered at l.a.'s biggest county hospital for a long time, so i've seen that. i've actually volunteered my time to help people. but the overall health care system is not generally staffed by volunteers. it takes a lot of money. when hospitals get someone coming to the emergency room who is sick, by a federal law, they can't turn them away. so when you have a hospital, even a private hospital with people showing up to the emergency room in need of care, whether it's a stroke or appendicitis or heart attack or even just a bad cold, guess what? they can't turn them away. someone has to pay for that. generally it's either the taxpayers or the other patients who do have insurance who are going to have to pay a little bit more, or a lot more. >> trace: the migrants on the "chicago sun-times," it's a looming crisis, and it goes on to say getting help can seem impossible, and that is if you know help exists. it really is, it's the same problem. it's the resources.

chicago complains, everybody complains he cannot get in and see a mental health professional because they don't have enough. >> exactly. mental health professionals are already pretty scarce for our citizens here. so it's even more of a pressing issue for immigrants. remember, their experience is a little different from you and i. it depends on the country of origin and the path they took to get here. they are facing different kinds of mental and physical problems. they are put in shelters which are cramped, usually, exposing them to communicable diseases. they are also facing poverty, social discrimination, inequality with increased chances of poverty and homelessness, which increases chances of known communicable diseases. so they are a very at risk population. but it's always better to prevent all that stuff from happening than treating it, because you're going to end up using a lot more money to treat. >> trace: is a part of the reason that immigration is the number one issue in iowa and the number one issue new hampshire? is it because of health care? because all these problems in

new york and chicago and across the country? >> absolutely. the migrants have to go and live somewhere affordable to them, ultimately. i lived in new hampshire 11 years ago before moving to l.a., and guess what? it's a lot cheaper over there. so you will see people dispersing throughout the country to areas like new hampshire and iowa, and it will increase the cost of care, increase the cost of housing, and ultimately the people who are there already may not like that too much. >> trace: i want to put this sound bite up on the air, because this is peter doocy talking with karine jean-pierre today about concerns about the president's mental watch. >> why do you think it is that more and more people polled feel that, over time, president biden is getting less and less mentally sharp? >> it's poll is this? >> abc has president biden's rating for health, since may, down five points, and for mental sharpness, down four points. >> trace: the public hasn't diagnosed him. but what is it that the polls keep going up for, his mental

rampant just like here in l.a. in-n-out burger says despite repeated efforts to create safer conditions for their workers and customers, both are regularly victimized by armed robberies, car break-ins, theft, and property damage. a spokesperson said that, though store 193 remains busy and profitable, the closure is the first of its kind throughout their 75 years operating. saying in part, "our oakland store will be the first location we have closed. we feel the frequency and severity of the crimes being encountered by our customers and associates leave us no alternative." the crime stats speak for themselves. robberies in 2023 were of the 38%, burglaries up 23%, and vehicle theft up 44%. many blame alameda county district attorney pamela price for the chaos they say is a result of her soft-on-crime policies. a recall campaign has been in motion since last year with organizers saying last week they have already locked in the

minimum number of signatures to qualify for the ballot. once submitted, alameda county will have ten days to validate the recall signatures and 45 days to schedule an election. in the meantime, what happens with that story? the oakland in-n-out plans remain open until march 24th, 2024, where all the affected associates will be given a choice to either transfer to a nearby location or receive a severance package. >> trace: a shame to have to go over the bay bridge to get the animal fries. that's the whole thing, it's a crime they're taking that away. let's bring in megan mccarthy and talk radio host jason rantz. thank you both for coming on. so, in-n-out worker daisy nunez valenzuela said this to "cbs news," quoting, "it's terrifying because it also puts us in danger. the thieves look around all the time and then they see the police department leaves for a second and that's when they take

their punishment, i think that's a valid conversation to have. because obviously, so long as we are not pushing them in one direction, they are less likely to reoffend. but this idea that we have to celebrate them, that we have to really do their advocates, that we have to pretend that they are on equal footing as the people they have hurt, that they have harmed, is absolutely ludicrous. there is too much glee associated with these people. i don't want to destigmatize people who have committed rape. sorry if that makes me controversial. that i think that should be stigmatized. >> trace: i think it's a fair assessment. the "l.a. times" address this a little bit, pushing, endorsing george gascon who was almost recalled, and other saying he's the one that's going to control crime in l.a., and the numbers just do not say that. >> i would love to know what world they live in, i mean, have even been to l.a.? have they been to california? two they live on mars? what kind of policies has he done to help the community?

he has revictimized victims, he has enabled this behavior. so for them to reendorse him means they are reendorsing criminal behavior and they don't care about their community members becoming victims of crime. >> trace: jason rantz, tell me about washington state house bill 20 2:30 eight that says, "this act intends to impose a sales and use tax on ammunitions statewide." >> it's worse than that. that's on top of any kind of sales tax, any additional tax a city might impose. so they're obviously trying to make purchasing ammunition very expensive. but what is part of this law is that it reclassified ammunition as a privilege, meaning, you don't actually have a right to purchase ammunition. which of course is ludicrous because it would render our second amendment prote protections -- here in washington state we have much stricter permission to use weapons and defense.
