have two big hours coming your way. first primary in the road to the white house now underway. polls are open in new hampshire where a potential curveball from supporters of president biden loom. it's a bit of drama on that side and see how it shakes down. it's tuesday morning and good morning, everybody. bill hemmer, how are you doing? >> dana: great, how are you? i love the band at 5:00 a.m. and my friend, johnny, who has his roof up above there. he is loving the band. he loves it so much. i'm dana perino and this is "america's newsroom." great to be here. at this hour voters are making voices heard. former president trump is looking for a decisive blow following his win in the iowa caucuses last week. >> bill: standing in his way is nikki haley. she received all six votes from the small town of dicksville, notch. it votes at midnight. she is at a high school with governor sununu and they're trying to pull a big upset here

today. >> i'm not going anywhere. what i will tell you is keep in mind, he got 56,000 votes in a state of 3 million. is that what we're going to say decides in the country? i no he the political elites are saying we need to -- this is not a coronation, it is a democracy. >> if you want to make america great again, vote trump. >> there is one candidate in this race that understands how to make our nation more secure, our nation more prosperous. >> if you want four more years of donald trump, let me hear you scream. [cheers and applause] >> bill: scream for this. jessica tarlov, charlie hurt take a bow. the president is not on the ballot in new hampshire but his supporters are pushing for him

to win the primary here. how will it go down today? >> bill, back in 2020 biden placed fifth in new hampshire and when the voters were headed to the polls he skipped to south carolina where he fared better. this year the dnc moved up south carolina's primary and moved back new hampshire. the state didn't expect that. there are a bunch of democratic groups starting a grassroots effort to get voters to write in joe biden's name on the ballot so he can win even though he is not printed on it. despite this implicit messaging from the biden campaign they don't really care about new hampshire voters, they're not a priority, the white house is trying to get voters energized about their key issue, which is abortion. the president tweeting a trump post from truth social last night writing in his own words donald trump is responsible for ending roe v. wade.

if you vote for him, he will go even further. >> president biden tries to make the national conversation about abortion. how many weeks into a pregnancy does he think abortion should still be legal? >> you've asked me this question before and clear. the president has been very clear. we want to see the protections in roe. we want to see that become the law of the land and that's what the president wants to see. the president will stand with the majority of americans on this. >> the little reported part of this position the president holds is that roe v. wade actually does impose some restrictions. states could not ban abortion before fetal viability. some regulations to protect women's health in the second trimester and the third it allowed states to ban abortion so long as there were exceptions to protect the life and health of the mother. democrats this year are blasting republican proposals to ban any abortion at any stage as

extreme. we'll see how that plays out. >> bill: thanks, jacque. nice to sigh. beautiful shot at the white house. thank you. >> dana: new hampshire voters get their say today in the primary. here is how it works. voters head to their local polling place to cast a ballot. republicans and democrats vote in their own party's elections but undeclared voters can take part on either side. if you are not registered, you can sign up on the site. for the democrats this year is unusual. state law for new hampshire to be the first primary in the nation. that's at odds with biden and the party. they picked south carolina to be the first. so the dnc is awarding no delegates in the contest and president biden won't even be on the ballot. instead dems are pushing a write-in campaign. there are no delegates at stake for the democrats. the republicans are battling for 22 delegates which candidates get based on results. that's how it works. >> bill: there will be a quiz later. a lot of moving parts.

good thing jessica tarlov and charlie hurt and byron york are here today. good morning to the three of you. byron, we don't talk about polls in the day of a national election. you are writing about it. all the polls have been hefsh re favored toward the former president. i think maybe to characterize it, you present a what if scenario. what is that? >> we all know individual polls that have been extremely wrong in the past. you can point to plenty of them. i look at the average of polls like you see at real clear politics. trump is currently leading nikki haley by 19.3 points. it is a huge lead. i asked the folks at real clear politics has it ever been that wrong? they pointed to the new hampshire primary in 2008 between barack obama, hillary clinton. final average had obama leading by 8 1/2, clinton by 2 1/2. 11-point difference.

huge, historic, never happened before. now if haley were to win even by a little bit you would have to have a 20-point difference. it seems absolutely impossible to this they could be that wrong. >> dana: nikki haley said she wanted a two-person race. she has one now. the night could have a surprise on the republican side and the democratic side. you are paying attention to the 40% of independent voters who can vote either way. >> it would be extraordinary to figure out how to overcome the deficit she has got here but you have the 40% in the middle. you know, they can go however they want to go. to me the question is -- many of them are bind en voters. do they want to do this weird write-in campaign that amounts to nothing on the democratic side or rather go and play on the republican side. i think it's going to be a

