th-- chaos on the border. they wrote a letter. here's a portion of what they're saying. they're saying military aged men from across the globe, many from countries or regions not friendly to the united states, are landing in waves on our soil by the thousands. not by splashing ashore from a ship. or parachuting from a plane but rather by foot across a border that's been accurately advertised around the world as largely unprotected with ready access granted. it is stark to say so, but having a large number of young males within our border who could begin you attacking unarmed citizens at the behest of foreign terror groups must be considered a distinct possibility. >> that's an alarming agent from former agents and directors of the fbi. one of the notes that stood out to me in reading it or having you read it here, pete, this morning on "fox & friends" was the border accurately advertised around the world as open. i was having a conversation with

a friend, said well, what would a president trump be able to do that would effectively practically be different and i said well, there's a lot of policies that could be implemented immediately. it is not a talking point or partisanship to point out that the rhetoric of the i biden administration has accurately advertised the invitation that is our southern border. and that would change with a change had in leadership. >> during the democratic primary debates i remember that joe biden was standing between stand he elizabethsanders and b. he said he wanted to illegal immigrants to surge our border. he's trying to be tough on the border. what a difference five years makes. that's was a statement from former fbi officials, just a few months ago christopher wray said this, while there have been many times over the years where individual threats could have be higher here or there than we they are right now i've never

seen a time when all the threats are so many of the threats are elevated at the exact same time. so he's talking about elevated threats happening all at once. i was reading a wall street journal article about how our withdrawal from often created a situation where isis k is on the rise, it's the number one threat in the middle east right now that could impact us and then you read that border number, 50 people on the terror watch list caught, imagine all that glnt the world knows if you can get to mexico, you can get to the united states. that means every single adversary realizes the most simple approach is that so this is a threat that's not just going to live under this administration but into the next. folks can go underground, they can wait for a target of opportunity, wait for a certain moment or date on the calendar, they can wait for certain instructions after a certain thing happens to then do something. this is why you hear the trump

secretary. >> fox news alert, the impeachment articles against dhs secretary alejandro mayorkas have just been released. >> peter doocy joins us with the details. hi, peter. >> reporter: carley, this is not something that will get pulled down by the house if the senate border negotiations take a turn because they're not happy in the house with the senate border negotiations and besides, in these officials articles of impeachment they're accusing mayorkas of lying to them. here's a key quote from the articles. it says alejandro mayorkas knowingly made false statements to congress that the border is secure, that the border is no less secure than it was previously, that the border is closed and dhs has operational control of the border. then there's this, quote, throughout his tenure as secretary of homeland security alejandro mayorkas has repeatedly violated the laws enacted by congress regarding immigration and border security and in large part because of his unlawful conduct millions of aliens have illegally entered

the united states on an annual basis with many unlawfully remaining in the united states. his refusal to obey the law is against the constitution of the united states, it threatens our national security and the homeland security committee chairman mark green is breaking it down by this, he said he breached the public trust by knowingly making false statements and obstructing congressional oversight of the department, and these facts are beyond dispute and the results have been disastrous for our country. dhs is responding, the statement says this farce of an impeachment is a distraction from other vital national security priorities and the work congress should be doing to fix the broken immigration laws but that's unlikely to move any of the house republicans and the speaker of the house, mike johnson, says they'll move to vote on these articles of impeachment for mayorkas as soon

as possible. back to you. >> all right, he peter, thank you so much. >> thank you very much. >> let's bring in congressman august pfluger, a republican from texas, a member of the house homeland security commit at this. good morning to you. your committee did the investigation. tell us why you decided to move forward with these articles of impeachment against the dhs secretary. >> well, thank you for having me. i take no pleasure in talking about this. what we want is a secure border. but when you look at the egregious nature of what this administration has done under the leadership of secretary mayorkas who took an oath of office to protect and defend the constitution, you're talking over 8 million people illegally if they the country, over 300 who match the terror watch list that we know about, 100,000 deaths from fentanyl. our articles of impeachment by the way which i think could have been done as early as last year and even before because we've been talking about this for so

long, they're very simple. the articles are very simple. article one says there's a willful and systemic refusal to follow the law, that's the immigration and nationity act. and article two says there's a breach of public trust which you just heard. those two are simple but they factually outline the refusal of secretary mayorkas to keep our country safe and article four of the constitution very clearly says it is the federal government's responsibility to protect all states from an invasion. that's exactly what's going on here. we do have an invasion. and they've refused to keep us safe. >> congressman, walk us through the timing. peter mentioned at the end of his report that speaker johnson wants a vote on it soon. does this have to pass out of a committee or is it ready for a floor vote? where do you see this going? >> that's right, the homeland security committee the will get together on tuesday. and we will mark the articles up so that means that there could

