mentions of president biden's memory were put in a special -- put into this report by a special prosecutor who felt pressure to please republicans and now the president's personal lawyer is saying the october interview was poorly conducted. >> the special counsel's decision to cherry pick in a very misleading way some of the references that you are discussing here is an example of what i call a really shabby work product. i didn't come away from the special counsel failure to ask precise questions and think to myself he has mental acuity problems. i just thought he was asking bad questions. >> the vice president, kamala harris, is also now putting out the word that if there is an issue with president biden's health and he has to step aside, she says she is ready to lead and that anybody who has watched her in this job knows she is ready to lead. sandra. >> sandra: peter doocy live at the white house, we anticipate the briefing shortly. thank you. i'm sure you saw the opinion pieces over the weekend, "new

york times," the "new york times," biden has a week he would like to forget, age and memory rise to the center of the 2024 presidential campaign, where the age issue is hurting biden so much more than trump. it was a big week last week so we do anticipate it will be a big moment at the white house press briefing to defend a lot of those concerns. >> john: not only that, but the abc ipsos poll, 86% of americans think he's too old, including some 70% of democrat, that really shows where the sentiments of the country are in this moment. we'll take that up with jerry baker later in the program. now a doubleheader for former president trump and his legal woes today. he is attending a closed door hearing in a florida court on the classified documents case against him. he's not in georgia where there's another hearing underway. we have team coverage, steve is live outside the fulton county courthouse in georgia keeping an eye on the fani willis hearing. and civil rights attorney leo

terrell is standing by to weigh in on this, but dana marie is in miami. >> different criminal case because of the sensitivity of classified documents involved in it. we did see trump's motorcade arrive at the courthouse and right now the sealed hearing is happening in a special room that can hold classified documents, it's called a scif, sensitive compartment facility, protects from electronic eaves dropping. his co-defendants are not there because they don't have the security clearance to see the documents. this complication has caused delays in the place since preparation takes more time. they are talking with the judge, a trump appointee, about their defense strategy and this afternoon another session for the special counsel where they

are going to talk to the judge about their own strategy. this case is scheduled for may later this year but expect the judge to push it back or reschedule for a later date because of all the complications surrounding these special classified documents, john. john all right, the latest from florida. thank you. sandra. >> sandra: in georgia, fulton county district attorney fani willis faces a hearing about a romantic relationship with a prosecutor she hired to run the trump racketeering case. steve is live outside the courthouse covering this. so, steve, what is the fight over today? >> sandra, the key question is when exactly did this personal relationship between the d.a. and the prosecutor she hired and paid more than $700,000 to, when did this relationship begin. fani willis, the d.a. and nathan wade both say it began only after wade was hired.

wade even gave an affidavit to the judge saying it was only after. but defense attorney says the two of them are lying and she has the witnesses to prove it. >> if it turns out that whole story was false, there will be very severe consequences for this. i would think at a minimum, it would involve disqualifying her and mr. wade from this prosecution, but there could be other consequences too if it turns out they lied to a judge. >> a hearing on the matter is set for thursday. right now, fani willis is trying to squash subpoenas so she won't have happen. in one hour's time we could find out whether or not a judge agrees with her. back to you. >> sandra: steve, thank you. see you again soon. >> john: leo terrell, a big fani willis and nathan wade hearing on thursday, what do you think should happen here and what do you expect will happen? >> i'll tell you, thank you for

the question. the judge has to do the right thing. the hearing today to determine whether or not witnesses, including fani willis and nathan wade and others who have knowledge to testify. if you are going to search for the truth, you have to have these people testify. so i think it is a foregone conclusion the judge has to allow individuals to testify as to whether or not fani willis and nathan wade -- here is the magic question, john, had a relationship before -- before the filing of these charges against president trump and 18 others. why? it determines a personal motivation to file the case and whether or not her boyfriend is involved in that. that is the key issue, john. >> john: right, and what jonathan turley said in a fox news op-ed that came out yesterday, the two prosecutors have insisted that they only became intimate after willis hired wade, contending that was in 2022. wade's former lawyer has

reportedly come forward to contest that claim. that allegation if true could make the continuation of willis and wade in untenable. it will not necessarily end the case but will provide options for the office. two grounds disqualifying a prosecutor, one is forensic misconduct or conflict of interest. and the conflict of interest has to go to this idea that the prosecutor has a personal stake in the defendant's condition, you indicated that they absolutely might. then a second issue. apparently they swore an affidavit that this relationship did not start until 2022, but there's information from wade's former divorce attorney that it started before she became the attorney general back in 2021. if they lied to the court, what are the implications there? >> thank you for that question. i'll tell you exactly. i've been a lawyer 30 years.

