hard time making that constitutional argument in court. keep in mind, on this fight -- the federal government has a upper hand legally. >> yeah so mark how does greg abbott and the state of texas argue that had is the invasion that the constitution talks about it? >> we have a constitutional republic here we don't have a monarchy the reason why that's important who decides what constitutes invasion really is an interesting question. jonathon turley is talking about courts but it doesn't necessarily have to be the courts making the final decision that in invasion is incuring. states have independent sovereignty could be the federal government so i think there's a very strong livelihood that courts may punt in the name of what's known as the political request doctrine is this is really a political question that needs to be fought out among our elected officials at the state level and frat level. i think they may just say look we're the courts and we're get our handle off this and let the

political process play out. and let texas fight it out with congress -- and the biden administration and so on and so on. again who defines invasion is important question here aishah as what is an invasion. aishah: i want to move on to what happened in a new york city court former president trump ordered an stunning move by a judge there -- ordered to pay a whopping $83 million in damages to eugene carroll it is stunning and crazy when you think about it because she -- at first started with $10 million. this is a huge drastic difference and, obviously, this was to send a message, right? >> yeah. i think there's a couple of ways to look at this really large verdict in president trump. the first one is -- was the process in and of itself fair? i think with this kind of number, that is really exceeded what carroll was asking for is strike the conscienceness over

the top and i think that judge kaplan will protect verdicts himself and cult back the number dramatically to make sure verdict survives appeal. so there's another level aishah which is appearance of fairness the justice system is not just making sure the process in and of itself is fair but appears fair to the american public. so people feel that they can trust the outcome of the processes and i have to say, that a number like this coming out of a blue city, blue state jurisdiction like new york city, against donald trump -- who no one in the blue state seems to like donald trump i think we can agree on that politically i think it is going to really play into donald trump's hands that he's being sort of prosecuted because he's a conservative republican candidate for the white house in these blue cities like atlanta. like washington, d.c., and like, of course, new york city so in some ways the as no, ma'am astronomical verdict will show people in blue cities and states are willing to do anything to

that's happen nothing our southern border or is it because the polls are showing in places like new hampshire of all places that immigration is top of mind of voters? >> i think, i mean, yes. i think they're negotiating good faith and you've got serious legislators in the senate on both sides of the aisle. who are coming together to really truly rye to work with the white house to get something done. this issue is going to be fought with mr. speakers but there's a moment in time here -- you have people like senator sinema now independent who has been working with the both sides to get stuff done and you say members of the house are talking about eve this their border bill hr2, this negotiation in the senate, you know, if you come over illegally there are consequences. much stricter consequences than there are in hr2. so you know, it baffles mind i think everybody needs to be more honest and when the president is putting on social and saying don't take this deal we need everything -- you know, i don't think that's being really i think that's

being political as well. so everybody needs to recognize that there's an opportunity here to do something. and that clearly needs to get done. griff: tim you want to respond to that? >> well, you know ironically we have faith and treatment coalition worked with president trump and in 2018 and '19 leading up to a solution that was about to be proposed when we had all kinds of -- problems and early 2020 i'll say that, we know that there's an appetite to actually fix this. not just political talking points but to truly fix these problems or at least significantly and to prioritize human suffering not only american suffering but those that are immigrating over kind of political back and forth and we actually think that there is an appetite to do just that. but we need the posturing to really kind of -- pull back significantly at this point. >> we'll see where it goes let

much of an issue is it going into this campaign? >> i think he's had to deal with it head on both need to head on they are getting older. i think president biden is really -- leaning into running on his record and who he is as a person and how he's represented us -- you know, across the world. but yes it is a political liability for both for both men. >> do you agree tim? or do you as many critics of joe biden have said that joe biden is far worse than trump and perhaps that was a misslip? >> well in all candor, we actually really don't take any interest in piling on to president biden, i think that, you know, we're three years into this. there are five or six incidents a day it is not just kind of one per speech but it's dozens per week hundreds per month, and you know, so our desire is really not only clear communication but also good policy. and then for that policy to be by the administration it is
