unfair treatment under the law. my understanding as a nonlawyer is that the banks involved, supposed fraud, they did their due diligence and said they were not victimized. there's no victim here, but here's a woman who promised to go after this man in a litigious way and it may not sit well for many americans and folks not inclined to love donald trump, this is troubling and see if the appeals process plays out. rachel: beyond troubling. it's election interference in my opinion especially if you take into account all the different cases and seems so coordinated what's going on right now. donald trump jr. says we've reached the point where political beliefs on social mediacom brief negotiated interviewed with what venue your case is heard in are the primary determinants of the outcome, not the facts in the case.

and i would say this message is really dangerous. it says two things. one f you're a republican, especially if you're a trump supporter, this is a message, we're going to come after you if you try to run or try to be part of this administration, we're going to dig everything we can up and trump up charges like this as well. i think it also sends a message to business owners. last night clay travis was on jesse watters saying this is why i would never have a business in a blue state. they weaponnize the legal system against their enemies and this all undermines foundational things in their country that make it work and you'll be treated fairly under the law, justice would be behind, that they're not going to find, try and find a crime and then apply it to you. also i think the whole idea of election interference. what they're doing to donald

trump. i done know how he gets out of bed every day. it's so many most people wouldn't withstand this level. pete: no doubt .x they can't see the irony and flip it over to msnbc or cnn and dual stories of death of political opponent in russia and then flip to we got our political opponent in new york and if only we could get him in jail and can't run for president. maybe we're doing the same thing to our political opponent here . rachel: the parallels are greater than you think. before they killed him they took him off the ballots and some crime of obscure crime and put his brother in jail for nothing because they knew it would hurt him because he loved his brother so much. going after family members as you see in this case as well. pete: here we government a year ago, there was the -- we'll move to another topic to middle america. tragic train derailment in east palestine, ohio. this is a big deal.

rachel: the five migrants arrested in connection to that brutal attack on nypd officers were arraigned yesterday as authorities say at least two of them are linked to a venezuela super gang known as [speaking non-english language] the criminal organization is expanding their influence including in the u.s.. kevin catalina is a former gang division officer and anti-gang violence expert and he joins us now. one of these guys got $1 for his bail? >> yeah, i don't know what you'd say about that and it's an insult to law enforcement and members of the nypd and this is a violent, violent gang and their presence is new york is growing daily. they're involved in everything

from retail theft, organized retail theft, extortion and kidnapping and it's a dangerous, dangerous group and nypd is concerned and i had a conversation with the chief detectives and it's an emerging threat we have to watch and can't afford for judges to let them go with $1 bail. rachel: yeah, just thinking about that marine daniel penny that got $100,000 of bail and bail is set on if you're a risk or not. daniel penny from long island and these guys are from a criminal gang in venezuela. obviously they're a flight risk so how de-moralizing has this been for the department? i can't imagine the frustration of knowing that these are people who beat up police officers brutally and getting off like this. >> yeah, it's de-moralizing and the nypd fought valiantly and

fleeing new york. just like elon musk left delaware, you're going to see businesses leave. pete: matt, he'll appeal. how long does that take? we have the flashily headline but is he ever likely to even pay and the case is so flimsy and appeal it, do you think he'll win on appeal? >> there's a chance that justice is not only delayed but denied because of the judges being appointed by democrat governors. judge engoron was so fundamentally biased and unfair to president trump that the court of appeals has to insert themselves and remember, the u.s. supreme court does sit above these state supreme courts ultimately and could if necessary and especially in an unfair anti-due process case like this where he wasn't even allowed to put on a case because

it was ultimately decided on summary judgment based on liability watching the damages piece and make its way to the u.s. supreme court because it's so fundamentally inconsistent with american juries prudence. guy: matt, let me quote, associated press analysis of 70 years and trump's case stands apart and it's the only big business found that was threatened with a shut down and outshowing obvious victims and major losses and i know people talk about the two tiers of justice and that sentence seems pretty damming on that front. >> incredibly damming. the attorney general of new york to campaign to harass and sue donald trump to get him out of business in new york and she as in the near term accomplish that goal and again, i think it's because only of that last 70 years of cases and also just the

way the law is set up. i don't think it's going to stand but today it's frustrating outcome i'm sure for the president. pete: then down to georgia and fani willis talking about hiding cash and didn't know and her father took the stand trying to defend his daughter and what fani willis' father said defending her yesterday. >> it's a black thing, you know, i was trained and most black folks hide cash or keep cash. pete: what's the argument here? doesn't matter what you're taught or what your your taught

but if it's campaign cash, you can't keep it. >> the issue is she had a large amount of cash for campaign for da in 2020. that shocked a lot of people but trying to prove there was not a conflict based on business relationship. the fact the county was paying the special prosecutor and also having a relationship and so the only way they could explain that away was if she reimbursed half of the expenses for lavish romantic travel around mostly central and america and on cruises and only way that would make sense is if she reimbursed half and a lot of people kind of shook their head and said that is specious. pete: that's a good way to put it. there's no record of it. guy: convenient. rachel: it's a black thing. that's what he said, the dad said. that's a crazy stuff.