really interesting thing to watch tonight. as extraordinary as it would be to overcome it, you don't know with 40% of the population that could do -- play games. this is a very sophisticated electorate and love to embarrass frontrunners. >> bill: they love to mess with the system. the economy seems to be issue number one. i don't know if it is right now. you talk about the border and immigration among primary voters. there are black democrats suing chicago over migrants. it has to do with an ongoing issue. i don't know how you solve it for how to manage this unless you throw a ton of money at it. senator john kennedy took it on saying it's time for most of cam to go ahead and wake up. >> i think it's time for the american people to wake up and smell the incompetence. the border is wide open. if the white house were a football team and performed like this, we would have already fired the coach, the athletic

director, and the mascot. and americans want better and it keeps getting worse. >> bill: i don't know when a mascot was fired but pretty low for that to happen. jessica, i don't know how democrats reflect on this issue here in new hampshire and -- but i guess we're about to find out between dean phillips and these write-in votes. >> i don't think immigration will be top of mind. some people who feel burned by the fact that their first in the nation was taken away from them unser moneyously and it was iowa's faults it happened. if 2020 hadn't been bungled as badly as it was by the iowa democratic party i don't think it would have happened. people have been talking about it for a long time. the fact iowa and new hampshire. it is not reflective of the base in the democratic party. these are white states. a conversation coming to life doesn't happen without 2020. new hampshire feeling the brunt

of iowa's mistakes. for democratic and independent voters. the thing about independents are. there is an issue that pushes them one way or another. we know how seminole an issue of abortion was. yesterday was the 51st anniversary. it doesn't show up as number one or two in the polling. abortion has been on the ballot eight times since the dobbs decision. democrats have won every single time on that. that is top of mind for democratic voters here and independents pro-choice. >> bill: you could argue that biden and harris are campaigning on that already. >> two weeks ago something changed, right? they started talking about abortion more. the anniversary makes a difference. they know this is what is animating the base. a lot of moderate voters and republican women and suburban voters who say we might not be for no limitations but we can't be for a six-week heartbeat. >> dana: what do you think about immigration and the border in

particular on not just the primary but the general election? >> it has become a nationalized issue. greg abbott gets a lot of credit or blame for making this happen by arranging for transportation of illegal border crossers into new york and other places. but it was going to happen. you cannot have 8 million people cross the border into the united states and expect them all to stay in eagle pass. so many of them have a destination. they want to go to philadelphia, oklahoma city. they know somebody. so it was going to happen. now it is being felt in every community across the country and in blue cities, new york, chicago, and other places it is making a big, big impact. >> bill: it will be a big deal this campaign. what about jessica's point about 99% white in iowa, 99% white in new hampshire. it seems to me that that was on

joe biden four years ago. fourth place finish in iowa. fifth in new hampshire. in a state in iowa that voted overwhelmingly for barack obama twice. >> certainly there has been this discussion in the democrat party for a long time. complaints about new hampshire and iowa. the fact is joe biden had an embarrassing loss here four years ago and joe biden makes the decision to take the primary away from new hampshire? it seems like it is punishment for voters voting the wrong way four years ago. abortion is a big issue for the democrats pushing. the other issue is democracy and election integrity. it is interesting that in an election where democrats want to make it all about that the very first primary will be a fake election. running a fake election in which democrat voters show up to the polls and nothing counts. >> dana: do you think dean phillips is giving president a little bit of concern here in new hampshire? what do democrats think about

dean phillips? >> not favorably. a bit of a spoiler. he showed up and he wouldn't consider the no labels ticket. but when you have no viable path to the nomination and you are running around town saying we need a new generation of leaders. you aren't actually putting forth any sort of agenda that would be different. what's different about your policies than joe biden? i'm younger. that's not a policy, that's a fact. >> bill: he is pushing youth. >> the margins are so thin. we talk about this all the time. georgia, arizona, razor thin margins. do not get in the way of the outcome that you want. if the outcome is you want a democrat in the white house. joe biden is the nominee. he has a great record to run on and dean phillips needs to make sure that he is talking about that. its lendsing credence to people who do not think he can do the job for the next four years. incredibly damaging. >> bill: i imagine he will give a speech tonight. a lot of networks will pick that

that. she is trying to hide and shield her position. >> there could be a lot more trouble ahead for wade and willis. next week wade has to testify in that divorce case. he is likely to be grilled about the interesimacy of willis. republicans are going to investigate an improper relationship between the two. bill, back to you. >> bill: you have a story, steve. don't know where it goes. >> dana: let's bring in formal federal prosecutor and criminal defense and civil trial lawyer. always love having you. we wish you were here in new hampshire so let us commence. ruth markus is a liberal columnist. a lot of credibility amongst democrats. here is what she wrote today. what in the world was fani willis thinking? as a question, the situation is a disaster.