if i lied to the court -- lawyers have an obligation to be honest and candid to the court. i should expect my law license to be in jeopardy immediately and legal career gone immediately and that's what is at issue, john. there are witnesses who are willing to testify under oath that the relationship started beforehand. and that is critical to this. let's also remember this. fani willis wants to block everyone from testifying in this case. yet she'll go into a black church and play the race card to tamper the jury pool. think of the hypocrisy of that. $650,000 or more to nathan wade. he's not as qualified as others, he's never prosecuted a felony case, it has the smell of a corruption case involving two individuals who tried to gain the system. one other very important point, president trump a victim of this and 18 other defendants. they have a perfect -- if they

are disqualified, they have a perfect selective prosecution case against the state of georgia regarding these charges. >> john: clearly fani willis wants to control the message, she chose the message and the venue. switch gears and nypd and attacks on their officers appear to be far more prevalent than the public might know. we had the video of the two officers who were being beaten up by the allegedly by the illegal migrants, but these statistics, you know, going back to 2019, 4200 attacks on police officers, on track last year for that number to rise to 5436. there's problems with retention in the police department, problems with recruiting, charged suspects allowed to walk free after the attack, is it any wonder nobody wants to be a cop these days, or very few people? >> well, john, this is the summer of 2020, riots, george floyd scenario, where the democrats in these democratic

cities have been soft on crime, they are soft on prosecuting criminals, and they do not back up the police. remember, defund the police. so, it's not just the migrant situation, this is an ongoing process and they have decriminalized attacking law enforcement. john, no civilized society can operate without law and order. the democrats are experiencing that in los angeles, chicago, philadelphia, and new york. that's the problem. so, this is the ongoing problem, it needs to change immediately. >> john: yeah, i think a lot of people would like to see that, nobody is making a move in that direction. leo, great to have you kick us off today. thank you, my friend. >> thank you, my friend. take care. >> sandra: breaking news, the police have identified the person who opened fire at joel osteen's mega church in houston yesterday. william is on this for us. what exactly are we learning? >> so we just got ahold of the search warrant and confirm the shooter is identified as a

36-year-old genessee moreno, she had been born a man from el salvador, and she pointed an ar-15 at the officers, off duty officers who were in the church at the time, and they fired upon her, killed her and was considered in self-defense. also there was word that the woman had claimed that she had a bomb and she had a backpack, they checked that out, it was not true but she was in possession of a yellow color rope and substances consistent with the manufacture of explosives, they thought it was a detonation cord, turned out not to be the case. and the 5-year-old who was with this woman is likely not to make it, this -- the 5-year-old boy has been in critical condition

and according to the houston chronicle, it does not appear that that individual is going to make it. a 57-year-old man was also shot in this altercation at lakewood church there in houston, which of course is operated by celebrity pastor joel osteen. that individual, he is going to be ok, he was shot in the less. but we have seen a lengthy criminal record on this individual. again, as a man, he had a lengthy record of assaulting a police officer, marijuana, also got a lengthy record here, several different offenses over about the past, since 2005. so, that's what we got from here, and news conference scheduled for 2:30 eastern, should get more information. >> sandra: 2009 assault of a police officer in houston, william, 2010 forgery, 2022, a

joe bachino breaks down the operations on the ground there, but mike tobin is live from tel aviv where military officials say they have now rescued two hostages. mike, how did they get them out? >> well, just before 2:00 a.m., sandra, israeli special forces snuck into the center of rafah at the southernmost end of the gaza strip. we have new video we can show you of the airlift rescue of these hostages. they had developed intelligence that they were in this one particular apartment building where some of the video you may be able to see the special forces gathering around. they went into the second floor of this building, blasted the door, grabbed the hostages and the three men who were guarding them. that triggered a firefight. israeli air force struck another part of rafah to prevent hamas reinforcements from showing up. fernando marmon, luis hart were airlifted out of the gaza strip,

reunited with family already. this as israel's prime minister says a large israeli force will soon go into rafah. >> we believe it's potentially more hostages in that area, that's why we have to act and develop the plans to act in that area and again, you hear that prime minister. rafah has -- >> meantime in the north of the gaza strip, israel also uncovered a large tunnel they said acted as an intelligence hub for hamas. the catch is it ran underneath an unrwa facility and no way it could have operated without the unrwa employees at least knowing it was there. >> the tiling in this room shows you just how sophisticated some of the construction of these tunnels are. you see all of this wiring that connects to the surface. it also connects to racks and racks of computer servers and communication equipment. now, given the fact that all of this electricity is here, connected with the surface, a

lot of communications equipment in another room, also connected with the surface. given the fact this tunnel stretches about a kilometer, we traveled to get here underneath a kindergarten, underneath a u.n. school and right now we are about 25 yards under a u.n. headquarters. so, with all the construction noise out of here, simply the amount of dirt that had to be pulled out of here and moved somewhere else, israel says the unrwa employees on the surface had to know something was going on. >> and this comes after israel presented evidence that at least 12 unrwa employees were directly involved in the october 7th massacre. but looking to the hostage release, israeli army spokesman says this underscores the importance of the idf continuing with the offensive in the gaza strip and likely pushing south into rafah.

