welcome to "hannity". a busy news night. why a vote of 255-67. obama's attorney general eric holden was found in contempt of congress. he served no jail time. lois lerner, found in contempt of congress also zero days in jail. hunter biden refused to comply with an initial house subpoena and sent lawmakers on a wild goose chase taunting them every step of the way. hunter biden will phase no jail time for contempt of congress and is now complying after asking for a brand-new subpoena. by the way, naturally, two former advisers not so lucky. i wonder why. joe biden's department of justice is trying to lock up steve bannon and peter navarro. navarro was only sentenced to four months in prison this week and peter navarro will join us and tell his story exclusively here tonight. but first, breaking tonight.

he emphasized that his agencies relationship with texas is strong. rank-and-file, customs and border patrol agents also reportedly respect and appreciate what texas is doing. meanwhile texas governor abbott is offering cash payments to law enforcement personnel that volunteered to man the border. florida governor ron desantis is working on a measure to send the florida state guard to texas to help out. south dakota governor kristi noem is vowing to ship razor wire ends and in that state's national guard. virginia has already deployed 100 soldiers and airmen. arkansas, nebraska have previously deployed members of their national guard and are vowing to send more in the future. north dakota governor berger sent 125 soldiers from the 817th engineer company. more and more states now are stepping up to the plate to fill a void left by joe biden's dereliction of duty.

alan dershowitz. that is article one, section 10. i see this as the states having a sovereign right to protect their borders. if you look at article 4 i saw your column gregg jarrett of the constitution. it mandates that the federal government protect the states against invasion. these fbi luminaries are saying this is an invasion of military age male foreigners that are posing the biggest threat to american security. well, that sounds like they are within the law to me. >> absolutely. article 1, the state's have a sovereign interest in protecting their borders from invasion. it literally uses the word invade. that right becomes elevated where a president abdicates his duty under article 4 to protect the states against invasion. the question is, is this an invasion? as you point out the fbi says it

federal government does. the state's are more immediately involved in this decision. remember the supreme court didn't decide the case on merit. i have a guess, not a prediction, a guess, that justice barrett may reconsider her vote. i think the response to this has been so overwhelming among texans and people around the country that she may say, this was a temporary decision. it was just an injunction for the moment until we heard the case. now that we hear the case, i think maybe texas has a point. i maybe biased because i too am an honorary citizen of texas and i am proud of that. i think in this case texas is right in the federal government may very well be wrong. i think joe biden made a serious mistake both politically and constitutionally. >> politically a disaster. he is also aided and abetted in the lawbreaking and has never

here's the thing. here's what i ask your viewers to understand understand. it's not rare. i am the first senior white house advisor ever to be charged in this alleged crime. the irony here come, sean, the irony, the department of justice itself has maintain a policy for more than 50 years that says that senior advisers like me absolutely cannot be compelled to testify before congress. why? because it violates the constitutional separation of powers and interferes with the ability of executive privilege to provide effective presidential decision-making. that's where we stand right now. i have a great case that will go. i have said from day one, sean, day one, this is going to the supreme court. it's a case of first impressions that has significant constitutional issues. can congress compel senior aides

to testify? the answer is no according to doj policy. and then there is other issues related to that. it's just the oddest thing where joe biden himself interviewed me in this case to say that he can strip donald trump of executive privilege as soon as he leaves office. that is ludicrous. brett kavanaugh has said that is ludicrous. i appreciate you having me on, sean. but i want folks to know they can come after me and come after trump and come after you. four months in prison at my age is effectively a death sentence if you look at the average lifespan in america. this to me is why you've got to let donald trump in 2024 and get him into the oval. as you have been eloquent about it, sean, our economy is in shambles. the border is in shambles. our enemies are upon us.

service after being convicted of killing her boyfriend, stabbing him a whopping 108 times. after her attorneys claimed she was overcome by a weed induced psychosis. no, emily, i believe that could probably happen. but at what point do you have to bear responsibility for the drugs that you put in your body and the actions that come forth thereafter? i was shocked by this. >> frankly, a lot of people were. while the law accounts for involuntary intoxication i think the issue here surrounded that and the issue surrounded the judge coming in and doing this after the jury already made their decision in a certain way. there is two issues people have with this decision as it stands. one is the notion that the drugs out here are not the same kind of drugs especially and including marijuana that people decades ago found it to be.

now with the psychotic and psychosis element attached to it, does that mean that anyone who takes a hit is all of a sudden not responsible? as the family said there is no winner in this tragedy. there can however be accountability. that raises questions as well in this era of prosecutors not prosecuting and judges not levying sentences and legislation taking autonomy out of the hands of judges. here we have an example where a jury made a decision and the judge makes a different decision. that's removing all kinds of accountability. it sets a dangerous precedent. >> being the great criminal defense attorney that you are, mark geragos, why do i think somewhere in the back of that crazy mind of yours you are thinking i might be able to use this down the road one day as you represent high-profile clients? >> i will tell you, sean you and i are both old enough to remember the twinkie defense in california which eliminated diminished capacity.

what i've often said is you get these results that make great headlines. but arguably what is happening here is that either a judge or a jury, in this case a judge, heard the evidence and something resonates with them. for every one of these cases i could give you 250 to 300 cases where justice was not done. i have a little bit of hesitation before i jump on the bandwagon here because generally there are cases where people don't get a break when they probably should. >> listen, we've got to remember here there is a serious side of this. a guy got stabbed 108 times. the person that did it is not going to suffer any consequences. there something wrong with the system that doesn't mandate at least some type of incarceration for it. of time. but we will see what happens. good to see you. have a great weekend. emily thank you.
