political reputation of kamala harris. a go-to line of republicans today, of course is don't forget. a vote for joe is also a vote for this woman who when not not laughing like a jack call on meth. >> we have a lot of accomplishments. what americans want most in their leaders we actually get things done. we have done it. we haven't taken out adequate credit for it, frankly. we got to do a better job of getting the word out about what we have accomplished and who did it. >> laura: and today in the journal, we see that the vp is casting herself as up to the task. telling the reporter i'm ready to serve. there's no question about that. everyone who cease her on the job walks away fully aware of her capacity to lead. americans' biggest concerns it's almost inconceivable that voters would choose four more years that's the angle. joining us now is paul manafort former trump campaign manager he held manage ford wants 1976 convention battle which is relevant considering what may be happening down the road. paul, good to see you tonight. voters. >> good to see you, laura. >> laura: may not get the opportunity to put biden in for another four years, right? the democrats still do have a chance to dump him at the convention especially after the hur report and his performance since what would happen if democrats ended up with this type of contested convention? >> well, it would be a long shot situation, laura. the democrats, the republicans actually have a rule that delegates elected for the republican nominee in the primaries and caucuses have to vote on the first ballot for whoever they were pledged to. the democrats don't have that

they have a that set pledge but not a binding commitment hover they voted for in the caucuses. it's conceivable but not likely. the reality is the president controls all the mechanisms of power. you saw what he did when he knocked iowa out as first in the nation demoted new hampshire first primary and south carolina first in nominating process because he looked at that rewarding his base. that's the kind of control he has. he controls the democratic national committee as well which sets the temporary rules for the convention and can actually make the delegates bound. so they have got options unlikely that biden would -- wouldn't be the nominee; however. there is an interesting thoughts that i was thinking about that doesn't mean they have to support the vice president

harris think are not pledged to you her. >> laura: explain that paul, a lot of people have come up to me and said first of all is joe going to make it i said he is the most stubborn man in washington paul have you known him for a long time. he is one of the most stubborn people in washington. the idea he would ever voluntarily step aside is hysterically funny to me. it doesn't have to be kamala, why? explain that. >> well, because the delegation being elected are biden delegates. in theory biden delegate should be harris delegate. they are not bound to harris. the convention could nominateson from the floor to challenge harris even if biden is still supporting her. what would happen in that situation? i don't know. we know that the democrats don't want biden or harris as the nominees. they can't stop joe biden. they have might be able to cause a problem for harris. in which it, would be a major problem for biden. he would have to put the whole floor operation together to ensure she won if she everywhere

challenged on the floor. they will play with the rules and do everything they can to avoid that. that's where the risk is to a biden harris ticket. it's on the vp situation. >> the problem, paul, is that when people say republicans argue like remember a voted for joe is a vote for kamala and the democrats don't really love her either. if all the reporting out there is correct, they know she is a problem. but she is a first as i said in the angle you can't hopscotch her and go to mr. bar and grill cream in california. that's not going to be possible media says it's hard tore biden to do it. the delegates are different story. i would not be surprised to start to see some groundswell when they come to a realization in the media and democrat establishment that they're not going to get joe biden to retire. it's just not going to happen. and so if the fear is that a biden -- biden is too old and harris is incompetent, then

maybe the incompetent could make biden nor palatable. that would be the theory. frankly i don't think that works either. >> laura: paul, do you agree that biden is one of the most stubborn politicians in washington and. >> absolutely. >> laura: is he never going to step aside. i never see -- i just don't see that at all. >> not only is he stubborn. he doesn't know anything else. he has been in government his entire life. and so -- why does he care if he is too old? i mean, he doesn't have anything else. he doesn't want to retire. and he is the last person who is going to say i'm going to walk away from donald trump. i'm not -- i'm not going to look afraid of donald trump. so i mean, there is just nothing that's going to cause biden or jill biden to have him retire from the race. any point in time. and the convention will not unseat him. >> laura: who do you think is really running the white house? is it just a group of people? >> well, the problem is i don't know if anybody is running the white house. i think you have got little

thiefdoms there people close to obama and part of the obama network are moving their pet issues. whether it's in foreign policy or climate change or anything like that. but the problem is, as you said in your opening monologue, nobody is in charge. there is no coherent message. so you have got all these staff people and even the cabinet members are included in what i call staff because that's a level of competence. aren't performing in ways that are not really linked, i mean, one of the things, i noticed it last week. if you may remember when maduro sidelined his main opponent in venezuela in the presidential election, the white house actually released a statement saying that it's banana republic that doesn't allow the major opponent to the president to run in an election campaign. >> laura: they don't even get what they are saying. >> they don't connect the dots. >> laura: paul, great to see you tonight. invaluable insight. thank you. we have brand new details emerging about the shooter who opened fire at joel osteen's mega church in houston.