>> john: former centcom spokesperson, let's start with this tunnel complex and looks like some sort of a headquarters bun ker underneath the unrwa headquarters, and construction going on for some time, reports the parking lot was sinking, and when asked about it, people are like i don't know. but speaks to two things. first of all, hamas is hiding its operational facilities underneath a u.n. headquarters and then u.n. folks had to be turning a blind eye to this as mike was just reporting. >> it's not terribly surprising, john. over the past 5, 6 years these two organizations melded together, hamas which controls almost all aspects of life in gaza and unrwa, which has 12,000 workers in gaza. and you know, unrwa, if you think about the original mandate out of the 1948 war, seven decades ago, had a mandate to care for palestinian refugees.

now they consider virtually every person in gaza a refugee. and so over time these two organizations kind of meld together. i'm not surprised. i think what you need is another organization to go in and provide for the refugees and dissolve unrwa. >> john: had the two hostages rescueded in rafah, operations intensifying down there almost along the border with egypt, president biden at the same time seems to be increasing the pressure on netanyahu to go for at least an extended ceasefire, john kirby was talking about that a moment ago, if not a full blown ceasefire, the back and forth between biden and netanyahu at this point. >> i'm of the view as you know that the conduct of the response in gaza -- in the gaza strip has been over the top. >> i don't know what he meant by

that, but i can tell you where we are. look, we were attacked in the worst attack on jewish people since the holocaust. so, what would america's response be? i would say that it would be at least as strong as israel's. >> john: a similar situation, al-qaeda attacked the united states on 9/11, nearly 3,000 people died, america went back, got rid of al-qaeda, at least knocked them way back, got rid of the taliban for a while, israel is doing the same thing with hamas. it's just that it's in an intensely populated area. >> intensely populated area, you've now got a million and a half people in this tiny city of rafah that normally has 300,000, there's no place left for them to go. you've got to find these hostages and you've got to eliminate these four remaining battalions, and you really do have to take out sinwar, the hamas commander. you've got all that happening here. it's a very dire situation. you have 600,000 kids there.

so it's just a very dire situation and really it's going to be tough for any other way to solve for this for the idf. >> john: quickly about lloyd austin. unlike the last time we got a statement from the pentagon that he's back at walter reed military medical center with complications again it looks like from the prostate surgery. him out for a while, delegation -- delegating responsibility to his deputy, joe biden, people are saying he's too old to run for re-election, morgan ortagus thinks all of this taken together is very intriguing to our adversaries. what she said. >> from a national security perspective, when you have the press conference thursday night from the president and then whenever you have your secretary of defense hospitalized for a second time within a matter of days, our enemies are looking at our national security chain, not being as robust as they should be either mentally or physically. >> john: do you think that's

campaign on any strategy or anything like that and so i'm just very, very mindful of that. i did not know -- i knew as you all did. >> follow-up on the special counsel report last week. when ian sams was here on friday he said the white house was considering releasing the transcript of the president's interview with the special counsel which you all have objected to that characterization. update on that review process? >> so look, certainly i'm going to refer you to my colleagues at the white house counsel. i know the president's personal attorney obviously spoke to this on one of the sunday shows yesterday, so i know there have been responses, the team here has been responsive to those specific questions. i just don't have anything to share. >> also the discussions i have, the president -- creation of the task force to change policies around the handling of classified information in a presidential transition.

trend. i will say that it is about not apologizing for choosing to spend money in a way that we value. because truthfully, sandra, there are going to be people trying to pull our money from all of our directions everywhere and instead it's basically willing to say hey, here is where my values are. if i don't want to spend money on that, i no longer have to apologize for it. >> and like what you call money consciousness, and talk about people's relationships and feelings. when it comes to their money, some of what you have said on that, allison. >> if you are always feeling guilty spending money, listen up. spending money is not bad, money is a tool. but when we have mismanaged our money in the past, it's easy to start feeling guilty or shameful whenever we actually have to spend money. it's ok to spend money. as long as you are spending money intentionally and it is planned and has a purpose. >> sandra: i love this, allison.

you are talking about the feelings related to money, some do feel guilty but it's a tool and you have to make it work for you. explain. >> that's what mean is, it's money that we have coming in and sometimes whenever we are spending money and we are spending money based on emotions, we can spend it whether we feel mad, sad, bad, glad at the celebration and all of a sudden our money is gone and the guilt and the shame start seeping in. so really tackling the emotion piece of money is so big because money is just math, right, sandra. if you can go 5th grade math you can manage money yet so often we are struggling because we are not talking about the emotional side of it. >> sandra: and so many of us are dealing with inflation, right, the price of just about everything has gone up. january 2021 to january 2024, over just a few years overall costs up 20% almost, food prices skyrocketing, energy, those