be probably language change that doesn't really change the two articles that i mentioned but talking about the exact ways in which the secretary violated the law and the ways he misled congress, talking about detention of illegal aliens, parole of illegal aliens, his mass catch and release scheme. that's going to happen on tuesday and then we expect to vote on the house floor hopefully as early as wednesday or thursday. that would be op to the speaker and -- be up to the speaker and the leadership. >> just looking here, i think we might have some of this -- we can put this up on the screen, i'm not sure so i'm asking the producer at the same time, key quotes from the draft of what you guys have put together and you did lay out the various stages where you say mayorkas has failed the law, to implement the law as passed by congress. what this seems to come down to is a policy by the administration embraced and executed by mayorkas but

hearing, secretary mayorkas was sitting next to director wray, and i asked director i wray a simple question, i said are there person who match the terror watch list who entered the country that you know about who are at large. he said yes. i asked mayorkas who was next to him, i said is it your policy to detain anyone who matches the terror watch list, he couldn't answer that question in the you affirmative. that's why we're going through the impeachment trial. someone who matches the terror watch list should be detained, should be immediately be deported or something needs be done with them to protect the american citizens from some sort of terror act. it's that type of behavior that has happened for three plus years and resulted in almost 9 million people illegally in our country, many of whom have desires to do bad things in this country, criminally or on a terror aspect. >> we just don't know who they are. what would you say to somebody

remaining in the united states. his refusal to obey the law is an offense against the separation of powers and the constitution of the united states, it also threatens our national security. you reiterated that as well. we heard democrats speak a lot more about the border, a lot of it is because an election year is coming. do you think any democrats will vote for this impeachment or do you think it will be almost all republicans? >> that's a great question. i sure hope they do. i hope they're democrats from texas especially those that are on the border that know the damage that's being done to our communities that will have the courage to stand up. this is not just a policy fight. this is an actual refusal to enforce the laws that are already on the books. these democrats know that. i really hope they have the courage to do the right thing because it has hurt every american, not just republicans, this hurt democrats too. that's why you see many

impeachment a. i called for the impeachment less than a year into the administration because i saw the damage he was doing. when he was deputy secretary when joe biden was vice president we had a family surge. we stopped it by building more he detention facilities, forcing them to see a judge. 90% lost. we put them on an airplane sent them home. now he's not detaining them. i.c.e. can't arrest them because he said being in the country illegally on its own isn't enough for i.c.e. to seek an arrest so he's doing the complete opposite of what he knows worked. >> why is he doing that? i know you get asked that question a lot. is it just taking orders, is he just a tool of the administration? >> you know what i think deep down, i think he under jay johnson he played the game. i think he's always been about open borders. i tell you, i heard the prior conversation, i don't care if

president biden ordered him or not. you don't have to follow illegal orders. if he had an ounce of integrity, knowing the national security threat that's been created here, over 300 people on the terrorist watch list were arrested on the southern born deer in three years, under president trump we had 11 in four years. knows they're coming from 180 different countries, knows they're shy of 2 million got aways. he hasn't done a damn thing to stall the flow. if he had integrity he would tell the white house change policy or i would resign. a be better man would do it. his job is to protect the country, he's not doing it. >> make sure i understand this correctly. of course there's the flow, there's the incentive, the invitation to the vast numbers we're seeing at our southern border and there's the got aways but the am amnesty process, wee

the numbers of people that come over intentionally seeking out border patrol, seek them out to turn themselves in and claim am a necessity. what you -- am necessary you at this. --amnesty. they don't see a judge. thereleased into america, pendig some date. they're never dealt with, in essence. is that an accurate description of what's happening? >> well, they're not claiming amnesty. they're claiming asylum. but you're right. people need to understand, based on immigration court data the last 10 years, nearly nine out of ten people claim asylum will never get relief from u.s. courts because they don't qualify for asylum because that's he's scaring fear and persecution from your home government because of race or

rereligion. the secretary's report says this if you get an order of he removal and you're in an i.c.e. detention facility you're removed 99% of the time. if you're not retained, you leave 6% of the time. only 6% leave. that's exactly why mayorkas is detaining them because knows most are going to lose but they're not detained, they're not leaving. >> tom, help me out, though. you, donald trump, he's mentioned you, you've spoken at events, have said deportations will start under a new administration. can you deport someone who has already been given a ticket by the biden administration to say you have a court date in 2028, is there a way to change that process or do you have to wait for the time line that's all that's alreadystarted. >> you have to wait for an issue to be ordered by the judge. we need faster hearings.

