as much as he would. there was a lot he did not answer and a lot he said he couldn't answer because he did not answer and spent time whether a receipt was a credit card record. and the hush money case wrapped up a short time ago and jury selection set for next month after judge denied trump's motion to drop that case. we have a court date for that, trial date, which is march 25th. more on that in a moment, former president called entire trial a sham. of course he spoke, let's watch. >> it's a rigged state, rigged city, a sham. what they ought to do is go out and take care of the violent crime and migrant crime that has destroyed people and killing people, not a case everybody says take a look at the legal documents and legal scholars writing about this say there is no crime, this is no crime.

the two were not at a certain point, he traveled with willis in 22 and 23. if judge decides otherwise, it could uproot willis case. live for latest reporting outside courtroom in atlanta. steve, this went on and back and forth, who was in the courtroom? >> well, i guess most imposing figure was nathan wade and he had to suffer there on the stand for several hours. couple bombshells, attorneys from both sides came out swinging basically calling each other liars. one key point is not whether the two had a relationship, they both say they did. the key question is when the relationship began and is anyone lying about it. defense attorney said nathan wade is lying about it. this happened well before nathan wade got hired. he got hired when he was already

fani willis's boyfriend. they brought on former employee of d.a.'s office, self-described best friend of fani willis to testify under oath she saw the two were in a relationship two years before nathan wade was hired. here is the exchange. >> you know their relationship, their personal relationship began shortly after this municipal court conference? >> yes. >> when i say personal, romantic. i want to make sure we don't get in an argument do you take personal to mean romantic? >> she then went on to describe the two as hugging and kissing and seeing them hug and kiss. what got pursued today is money. did the two, wade and willis

profit from this relationship, make money from the state and spend on themselves? curious examination of how nathan wade carried out his businesses and travels. he said he put everything on his credit card and then fani willis paid him back in cash which he never declared on his taxes. here is wade talking about their financial arrangement. >> what i allege is -- what i allege is our travel was split roughly evenly, so where you see i have booked a flight or paid for a flight with my credit card, what you don't see is that she covered her own flight. >> we've seen nathan wade on the stand, will we see fani willis? that is up to the judge. certainly a lot of blows against nathan wade and keep in mind the stakes in this case. the judge warned if there is

ap appearance of conflict of interest, that could mean disqualification for d.a. and prosecutor she hired. >> harris: excellent reporting, steve. bring in leo terrell, top radio host and "fox and friends" news contributor. you and i have talked about this case leading up to it. what surprises? what blew your mind in the courtroom today? >> the bombshell is the witness who testified there was a personal relationship before the prosecution of this case, that is the evidence the judge will have to decide. steve steve harrigan said it best disqualification occurs if there is conflict or appearance. witness who testified on the relationship prior to 2022 is evidence of appearance of a romantic relationship and wade's characterization his marriage was over in 2015, he lost a lot

of credibility, he denies ex existence of any gift, dinners or anything else. i don't think it will fly, it doesn't pass the smell test, two facts that were significant today, harris. >> harris: robin was her name, she worked with her and rented housing to fani willis when she did not want to live at home anymore, she rented from her, they were close friends, that is what she called them. >> kayleigh: two lines of questioning of major interest, when did this relationship begin, you have nathan wade, fani willis saying not until 2022. number two, financial component of this, did she use that money

that went to nathan wade, was it spent on fani willis? did they make progress on two lanes in this gathering of information? >> regarding existence of relationship prior to 2022, yes, this friend had personal knowledge. she saw fani willis. she conversed with fani willis. fani willis told her there was a romantic relationship. definitely on that, yes. i go back to interog tories where nathan wade tried to conceal by way of interrog tory ex existence of gifts and trips. there is evidence the judge has now that he did not have 24 hours ago. disqualification occurs if there is conflict or appearance. we learned a lot today, those two components have been met.

did the witness that had confirming information, was she damaged pointing out she was a disgruntled employee and finally she left? they had been close friends, the relationship was more than at the office. what is your take? >> kevin: i want to make an observation on this case. looking at data that shocked me, in media, buying time, say in a presidential election, we would not be tracking this case if it was not tied to trump. what i learned in last 10 days, i get data every five business cycles, we pay so much money on social media, buys for capable and network. trump has done something no one has ever done before, not saying good or bad, he's sucked oxygen out of the room for every commet

welcome. the judge made clear prior to today's preceding there needed to beevident ushgary hearing, do the facts match the law? >> great to be with you. what the judge said is what i said, ashley merchant has made out a case that would be sufficient grounds to disqualify not only fani willis, everybody who works for her. we know there was a relationship, what we also have heard at least from a former employee under oath, the people who are talking about this relationship are lying about it, they are saying it started much earlier than nathan wade said in his affidavit filed. that raises a big question. the other thing we're seeing them drill down on and have to

hear more after lunch, is whether or not that was a solid proof of financial gain by district attorney willis as a result of her steering the taxpayer money through a no-bid contract to her boyfriend nathan wade. that is what this is all really about. they are going to have to answer those questions. to be honest, i don't know how the judge is receiving this information about the alleged lying by mr. wade. if i were the judge, i would pump the brakes on all this, pause the entire case and order an independent outside investigation who can track down whether or not there really were cash payments made by willis to reimburse mr. wade. if they are lying to the court and purgery in the case today that we're watching that is the kind of thing the judge ought to be upset about.

i would be if i'm the judge. we don't know if we'll get more than just testimony from nathan wade and is the judge going to accept his word for these things? >> kayleigh: key point. number one, we want to know times of this relationship, former employee, did this romantic relationship begin in 2019, the employee said she witnessed it and yes. nathan wade refutes it. cash payments, nathan wade insists fani willis paid him cash payments, how do you track down cash payments? look at fani willis bank with dollar the drawal, how do you determine that is the case? >> you have to get fani willis under oath. some outside investigation need to be considered by the judge, there are resources available to court and law enforcement that can track these things down. they have more resources than

private lawyer in her office in georgia, which she shares with her law partner husband, she does not have resources law enforcement has, she can't subpoena things and can't force people to provide proof to back up their claims like law enforcement can and like train investigators can. she's done a great job representing her clients, only so much a lawyer can do. it will be difficult for legal team to corroborate cash payments and that is what needs to happen. >> kayleigh: seems like fani willis will have to take the stand, we'll see if that happens, we will have to hear from her. more "outnumbered" in a moment. it's not wet food. it's just real food. it's an idea whose time has come. there's an old saying in the navy

that's going to slow it way down. >> leo: yeah, let me be very quick. appreciate my friend phil. i think that will delay the trial way too long, harris, but i think as i said to you are earlier, there is evidence that there is a financial gain here. remember, nathan wade lied, in my opinion he lied about the fact his divorce was over in 2015. that's why his answers about the gifts, the trips, the dinner, he said that's why i said no because my marriage was over. his marriage was not over in 2015. so i think the judge will have enough evidence to rule on the case. expect a well-written opinion, harris, but will rule after all the examination takes place today and tomorrow. expect the ruling. that's what i expect. >> harris: the way you look at this is there would have to be a legal end to that marriage to make what he is saying true in 2015. >> leo: you are right. >> harris: the fact he thinks anyone would believe you give another woman gifts because you