unexpected gift to trump that he will exploit not only to discredit the georgia prosecution but also to augment his broader claims of being unfairly persecuted. since we talked to you last, what have you been thinking about in terms of how this case affects all of the cases against those 18 defendants? >> well, i think it looks like willis got kickbacks from nathan wade. that's effectively the most illegal or most unethical type of conduct being investigated here. fani willis appointed nathan wade and then the problem becomes if you appoint someone and all of a signed you get elaborate trips and favors from that individual and the case drags on forever, is that actually a criminal act? is that something like honest services fraud? fani willis has to think primarily about her criminal liability here. we get into the issues of prosecutorial misconduct and her own professional ethics under

the georgia state bar. it could have a direct impact on the trump trial but they are going to have to show prejudice to trump in order to get this case dismissed or to restart it all over again. >> bill: the case that she argues it is legally irrelevant. we can debate that until it's decided. this sticks out with me. dwight thomas is an attorney in atlanta. all i can say is love makes you do strange things. apparently they were eating at chop steakhouse in buckhead and they were regulars. let me tell you, after living in atlanta if you want to be subtle around the side you don't go to chops. you are out there in public. here is the judge, henry thompson, who believes the nathan wade is a significant source of information. watch here. >> it seems to me that mr. wade would be the first and best source of information on what his income has been and how he has been spending it. and that he would have firsthand

knowledge of whether he is engaged in an extramarital affair. only after i hear what mr. wade has to say do i think i can make a determination of whether the proposed deponent has any knowledge of these issues. >> bill: based on what has been reported she will have to be deposed, will she not? >> she is not necessary is her claim because they can get the information from other source. with her busy schedule she claims she shouldn't have to be put into a deposition. nathan wade is obviously going to be made to answer questions in a deposition related to his divorce proceedings. even if he answers questions about his relationship with fani willis is that credible and should they be able to have a separate deposition to talk to willis about the same types of topics? i think ultimately the judge is going to order that and they will be able to dig pretty deep

it will come in as unprocessed ballots. once counted and added up they'll be considered processed and put an estimate where we think biden will do. dean phillips and marianne williamson are on the ballot. an easier thing for folks to tabulate. why are democrats in the situation? four years ago and refresh your mind. the 2020 results from the democratic primary. bernie sanders was the winner here. look where joe biden was. he was fifth place. a week before that in iowa, take it back again, sanders and pete buttigieg and joe biden on the second page yet again in fourth place. then it was 17 days after the new hampshire primary, four years ago when joe biden on leap day, february 29th, 2020, this is what joe biden did.

48.6%, an amazing comeback. swept the primary. how did new hampshireites feel about the dnc making the decision they did? one democratic leader said the dnc is as popular in this state as the new york yankees. as you might know we're in boston red sox territory. >> the democratic national committee has said the democratic primary here is not relevant or real. i think that's nonsense. >> disappointed this year not to have the democratic primary and why we're doing this. it is not meaningless like the dnc says it is. i'm annoyed the biden and dnc people did this because i think they are going to rue to day. >> bill: we'll see if they rue the day in november. andrew yang is here campaigning for dean phillips from minnesota taking on joe biden and others, good morning. >> great to be here. new hampshire primary day. >> bill: is this a good look? >> i think it's a terrible look

terribly positioned in the fall. he is down by eight in georgia, which he won last time. down by eight in michigan, which he won last time. having joe biden on the ballot against donald trump is not the best bet. i think dean phillips is going to make that point tonight. >> bill: the point he continues to make is that he is young but doesn't discern on policy. so peter doocy had the honors at the white house to ask about that and more. >> why do you think it is that more and more people polled feel like over time president biden is getting less and less mentally sharp? >> you know, i have to say that's a little confusing for me because if you look at what this president has done the last three years, historical pieces of legislation, someone who has had senate experience, someone who was a vp under president obama and someone who has been a pretty effective president over the last three years. >> bill: you are representing dean phillips. >> dean phillips wants to

i am curious if you think there is enough understanding of like what are we doing? >> i think there is not one thing that will stop the houthis from attacking or will stop some attacks as we've seen in iraq. striking the houthis in yemen is an important first step. allies doing it with us is important. redesignating the houthis as a terrorist organization gives us additional tools, sanctions or other international pressure. no one thing will stop this. i have think that there are a number of things we need to see happen in the region. i do think a slowdown or pause in the israel/gaza war will take away some of the houthis reason for taking some of these strikes. israel a trying to negotiate some of that today. i think we need other countries to step up here. we cannot do this on our own. we need countries like china and others who want shipping lanes to be open and international commerce to be able to move to apply pressure as well. taking kinetic action is great. i'm glad the biden team is doing

that. the houthis have been a thorn in our side for a long time. as long as they have support from iran and some of these weapons we try to prevent a broader outbreak of an even bigger conflict in the region. right now they are doing that. >> bill: the last point is the most relevant. that is that iran has been helping the houthis for years now. the saudis fought a war with the houthis to ten years and fought to a draw. >> marie is making a point that no one thing can do this. holding iran responsible. the houthis aren't independent. they are a wholly owned subsidiary of iran. the way you make it stop is hold iran responsible. when donald trump was president he drew a red line. he said that if iran or any of its proxies kills a single american, that he will hold iran responsible and he will strike against iran and when they cross that red line he killed