there's a lot of people in deportation hearings, if you look back at what happened, i.c.e. released a report a few weeks ago, they only deport 140,000, most were border cases on the border. if you look at who has been released by this administration in the interior, only 5% of arrests were those people. alejandro mayorkas said if you don't qualify for for asylum you will be released. i.c.e. isn't looking for them. only 5% of total i.c.e. removals the last year was somebody that entered the country illegally was ordered removes. i.c.e. isn't looking for them. they're here to stay. under the trump administration, those people with orders were sought out and they're going to be deported. >> there will be changes. we're talking about policies and articles of impeachment. there's also a human element to the crisis, the victims. there's a woman i spoke to whose

20-year-old daughter was raped and strangled to death by a known gang member, a known member of ms-13. the 20-year-old didn't know him at all. complete victim and her mother is beside herself. her name is tammy nobels. take a listen to what she had to say. >> everyone down at homeland security, department of health and human services, didn't do their jobs. if they would have done their job, and properly vetted and checked her murderer, my daughter would still be alive today. he wouldn't have been allowed to go from techs the as all the way -- texas all the way to maryland. >> this is why you care about this issue so much because of these tragedies that take place that should never happen. can you tell us about what you've seen and the threat that people across the country might be under? >> well, here's what you need to understand. we're almost at 2 million got

aways. known got aways. these are people conduct on images, drones, who got in the country and weren't apprehended because border patrol is too busy to deal with the humanitarian crisis. why did 2 million people choose to pay more -- you've got to pay more for the cartels to get to new york or chicago. it's cheaper to move you across the river. why did 1.9 million almost 2 million now, why did they pay more to get away? why didn't they pay less to get processed within 24 hours, get a plane ticket to the city of their choice, get work authorization pending their case and if they lose their case which most will i.c.e. isn't looking for you, who wouldn't take advantage of that give away program. why did 2 million people say no, i'm going to pay more to get away. because they don't want to be finger printed and vetted. these will be criminals, gang members, the people carrying

fentanyl, people trafficking in sex trafficking and women and children and these are going to be known as prospective terrorists. these 2 million is a number that ought to scare the hell out of everybody. it does me. this is the biggest national security failure i've seen in this country since 9/11. and pete, this is why they're not detaining them because if they detained them they would get aer hearing within 3 35 day. nine out of ten would be removed. they release them, knowing it will take five to seven years. after that they've got kids and no one wants to remove them. the trump administration, they're going to be removed. you can't demand due process. you can't demand that you've got a right to claim asylum. when you lose the case, that due process doesn't mean squat if the final orders of the court isn't carried out. that's what the trump administration was doing. they would execute the final

orders of removal and remove the people. there has to be a consequence or you're never going to fix the problem. >> i want to follow up on that quickly. i found that conversation between you and pete interesting as well. from what i'm gathering, you can immediately -- you can go after the got aways to the extent you can find them. they're the dangerous guys you're talking about. then there's people with deportation orders or failed cases. you can start the deportation process for them immediately. but to pete's point, i think you told us this, nine out of ten come in and claim asylum. they get a court date that can stretch out for five plus years. way into the future. can the trump administration change that? inine out of ten are waiting for an asylum case into the distant future, how many years does the biden administration policy set us back? that seems like we'll pay the price for this long after the biden administration. >> unless there's a final

order, like what i said was nine out of ten will fail an immigration court order to get removed and if they have an you asylum claim pending we can't remove someone who has permanent asylum claim pending. we can't return somebody unless we're sure -- >> can you move up the court date? >> absolutely. i think the trump administration will hire a bunch of immigration attorneys, he brings attorneys from the military in. we massively push immigration hearings. you build more detention facilities so you hold people because immigration courts prioritize those in he detention. if you're in detention the, you get a hearing within 35 days, if you're outside it could be years. that's why this administration is not detaining them. they know if they release them they'll be hard -- even when they get an order to remove it will be hard to locate and remove. this is their plan. this isn't mismanagement. this is by design. let as many people as you can in, release them, t push the cot

date out for years. when they get a final order -- when i was i.c.e. director i got calls from republican senators, tom, why did you remove that guy who has two kids. i said he didn't have two kids when he entered illegally. he didn't have two kids when he was ordered removed. since he became fugitive and ignored the court order and now he's immune, beyond the law? no. if the court orders don't mean anything what are we doing. shut down immigration courts. there has to be a consequence. and i'm sick and tired of hearing the other side saying tease are a asylum seekers. okay. you i guess technically they're seeking asylum but no one ever auction about the vast majority don't qualify. they're taking advantage of a loophole. this is one of the things hr2, the white house is serious about securing the border, the house passed hr2. hr2 will it work? absolutely. why? because it did before.