for all the details we go to bill melugin. what can you tell us? >> laura, we are getting a much clearer picture of who this shooter was. she was apparently a woman from el salvador with mental health issues who had palestine written on her rifle identified as both genders and may have had an anti-semitic motive. police have identified the shooter as general necessary yvonne morano biological woman who sometimes identified as a man named jeffrey. lengthy criminal history and lengthy mental health issues eye motorcycle defence in 2016. morano opened fire with ar-15 with palestine written on it. this happening at joel osteen's ladies and gentlemen wood church on sunday. she was killed after off duty police officers responded and engaged her in a shootout. two people injured in that shooting. 57-year-old man and more reno's own 7-year-old son for some reason she brought to the church. he was shot in the head at some point and tragically not

expected to survive. local authorities say they are thankful for the quick actions of those two off duty officers who they say likely saved many lives by engaging the shooter directly. >> these two officers held their ground think held their ground in the face of rifle fire at point blank range and they continued to fire until the perpetrator was neutralized they did not yield there was a sticker on the butt rifle said palestine. a sticker simply stated palestine. we do have anti-semitic writings we have uncovered in this process. >> and laura the question now turns to how did somebody with an established mental health history and long criminal history get an ar-15 to carry out this attack criminals outs

fox news contributor george washington university law professor; professor, this is interesting i'm a former white collar defense attorney so i hear about deleting evidence as an investigation is announced hu. bleach bit or blackberries or smashing stuff with a hammer or this. it certainly sounds bad. >> i'm a criminal defense attorney as well and i would be very concerned about a client who was informed of a pending investigation and destroyed the key material evidence. the other interesting anomaly in this is if they wanted to pursue this aggressively as they did with the trump administration we may indict you for obstruction to get cooperation to see if they have more evidence to offer. instead they did what the they

did with the president. they sort of convinced themselves there was no reason to seriously pursue criminal charges. and it's very hard to square with what the report says. this report establishes all of the elements of crimes. they could have easily on these facts, charged the president with mishandling of classified material, willfully retaining classified material. showing that material to others. that should sound familiar those are the charges against trump: too sympathetic to prosecute. otherwise, really left wondering well, okay. why don't you say you should prosecute him after he leaves office? >> today, also to move on. president trump asked the municipal court to further delay

his trial asking for stay from d.c. appeals court ruling that says he doesn't not have immunity from prosecution. what happens next, jonathan, do you think? >> well, laura, as you know. as a former supreme court clerk. this going to go to the chief justice. chief justice roberts first. he could make this decision on the stay. it's highly unlikely. he will extend this to all of his colleagues. and they have to make a decision. in my view, there are -- there is really is ample reason to grant the stay on the procedural questions. the panel is really cutting off trump from one of the options usually afforded to defendants to appeal. they are making it very difficult for him to seek what is called an en banc appeal. they are objecting to that and saying we would really like to have the same appellate process that other people are entitled. to say the only complication here is to separate that from the merits of the immunity issue

something tucked into this bill that you are very concerned about if donald trump becomes president. what is it? >> well, it's very simple, laura. the reason the democrats impeached donald trump in 2019, was remember, that he refused to send resources that had been appropriated for ukraine in this bill trying to tie his hands. handicap donald trump and prevent him from ending the war through diplomacy. they want to force the trump administration, starting in january of 2025 to send more and more money to ukraine. now, what if trump refuses? if trump refuses and says i'm going to conduct american foreign policy like i would like because it's my presidency, then i guarantee the democrats will use this as a predicate to impeach donald trump. is it spurious and stupid, laura? well, of course it is. but so is the original impeachment trial. we are giving these guys a weapon that they will use against the next republican president and it's our own fault
